R E S O L U T I O N
ANNEXING STATE OWNED PROPERTY
TO THE CITY OF MCHENRY
WHEREAS, the City of McHenry desires to annex certain state
owned property lying north of its existing corporate limits; and
WHEREAS, the property in question is legally described and
depicted on Exhibit A, attached hereto and made a part hereof (the
"Subject Property"); and
WHEREAS, pursuant to 65 ILCS 5/7-1-2(f), the City petitioned
the Governor of the State of Illinois for his consent to the
annexation of the Subject Property; and
WHEREAS, on the 17th day of March 1995, James Edgar, Governor
of the State of Illinois, consented to the annexation of the
Subject Property. A true and correct copy of said Petition and
Consent is attached hereto as Exhibit B; and
WHEREAS, it has been determined by the City Council of the
City of McHenry, McHenry County, Illinois, that this Resolution
shall become effective immediately upon its passage.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council
of the City of McHenry, that pursuant to 65 ILCS 5/7-1-2(f), the
City hereby annexes the Subject Property.
BE IT FURTHER RESOLVED that the Clerk of the City of McHenry
file a certified copy of this Resolution with the Clerk of the
McHenry County and record a certified copy of this Resolution with
the Recorder of Deeds for McHenry County.
BE IT FURTHER RESOLVED that the City Clerk spread the above
Resolution upon the minutes of the meeting of the City of McHenry
at which the above Resolution was adopted.
BE IT FURTHER RESOLVED that this Resolution shall be in full
force and effect immediately upon its passage. Publication in
pamphlet form is hereby authorized, as provided by law.

PETITION FOR GOVERNOR'S CONSENT
The CITY OF McHENRY, on this 5th day of December, 1994,
through its attorneys, Zukowski, Rogers, Flood & McArdle, hereby
petitions the office of the Governor of the State of Illinois,
pursuant to Section 7-1-2(f) of the Illinois Municipal Code (65
ILCS 5/7-1-2(f)) for the Governor's consent to annex certain
unincorporated property. The grounds for this Petition are as
follows:
1. The City of McHenry desires to annex property lying north
of its existing corporate limits on both sides of Illinois State
Route 31, however, the relevant parcel owners requesting annexation
are separated from the City by a portion of property, title to
which is held by the State of Illinois, Illinois Department of
Transportation, known as FAP 420 (formerly FA Route 201).
2. Attached hereto as "Exhibit All is a plat of annexation
depicting and legally describing that area (four parts) of the FAP
420 unincorporated property to be annexed, all title to which is
held by the State of Illinois, Illinois Department of
Transportation.
3. The Illinois Department of Transportation took title to
the property desired to be annexed by virtue of a condemnation suit
filed in the Circuit Court for the Nineteenth Judicial Circuit,

McHenry County, Illinois, under case no. 73-3756. Judgment orders
granting fee simple title to the subject property requested to be
annexed were entered on November 10, 1977.
4. The State of Illinois has the authority to consent to
this annexation, through the signature of the Governor, pursuant to
65 ILCS 5/7-1-2. The proposed consent of the Governor appears at
the bottom of this petition.
5. On December 7, 1994, the City of McHenry held various
public hearings relating to the annexation of the parcels of
property surrounding that portion of FAP 420 owned by the State of
Illinois, Illinois Department of Transportation. During these
public hearings, no objections were voiced or questions raised with
respect to annexing that portion of FAP 420 described in this
petition to the City of McHenry.
WHEREFORE, the CITY OF McHENRY hereby requests the Governor to
execute the consent which appears below this Petition effectively
consenting to the City's annexation of that portion of FAP 420
depicted and legally described on Exhibit A.
