At roll call the following Aldermen were present: Bolger, Glab, Low, Murgatroyd, Wimmer, Peterson and Condon. Absent: None. City Staff in attendance were: City Administrator Maxeiner, City Attorney McArdle, City Clerk Jones, Chief of Police O'Meara, Director of Community Development Napolitano, Assistant Director of Public Works Fink, Director of Finance Kline. Absent: Director of Parks and Recreation Merkel and Director of Public Works Marcinko. TEN MINUTE PUBLIC INPUT SESSION No one signed in to speak during the Ten Minute Public Input Session. CONSENT AGENDA Alderman Glab requested that Item A, Special Event/Picnic Permit Requests, and Item C, Request for Special Event Liquor License, Riverbend Ltd. USE VARIANCE TO ALLOW ADDITIONAL USES IN CONJUNCTION WITH A MEDICAL OFFICE/PROFESSIONAL BUILDING — NORTHWEST CORNER OF GREEN STREET AND CHARLES MILLER ROAD Mayor Low informed Council that a use variance to allow certain additional uses on the property located at the northwest comer of Green Street and Charles Miller Road has been removed from this evening's Agenda for consideration at the Petitioners' request. FINAL PLAT AND VARIANCES FROM SUBDIVISION CONTROL AND DEVELOPMENT ORDINANCES— EVERGREEN PARK SUBDIVISION Director of Community Development Napolitano reiterated that at the August 2, 2004 meeting concerns were expressed by Council regarding the following issues in the Evergreen Park Subdivision: • Streetscape and building envelopes in the proposed development; • Variances to the City's Subdivision Control and Development Ordinance; • Detention, storm water runoff to Olde Mill Ponds Subdivision; and August 16, 2004 Page 8 • Vacation of a portion of Blake Boulevard. --� 1. Streetscape and Building Envelopes: The developer, Alex Jensen of Centex Homes, presented color renderings depicting the layout of the development with the townhomes and streetscapes. Director Napolitano informed Council that Staff, the developer and the City's engineer met to discuss the concerns expressed by Council regarding the proposed detention, the options proposed to enhance the capacity of the detention basins, and requested variances from the City's Subdivision Control and Development Ordinance. 2. Variances: Robert Wegener, representing City Engineer Smith Engineering Consultants, Inc. provided a letter, dated May 11, 2004, explaining the justification for the requested variances. 3. Detention and Storm Water Runoff: Director Napolitano stated the developer has met the City's Ordinance and exceeded the requirements for detention and storm water runoff rate by reducing the storm water runoff below what is required. Director Napolitano noted that in order to address periods of standing water, dead grass and drought conditions, the developer has agreed to employ a wetland planting program consisting of prairie plants that excel in wet and dry/drought conditions. 4. Vacation of 'a portion of Blake Boulevard: The City's Engineer has recommended that a portion of Blake Boulevard not be vacated at this time. Smith Engineering Consultants, Inc. believes in the future this right-of-way may be necessary. Once a road is vacated it reverts back to private property and the City no longer maintains control. Staff opined a portion of the right-of-way could always be vacated in the future. Alderman Condon expressed concerns regarding an insufficient amount of open space. Responding to Alderman Bolger's inquiry, Mr. Jansen assured Council a homeowner's association would be established. Motion by Murgatroyd, seconded by Wimmer, to direct Staff to prepare an ordinance granting variances from the City's Subdivision Control and Development Ordinance and granting approval of the Final Plat of Subdivision for Evergreen Park Subdivision, subject to the following: • Dedication of a perpetual landscapetfencing easement, for the purpose of maintenance, by the City of McHenry to Centex Homes and the future Homeowners' Association for Evergreen Park Subdivision; • Council's direction on a requirement by the Developer to further reduce the storm water runoff release rates from the subject property at .07 cubic feettsecond; • Requiring the recording of the Final Plat within six months of Council approval. ORDINANCE VACATING PORTION OF DRAPER ROAD AND RENAMING A PORTION OF DRAPER ROAD Director Napolitano reiterated the discussion to Council regarding several road and right-of-way issues relating to Draper Road and Curran Road in the vicinity of Shamrock Farms, now known as Legend Lakes. Due to the road configuration, Staff brought forth the following recommendations for Council's consideration: • Vacate a now unimproved portion of Draper Road and end Draper Road at the new intersection of Curran Road on the north side of the Shamrock Farm development; • Rename the portion of Draper Road from Route 120 south to Curran Road as Curran Road; • Rename the portion of Draper Road just south of Roundup Road to Old Draper Road. Director Napolitano stated following the required Public Hearing to vacate a portion of the Draper Road right-of-way, Council, by a 4-2 vote, directed Staff to prepare the necessary ordinances to facilitate Staffs recommended changes. On April 19, 2004 Council considered the ordinances and took the following action: • Ordinance renaming a portion of Draper Road just south of Roundup Road to Old Draper Road, approved by a vote of 4-2; • Ordinance vacating the now unimproved portion of Draper Road, denied. • Ordinance changing the name of Draper Road, from Route 120 south to Curran Road, to Curran Road, tabled until such time as all Council members are present. Staff is again bringing forward the ordinances vacating a portion of Draper Road and renaming a portion of Draper Road from Route 120 south to Curran Road. Staff believes these changes would result in less confusion by persons traveling these roads and would save the City in signage and maintenance dollars. It was the consensus of Council to consider the remaining items on the Agenda, prior to voting on this matter. ENGINEERING SERVICES AGREEMENT FOR DESIGN OF TRAFFIC SIGNALS AND ROADWAY LIGHTING AT RIDGEVIEW DRIVE AND BULL VALLEY ROAD — SMITH ENGINEERING CONSULTANTS, IN AN AMOUNT NOT-TO-EXCEED $31,340.40 Assistant Director of Public Works Fink informed Council that Smith Engineering Consultants, Inc. has submitted an Engineering Services Agreement for the preparation of contract plans and specifications for the design of the traffic signal and roadway lighting for the intersection at Ridgeview Drive and Bull Valley Road in the amount of$31,340.40. Assistant Director Fink stated that once the warrants were met, Smith Engineering Consultants performed a capacity analysis to determine the effects the addition of a traffic signal would have on the intersection's level of service. The signal warrant study August 16, 2004 Page 10 concluded that the installation of a traffic signal would greatly reduce backups and delays along Ridgeview Drive without causing adverse impacts on Bull Valley Road. The McHenry County Highway Department was contacted with the results of the study and the City acquired the County's approval regarding the study. However, the County requires that intersection lighting be incorporated into the design. Assistant Director Fink noted that the project was budgeted in the 2004/2005 Capital Improvement Fund in the amount of$280,000. Alderman Bolger opined the fee for the design of the traffic signals and roadway lighting seems excessive. Alderman Glab concurred with Alderman Bolger. Motion by Condon, seconded by Murgatroyd, to accept Staffs recommendation to approve an Engineering Services Agreement with Smith Engineering Consultants, Inc. for the design of the traffic signal and roadway lighting at Ridgeview Drive and Bull Valley Road, in an amount not-to-exceed $31,340.40. REQUEST FOR CHANGE ORDER NO. 1 AND FINAL PAYMENT FOR THE CONSTRUCTION OF EDGEBROOK DRAINAGE IMPROVEMENTS PHASE II TO- LANDSCAPE RESOURCE, INC, IN THE AMOUNT OF $26,826.04 Assistant Director Fink informed Council that Landscape Resources, Inc. has submitted a final invoice to the City in the amount of$26,826.04 for the construction of the Edgebrook Drainage Improvements Phase II. He noted Landscape Resources, Inc.'s final contract price is $25,043.63 below the approved contract price of $227,248.50 due to the reduction in various quantities that were made in the field during construction. The State requires City approval when the final contract price fluctuates by a total of$10,000 or more from the original contract amount, necessitating the Change Order. Assistant Director Fink noted during the spring season's heavy rain the Edgebrook Drainage Improvements performed according to design, yielding no reported flooding to any of the homes along the drainage way. Motion by Bolger, seconded by Murgatroyd, to accept Staffs recommendation to approve Change Order No. 1 for the Edgebrook Drainage Improvements Phase II and authorizing final payment to Landscape Resources, Inc., in the amount of$26,826.04. SPECIAL CENSUS TEMPORARY SIGN REQUEST City Administrator Maxeiner informed Council that in working with the Project August 16, 2004 Page 11 Manager from the US Bureau of Census it was recommended that signs be made available to notify residents that the census enumerators are out in the community. Signs would provide an immediate method of notification to the citizens of McHenry. City Administrator Maxeiner stated that five signs would be posted, containing a telephone number should residents have any questions regarding the census. The sign locations would vary as the special census progresses throughout the City. Staff indicated direction would be given to the Project Manager to be cognizant of safety and traffic sight lines when placing signs. Motion by Condon, seconded by Wimmer, to accept Staffs recommendation to authorize a Temporary Sign Permit for the partial census, from August 10, 2004 through September 9, 2004. A discussion ensued regarding current ownership of the property and the possibility of an easement as opposed to vacation. w Alderman Murgatroyd stated he supports renaming a portion of Draper Road to Curran Road. He opined it is less confusing for emergency vehicles and new residents. Alderman Bolger indicated he does not favor the name change due to future construction of the West McHenry Bypass. Alderman Glab stated he does not support the name change. Mayor Low concurred with Alderman Murgatroyd. City Attorney McArdle informed Council that six favorable votes are required to approve an ordinance vacating a portion of Draper Road. Motion by Wimmer, seconded by Condon, to accept Staffs recommendation to approve an ordinance vacating a portion of Draper Road, ending Draper Road at the new intersection of Curran Road on the north side of the Shamrock Farm development, subject to confirmation that the City of McHenry does not hold title to the property. COMMITTEE REPORTS Alderman Wimmer informed Council of the Community Development Committee meeting scheduled on Wednesday, August 18, 2004 at 7:00 p.m. in the Aldermen's Conference Room. STAFF REPORTS City Administrator Maxeiner stated that Director of Parks and Recreation Merkel is attending a NISRA function and was therefore unable to attend tonight's Council meeting. Chief of Police O'Meara informed Council that two police officers were sworn in today: , • Officer Harris has experience as a police officer; and • Office Ochocki begins training at the Institute in Champaign on Sunday. Chief of Police O'Meara stated the police force is now fully staffed. FUTURE AGENDA ITEMS Alderman Condon expressed strong disappointment regarding Mr. Engelke's withdrawal of his application for a temporary use permit and the fact that the Garden Quarter modular unit would not be constructed. Mayor Low stated that Mr. Engelke indicated he would be providing a second apartment in place of the modular unit. Alderman Murgatroyd opined the Council needs to be cognizant regarding the tone that is set throughout the community and everyone is entitled to be treated respectfully. He stated he took exception that an Alderman would make an implied threat due to disagreement on an issue.
