RESOLUTION
WHEREAS, when soliciting support for the special
assessment sanitary sewer project to be constructed in
McHenry Shores Units 1 through 5 inclusive, Idyll Dell
subdivisions and four adjacent special assessment parcels
thereto, the City promised that the sewer capital
development fees charged to said properties would not be
increased for a reasonable period of time after connection
to the City sewer mains first become available; and,
WHEREAS, the City has recently increased its sewer
capital development fees but desires to abide by its
aforesaid promise.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MCHENRY, ILLINOIS AS FOLLOWS:
SECTION 1. Until January 1, 1993, the Capital
Development Fee charged a single family residence connecting
to the City sewerage system in McHenry Shores Units 1
through 5 inclusive, Idyll Dell subdivision and the four (4)
special assessment parcels adjacent thereto shall be $750.00.
From and after January 1, 1993 the Capital Development Fee
charged a single family residence connecting to the City
sewerage system in said sanitary sewer special assessment
territory shall be the sewer Capital Development Fee that is
provided for by Ordinance and that is generally applicable
throughout the City.
SECTION 2. All resolutions, or parts thereof, in
conflict with the terms and provisions hereof, be and the
same are hereby repealed to the extent of such conflict.
S_EC_TION 3. This resolution shall be published in
pamphlet form by and under the authority of the corporate
authorities of the City of McHenry, Illinois.
SECTION 4. This resolution shall be in full force and
effect from and after its passage, approval and publication
in pamphlet form, as provided by law.
