MAY 24, 2004
The Regular Meeting of the McHenry City Council was called to order by Mayor Low
at 7:30 P.M. on Monday, May 24, 2004 in the Council Chambers of the Municipal Center.
At roll call the following Aldermen were present: Bolger, Glab, Low, Wimmer, Peterson and
Condon. Absent: Alderman Murgatroyd. City Staff in attendance were: City Administrator
Maxeiner, City Attorney Fetzner, City Clerk Jones, Chief of Police O'Meara, Director of
Parks and Recreation Merkel, Director of Community Development Napolitano, Assistant
Director of Public Works Fink, Director of Finance Kline. Absent: Assistant Administrator
Lockerby, City Attorney McArdle, Director of Public Works Marcinko.
PROCLAMATION: NATIONAL GARDEN CLUB WEEK
Mayor Low informed Council that the National Garden Club was established to
stimulate the love and knowledge of gardening and to aid in the protection of native trees,
birds, shrubs and wild flowers. She noted that the McHenry Garden Club was formed in
January 2002 and embraces the goals and objectives of the National Garden Club. Mayor
Low introduced members of the McHenry Garden Club in attendance and read a
Proclamation naming the week of June 8, 2004 as National Garden Week in the City of
McHenry.
TEN MINUTE PUBLIC INPUT SESSION
Master Shayne Hayes, a resident at 3503 Forest Road, addressed Council. Master
Hayes proposed installation of a park at Forest Road and Bonita Lane for a play lot. He
informed Council that he has canvassed the neighborhood, obtained 51 signatures, and
informed Council no one objected to the play lot.
Mayor Low assured Mr. Hayes that Staff would look into the request and advise him
of the results.
CONSENT AGENDA
Police Chief O'Meara informed Council that an amendment was required to Item C,
CALEA, Proposed Police General Order 31.1, Civic Groups, adding Kiwanis to the list.
Motion by Peterson, seconded by Bolger, to approve the Consent Agenda as

REQUEST FOR TEMPORARY' USE OF PETERSEN PARK, TEMPORARY SIGN
PERMIT, AND WAIVER OF ALL ASSOCIATED FEES — MCHENRY LION'S CLUB
ANNUAL CARNIVAL
Director of Parks and Recreation Merkel informed Council that the McHenry Lion's
Club has hosted an annual carnival for over 25 years and has utilized Petersen Park for
the event for the past eleven years. The schedule this year for the event is June 9 through
``. June 12, 2004. Director Merkel noted proceeds from the carnival provide aid for those
persons who are sight and hearing impaired.

The Lion's Club is requesting the temporary use of Petersen Park for the carnival
and requests that park fees be waived along with any sign permit fees. The Lion's Club
has requested placement of signs at the following locations:
• Riverside Drive and McCullom Lake Road
• Route 120 and Chapel Hill Road
• Route 120 and Ringwood Road
• Route 31 and Pearl Street
• Route 31 and High Street
• Route 31 and McCullom Lake Road
Responding to Alderman Peterson's inquiry regarding a contingency plan for
inclement weather, Director Merkel stated the land where the carnival is held is on high
ground and inclement weather has not presented a problem in the past.
Motion by Peterson, seconded by Condon, to approve a request by the McHenry
Lion's Club for their annual carnival, waiving all park fees and sign permit fees, and
approving placement of signs at the following locations:
• Riverside Drive and McCullom Lake Road
• Route 120 and Chapel Hill Road
• Route 120 and Ringwood Road
• Route 31 and Pearl Street
• Route 31 and High Street
• Route 31 and McCullom Lake Road
Voting Aye: Bolger, Glab, Low, Wimmer, Peterson, Condon.

REQUEST FOR FENCE VARIANCE, 1002 THIRD STREET
Director of Community Development Napolitano informed Council a letter was
received from Dana and Carrie Obermayer, residents of 1002 Third Street, requesting a
variance to allow installation of a 4-foot high, black, ornamental aluminum fence around
their property at Third and John Streets. Director Napolitano stated the property is a
corner lot with frontage on both John and Third Streets. The City's fence regulations state
that any fence abutting a street right-of-way, except split rail, must be set back 30-feet from
the right-of-way line.
Director Napolitano stated the applicants are currently constructing an in-ground
pool on their lot and are seeking the additional privacy and security a fence would provide.
It was noted the applicants have made extensive improvements to the property and the
proposed fence would be an enhancement. Staff indicated it is not likely the fence would
cause an impact to the sight lines at the intersection of John and Third Streets because of
the openness of the fence and its relatively low height.
Alderman Glab expressed concern regarding the sight lines.

Mayor Low commended the applicants on the work done on the home.
Motion by Bolger, seconded by Wimmer, to accept Staffs recommendation to
approve a variance to allow a 4-foot high, black aluminum fence in the required corner side
yard for the property located at 1002 Third Street.
Voting Aye: Bolger, Low, Wimmer, Peterson, Condon.
Voting Nay: Glab.
Absent: Murgatroyd.
Motion carried.
PROPOSED ZONING TEXT AMENDMENTS
Director Napolitano reiterated that Council on April 5, 2004 approved various
amendments to the City of McHenry Zoning Ordinance, including deletions of ambiguities
and inconsistencies, together with the addition of various definitions and diagrams to make
the Zoning Ordinance more readable. Staff is seeking approval from Council prior to
moving forward with preparation of the ordinance.
Alderman Glab expressed numerous concerns with the amendments. Alderman
Wimmer opined each of these matters have been addressed during several Community
Development Committee meetings and it is a waste of Staffs time to continue discussions
regarding further revisions. Alderman Condon concurred with Alderman Wimmer.
Responding to'Alderman Glab's concerns regarding Rules of Procedure, Page 4,
Section H, entitled Hearing Officer Alternative Process, Director Napolitano stated the City
Attorney provided the language for Section H. He suggested striking Section H in its
entirety pending revision to the language to address the questions regarding the Rules of
Procedure.
Motion by Bolger, seconded by Peterson, to table the decision regarding definitions
for commercial and recreational vehicles, and regulations for commercial and recreational
vehicles.
Voting Aye: Bolger, Glab, Peterson, Condon.
Voting Nay: Low, Wimmer.
Absent: Murgatroyd.
Motion carried.
Motion by Condon, seconded by Wimmer, to direct Staff to prepare an ordinance
amending the City's Zoning Ordinance and Municipal Code as follows:
1. Move driveway section from the Municipal Code to parking and loading section of
the Zoning Ordinance;
2. Add Section to the Administration section of the Zoning Ordinance regarding public
hearing procedures, subject to striking Section H, Page 4, pending language
clarification from the City Attorney;
3. Delete use table attached as appendix to the Zoning Ordinance;
4. Add the term "Required" to "Front , "Interior Side" and "Rear" Yards.

MAYOR—STATEMENT AND REPORT
Mayor Low complimented Assistant Director of Public Works Fink and Public Works
Department on their diligent efforts during the inclement weather.
COMMITTEE REPORTS
There were no Committee Reports.
STAFF.REPORTS
Director of Parks and Recreation Merkel announced that the pool at Knox Park is
scheduled to open on Saturday.
City Administrator Maxeiner stated he is pleased to report there have been few
problems experienced throughout the City during the significant rainfall.
Assistant Director of Public Works Fink announced that sandbags are available at
the Public Works Garage located at 105 North Green Street and also at the Water
Department Building located at 1401 Beach.
NEW BUSINESS
Responding to Alderman Glab's inquiry, Assistant Director of Public Works Fink
stated six to seven inches of water has accumulated throughout the City and the ground is
saturated. He noted, however, with few exceptions, no problems have been experienced.
Alderman Glab suggested in an effort to avert future problems, detention should be
reviewed in the near future.
Alderman Peterson suggested a camera be installed and directed at the podium to
facilitate the viewing of speakers by the television viewing audience.
