RESOLUTION
WHEREAS, tests and studies conducted by competent authorities,
including but not limited to, both University and Public Health
and Safety facilities, show that driving while under the influence
of marijuana constitutes a significant and increasing threat to the
public welfare, and
WHEREAS, the City of McHenry finds itself, in the absence of
specific authorization by reason of existing state statutes, to
establish ordinances that could increase the safety of our citizens
on the streets and highways of our City, and
WHEREAS, we desire that our residents also receive such pro-
tection to their welfare and safety while traveling in other areas
of the State of Illinois that are outside of the jurisdiction of
this governmental unit,
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of McHenry strongly urges the State Legislature to swiftly
enact legislation that would accomplish the following:
1. Materially increase the penalty for the possession of
marijuana in a car, bus, train, or any other moving
vehicle.
2. Embark upon a program to substantially increase public
awareness of the danger of marijuana use and driving.
3. Through specific actions, both encourage and speed up
the development of a roadside test kit to determine
the level of THC in the blood (similar to the breath-
alyzer in alcohol intoxication detection) .
4. To revoke the license of any driving instructor who
either permits or otherwise encourages the operation
of a vehicle while under the influence of marijuana.
5. Prohibit governmental employees from driving govern-
mental vehicles within 8 hours of using pot.
6. Provide that other governmental units in the State of
Illinois may take such action in the event that the
State Legislature fails to do so.
