HomeMy WebLinkAboutMinutes - 09/20/2004 - City Council REGULAR MEETING SEPTEMBER 20, 2004 The Regular Meeting of the McHenry City Council was called to order by Mayor Low at 7:30 P.M. on Wednesday, September 20, 2004 in the Council Chambers of the Municipal Center. At roll call the following Aldermen were present: Bolger, Glab, Low, Murgatroyd, Wimmer, Peterson and Condon. Absent: None. City Staff in attendance were: City Administrator Maxeiner, City Attorney McArdle, City Clerk Jones, Chief of Police O'Meara, Director of Parks and Recreation Merkel, Director of Community Development Napolitano, Director of Public Works Marcinko, Director of Finance Kline. Absent: None. PRESENTATION: LEADERSHIP GREATER MCHENRY COUNTY Mr. Roger Schlies, Coordinator of Leadership Greater McHenry County provided Council with a presentation regarding the organization's goals and benefits which the organization provides to the community, including building and enhancing leadership skills, personal development and service to others. Mr. Schlies stated the organization is committed to making a difference in the Greater McHenry County community. TEN MINUTE PUBLIC INPUT SESSION Mr. Enrico Heirman, a resident of 520 Kresswood, Director of the CABA World Series, addressed Council. Mr. Heirman thanked Mayor Low for her participation in throwing out the starting pitch in the tournament, which was held July 23, 2004 through August 1, 2004. He presented Mayor Low with a baseball signed by the Japanese team. CONSENT AGENDA ITEM A: PICNIC PERMIT REQUEST Alderman Glab stated he continues to have concerns regarding sources outside the City limits utilizing the City parks and resources. He informed Council that he would like all of the park fees reviewed by the Parks and Recreation Committee in the near future. Motion by Murgatroyd, second by Wimmer, to approve the Picnic Permit Request submitted by Knaack Manufacturing Company on October 2, 2004. Voting Aye: Bolger, Low, Murgatroyd, Wimmer, Peterson, Condon. Voting Nay: Glab. Absent: None. Motion carried. REQUEST FOR MINOR VARIANCE TO SIDEYARD SETBACK— 5003 BROMLEY DRIVE Director of Community Development Napolitano informed Council that applicant, Thomas Cichowski of 5003 Bromley Drive has requested a minor variance to allow a side yard setback of 4.08 feet, rather than the required 7.4 feet, in order to extend an existing one-car garage to a two-car garage. Director Napolitano stated that all of the abutting homes in the applicant's neighborhood have the same or greater lot width. He noted the applicant lives in a wide ranch home and, due to the placement of the home and the existing lot width of 74 feet, the applicant is unable to meet the City's required side yard setback. Staff opined that the proposed variance is minimal and would not have an impact on the character or appearance of the area. Staff has no concerns with the requested variance, Director Napolitano indicated that the Planning and Zoning Commission at a Public Hearing held on September 4, 2004 unanimously recommended approval to allow a west side property line setback of 4.08 feet. Motion by Condon, seconded by Wimmer, to accept the unanimous recommendation of the Planning and Zoning Commission, and to approve an ordinance granting a 3.32 foot variance to allow a 4.08 foot side yard setback on the west lot line at 5003 Bromley Drive. ti September 20, 2004 Page 10 Voting Aye: Bolger, Glab, Low, Murgatroyd, Wimmer, Peterson, Condon. Voting Nay: None. Absent: None. Motion carried. REQUEST FOR TRANSFER OF LIQUOR LICENSE 172-11 TO ROUTE 120 LIQUORS, INC. D/B/A TOOLLAND & LIQUORS LOCATED AT 2360 WEST ROUTE 120 Mayor Low informed Council that Toolland & Liquors, located at 2350 West Route 120, has been sold to Route 120 Liquors, Inc. The new owners have submitted a request to transfer the F2-11 liquor license to the new entity. Mayor Low stated the corporation's President, Jagdish Shah, has been fingerprinted and all City requirements for transfer of the license have been met. Mayor. Low noted that Cheryl Heneise, the current manager, would remain at Toolland and has also been fingerprinted. REQUEST FOR AMENDMENT TO CONDITIONAL USE PERMIT AND SIGN VARIANCE§ — 1901 NORTH RICHMOND ROAD, MOBIL OIL Mayor Low informed Council that this Item was pulled from tonight's Agenda at the request of the Applicant. The request would be considered at a later date. REQUEST FOR VARIANCE TO REQUIRED NUMBER OF PARKING §PACES — 3710 WEST ELM STREET In attendance was Ron Bykowski, applicant and property owner. Director Napolitano informed Council that Applicant Ron Bykowski has requested a variance from the Zoning Ordinance to allow a reduction in the number of required parking spaces for redevelopment of the former Eby Brown building, located at 3710 West Elm Street. Director Napolitano stated that Mr. Bykowski acquired the property in 2003 with the intention of redeveloping the building from its former warehouse use into a retail strip center extension of the Mill Pond Court. The change of use necessitated an increase in parking spaces. Because the site is limited regarding available parking, the applicant has submitted a parking variance for Council's consideration. ' Director Napolitano stated that originally it was Mr. Bykowski's intent to demolish approximately 6,500 sf. of the 28,000 sf. building, on the south and east sides, which. September 20, 2004 Page 11 would result in the need for 59 parking spaces. Mr. Bykowski was able to provide 39 spaces on the site, 20 less than required. Director Napolitano stated at a Public Hearing held on August 21, 2003, the Planning and Zoning Commission reviewed the request and unanimously recommended approval. Director Napolitano noted that, since the original site plan was presented, Verlo Mattress has signed a lease for over half of the building. Verlo's space needs were different and therefore a lesser portion of the building was removed, approximately 750 sf. on the south side of the building. Verlo will have more area devoted to assembly and warehouse than retail requiring less parking. With the latest revisions to the site plan the actual variance being requested is less than what was originally requested, a 16-space reduction rather than the 20-space reduction. Staff opined that with the constraints of the site, such as the existing building and parking lot layout, the parking variance is justified. The impacts of permitting a parking reduction are somewhat lessened because on-street parking is available on Elm Street and Millstream Drive. Director Napolitano indicated the site has been vacant since January 2001 and the applicant has invested a considerable amount of time and funds to bring the property back to a viable condition. Staff indicated that approval of Applicant's request would allow conversion to a viable retail use. Mr. Ron Bykowski thanked,.Council for their consideration and indicated he is anxious to move forward with the project. Motion by Bolger, seconded by Peterson, to accept the unanimous recommendation of the Planning and Zoning Commission, and to direct Staff to prepare an ordinance granting a parking variance to allow a reduction to 28 spaces for the property located at 3710 West Elm Street. REQUEST FOR TIF ASSISTANCE FOR THE PROPERTY LOCATED AT 3710 WEST ELM STREET Director Napolitano stated Mr. Bykowski appeared before Council in June 2003 with a conceptual plan to renovate the Eby Brown building located at 3710 West Elm Street. The renovation would provide for tenant space for retail, office and professional uses. At that time, Mr. Bykowski was working with Staff in an effort to ascertain what enhancements could be made to the site, which were eligible for Tax Increment Finance (TIF) assistance. Originally the amount of TIF assistance requested was $111,500. Director Napolitano noted it was estimated the proposed improvements to the site would generate an increment of$138,856 over the life of the TIF, with the first year generating $4,222. Director Napolitano stated Mr. Bykowski has met with Staff and refined his proposal for the site. Since Verlo Mattress Factory has signed a lease to occupy nearly half of the September 20, 2004 Page 12 renovated space, the applicant's plans have been revised and the request for TIF assistance has been reduced. This evening Mr. Bykowski is requesting: • Replacement of-the existing sidewalk on the north side of Elm Street from the Boone Creek Bridge to 3814 West Elm at an estimated cost of$20,400; and • Reimbursement of the cost of the building permit in the amount of $7,200 for remodeling the existing structure, as well as waiving any future remodeling permit fees, estimated at $1,600. Staff opined that the site has been vacant since January 2001. Mr. Bykowski has invested considerable funds to bring the property back to viable condition. Staff noted that the original discussions with Mr. Bykowski regarding TIF assistance centered on exterior improvements that would make the building conducive to retail operations and provide a highly visible standard for redevelopment projects within the TIF District. The exterior improvements included: • Parking lot improvements; • Right-of-way vacations; • Traffic flow reconfigurations on Millstream; and • Hydrant and utility pole relocation. Director Napolitano stated that Staffs' intent was for the developer to implement the improvements identified within the downtown plan and raise the bar for future developments. With the change in the applicant's planned use of the property, and the change in the contemplated improvements, Staff suggested the following: + 50/50 cost sharing on the cost to replace the sidewalk, 50% public cost and 50% developer cost; • Future building permit fees for the property at 3710 West Elm to be waived for remodeling or alterations for additional tenants within the next 12-month period, but no waiving of the original building permit fee; and • The City would work with the utility companies to get utility poles straightened on the property. It is Staffs' opinion that any additional incentives would serve to set a precedent that future redevelopment projects elsewhere in the TIF could expect TIF incentives despite a lack of conformance with the Downtown Plan. Staff does not support Mr. Bykowski's request for consideration of lesser incentives and recommends Council deny the Applicant's request. Mr. Bykowski addressed Council noting numerous meetings with Staff during the renovations at the site. In particular, he pointed out the deplorable condition of the sidewalk from Boone Creek Bridge to 3814 West Elm. Mayor Low concurred with Mr. Bykowski that the sidewalks were in terrible condition _ and opined they should be replaced. Alderman Condon concurred with Mayor Low. Alderman Condon opined that developers must have incentives to redevelop the Downtown area. Alderman Murgatroyd inquired whether TIF funds or Developer Escrow funds September 20, 2004 Page 13 should be utilized. Alderman Glab opined the funds should come from TIF. _ Alderman Bolger stated he supports Mr. Bykowski's requests for replacement of the existing sidewalk and reimbursement of the cost of the building permit for remodeling the existing structure. Motion by Bolger, seconded by Glab, to approve the replacement of the existing sidewalk on the north side of Elm Street, from the Boone Creek Bridge to 3814 Vilest Elm. He invited Council to attend the dedication ceremony. AWARD OF BID FOR BACKSTOP AND FENCE INSTALLATION AT A. P. FREUND FIELD PHASE III— MIKE MEIER& SONS FENCE Director of Parks and Recreation Merkel noted a typographical error on the Agenda. He informed Council that the correct amount is $9,900, instead of$9,800. Director Merkel stated that a price quotation was submitted by Mike Meier& Son's Fence of Spring Grove, Illinois, for installation of backstop and sideline fencing at A.P. Freund Field. Director Merkel informed Council that the Phase III Improvements at A.P. Freund Field are nearing completion with installation of the parking area and landscaping. Price quotations were solicited for installation of the backstop and sideline fencing for the new ball field, to be completed by October 29, 2004. Mike Meier & Son's submitted the lowest quotation. He noted that rededication of the field and opening day ceremonies are scheduled in spring 2005. AUTHORIZATION TO WAIVE BID REQUIREMENTS AND PURCHASE TWO CIVIL DEFESE WARNING SIRENS City Administrator Maxeiner informed Council that the City's existing warning system is managed by the Police Department and consists of six warning sirens at the following locations throughout the City: • Sunnyside Dodge • Center Street • Crystal Lake Road and Malibu Court • Albany and Belden Roads • Martin Road • Hilltop School. City Administrator Maxeiner stated the signals at Martin Road and Hilltop School are powered by solar charged batteries and controlled via a Federal digital control unit located in the Emergency 9-1-1 Center. The other four units utilize older technology and are controlled by a Zetron paging unit also located in the 9-1-1 Center. It was noted that all the units are currently functional and are tested regularly. City Administrator Maxeiner informed Council that newer subdivisions in the City are not effectively served by warning sirens at this time. Following considerable analysis, a plan has been developed by Staff to locate two sirens to service these newer areas, with plans for future additional improvements. The Police Department and the Community Development Department have worked extensively to facilitate the location of two additional warning sirens in the City and have determined the following: • One siren would be located adjacent to Shamrock Farms Subdivision; and • One siren would be installed on City-owned property behind the Petersen Historic Farm. City Administrator Maxeiner stated future improvements call for the replacement of the older sirens with newer technology meeting today's standards, including the relocation of two of the existing sirens to provide better coverage throughout the City. He noted that with the installation of the two new sirens and future relocation and replacement of existing sirens, coverage of the entire City would be complete. Staff would like to continue with standardization of warning equipment throughout the City, thereby simplifying and expediting activation during emergencies by eliminating multiple activation procedures. Staff is requesting Council waive the bidding process in _ order to purchase two new Federal Signal Corporation signals through Braniff _ Communications Incorporated, the authorized dealer serving this territory. City Administrator Maxeiner noted the Federal Signal brand is a proprietary product and can be acquired only through an authorized representative of the company. The cost for the acquisition and installation of two new units is $34,961. City Administrator Maxeiner September 20, 2004 Page 15 informed Council the 2004/2005 budget includes $35,000 in the Civil Defense Fund for the purchase of sirens. Staff recommends Council authorization to: 6 Waive the bid process for the acquisition of two new emergency warning sirens; and • Purchase two new Federal Warning Systems emergency warning sirens from Braniff Communications Incorporated, in an amount not-to-exceed $34,961. TO FUND TOURISM ACTIVITIES IN THE CITY OF MCHENRY City Administrator Maxeiner reiterated to Council that the McHenry County Economic Development Corporation (MCEDC) is attempting to establish a McHenry County Convention and Visitor's Bureau (MCCVB). The MCCVB would promote McHenry County as a destination for conventions, weekend getaways, sports competitions and special events while facilitating the attraction of additional patrons to restaurants, shopping, lodging and other area amenities, generating additional tax revenue. City Administrator Maxeiner noted that by establishing a convention and visitors bureau the area would also become eligible to access state funds for tourism promotion activities. City Administrator Maxeiner stated that operation costs for the MCCVB would require a collaborative effort between the local governments of McHenry County. McHenry County has committed to funding 80%, 60% and 40% respectively over the first three years. However, it is the County's intention to pass 100% of the funding requirements to the municipal partners and the State of Illinois from year four onward. The calculation for municipal contributions is based upon the ratio of hotel/motel rooms in each community compared to the total available in the County. The City of McHenry has 133 rooms and the municipal share would currently be 12.7% resulting in costs as follows: • Year One $11,000 • Year Two $12,000 • Year Three $14,500 • Year Four $18,500 City Administrator Maxeiner noted on July 21, 2003 Council voted unanimously to provide the authority to establish a Hotel Operators' Occupation Tax of up to 5% of the gross rental receipts to fund tourism activities. The revenue collected from the tax would be used solely to promote tourism and conventions, or to otherwise attract overnight September 20, 2004 Page 16 visitors to the municipality. City Administrator Maxeiner stated that by establishing a 2.5% tax the intent would be to commit a portion of the receipts to the MCCVB operations, with the remainder utilized for City tourism initiatives. He noted the Finance and Personnel Committee discussed a caveat rescinding the tax should the MCCVS not be established or imminent within 36-months following approval of the tax. Support of the 2.5% tax was indicated by Council following a brief discussion. Motion by Condon, seconded by Wimmer, to approve the establishment of a 2.5% Hotel/Motel Tax in the City of McHenry, effective when administratively feasible, with revenues allocated to fund County and City tourism initiatives, subject to the tax being rescinded should the MCCVB not be established or imminent within 36-months following initiation of the 2.5% Hotel/Motel Tax.
