RESOLUTION
WHEREAS, the City of McHenry participates in the North Central
Narcotics Task Force; and
WHEREAS, in connection with such participation, a City of
McHenry Police Officer is assigned to the North Central Narcotics
Task Force; and
WHEREAS, under provisions of the Cannabis Control Act, (ch.
56-1/2, 701 et seq., Ill. Rev. Stat.), the Controlled Substances
Act (Ch. 56-1/2, 1100 et seq., Ill. Rev. Stat.) and the Narcotics
Profit Forfeiture Act (Ch. 56-1/2, 1651 et seq., Ill. Rev. Stat.)
the City of McHenry is entitled to a share of any fines that result
from a violation of these acts if a City of McHenry Police Officer
is involved in the arrest; and
WHEREAS, the corporate authorities of the City of McHenry find
that it is in the best interests of the City to assign to the North
Central Narcotics Task Force the City's share of any fines the City
would otherwise be entitled to receive under the Cannabis Control
Act, the Control Substances Act or the Narcotics Profit Forfeiture
Act, as a result of the participation of a City Police Officer in an
arrest made by or under the direction of the North Central Narcotics
Task Force.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
MCHENRY, MCHENRY COUNTY, ILLINOIS, as follows:
SECTION 1: The corporate authorities of the City of McHenry do
hereby --authorize and direct that the proceeds of any fines which the
City is entitled to receive under the Cannabis Control Act, the
Controlled Substances Act or the Narcotics Profit Forefeiture Act as
a result of the participation of a City Police Officer in an arrest
made while the officer is assigned to or working under the direction
of the North Central Narcotics Task Force be assigned and paid
directly to the North Central Narcotics Task Force.
SECTION 2: Except as provided in Section 1 of this Resolution,
the CityHenry's share of any fines the City is entitled to
receive under the Cannabis Control Act, the Controlled Substances
Act or the Narcotics Profit Forfeiture Act, shall be continued to be
paid to the City.
SECTION 3: This resolution shall be in full force and effect
from and a tamer its passage and approval as provided by law.
