At roll call the following Aldermen were present: Bolger, Glab, Low, Murgatroyd and Wimmer. Absent: None. City Staff in attendance were: City Administrator Maxeiner, Assistant Administrator Lockerby, City Clerk Jones, City Attorney McArdle, Director Community Development Napolitano, Director Public Works Marcinko and Director Parks and Recreation Merkel. Voting Nay: None. Absent: None. Motion carried. DOWNTOWN DEVELOPMENT PLAN —VISIONARY EXERCISE SUMMARY RESULTS Mayor Althoff introduced Devin Lavigne of Trkla, Pettigrew, Allen & Payne Inc. She stated Mr. Lavigne participated in the Project Advisory Committee Workshop data collection and analysis and would make a presentation to review the preliminary "Vision Statement." Mr. Lavigne reminded Council on Monday, December 16, 2002 a Visioning Workshop for the Downtown Plan was conducted. The purpose of the Workshop was to develop a Vision Statement describing Downtown McHenry as it might be in 2013. Mr. Lavigne stated participants in the Visioning Workshop included the Council, Downtown Plan Advisory Committee, downtown business people, Riverwalk Committee members, Planning and Zoning Commissioners, City Staff and interested residents in attendance at the Council meeting. He explained the Visioning Statement is intended to be a retrospective chronicling of the accomplishments and achievements undertaken in Downtown McHenry since completion of the Downtown Plan in 2003. Assistant City Administrator Lockerby interjected stating the intent of the information .� provided is to gain insight from Council on the Visioning Workshop and Synthesis for presentation to the Downtown Advisory Committee for incorporation into the Downtown Plan prior to returning to Council for approval of the Downtown Plan. January 20, 2003 Page 6 Mr. Lavigne stated the Synthesis summarizes the primary findings derived from community outreach and inventory and analysis phases of the Downtown McHenry Planning Program. He explained the purpose of the Synthesis report is to briefly highlight the issues and opportunities to be addressed in the next phases of the planning program. The primary issues and opportunities recognized were divided into eight categories: 1. Achieving a balance between preservation and new development; 2. Accommodating and establishing the multiple roles of Downtown; 3. Maintaining Downtown as a mixed-use environment; 4. Establishing improvement and development guidelines for land use areas; 5. Improving vehicular circulation and parking; 6. Establishing guidelines for buildings and storefronts; 7. Improving the pedestrian environment; 8. Enhancing other urban design aspects of Downtown. Mr. Lavigne noted the objective is to reach agreement on the issues and opportunities outlined above with the Downtown Plan Steering Committee and City Council prior to proceeding to the next phase of the planning program. Mr. Lavigne stated the primary objective of the Downtown Plan should be to accommodate continued improvement and encourage appropriate redevelopment of select Downtown areas, while also building upon and enhancing the established qualities and characteristics that give the area a unique identity. Alderman Murgatroyd opined the Visioning Workshop and Synthesis has provided Council the opportunity to pull the project together. Alderman Bolger concurred with Alderman Murgatroyd expressing full support of the project. TIF REDEVELOPMENT PROPOSAL— RIVERWALK PLACE TOWNHOMES Mayor Althoff recognized the efforts of City Administrator Maxeiner, Assistant City Administrator Lockerby, Director of Community Development Napolitano and Project Coordinator Cliff DiLorenzo for their efforts in the analysis of the Riverwalk Place Townhome Project within the Tax Increment Financing (TIF) District. Director of Community Development Napolitano addressed Council stating the site consists of 1.69 acres located on the north side of Waukegan Road, just east of the McHenry Villa parking lot. He informed Council it is the intent of the developer to construct twenty luxury townhomes consisting of 2-bedrooms (a third bedroom would be optional), 2- 1/2 baths and 2-car garages. He informed Council to accommodate the development on the site several zoning actions would be necessary: • Rezoning from 0-1 Local Office to RM-2 High Density Multi-Family Residential District; • Variances to allow multiple buildings on a single zoning lot; • Variances of front, side and rear year setbacks; • Preliminary and Final Plat of Subdivision, which, to expedite the process, could be considered simultaneously; and • Variance of the Municipal Code requirement for a 70% brick exterior. January 20, 2003 Page 7 Director Napolitano stated the developer has indicated he would also be requesting a waiver of the sidewalk provision due to the site limitations on Waukegan Road. Mayor Althoff introduced Project Developer Curt Langille of Lanco Development. Mayor Althoff noted should Council approve the conceptual plan this evening, the matter would then be presented to the Planning and Zoning Commission for Public Hearing. Mr. Langille presented the conceptual plan for a 20-unit luxury townhome development on Waukegan Road, east of Green Street, within the City's recently established TIF District. He noted $8,000 per unit has been allocated for landscaping. He opined his enthusiasm for the Riverwalk Project and stated he has been intrigued with the prospect of this type of project since contracting for the property over a year and a half ago. Mr. Langille stated he would be seeking municipal assistance from the City in the form of TIF funds and other incentives as follows: ■ Partial improvement of Waukegan Road with a paving base, binder and surface course, street lighting, storm sewer; water main; and sanitary sewer; ■ Waiver of Building Permit Fees; ■ A reduction in the Letter of Credit security from 125% to 100%; ■ Deferment of Capital Development Fees and tap on fees until townhome occupancy permits are issued; ■ Deferred Developer Donations. ■ Boat slips and the rights to provide water access for residents. He is requesting '— ten piers, providing 20 boat slips. Alderman Bolger expressed support for the project. Director of Public Works Marcinko, responding to Alderman Murgatroyd's inquiry, stated in the next several years infrastructure improvements would be required on Waukegan Road regardless of whether or not the Riverwalk Place Townhomes project was approved. He opined the improvements to Waukegan Road at this time are only conceptual, stating the $170,000 figure indicated incorporates basic improvements, which meet the City's standards. Mr. Langille, responding to Alderman Murgatroyd's inquiry, stated the piers would be constructed to a design standard and the pier rights would remain part of the property, assuring Council the piers would not be sold separately. Alderman Murgatroyd opined his concern regarding deferring Developer Fees without first contacting the other taxing bodies and obtaining consensus regarding deferment. Responding to Alderman Glab's concerns regarding drainage issues, Director of Public Works Marcinko stated the site is currently all asphalt and storm water pools and drains into Boone Creek. Responding to Alderman Glab's concerns regarding density, Mr. Langille stated it January 20, 2003 Page 8 was not viable to consider a reduction in the number of units from 20 to 16. "�- Responding to Alderman Glab's inquiry, Director of Community Development Napolitano informed Council a conceptual development plan showing 25 townhomes on the site was included with the request to amend the Conditional Use Permit for a reduction in parking in September 1999. Upon approval of the parking reduction by the City, the owner was contemplating development of the remainder of the property for multi-family townhomes. However, at no time was a formal request submitted to the City to rezone the property for townhome use or residential development. Director Napolitano stated the issue of the parking reduction and the development of the site for townhomes were two separate matters. Alderman Low opined support for the project as presented, commenting the City is at a crossroads regarding redevelopment of the Downtown area. She stated further the Council has made a commitment to the TIF District and needs to be willing to make a leap of faith and support the proposed project. Alderman Bolger concurred with Alderman Low. Mayor Althoff commented that 98% of the proposed Riverwalk is in private ownership, which presents an issue to be taken into consideration. Motion by Bolger, seconded by Low, to approve the conceptual development plans for Riverwalk Place Townhomes, and to direct Staff to prepare a Developer's Agreement — specifying the terms and conditions for the development; subject to clarification regarding deferment of Developer Fees from the other taxing bodies. Voting Aye: Bolger, Glab, Low, Murgatroyd, Wimmer. Voting Nay: None. Absent: None. Motion carried. REQUEST TO SOLICIT REQUEST FOR QUALIFICATIONS FOR LANDSCAPE ARCHITECT— MCHENRY RIVERWALK Mayor Althoff introduced Cliff DiLorenzo of Trkla, Pettigrew, Allen and Payne Inc. and stated he was in attendance to address any questions presented by Council. Assistant Administrator Lockerby stated the Request for Proposals (RFP) for a landscape architect for design services for the McHenry Riverwalk has been drafted by Trkla, Pettigrew, Allen and Payne. He explained the RFP defines the scope of services needed and ranges from design of the Riverwalk through construction management. Assistant Administrator Lockerby informed Council Staff is seeking authorization to proceed with issuing the RFP for Landscape Architectural Services for the Riverwalk. Responding to Alderman Murgatroyd's inquiry, Assistant Administrator Lockerby announced the process for selecting a firm includes the following steps and complies with requirements of selecting professional services of this nature: • Meet with approximately ten potential design firms to review qualifications; • Issue the RFP to the qualified firms; January 20, 2003 Page 9 • Receive and review proposals; • Rank the proposals and conduct presentations with the top three firms; • Negotiate price and contract with the top firms; • City Council will award the contract to the selected firm. Responding to Alderman Murgatroyd's inquiry regarding who will make the determination of qualified firms, Assistant Administrator Lockerby stated Staff will conduct the preliminary reviews and Council will make the final selection. He noted the process is anticipated to take approximately two months with the firms selected providing a presentation to Council in late March or early April. A brief discussion ensued regarding Council's participation in the selection process. Motion by Glab, seconded by Murgatroyd, to authorize issuing the Request for Proposals for Landscape Architectural Services for the McHenry Riverwalk, with the stipulation a minimum of the top three firms chosen make a presentation to full Council. Voting Aye: Bolger, Glab, Low, Murgatroyd, Wimmer. Voting Nay: None. Absent: None. Motion carried. MAYOR—STATEMENT AND REPORT Mayor Althoff reminded Council of the Metra Presentation at the Village of Johnsburg Board Meeting scheduled to take place on January 21, 2003 at 7:30 p.m. Mayor Althoff mentioned the McHenry County Council of Governments meeting scheduled to take place on Wednesday, January 22, 2003 at 6:00 p.m. at the Bull Valley Golf Club. Metra officials will be in attendance to offer a presentation on Metra service in general, as well as the short and long range plans for McHenry County. COMMITTEE REPORTS Chairman Alderman Murgatroyd reminded Council there is a Finance and Personnel Committee meeting scheduled on February 3, 2003, prior to the Council meeting, at 6:30 p.m. in the Aldermen's Conference Room. DEPARTMENT HEAD REPORTS Assistant Administrator Lockerby informed Council a Homestead Tour of the Petersen Farm Property is scheduled to take place on Saturday, January 25, 2003 at 9:00 a.m. He stated anyone interested in the tour should contact Ms. Marci Geraghty to confirm attendance. It was also mentioned should anyone care to tour the outbuildings appropriate attire is in order. Assistant Administrator Lockerby also stated a meeting was scheduled with YMCA representatives to move forward with formation of the Steering Committee for the Recreation Center. He assured Council he would keep them apprised. Director of Parks and Recreation Merkel informed Council with the onset of �-' consistently cold weather the maintenance department has begun the water application and flooding of Freund Field. The liner has been installed and the ice rink should be ready January 20, 2003 Page 10 in approximately one week. Director Merkel stated East Beach and McCullom Lake are safe for skating. Director of Public Works Marcinko reminded Council a neighborhood meeting is scheduled on January 21, 2002 at 6:00 p.m. in the Municipal Building Council Chamber to discuss options regarding Edgebrook Drainage Phase II. City Administrator Maxeiner informed Council he intends to release the Capital Improvement Plan ("CIP") on January 29, 2003 and to schedule a workshop for February 10, 2003, with the focus of the workshop on wastewater treatment. City Administrator Maxeiner also stated a meeting was held on January 16, 2003 with representatives of the Olde Mill Pond Subdivision. Potential solutions were explored to eliminate the drainage problems experienced. City Administrator Maxeiner informed the Council Inland Development has been encouraged to participate in resolution of the issues. In conclusion, City Administrator Maxeiner advised Council the backup centrifuge at the Central Wastewater Treatment Plant malfunctioned and is in need of repair. Repair of the backup centrifuge is expected to cost in excess of $15,000. City Administrator Maxeiner requested authorization from Council for the repair of the backup centrifuge. The sewage overflow at the South Wastewater Treatment Plant was due to a screen clog and Staff is working with Baxter and Woodman to correct this problem. Motion by Glab, seconded by Bolger, to authorize the expenditure for repair of the backup centrifuge at the South Wastewater Treatment Plant, in an amount not to exceed $20,000. Mayor Althoff called the Executive Session to order at 8:15 p.m. Property Acquisition City Administrator Maxeiner iterated Council's tentative approval,at the January 6, 2003 Council Meeting,regarding purchasing the rights for the construction or installation of 30 piers (60 boat slips)at a cost of$300,000. Mayor Althoff informed Council she is seeking authorization to execute the Fox Waterway Pier Purchase Agreement for the purchase of 30 piers (60 boat slips) in the amount of $300,000, payable to Stanton Point Partnership, Keith Vargo and Bob Korvas, Sellers. Responding the Alderman Murgatroyd's inquiry regarding the source of the funds, Mayor Althoff stated the $300,000 payment would come from the Riverwalk Fund. City Administrator Maxeiner and City Attorney McArdle will complete the transaction.
