RESOLUTION
WHEREAS, David J. Faestel and Ray Schmitt have requested that they be
allowed to deposit a sum of money less than that required by Section 28-3 of
the Municipal Code, City of McHenry, Illinois, in the matter of the petition
for annexation of LaSalle National Bank, a National Banking Association, as
Trustee under the provisions of a Trust Agreement dated September 1 , 1977,
and known as Trust No. 53067; STATE BANK OF WOODSTOCK, as Trustee under the
provisions of a Trust Agreement dated December 8, 1978, and known as Trust
No. 2695; WERNER ELLMAN and ELIZABETH ELLMAN, his wife, the property being
commonly known as Valley Brook Subdivision to the City; and
WHEREAS, good cause has been shown to reduce the amount of such initial
deposit,
WHEREAS, a check in the amount of $7,500 based on the total acreage of
202 which is included in Valley Brook Subdivision will be deposited with the
City.
WHEREAS, David J. Faestel and Ray Schmitt have agreed to maintain a
balance of $5,000 in the deposit account at all times with respect to the
development of the subdivision.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
McHENRY, McHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1. That pursuant to the authority contained in Section 28-10
of the Municipal Code, and upon good cause shown, the initial deposit re-
quirements of Section 28-3 aforesaid be and the same are hereby partially
waived as to the pending Valley Brook Subdivision annexation proceedings
and in lieu of the requirement thereof, David J. Faestel and Ray Schmitt be
and are hereby authorized to deposit the initial sum of $7,500.
SECTION 2. This Resolution shall be in full force and effect immediately
upon its passage and approval .
