RESOLUTION AUTHORIZING SALE OF
MUNICIPALLY OWNED REAL ESTATE
WHEREAS, the City of McHenry, Illinois owns the
following described real estate;
Part of the Southwest Quarter of Section 26, Township
45 North, Range 8 East of the Third Principal Meridian,
bounded and described as follows: Commencing at the
Southwesterly corner of a tract of land conveyed in
instrument recorded May 16, 1949 as Document No. 219133
(including easement); thence Northwesterly along the
Southwesterly line of said tract extended, being a line
parallel with the Southwesterly of Block 23 in the
original plat of McHenry, according to the plat thereof
recorded July 6, 1840 in Book B of Deeds, page 160, a
distance of 107.25 feet for the point of beginning;
thence Northerly along a curved line concave to the
East, and having a radius of 29 feet, an arc distance
of 25.56 feet to a point; thence Southwesterly along a
line forming an angle of 74 degrees 47 minutes 19
seconds measured clockwise from the chord of the last
described curved line at the last described point, a
distance of 144.10 feet, more or less, to the
Northeasterly edge of water of Boone Creek; thence
Southeasterly along the edge of water of Boone Creek, a
distance of 117.75 feet, more or less, to the
intersection with a line drawn 272 feet Westerly of and
parallel with the Northwesterly line of Green Street;
thence Northeasterly along said parallel line, a
distance of 117.30 feet, more or less, to the
intersection with a line drawn parallel with the
Southwesterly line of Block 23 and extending from the
Southwesterly corner of said land conveyed by above
mentioned document No. 219133, thence Southeasterly
along said parallel line, a distance of 12.75 feet to
the point of beginning, all in McHenry County, Illinois.
which is currently used for a municipal parking lot; and,
WHEREAS, the Corporate Authorities of the City of
McHenry, Illinois have determined that it is no longer
necessary or in the best interest of the City that it retain
title to said real estate and that said real estate is
surplus and is not required for the use of, or profitable to
the City; and,
WHEREAS, the above described parcel of real estate
contains an area of 15,735 square feet (or 0.3612 acres), is
presently used as a municipal parking lot and is zoned C-5
Highway Commercial District; and,
WHEREAS, the value of said real estate has been
determined by a written MAI certified appraisal to be
$55,000.00, which appraisal is available for public
inspection in the office of the City Clerk; and,
WHEREAS, McHenry Savings Bank has offered to purchase
the above described real estate for the net sum of
$55,000.00 at the closing of the sale transaction; and
NOW THEREFORE BE IT RESOLVED by the City Council of the
City of McHenry, McHenry County, Illinois as follows:
SECTION 1. The Corporate Authorities of the City of
McHenry find as facts the recitals hereinabove set forth.
SECTION 2. It is hereby determined by the Corporate
Authorities of the City of McHenry, Illinois that it is in
the best interests of the City that the above described
offer of McHenry Savings Bank to purchase said real estate
from the City for the net sum of $55,000.00 should be
accepted. Accordingly, the Corporate Authorities of the
City of McHenry, Illinois do hereby accept the aforesaid
offer of McHenry Savings Bank to purchase said real estate
for the net sum of $55,000.00.
SECTION 3. The Mayor is hereby authorized and directed
to sign and the Village Clerk is hereby authorized and
directed to attest a contract for the sale and purchase of
the aforesaid real state, which contract shall be in the
form prepared by the City Attorney.
SECTION 4. The Mayor and City Clerk are hereby
authorized, respectively, to execute and attest such other
and further documents as may be necessary to convey and
transfer the above described real estate to McHenry Savings
Bank upon receipt of the aforesaid net purchase price.
SECTION 5. This Resolution shall be published in a
newspaper published in the City of McHenry, or if none, then
in a newspaper published in McHenry County, Illinois.
SECTION 6. This Resolution shall be in full force and
effect from and after its passage, approval and publication
in the manner provided by law.
