I-ieder Michael R. beta WARD a Ra\'tnond Smith Frank \I(I:Iatche\' Or Cecilia Serritrlla � �F Rand\' Pallerson E City ClerT ,TO : MCHEHRY APR-04-'90 ICED 13:39 ID:NARUSIS & NARIJSI7 TEL_NQ:1-?08-639-5549 #471 P02 This Agreement entered into by and between the Villages of Cary and Lake in the Hills and the City of McHenry, municipalities located in the State of Illinois, hereinafter referred to as "Participating Municipalities", WITNESSETH s NB EREAS, Public Act 86-256 provides, among other things, that any municipality or combination of municipalities that have total population of 20,000 or more may apply to the Illinois Department of Energy and Natural Resources for assistance grants to operate pilot recycling projects; NNERHA$, the Participating Municipalities possess a total combined population in excess of 20,000 person; WHEREAS, the Participating Municipalities desire to apply to the Illinois Department of Energy and Natural Resources for such assistance grants pursuant to said statutory authority, to operate their respective pilot recycling projects; WHEREAS, the 1970 Illinois Constitution (Article VII, Section 10) and the Illinois Revised Statutes, 1987, Chapter 127, Section 741-748, provide authority for intergovernmental cooperation; ICON, THERSFORE, in consideration of the mutual agreements contained in this Agreement, the Participating Municipalities agree as follows; 1. That the Participating Municipalities have either adopted or are committed to adopt pilot recycling projects which include, at the minimum, the following elemental a. A curbside program requiring the occupants of at least 3,000 single family residences to separate at least 3 materials deemed appropriate by the municipality from other solid waste generated at their residences, and to store such material until collection; the 3 70:MCHENRY APR-04—'90 WED 13:40 ID:NARUSIS,.b? NARU�,I? TEL NU:1—?LDS-639-5t49 ##4 1 F'L13 materials shall be chosen from the following: glass, aluminum, steel and bimetallic cans, newsprint, corrugated paper, used motor oil, or plastics. b. A scheduled day, at least twice per month, during which separated materials re to be placed at the curbside or a similar location for collection. c. A system including trucks and related equipment for collecting recyclable materials from the curbside or similar locations at least twice per month from each participating residence. d. A drop-off or buy-back center for the collection and sale or reuse of recyclable materials, including but not limited to glass, aluminum cans and newsprint. e. Provisions for recycling of collected materials. f. Provisions for public education and compliance. 2. That the Participating Municipalities shall, in combination, apply to the Illinois Department of Energy and Natural Resources for assistance grants to operate pilot recycling projects on such forms that may be provided by the Department and shall set forth such information as may be required by the Department. 3. That grant proceeds received from the Illinois Department of Energy and Natural Resources shall be distributed to the Participating Municipalities as specified and directed by the Department, or, in the absence of such direction and specification, on a pro rata basis of the approved eligible project costs and expenses of each Participating Municipality. 4. Each Participating Municipality agrees that it shall retain ownership and/or will guarantee third -party use of the equipment purchased in full or in part with grant funds for the purposes specified for three (3) years from the agreed purchase date. Each Participating Municipality agrees that grant funds received from the Department shall be used only for the purposes specified in the grant application. 6. After receipt of notification of selection for funding support, the Participating Municipalities shall execute such agreements as may be required by the Department setting forth the grant obligations of the respective parties. YE WITLESS WHEREOF, the undersigned governmental units have each duly eXecuted this Agreement pursuant to the direction and authority of their respective governing bodies.
