HomeMy WebLinkAboutResolutions - RS-97-8 - 01/29/1997 - Sale of 1115 N River RoadResolution RS-97- 8 Authorizing the Sale of Surplus Real Estate Owned by the City of McHenry WHEREAS, the City of McHenry, County of McHenry, Illinois, owns certain real estate commonly known as 1115 North River Road, McHenry, Illinois, and legally described as follows: Lot 1, (except that part described as follows: Beginning at the Northeast corner of said Lot 1; thence on an assumed bearing of south 00 degrees, 13 minutes, 15 seconds West along the East line of said Lot 1, a distance of 9.00 feet to a point; thence South 89 degrees, 04 minutes, 25 seconds West along a line parallel with the North line of said Lot 1, a distance of 187.00 feet to a point on the Westerly line of said Lot 1; thence North 06 degrees, 07 minutes, 52 seconds West along the said Westerly line of Lot 1, a distance of 9.04 feet to the Northwest corner of said Lot 1; thence North 89 degrees, 04 minutes, 25 seconds East along the North line of said Lot 1, a distance of 188.00 feet to the point of beginning) and Lot 2 in block 9 of the Original Plat of the Village (now city) of McHenry, East side of the Fox River, a Subdivision of part of the Southeast Quarter of Section 26, Township 45 North, Range 8 East of the Third Principal Meridian, according to the Plat thereof recorded July 6, 1840 in Book B of Deeds, page 160, in McHenry County, Illinois. ("Surplus Property"); WHEREAS, the size of the Surplus Property is approximately 17,333 square feet; WHEREAS, the current use of the Surplus Property is as a single-family residence; WHEREAS, the Surplus Property is no longer needed by the City and is therefore surplus City property; WHEREAS, pursuant to 65 ILCS 5/11-76-4.1, which authorized the sale of surplus real estate by resolution, the City is in receipt of a written MAI appraisal relating to the Surplus Property, which is available for public inspection from the City Clerk; and NOW, THEREFORE, BE IT RESOLVED by the Mayor and Aldermen as follows: 1. That pursuant to 65 ILCS 5/11-76-4.1, the Surplus Property is hereby declared as surplus municipal real estate. 2. The City Staff is directed to prepare the necessary documents, negotiate and sell the Surplus Property following City Council approval. 3. The terms of the sale are cash offers of not less than 80 percent of the written MAI appraisal on file with the City. In addition, the buyer shall be required, immediately upon receipt of title from the City, to a. convey title to the City relating to a portion of the Surplus Property described as follows: The east 70.00 feet of the south 30.00 feet of Lot 2 (as measured at right angles to the east and south lines thereof) in Block 9 of the Original Plat of the Village (now City) of McHenry, East side of the Fox River, being a subdivision of part of the Southeast Quarter of Section 26, Township 45 North, Range 8 East of the Third Principal Meridian according to the plat thereof recorded July 6, 1840 in Book B of Deeds, page 160, in McHenry County, Illinois. b. grant to the City an 18-month temporary easement over the Surplus Property for purposes of storing earth materials, construction equipment and vehicles in relation to the City's construction of a sanitary sewer lift station, main and appurtenances under the Fox River and through the Surplus Property; and I upon (2, afar c. grant to the City, with inA+re�months of closing,/a permanen� ten -foot easement, superior to any mortgage or other lien on the Surplus Property, for maintenance of the new sanitary sewer main connecting the lift station being constructed with the south waste water treatment plant. The exact location and form of this permanent easement shall be determined by as built drawings provided by the city engineer. 4. The City reserves the right to reject any and all offers. 5. All offers must be received by the McHenry City Clerk, 333 South Green Street, McHenry, Illinois, no later than March 7, 1997. 6.
