RESOLUTION
WHEREAS, Illinois Revised Statutes , Chapter 5, Section
138 .7, provides , among other things , that the governing body
of any incorporated City or Village shall have the authority
by resolution to the District and to the Department of Agriculture
of the State of Illinois to remove all or part of the land lying
within the boundaries of the City or Village from a soil and
water conservation district; and,
WHEREAS, it is the desire of the City of McHenry to
remove any and all of the lands now lying within its boundaries
and any and all territory that may be annexed to the City in the
future from the McHenry County Soil and Water Conservation
District, pursuant to the authority granted by law.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of McHenry, Illinois, as follows :
SECTION 1. That all of the lands now lying within the
boundaries of the City of McHenry, and any and all territory
that may, in the future, be annexed thereto, are hereby removed
from the McHenry County Soil and Water Conservation District.
SECTION 2 . That a certified copy of this resolution shall
be transmitted or delivered to the McHenry County Soil and Water
Conservation District, and also recorded in the Office of the
McHenry County Recorder of Deeds .
SECTION 3 . That this resolution shall take effect
immediately .
