HomeMy WebLinkAboutMinutes - 06/21/2004 - City Council REGULAR MEETING JUNE 21, 2004 The Regular Meeting of the McHenry City Council was called to order by Mayor Low at 7:30 P.M. on Monday, June 21, 2004 in the Council Chambers of the Municipal Center. At roll call the following Aldermen were present: Bolger, Glab, Low, Murgatroyd, Peterson and Condon. Absent: Wimmer. City Staff in attendance were: City Administrator Maxeiner, City Clerk Jones, City Attorney Fetzner, Chief of Police O'Meara, Director of Parks and Recreation Merkel, Director of Community Development Napolitano, Director of Public Works Marcinko, Director of Finance Kline. Absent: Assistant City Administrator Lockerby, City Attorney McArdle. RESOLUTION: HONORING RETIRING EMPLOYEE JAMES A. KEEVIL Mayor Low read Resolution R-04-006 acknowledging retiring employee James A. Keevil's thirty-two years of service to the Police Department of the City of McHenry. Motion by Murgatroyd, seconded by Bolger, to pass an approve Resolution R-04- 06. Voting Aye: Bolger, Glab, Low, Murgatroyd, Peterson, Condon. Voting Nay: None. Absent: Wimmer. Motion carried. RESOLUTION: ADOPT-A-STREET PROGRAM Mayor Low read a Resolution for the Adopt-A-Street Program, acknowledging the following organizations currently participating in the Program and the respective adopted streets: • Northtown Auto, the portion of McCullom Lake Road in front of their facility; • McHenry Area Jaycees, a portion of Crystal Lake Road; • Cub Scout Pack 311, portions of Lincoln Road near Hilltop School; • First United Methodist Church Men's Club, a portion of Route 31 from the Warsaw Inn to a point two miles south; • Boy Scout Troop 131, portions of Green Street. Mayor Low requested a Motion to approve a Resolution recognizing the volunteers who have spent countless hours keeping McHenry's right-of-ways beautified. Motion by Bolger, seconded by Murgatroyd, to approve a resolution recognizing the organizations and volunteers who have spent countless hours keeping McHenry's right-of- ways beautified as part of the City's Adopt-A-Street Program. Voting Aye: Bolger, Glab, Low, Murgatroyd, Peterson, Condon. Voting Nay: None. Absent: Wimmer. Motion carried. Z TEN MINUTE PUBLIC INPUT SESSION Mr. David Boger, a resident at 1102 N. Oakwood Drive,. addressed Council regarding the reasons he is against Metra establishing a station north of the City of June 21, 2004 Page 2 McHenry. He stated he is concerned with traffic congestion, noise and safety issues. CONSENT AGENDA Alderman Bolger requested Consent Agenda Item A, Contract with Hey and Associates for development of a Natural Resource Management Plan, in an amount not-to- exceed $17,000, be pulled from the Consent Agenda for further discussion. CONSENT AGENDA ITEM A: CONTRACT WITH HEY AND ASSOCIATES FOR DEVELOPMENT OF NATURAL RESOURCES MANAGEMENT PLAN, NOT TO EXCEED 17 000 Responding to Alderman Bolger's inquiry, Director of Parks and Recreation Merkel stated that from a technical and implementation standpoint Staff does not have the necessary expertise to prepare the Management Plan. Motion by Condon, seconded by Murgatroyd, to approve a contract with Hey and Associates for development of a Natural Resources Management Plan, in an amount not- to-exceed $17,000. CONSENT AGENDAT ITEM E: REQUEST FOR PICNIC PERMITS Alderman Glab reiterated his concerns regarding the use of City parks by non- residents. Motion by Murgatroyd, seconded by Peterson, to approve a request for a Picnic Permit submitted by Anthony Castellaccio of Ingleside for a family picnic. Voting Aye: Bolger, Low, Murgatroyd, Peterson, Condon. Voting Nay: Glab. Absent: Wimmer. Motion carried. REQUEST FOR FENCE VARIANCE—3301 BRETONS DRIVE Director of Community Development Napolitano addressed Council. He stated a letter was received from William and Heather Dust, residents of 3301 W. Bretons Drive. In the letter Mr. and Mrs. Dust explained they received a permit to install a fence in their comer side yard, along Valley Road. In accordance with the City's requirements, the fence was to be installed 5-feet from the Valley Road property line, which is approximately 1.6 feet from the edge of the sidewalk. However, when the contractor installed the fence, they took the measurement 5-feet from the edge of the sidewalk. Therefore, the fence is 1.6 feet closer to the Valley Road property line than is allowed by ordinance. The contractor's -�„ error was not discovered until the final inspection of the fence. June 21, 2004 Page 8 Director Napolitano stated Staff has no concerns with the applicant's request. The fence creates no impact on sight lines at the BretonsNalley Road intersection, due to the low fence height and curvature of Valley Road. Motion by Condon, seconded by Bolger, to approve a variance for a fence in the corner side yard along Valley Road at 3301 Bretons Drive. Voting Aye: Bolger, Glab, Low, Murgatroyd, Peterson, Condon. REQUEST FOR ZONING MAP AMENDMENT—3719 WAUKEGAN ROAD Director Napolitano informed Council that Petitioners, Thomas and Ruth Fenwick, residents at 3719 Waukegan Road, are requesting a Zoning Map Amendment from RA-1 to RS-4 in order to divide the existing lot at 3719 Waukegan Road into two parcels. Director Napolitano stated that if the Zoning Map Amendment is approved, the Petitioners would keep the existing single-family home and detached garage on the west part of the site, and sell the newly created parcel for development of a single-family home. Staff noted that the property is currently zoned RA-1, Attached Residential. The RA-1 District allows up to two dwelling units, attached or built side by side, on the subject - property. Under the,current zoning the petitioners could demolish the existing home and build a multi-family side by side housing unit without any zoning relief. By rezoning the property to RS-4, which allows only single-family homes, the property becomes consistent with the City's Comprehensive Plan and the recently adopted Downtown Plan. Director Napolitano indicated the character of the area is of mixed residential uses. He noted the property is 0.4 acres in size, which is inconsistent with the lot sizes of the surrounding properties. Creating two new lots, of approximately 8,500 square feet each, would create lot sizes more consistent with the surrounding area. Director Napolitano stated that the Planning and Zoning Commission at a Public Hearing held on May 20, 2004 unanimously recommended approval to grant a Zoning Map Amendment to RS-4, High-Density Single-Family Residential, for the property located at 3719 Waukegan Road. Responding to Alderman Murgatroyd's inquiry, Director Napolitano stated there are no restrictions on the type of home that can be built when a property is rezoned. Attorney James Cowlin, representing Applicants Thomas and Ruth Fenwick, assured Council the type of home eventually built would be consistent with the homes in the surrounding vicinity. June 21, 2004 Page 9 Motion by Murgatroyd, seconded by Bolger, to accept the unanimous recommendation of the Planning and Zoning Commission to grant a Zoning Map Amendment from RA-1 to RS-4, High-Density Single-Family Residential, for the property located at 3719 Waukegan Road. Voting Aye: Bolger, Glab, Low, Murgatroyd, Peterson, Condon. Voting Nay: None. Absent: Wimmer. Motion carried. REQUEST FOR CONDITIONAL USE, 731 RIDGEVIEW DRIVE Director Napolitano informed Council that Applicant, Dr. Thomas Kukla of Fox Development, is requesting a Conditional Use Permit to utilize 1,584 square feet of a newly constructed 68,000 square foot warehouse/office building as a bistro. Director Napolitano stated that pursuant to the City's Zoning Ordinance permitted uses in the C-5 District are considered Conditional Uses in the BP Zoning District. Director Napolitano opined the proposed use would not generate any adverse impacts. It is the intention of the applicant to be open for business from 6:00 a.m. until 2:00 'p.m. and to serve primarily coffee, pastries, deli sandwiches and salads. There is adequate parking, 96 spaces, to accommodate the use. Property owner Jack Pease has assured Staff that two spaces would be reserved for pick-up orders only. Director Napolitano noted that a business park is intended to allow a diversity of uses that complement each other and provide services to those within the park, as well as those outside the park. Staff believes this use is appropriate for the location and would be a good addition to the business park. Director Napolitano informed Council at a Public Hearing held on June 3, 2004 the Planning and Zoning Commission voted unanimously to recommend approval of the Conditional Use Permit to allow a bistro at 731 Ridgeview Drive, with the condition that the bistro maintain its hours of operation between the hours of approximately 6:00 a.m. and 2:00 p.m., as indicated on the Public Hearing Application. L June 21, 2004 Page 10 REQUEST FOR CONDITIONAL USE PERMIT TO ALLOW A CREDIT UNION AT 4115- 4117 SHAMROCK LANE IN THE LIBERTY SQUARE SHOPPING CENTER Director Napolitano informed Council that Applicant RST Development LLC has requested a Conditional Use Permit to utilize two tenant spaces, 2,977 square feet of the existing commercial building located at 4115-4117 Shamrock Lane for the Corporate America Credit Union. He noted a credit union is considered a financial institution according to the City Zoning Ordinance. The subject property is zoned 0-1, requiring a Conditional Use for the financial use. Director Napolitano stated that Kevin Harder of Smith Engineering Consultants was in the audience to answer any inquiries posed by Council. Director Napolitano stated the Liberty Square Shopping Center is located at the southwest corner of State Route 31 and Shamrock Lane. The Shopping Center is comprised of three buildings, which includes AmCore Bank, a commercial building and a professional office building. Staff believes the credit union is an appropriate use in the commercial building. He noted if the request is approved there would remain three vacant tenant spaces in the commercial building. Director Napolitano informed Council at a Public Hearing held on June 3, 2004 the Planning and Zoning Commission unanimously recommended approval of a Conditional Use Permit to allow a credit union at 4115-4117 Shamrock Lane. RECOMMENDATION TO CONTRACT REINWALL REPAIRS FOR REPLACEMENT OF 40 FEET OF FAILED BREAKWATER AT RIVIERA MARINA IN THE ESTIMATED AMOUNT OF $9,309.16 Director of Public Works Marcinko reiterated to Council that the City purchased the marina adjacent to the Central Wastewater Treatment Plant in the year 2000 for the purpose of implementing improvements to the wastewater plant. He noted the marina has continued to operate while treatment improvement plans are finalized and permits are obtained. The City remains responsible for maintaining the property in good and safe condition and for any significant improvements on the site. While preparing for the opening of this year's boating season, D's Marine notified --.1 the City that approximately 40 feet of the breakwater wall had fallen into a state of disrepair. The deteriorated breakwater is located on the eastern most point of the marina property and is the primary protection in absorbing waves transmitted from the main channel of the Fox River. The breakwater protects the boats in their slips and the June 21, 2004 Page 11 shoreline from erosion. Mr. Danko, the owner of D's Marine, has obtained a quote for the repair to the breakwater wall in the amount of$9,309.16. Director Marcinko stated that in the last two years the City has realized over $50,000 annually in revenue from operation of the marina. He noted the 2004/2005 Budget includes $15,000 for miscellaneous repairs to the marina. He anticipates no other significant repairs at the site during this fiscal year. Staff is seeking Council approval of Reinwall Repairs proposal to replace and/or repair a portion of the breakwater wall at the Riviera Marina, in an amount not-to-exceed $9,309.16. COMMITTEE REPORTS Alderman Bolger requested a Public Works Committee meeting be scheduled on Wednesday, July 7, 2004 at 6:30 p.m. in the Aldermen's Conference Room prior to the Council meeting. STAFF REPORTS There were no Staff Reports. NEW BUSINESS Alderman Glab commented that the chillers have not been installed as yet on West Campus High School. Responding to Alderman Glab's inquiry, Director of Public Works Marcinko stated the project is due to be completed no later than June 25, 2004.
