HomeMy WebLinkAboutMinutes - 06/06/2005 - City Council REGULAR MEETING JUNE So 2005 The Regular Meeting of the McHenry City Council was called to order by Mayor Low at 7:30 P.M. on Monday, June 6, 2005 in the Council Chambers of the Municipal Center. At -- roll call the following Aldermen were present: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, and Condon. Absent: None. City Staff in attendance were: Assistant to the City Administrator Martin, City Clerk Jones, City Attorney Cahill, Chief of Police O'Meara, Director of Public Works Marcinko, Director of Community Development Napolitano, Director of Parks and Recreation Merkel, Community Relations Management Assistant Hobson. Absent: City Administrator Maxeiner, City Attorney McArdle and Director of Finance Kline. RESOLUTION; ADOPT A STREET PROGRAM Mayor Low requested that Director of Public Works Marcinko explain the program. Director Marcinko stated the Adopt-A-Street Program is a partnership between the City and local individuals and organizations that encourages community pride through volunteer litter control. Mayor Low read a resolution recognizing area individuals and organizations for their contributions in the Adopt A Street Program. She recognized the following as currently participating in the program, noting many of the volunteers were present in the audience: Northtown Auto • McHenry Area Jaycees • Cub Scout Pack 311 • First United Methodist Church Men's Club • Boy Scout Troup 131 • Pablo Zuleta • Northwest Herald • McHenry High School Golf Team • Catholic Order of Foresters Mayor Low stated she, the Council and City Staff wish to recognize and thank the numerous volunteers for assisting in keeping the rights-of-way throughout McHenry litter- free. Motion by Murgatroyd, seconded by Santi, to accept Staffs recommendation to approve a resolution acknowledging contributions in the City of McHenry Adopt-A-Street Program. Voting Nay: None. Absent: None. Motion carried. REQUEST FOR THE USE OF PETERSEN PARK, AND WAIVER OF ALL ASSOCIATED FEES - PIONEER CENTER FISHING DERBY. SEPTEMBER 24, 2005 Sandra Salgado, of Pioneer Center's Office of Corporate Funding & Community Relations, addressed Council. Ms. Salgado informed Council that Pioneer Center is a June 6, 2005 Page 3 non-profit agency in McHenry which would like to hold a fishing derby fundraising event in McCullom Lake at Petersen Park on September 24, 2005. The event would raise funds for _. many programs which provide services for individuals with disabilities in McHenry County. Ms. Salgado stated Pioneer Center anticipates approximately 200 participants. The event would begin with registration at 6:00 a.m. and end at noon. Pioneer Center intends to charge $20.00 per individual for ages between 17 and 65 years of age and $5.00 for senior citizens and youths 16 years of age and younger. Pioneer Center is seeking sponsorships for prizes. Cash prizes would not exceed $1,000. There would be two fish tagged by the Illinois Department of Natural Resources (IDNR) with proposed prizes of $400 and $200 each. Pioneer Center is requesting Council approve the use of Petersen Park on Saturday, September 24, 2005 for the Pioneer Center Fishing Derby and waiver of all park usage fees for the event. Alderman Condon opined her support of the event. She stated the event would bring awareness to the community and offers a good opportunity to exhibit the new amenities at Petersen Park. Aldermen Wimmer and Santi concurred with Alderman Condon. Responding to Alderman Schaefer's inquiry, Director Merkel stated the Illinois Department of Natural Resources has continued stocking McCullom Lake. No additional stocking would be required for the event. Motion by Wimmer, seconded by Peterson, to accept Staffs recommendation to approve a request by Pioneer Center to hold a fishing derby on McCullom Lake at Petersen Park on September 24, 2005 from 6:00 a.m. to noon, and to waive all associated fees. REQUEST FOR USE OF PETERSEN PARK, AND WAIVER OF ALL ASSOCIATED FEES - 11T" ANNUAL "FOR THE CHILDREN" HAND CAR RACES, AUGUST 21, 2005 Management Assistant for Community Relations Hobson informed Council the 2005 Hand Car Races are scheduled for Sunday, August 21, 2005 from 9:00 a.m. to 4:00 p.m. He indicated elements of the event this year would include the handcar races, a silent auction, various displays, vendor booths, and a Union Pacific trailer selling food and beverages. Two motorcycle rides that begin in Kenosha and Chicago will conclude in Petersen Park. Management Assistant Hobson stated the motorcycle riders donate books to children's hospitals from their respective communities. Employees from Union Pacific �. are again coordinating and promoting the fundraising event. Management Assistant Hobson stated that Mr. Gary Mang, Manager of Track June 6, 2005 Page 4 Maintenance for Union Pacific and Founder/Coordinator of For the Children Hand Car -1 Races fundraising event, was unable to attend this evening's meeting. However, Mr. Mang is requesting the use of Petersen Park on Sunday, August 21, 2005 from 9:00 a.m, to 4:00 p.m. for the annual "For The Children" Hand Car Races and waiver of all park usage fees for the event. Alderman Murgatroyd opined support for the event stating not only is it a good cause, but very entertaining. Alderman Condon concurred with Alderman Murgatroyd. Responding to Alderman Condon's inquiry, Management Assistant Hobson stated, in the past, the event has made donations toward Flight for Life. Alderman Condon suggested books be considered for donation in the future. Motion by Murgatroyd, seconded by Santi, to accept Staffs recommendation to approve a request for use of Petersen Park on Sunday, August 21, 2005, from 9:00 a.m. to 4:00 p.m. for the annual "For The Children" Hand Car Races Event, and to waive all park usage fees for the event. Voting Aye: Santi, Giab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon. Voting Nay: None. Absent: None. Motion carried. -- REQUEST FOR FENCE VARIANCE, 1610 TYLER TRAIL Director of Community Development Napolitano informed Council that Applicants Jess and Kristi Kunish of 1610 Tyler Trail are requesting a variance to allow the installation of a 6-foot high, scalloped board-on-board fence setback five feet from their Tyler Trail property line. Director Napolitano stated the Applicant's lot is uniquely configured on the corner bulb of Tyler Trail. The City's fence regulations state that if a comer yard abuts the front yard of an adjoining property all fencing must be setback fifteen feet from the right-of-way line. Director Napolitano stated, due to the shape of the lot and the placement of the home on the lot, the usable backyard area is small. A variance would allow the applicants to enclose a greater portion of their yard. Staff indicated the proposed fence would have no adverse impact on the sight lines or the nearby properties. Staff recommends the variance be granted as requested. Alderman Santi indicated he had driven past the property inquired if plans had been made to landscape the property. Mr. Kunish stated they were awaiting a decision from the City regarding installation of the fence prior to proceeding with landscaping of the property. Mr. Kunish stated they hope to have the landscaping nearly finished by the end of July. Motion by Wimmer, seconded by Condon, to accept Staffs recommendation to approve a fence variance to allow installation of a 6-foot high, scalloped, board-on-board fence, setback five feet from the Tyler Trail property line of the property located at 1610 Tyler Trail. Motion carried, REQUEST FROM GARDEN QUARTER NEIGHBORHOOD RESOURCE CENTER TO PAINT A PUBLIC MURAL AND AFFIX IT TO THE DARTMOOR DRIVE BRIDGE Director Napolitano informed Council that a letter was received from Christie Moore, Project Director of the Garden Quarter Neighborhood Resource Center. He indicated the children who attend the Center had been awarded a grant from the Barrington Area Arts Council/Illinois Arts Council and have chosen to create a public mural they believe would be a source of pride for the City of McHenry. The group considered sites for the mural and has chosen to affix the mural on the Dartmoor Drive Bridge. Staff believes this to be an excellent community project and supports qse of the bridge for the mural. Director Napolitano noted the City has previously sought ways to enhance the bridge but has found alternatives to be cost prohibitive. Ms. Moore has pledged that the mural would be a piece with artistic value and integrity. Addressing an inquiry from Council, Ms. Moore indicated a specific project has not been chosen. Responding to an inquiry from Alderman Condon, Ms. Moore stated it might not be feasible to bring the artwork before Council for review prior to its installation on the bridge. The project would take place between 9:00 a.m. and 4:00 p.m. during to the week of June 13, 2005 through June 17, 2005. Ms. Moore stated an Open House is scheduled at the Center on Saturday, June 18, 2005, at which time all are welcome to review the mural. Responding to an inquiry, Director Napolitano stated the mural would not have any impact on the structural integrity of the bridge. Should repairs be required to the bridge the mural could be removed. Alderman Glab opined he is concerned that Council is relinquishing its responsibility by voting on the mural without having seen it. He stated he is not able to support the project. A lengthy discussion ensued. Alderman Peterson opined he would have liked this type of project opened up to city-wide participation, but understands, due totime constraints, that it is not feasible. Ms. Moore stated that all are welcome to participate in the project. Responding to Alderman Schaefer's inquiry, Ms. Moore stated the mural would be painted on signboard with special paint with a protective coating. The artist, Steve Wood, is nationally known and familiar with the painting of this type of mural. It is expected to remain in good condition for 10 to 15 years. �.. Alderman Murgatroyd opined this presents a good opportunity to foster community spirit and participation. June 6, 2005 Page 6 Applauding the project, Mayor Low stated obtaining the grant is a coup for the City -1- of McHenry. She expressed her support for the project. Motion by Condon, seconded by Murgatroyd, to accept Staffs recommendation to approve a request from the Garden Quarter Neighborhood Resource Center to affix a painted mural to the Dartmoor Drive Bridge over Boone Creek. Voting Aye: Santi, Schaefer, Murgatroyd, Wimmer, Condon. Voting Nay: Glab, Peterson. Absent: None. Motion carried. INTERGOVERNMENTAL AGREEMENT WITH MCHENRY PUBLIC LIBRARY DISTRICT Assistant to the City Administrator Martin informed Council that in 1995 the City of McHenry and the McHenry Public Library District entered into an Intergovernmental Agreement for use and occupancy of a storage shed located at 809 North Front Street. The City provides street sweeping, snow plowing and snow removal services of the library's parking lot in exchange for use of the shed for storage of City property. He noted both the library and the City maintain their own liability insurance with each party indemnifying the other. Assistant Martin stated the Agreement expires on June 2, 2005. The Library District .has expressed interest in extending the Agreement for one year. Assistant Martin indicated either the City or the Library may terminate the agreement with 90-days notice to the other party. The Library has indicated long-term plans to expand the current library and eventually utilize the storage shed on the site. Currently, the City Police Department uses the shed to store bicycles, evidence and other miscellaneous items. At this time, Staff is seeking alternative storage arrangements for the Police Department, however the current arrangements would continue until other arrangements are found. Motion by Wimmer, seconded by Condon, to accept Staffs recommendation to approve an Intergovernmental Agreement between the McHenry Public Library District and the City of McHenry for a period of one year with an expiration of.tune 2, 2006. INTRODUCTION OF NEW EMPLOYEE Director Napolitano introduced City Planner Liz Zeller, who began employment with the City of McHenry last week. He indicated Liz is very capable and he looks forward to working with her. Mayor Low welcomed Ms. Zeller to the Staff. June 6, 2005 Page 7 ENGINEERING SERVICES AGREEMENT FOR ELEVATED WATER STORAGE TANK NO 4 CONSTRUCTION OBSERVATION -SMITH ENGINEERING CONSULTANTS, INC. Director of Public Works Marcinko stated Council, at its May 16, 2005 regularly scheduled meeting, awarded the contract to CB&I Contractors, Inc. for the construction of the 1.0 million gallon Elevated Water Storage Tank No. 4 to be located on the west side of Crystal Lake Avenue south of Bull Valley Road. The City's engineering firm, Smith Engineering Consultants, Inc. (SEC) has submitted an Engineering Services Agreement, which provides for a periodic, part-time Project Representative to be on site to observe the contractor's work and assure conformance with the approved design documents during construction of the storage tank. Director Marcinko noted the proposed Engineering Services Agreement from SEC for construction observation and laboratory testing services represents approximately 2.8% of the proposed construction bid of$1,495,000. Responding to Alderman Murgatroyd's inquiry, Robert Wegener, CEO and President of SEC, stated there is no reason for an engineering firm to inspect everything, every day during construction of this project. Motion by Santi, seconded by Schaefer, to accept Staff s recommendation to approve an Engineering Services Agreement for construction observation of Elevated Water Storage Tank No. 4, with Smith Engineering Consultants Inc., in an amount not-to- exceed $44,155. Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon. -- Voting Nay: None. Absent: None. Motion carried. MAYOR— STATEMENT AND REPORT Mayor Low announced a ceremony for the rededication of A. P. Freund Field Rededication is scheduled for Saturday, June 11, 2005 at 1:00 p.m. The Freund family will be in attendance and Mayor Low encouraged Council to attend. Mayor Low stated on Saturday, June 18, 2005 the following events are scheduled: • 3`d Annual McHenry Kiwanis Club Soap Box Derby, from 9:00 a.m. to 6:00 p.m.; • Miss McHenry Pageant; and • Open House at the Garden Quarter Neighborhood Resource Center. COMMITTEE REPORTS Alderman Condon informed Council that she provided each with a copy of the Program Coordinator's Notes from the McHenry Area Youth Commission Board Meeting, which was held on May 26, 2005. Additionally, she announced that the Committee at Large (CAL) is having the 11 m Annual Charity Golf Outing on August 3, 2005. Alderman Condon strongly encouraged participation stating the proceeds from the event fund the mission of the M.A.Y.C. Parks and Recreation Committee Chairman Alderman Peterson informed Council that a Parks and Recreation Committee has been scheduled on Thursday, June 9, 2005 at June 6, 2005 Page 8 7:30 p.m. in the Alderman Conference Room. --�. STAFF REPORTS There were no staff reports. FUTURE AGENDA ITEMS Alderman Condon complimented Director Merkel on the Petersen Park waterfront entrance. She opined the project was a success.
