RESOLUTION
•
WHEREAS, on October 4, 1979, the County Board for the County
of McHenry passed a comprehensive amendment to the County Zoning
Ordinance, and
WHEREAS, said comprehensive amendment fails to provide input
from municipalities as related to the issuance of conditional use
permits by the County within 12 miles of municipal limits, and
WHEREAS, said failure to consider the interests of the muni-
cipalities may have a significant adverse effect on the future of
the municipalities,
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council
of the City of McHenry, that the City of McHenry hereby raises its
objection to the action of the County Board whereby the County
Board refused to include in its comprehensive amendment to the
County Zoning Ordinance, a provision providing for input from the
municipalities in McHenry County relating to the issuance of con-
ditional use permits within the planning jurisdictions of the
various municipalities.
BE IT FURTHER RESOLVED that the Mayor and City Council of the
City of McHenry respectfully request that the County Board recon-
sider that section of the comprehensive amendment to the County
Zoning Ordinance dealing with conditional use permits and that it
be amended to provide that where a petition for a conditional use
permit has been filed affecting land within 12 miles of a munici-
pality, that that municipality be given notice of the petition and
an opportunity to object, and that in case of an objection by the
municipality, that the County Board be able to issue the conditional
use permit only by a three-fourths majority vote.
