HomeMy WebLinkAboutResolutions - RS-92-3 - 05/13/1992 - Object to Anest Zoning AmendmentR-92-3 RESOLUTION OF THE CORPORATE AUTHORITIES OF THE CITY OF MCHENRY, ILLINOIS OBJECTING TO PROPOSED ZONING AMENDMENT WHEREAS a Petition for a Zoning District Reclassification has been filed before the McHenry County Zoning Board of Appeals entitled "In the Matter of the Application of Bill Anest and Peter Anest, for an Amendment of the Zoning Ordinance of McHenry County, Illinois," as Zoning Petition No. 91-85, to change the Zoning District Classification of the parcels of real estate which are legally described in the attached Exhibits A and B to "B-1", Neighborhood District Classification, which legal descriptions are incorporated herein by reference; and, WHEREAS the western boundary of the premises legally described in the attached Exhibits A & B are contiguous to boundary of the City of McHenry, Illinois; and, WHEREAS the City of McHenry, Illinois is a Zoned Municipality; and, WHEREAS the petitioners have notified the Mayor and City Council of the City of McHenry that the petitioners propose and intend to conduct an automobile service station operation on Parcel 2 of said premises from which packaged alcoholic beverages would be sold in conjunction with such automobile service station operation; and, WHEREAS an automobile service station operation is a permitted use under the terms and provisions of B-1 Zoning District Classification of the McHenry County Zoning Ordinance, but is not made subject to any special site, design or operational conditions, restrictions or regulations by said County Zoning Ordiance as it would be if it were a conditional use (as it is under the terms and provisions of the Zoning Ordinance of the City McHenry, Illinois); and, WHEREAS automobile service stations located within the City of McHenry are not permitted to sell alcoholic beverages; and, WHEREAS it is the determination of the Corporate Authorities of the City of McHenry, Illinois that the Petitioner's intended automobile service station and alcoholic liquor sales operations from said premises would be detrimental to and endanger the health, general welfare, comfort and safety of the residents and citizens of the City of McHenry, Illinois; and, WHEREAS it is the intention of the City of McHenry, Illinois, by this resolution to object to and protest against the reclassification of said premises to "B-l" Neighborhood District zoning classification under the terms and provisions of the McHenry County Zoning Ordinance, pursuant to the terms and provisions contained in the Illinois Revised Statutes, Chapter 34 Section 5-12014 and contained in Section 805.9 and 805.10 of the McHenry County Zoning Ordinance, as amended. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MCHENRY COUNTY, ILLINOIS AS FOLLOWS: 1. That the City of McHenry County, Illinois, hereby objects to and protests against the proposed Zoning District reclassification to "B-1" Neighborhood Business District under the terms and provisions of the McHenry County Zoning Ordinance, which would permit the use of said premises for an automobile service station operation and the sale of alcoholic beverages in conjunction therewith. 2 2. That a certified copy of this Resolution shall be filed in the Office of the County Clerk of McHenry, Illinois and shall be served upon the Petitioner and Petitioner's attorney, as provided for in such statutes in McHenry County Zoning Ordinance.
