HomeMy WebLinkAboutMinutes - 01/06/2003 - City Council REGULAR MEETING JANUARY 6, 2003 The Regular Meeting of the McHenry City Council was called to order by Mayor Althoff at 7:30 P.M. on Monday, January 6, 2003 in the Council Chambers of the Municipal Center. At roll call the following Aldermen were present: Bolger, Glab, Low, Murgatroyd and Wimmer. Absent: None. City Staff in attendance were: City Administrator Maxeiner, Assistant Administrator Lockerby, City Clerk Jones, City Attorney McArdle, Director Community Development Napolitano, Director Public Works Marcinko, Director Parks and Recreation Merkel and Chief of Police O'Meara. Absent: None. TEN MINUTE PUBLIC INPUT Lynn Whitney, a Ronda Road resident, addressed Council regarding coyotes roaming in large packs throughout the Green Valley Subdivision. The coyotes are becoming more aggressive and Mr. Whitney stated the residents are becoming concerned. They requested Council consider a removal and/or relocation program. Assistance from McHenry County Animal Control is not available at this time. Mayor Althoff suggested Mr. Whitney and his neighbors seek assistance from Staff to alleviate the problem. CONSENT AGENDA Motion by Bolger, seconded by Glab, to approve the Consent Agenda as presented: ■ Public Works Committee Recommendation to enter into an agreement with Smith Engineering Consultants Inc to perform a Facility Needs Analysis and Concept Plan for a new Public Works Garage; ■ North Interceptor Sewer Project: Payment No 12 to George Kennedy Construction Inc; ■ CALEA Proposed Police General Order Revision. Voting Aye: Bolger, Glab, Low, Murgatroyd, Wimmer. Voting Nay: None. Absent: None. Motion carried. REQUEST TO CLOSE CERTAIN PORTIONS OF WAUKEGAN ROAD AND TO DIRECT CITY STAFF TO ASSIST IN 2003 SOAP BOX DERBY ON SATURDAY JUNE 28 2003 — MCHENRY KIWANIS Mayor Althoff reminded Council at the December 2, 2002 Council Meeting Mr. James Marinangel of the McHenry Kiwanis appeared before Council seeking permission to work with Staff regarding the feasibility of closing off Green Street on June 28, 2003. The Kiwanis are proposing to host a Soap Box Derby and are requesting street closure to facilitate the race. At that time, it was Council direction to seek an alternative street, as Green Street was too busy to be closed for any period of time, particularly on a Saturday during the summer season. Mayor Althoff noted this evening's request is to close a portion of Waukegan Road 1.. for the Soap Box Derby on June 28t'. Mr. Marinangel stated Staff suggested the Waukegan Street location. The only January 6, 2003 Page 2 outstanding issue is whether parking space may be available at the East Campus Parking 1" Lot. Phase 3 of the East Campus renovations will be taking place and parking may not be possible on the premises. Mr. Marinangel noted traffic will be temporarily stopped and released periodically throughout the day at the intersection of Waukegan Road and Green Street. Assistant Administrator Lockerby noted Staff has worked with the Kiwanis. Issues which have been addressed include: • The City will provide Police presence during the event • The City will provide signage, barricades and traffic cones to minimize the disturbance to vehicular and pedestrian traffic; • The City will provide bleachers for audience viewing; • The City will provide hand held radios for communication at the top and lower end of the run. Alderman Glab opined the Waukegan Road site is much better than the previously considered Green Street closure for the race. He suggested Staff and Council be made aware of the date for the trial run on the course. Some discussion occurred regarding utilizing a portion of the east campus parking lot for residents and business people to access locations east of Green Street on Waukegan Road during the day of the derby. Motion by Bolger, seconded by Low, to grant permission to close portions of Waukegan Road on Saturday, June 28, 2003 to host a Soap box Derby to the McHenry Kiwanis Club, and that the City provide the following for the event: • Police presence during the event • Signage, barricades and traffic cones to minimize the disturbance to vehicular and pedestrian traffic; • Bleachers for audience viewing; • Hand held radios for communication at the top and lower end of the run. Mr. Marinangel stated the practice day would be held two weeks prior to the event on Saturday, June 14, 2003 or Sunday, June 15, 2003 depending upon weather conditions. The practice session would last no longer than three hours. DEVELOPMENT AGREEMENT WITH MCHENRY HIGH SCHOOL DISTRICT 156 Mayor Althoff stated the intent of the proposed agreement with District 156 was to clarify and itemize the City's desire and intent for development on the subject property. City Administrator Maxeiner informed Council the Development Agreement is an attempt to remove interpretation from both parties, i.e. the School District and the City. Alderman Glab expressed his concern with regard to the engineer's reference to a January 6, 2003 Page 3 release rate not to exceed the 100-year storm frequency. Drainage issues occur when less intense storms occur. City Attorney McArdle noted the City's ordinance summarizes the intent of the State Statute. McHenry City ordinance requires upon the development of a parcel the engineer for the developer and the property owner must certify that to the extent they are altering the downstream flow of the surface water, and that they have handled it with whatever good engineering practices require. Further, the developer must divert the flow or store it as required. City McArdle stated all of this is derived from the Common Law which requires that a person can not increase the rate of flow or the volume of flow of water downstream following development of property. Mayor Althoff stated the document is surety that any future development of this property would be subject to the provisions of this agreement, regardless of who is on the Council or who is in management or on the School District 156 Board. Further discussion occurred regarding the existing and potential use of the subject property as a drainage detention basin. Motion by Bolger, seconded by Wimmer, to approve and authorize the Mayor's execution of a Development Agreement between the City of McHenry and McHenry High School District 156 for the school district property located on Crystal Lake Road. Voting Aye: Bolger, Glab, Low, Murgatroyd, Wimmer. Voting Nay: None. Absent: None. Motion carried. AWARD OF BID FOR THE PURCHASE OF SPORTABLE SCOREBOARD TO BE INSTALLED AT KNOX PARK BALL FIELD TO RECREATION CONCEPTS Director of Parks and Recreation Merkel stated the Knox Park Ball field Scoreboard was a budgeted item in the 2002-2003 Budget in the amount of $4,500. rector Merkel noted the proposal is slightly over the budgeted amount, however here rare sufficient monies in the capital account as other items have come in under budget. It is Staffs recommendation to replace the existing unit at the Knox Park Ball Field in an amount not- to-exceed $5,280. In response to Alderman Murgatroyd's inquiry, Director Merkel noted the remote would be stored onsite with other grounds equipment and would be provided to users by department Staff. Director Merkel noted the remote operational feature reduces the cost of the installation of the scoreboard as multiple cable trenches are no longer required. Motion by Bolger, seconded by Low, to approve the award of bid for the installation of a sportable scoreboard at the Knox Park ball field to Recreation Concepts, in an amount not-to-exceed $5,280. January 6, 2003 Page 4 MAYOR—STATEMENT AND REPORT Mayor Althoff informed Council contact has been made with the Village of Prairie Grove Village President Friedman to continue negotiations regarding a potential border agreement. Mayor Althoff noted a final draft could be presented to Council in the near future. Mayor Althoff also noted Alderman Murgatroyd informed her Paul Pacini had contacted him regarding a potential meeting about his property located at Crystal Lake Road and Bull Valley Road. The City has responded and a meeting will be scheduled to discuss Mr. Pacini's concerns and views regarding this property. COMMITTEE REPORTS Finance and Personnel Committee Chairman Alderman Murgatroyd noted the budget process will commence in the near future. Noting past procedures, Alderman Murgatroyd inquired if Council was amenable to preliminary meetings occurring which would include the City Administrator, Assistant Administrator, Mayor and Finance and Personnel Committee Chairman in conjunction with each of the department heads in an attempt to achieve a balanced budget. Once the preliminary meetings have occurred, regular Finance and Personnel Committee meetings would be held to deliberate the initial findings regarding the proposed budget. Ultimately, the budget would be presented to full Council :: consideration, review and formal action, as in the past. Alderman Murgatroyd ._ noted this v -)uld streamline the process. City ,dministrator Maxeiner stated typical department head requests on any given year are $1 million to $3 million higher than anticipated revenues for that year. It is a lengthy process to trim the proposed budget so that it is balance when finally presented to the Finance and Personnel Committee. Mayor Althoff reminded Council a Parks and Recreation Meeting has been scheduled for Thursday, January 9, 2003 at 7 p.m. in the Aldermen's Conference Room. DEPARTMENT HEAD REPORTS Chief of Police O'Meara referenced the Friday Report, noting Rebecca Vachlin resigned which leaves an opening on the department. Chief O'Meara stated the Police Commission posted a new list of 44 candidates. The City has begun scheduling for tests and a qualified candidate should be selected by January 13'. Director of Public Works Marcinko reported Illinois Department of Transportation (IDOT) has scheduled the Route 31/McCullom Lake Road Improvement Bid Opening for June 130'. Director Marcinko also reported the Illinois Route 120 Improvements from Illinois Route 47 to Illinois Route 31 Bid Opening is in January and a proposed construction schedule will be forthcoming. Director of Community Development Napolitano reported on Saturday evening a vehicle ran into the Express Cleaners building at the corner of Route 31 and Bull Valley Road. There was some minor damage to the building, however, there was no structural damage. January 6, 2003 Page 5 City Clerk Jones reported the City has received information regarding a Special Census. The cost estimate fee is $200. City Clerk Jones noted the $200 fee must be paid — in order to determine the estimated cost of a Special Census ordered by the City. City Clerk Jones inquired if Council was interested in conducting a Special Census. City Administrator Maxeiner stated if approved, the Special Census would be conducted in the 2003 with another potentially in 2007. Motion by Glab, seconded by Murgatroyd, to authorized the expenditure of $200 to the U.S. Census Bureau for payment of a cost estimate for a Special Census in the City of McHenry. Voting Aye: Bolger, Glab, Low, Murgatroyd, Wimmer. Voting Nay; None. Absent: None. Motion carried. City Administrator Maxeiner reported he and Assistant Administrator Lockerby had met with all three collective bargaining units last Monday. Progress has been made in some areas. A full report will be made to Council at the February 3, 2003 "regularly scheduled Council Meeting. NEW BUSINESS There was no New Business. EXECUTIVE SESSION: PROPERTY ACQUISITION Motion by Bolger, seconded by Glab, to go into Executive Session at 8:15 p.m. to discuss Property Acquisition. Voting Aye: Bolger, Glab, Low, Murgatroyd, Wimmer. Voting Nay: None. Absent: None. Motion carried. Council went into Executive Session at 8:19 p.m. Motion by Bolger, seconded by Wimmer, to return to Open Session at 8:34 p.m. Voting Aye: Bolger, Glab, Low, Murgatroyd, Wimmer. Voting Nay: None. Absent: None. Motion carried. Council went back into Open Session at 8:34 p.m. ..
