R E S O L U T I O N
ANNEXING A CERTAIN PORTION
OF THE FOX RIVER TO THE CITY OF MCHENRY
WHEREAS, the City of McHenry desires to annex a portion of the
Fox River lying east of its existing corporate limits; and
WHEREAS, the property in question is legally described and
depicted on Exhibit A, attached hereto and made a part hereof (the
"Subject Property"); and
WHEREAS, on the 9th day of February, 1994, the City held a
public hearing to receive input with regard to the annexation of the
Subject Property and no objections were voiced with respect to the
annexation; and
WHEREAS, pursuant to 65 ILCS 5/7-1-2(f), the City petitioned
the Governor of the State of Illinois for his consent to the
annexation of the Subject Property; and
WHEREAS, on the 19th day of May, 1994, James Edgar, Governor of
the State of Illinois, consented to the annexation of the Subject
Property. A true and correct copy of said Petition and Consent is
attached hereto as Exhibit B.
WHEREAS, it has been determined by the City Council of the City
of McHenry, McHenry County, Illinois, that this Resolution shall
become effective immediately upon its passage.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of
the City of McHenry, that pursuant to 65 ILCS 5/7-1-2(f), the City
hereby annexes the Subject Property.
BE IT FURTHER RESOLVED that the Clerk of the City of McHenry
file a certified copy of this Resolution with the Clerk of McHenry
County and record a certified copy of this Resolution with the
Recorder of Deeds for McHenry County.
BE IT FURTHER RESOLVED that the City Clerk spread the above
Resolution upon the minutes of the meeting of the City of McHenry at
which the above Resolution was adopted.
BE IT FURTHER RESOLVED that this Resolution shall be in full force
and effect immediately upon its passage. Publication in pamphlet form is
hereby authorized, as provided by law.

PETITION FOR GOVERNOR'S CONSENT
The CITY OF McHENRY, on this 23rd day of March, 1994, through
its attorneys, Zukowski, Rogers, Flood & McArdle, hereby petitions
the office of the Governor of the State of Illinois, pursuant to
Section 7-1-2(f) of the Illinois Municipal Code (65 ILCS 5/7-1-
2(f)) for the Governor's consent to annex certain unincorporated
property. The grounds for this Petition are as follows:
1. The City of McHenry desires to annex property lying east
of its existing corporate limits, however, its entire existing
corporate boundary is bounded on the east by the Fox River.
2. Attached hereto as "Exhibit All is a map depicting and
legally describing the unincorporated property to be annexed, all
included within the banks of the Fox River.
3. The City of McHenry believes that the State of Illinois
owns the Fox River or at least has the authority to consent to this
annexation, through the signature of the Governor, pursuant to
subsection (f) of Section 7-1-2 of the Illinois Municipal Code.
The proposed consent of the Governor appears at the bottom of this
petition.
4. On February 9, 1994, the City of McHenry held a public
hearing to receive input with regard to annexing the Fox River and
properties lying east of the Fox River. During this public
hearing, no objections were voiced with respect to annexing the Fox
River into the City of McHenry.
WHEREFORE, the CITY OF McHENRY hereby requests the Governor to
execute the consent which appears below this Petition effectively
consenting to the City's annexation of that portion of the Fox
River depicted and legally described on Exhibit A.

CONSENT OF GOVERNOR
The Governor of the State of Illinois, James Edgar, hereby
consents to the City of McHenry's annexation of that portion of the
Fox River legally described and depicted on Exhibit A attached to
the City's Petition, dated March 23, 1994, pursuant to Section 7-1-
2(f) of the Illinois Municipal Code.
