RESOLUTION
RESOLUTION OBJECTING TO and PROTESTING THE PROPOSED
AMENDMENT and CONDITIONAL USE PERMIT
IN PETITION NO. 96-22 ENTITLED:
IN THE MATTER OF THE APPLICATION )
OF McHENRY STATE BANK AS TRUSTEE )
UNDER TRUST 4426 AND JOHN FUHLER ) No. 96-22
FOR AN AMENDMENT OF AND FOR )
CONDITIONAL USE PERMITS UNDER )
THE McHENRY COUNTY ZONING )
ORDINANCE, McHENRY COUNTY, )

WHEREAS, a Petition was filed before the McHenry County Zoning
Board of Appeals by McHENRY STATE BANK, as Trustee under Trust
#4426 and JOHN FUHLER, requesting a reclassification of the
property described in McHenry County Zoning Petition No. 96-22 from
"A-1" Agricultural Zoning District to 11B-3" Business District; and
WHEREAS, said Petition further request a Conditional Use
Permit be issued allowing living quarters for a caretaker of mini -
warehouse operations;
WHEREAS, said Petition further requests a Conditional Use
Permit to allow outdoor commercial storage; and
WHEREAS, the CITY OF McHENRY is a zoned municipality; and
WHEREAS, the land which is the subject of the above -described
Zoning Petition lies within one and one-half (12) miles of the
limits of the City of McHenry; and
WHEREAS, the requested 11B-3" zoning and conditional uses are
inconsistent with the surrounding "A-1" Agricultural zoning to the
east and the "RS-1" Residential zoning to the north; and
WHEREAS, the requested zoning and conditional uses are
inconsistent with the surrounding zoning and will be detrimental to
the public health and safety (including traffic impact and
environmental impact); and
WHEREAS, the proposed zoning and conditional uses are
inconsistent with the City of McHenry's Land Use Plan; and
WHEREAS, the requested "B-3" zoning and conditional uses are
inconsistent with the McHenry County Land Use Plan.
NOW, THEREFORE, BE IT RESOLVED BY THE Mayor and City council
of the City of McHenry, McHenry County, Illinois, as follows:
1. The City does hereby incorporate the hereinabove recitals
as if fully set forth herein and by this reference makes said
recitals a part hereof.
2. The City does hereby protest and object to the
reclassification and conditional uses requested by Petitioners
relating to the subject property.
