RESOLUTION
WHEREAS , the establishment of a grade level crossing over
the Chicago & North Western Transportation Company railroad tracks
at Orleans Street will facilitate and improve the flow of traffic
in the City of McHenry, will thereby promote the health, welfare
and safety of its inhabitants and of the public generally and is
urgently required in the interest of the public convenience and
necessity .
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF McHENRY,
McHENRY COUNTY, ILLINOIS , AS FOLLOWS :
1 . That the City of McHenry petition the Illinois Commerce
Commission for permission to extend Orleans Street, within the
City, across the railroad tracks of the Chicago & North Western
Transportation Company , at grade level, and that the Commission
be requested to direct the Illinois Department of Transportation
to pay from the Grade Protection Fund as set forth in the Motor
Fuel Tax Law, a substantial part of the cost involved in connection
with the installation, if any , of flashing light signal protection
devices at such location.
2 . That the City shall improve Orleans Street to the
westerly and to the easterly right-of-way line of said railroad.
3 . That the entire cost and expense of constructing the
aforesaid crossing, and any other expenses in connection therewith,
will be paid by the City.
4 . That the City Attorneys be and they are hereby authorized
and directed to file the above-described petition in the Illinois
Commerce Commission, as provided by law.
