HomeMy WebLinkAboutResolutions - R-79-36 - 12/17/1979 - Donation of land at Brittany Heights y_ - -� R-79-36 RESOLUTION At a regular meeting of the City Council of the City of McHenry, McHenry County, Illinois, the following resolution was introduced and adopted: WHEREAS, JEROME M. MILLER, EUGENE J. MILLER and CHARLES J. MILLER are all of the beneficiaries of a certain land Trust No. 1284 with McHenry State Bank as Trustee; and WHEREAS, said Trust No. 1284 concerns the following described real estate situated in McHenry County, Illinois: "The West 27-1/2 acres of the Northwest fractional quarter of the Northwest Quarter of Section 1, Township 44 North, Range 8 East of the Third Principal Meridian in McHenry County, Illinois. " WHEREAS, said property is vacant property with no buildings or structures located thereon; and WHEREAS, the above Trust No. 1284 and its beneficiaries , JEROME M. MILLER, EUGENE J. MILLER and CHARLES J. MILLER, wish to donate the subject property to the City of MGEgy, McHenry County, Illinois, to be used as a city sewe{�(si a or for whatever other purposes the City Council of McHenry shall determine; and WHEREAS, the City Council of the City of McHenry wishes to accept the donation of said property; and WHEREAS, in July, 1979, the beneficiaries of said Trust No. 1284 did order and receive an appraisal of the subject property from Thomas J. Peters, 5200 South Route 31 , Crystal Lake, Illinois, and said individual appraised said property in the amount of $165,400. 00, and an appraisal from Frank Spose Appraisal Company by Frank Spose, and said individual appraised said property in the amount of $165,000.00 , thereby setting $165,000. 00 as a fair and reasonable valuation of the subject property; and WHEREAS, McHenry State Bank as Trustee under Trust No. 1284 has executed a Trustee' s Deed dated December 5 , 1979 , conveying subject property unto the City of McHenry. NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of McHenry, McHenry County, Illinois , to accept the subject property as a donation from the said Trust No. 1284 and its beneficiaries to the City of McHenry, as conveyed by a Trustee's Deed dated December 5, 1979.
