FEBRUARY 17, 2003
The Regular Meeting of the McHenry City Council was called to order by Mayor
Althoff at 7:30 P.M. on Monday, February 17, 2003 in the Council Chambers of the
Municipal Center. At roll call the following Aldermen were present: Bolger, Glab, Low,
Murgatroyd and Wimmer. Absent: None. City Staff in attendance were: City
Administrator Maxeiner, Assistant Administrator Lockerby, City Clerk Jones, City Attorney
McArdle, Director Community Development Napolitano, Assistant Director Public Works
Fink and Chief of Police O'Meara. Absent: Director of Public Works Marcinko and
Director of Parks and Recreation Merkel.
TEN MINUTE PUBLIC INPUT
Geri Condon, a resident of 4823 Loyola, and Riverwood School Parent Teachers
Organization President, addressed Council, speaking on behalf of a number of residents in
support of the expeditious installation of a traffic signal at Winding Creek Drive and Crystal
Lake Road. She presented numerous signatures of concerned parents encouraging
Council to consider the safety of the children attending Riverwood School when
determining whether to install the stop light at Winding Creek Drive and Crystal Lake Road
or Glenbrook Trail and Crystal Lake Road. Ms. Condon made particular note the
signatures obtained were from word of mouth and more signatures could have been
obtained had printed material been distributed and included in the school's newsletter.
Mayor Althoff informed Ms. Condon the matter was on the Agenda for consideration
at the Public Works Committee meeting scheduled to take place on March 3, 2003 at 6:30
p.m. in the Aldermen's Conference Room. She stated the public was welcome to attend.
CONSENT AGENDA
Motion by Low, seconded by Bolger, to approve the Consent Agenda as presented:
• Request for Special Event Liquor License from St. Paul's Episcopal Church;
• Committee recommendation to authorize City Administrator to administer step
increases as a component of the pay-for-performance merit pay system;
• Authorize repairs to the centrifuge at the Central Wastewater Treatment Plant, in
an amount not to exceed $30,000;
• Request for final payment to Berger Excavation for the Crestwood Drive
infrastructure improvements, in an amount not-to-exceed $40,651.79;
• Approve City Council Minutes: February 3, 2003 regularly scheduled meeting;

Responding to Alderman Murgatroyd's inquiry, Mr. Pearson of St. Paul Episcopal
Church informed Council the Clergy Chili Cook-Off Challenge is a fundraising event co-
hosted by Holy Apostles Church and Shepherd of the Hills Church and all proceeds would
benefits McHenry PADS sites.

REQUEST BY WONDER LAKE SKI TEAM FOR THE USE OF PETERSEN PARK AND -�
WAIVER OF ALL ASSOCIATED FEES FOR THE OPERATION OF THE HAUNTED
HAYRIDE ON OCTOBER 11, 17, 18, 24. 25 AND NOVEMBER 1, 2003
Kim Carlsten, a member of the Wonder Lake Ski Team, addressed Council
requesting the use of Petersen Park, as in years past, for a Haunted Hayride on the
following dates:
Saturday, October 11 h from 7 p.m.-until 10:30 p.m.
Friday, October 17`h from 7 p.m. until 10:30 p.m.
Saturday, October 18"' from 4 p.m. until 6 p.m. and 7 p.m. until 10:30 p.m.
■ Friday, October 24"' from 7 p.m. until 10:30 p.m.
■ Saturday, October 25th from 4 p.m. until 6 p.m. and 7 p.m. until 10:30 p.m.
■ Saturday, November 1�` from 7 p.m. until 10:30 p.m.
Ms. Carlsten also requested permission to display 4 x 4 freestanding advertising
signs during the month of October at the following locations:

Ms. Carlsten introduced Mr. Rick Berndt, President of the Wonder Lake Ski
Team. Mr. Berndt expressed gratitude for the City of McHenry's continued support of the
annual Haunted. Hayride event at Peterson Park, which assists in raising funds for the
organization.
Mr. Berndt explained one dollar from each ticket sale is donated to charity, noting
this year the following entities were selected to received $200 donations from the Ski
Team:
• Harrison School in Wonder Lake
• Greenwood School in Greenwood
• Home of the Sparrow
• PADS
Mr. Berndt informed Council the Wonder Lake Water Ski Show Team has also
elected to donate $500 to the City of McHenry Parks and Recreation Department, in
appreciation for the use of Petersen Park. City Administrator Maxeiner accepted the $500
contribution on behalf of the City of McHenry.
Alderman Bolger complimented the Wonder Lake Water Ski Show Team on their
efforts. Mayor Althoff wished them continued success.
RIVIERA MARINA PROPERTY:
1. RENEWAL OF LEASE AGREEMENT WITH D'S MARINE SERVICE INC.

MARINA OPERATION FUND
City Administrator Maxeiner informed Council the current lease between the City of
McHenry and Jerry Danko of D's Marine for Riviera Marina expires on February 28, 2003.
He reminded Council the Marina was purchased in 2000 with the intent of using the
property for improvements to the Central Wastewater Treatment Plant (CVWVTP). Mr.
Danko has continued operations at the marina on behalf of the City while the City prepares
to implement the improvements. City Administrator Maxeiner noted in light of recent
discussions on how best to address wastewater treatment issues, it appears the City will
not be in a position to use the marina property for improvements at the CWWTP during the
coming boating season, precipitating extension of the lease for another year. He informed
Council rental for boat slips and boat storage on the property in 2002 resulted in a gross
amount totaling $100,740.58. Of the gross amount the City realized $50,370.29 from the
�- lease.
City Administrator Maxeiner stated the tenant is responsible for maintaining the

premises. It was noted Mr. Danko has met with Mayor Althoff and Staff regarding concerns -t
with the structural integrity of the decking on the current piers affecting the safety of
patrons. Mr. Danko has obtained a quote for the deck reconstruction project from Reinwall
Repairs in the amount of $37,600. Staff is requesting authorization from Council for
reconstruction of pier decking at Riviera Marina in an amount not to exceed $40,000. it
was opined the City requires that Mr. Danko maintain the facility in good working order and
a reconstruction project of this nature would be the obligation of the City.
City Administrator Maxeiner informed Council the contractor stated the optimal time
to make the improvements is while solid ice still covers the river and inlet. Staff is
requesting authorization from Council, as having the work done expeditiously would
require a budget amendment for the current year budget. It was noted revenues to fund
the amendment would come from fund reserves and future revenues.
Motion by Bolger, seconded by Murgatroyd, to approve renewal of the lease
between the City of McHenry and D's Marine Service, Inc., for operation of the Riviera
Marina from March 1, 2003 through and including February 29, 2004.

not—to-exceed $40,000 for the removal, construction and installation of new decking
pursuant to the quote received from Reinwall Repairs.

Marina Operations Fund for the 2002/2003 Fiscal Year Budget in the amount of$40,000.

ORDINANCES APPROVING CONCORD DEVELOPMENT
• ANNEXATION AGREEMENT

Mayor Althoff introduced Attorney Thomas Zanck of Militello, Zanck & Coen,
representing the Petitioner, Concord Homes. Attorney Zanck informed Council the

Petitioner requests Council approve an Annexation Agreement with Concord Homes for
the 89-acre Krumholz Farm located on the east side of Route 31, south of Albany Road.
Concord Homes proposes to develop the southern 35 acres with 244 townhome units,
zoned RM-2 and the northern 54 acres would be zoned C-5 Commercial and BP Business
Park and developed with retail and business park use. A major office tenant has
expressed interest, and potential for a banquet hall and a warehouse exists.
Director of Community Development Napolitano iterated to Council, based upon
discussion of the terms and conditions of the Annexation Agreement proposed at the
Council meeting on December 30, 2002, the following items have been modified:
• The sanitary sewer capacity will not be reserved.
• The number of residential units permitted per year will be 60 (or higher based on
the number of units in the last building issued a permit for that year. This will result
in an approximate 4-year build out.
• A hold harmless clause relating to the Pintozzi Recapture Agreement be inserted
into the agreement. The City would be held harmless from any liability the City may

• Includes language to clarify road improvements and contributions to be made by the

collector road through the property. Construction of this road would allow
ease of expansion when the property to the east is developed.

Alderman Glab expressed concerns regarding future traffic issues and drainage. A

studies have been conducted and it was noted the construction design of the road is being
made to simplify future expansion.

CONSTRUCTION OF THE ILLINOIS STATE BANK WITH A 4-LANE DRIVE-THRU
FACILITY AT THE SOUTHWEST CORNER OF ILLINOIS STATE ROUTE 120 AND
DRAPER ROAD
Mayor Althoff recognized Petitioner Brian Cunat of Cunat , Inc. and Attorney Mark
Saladin of Militello, Zanck& Coen.
Mr. Cunat addressed Council stating the applicant seeks approval for a Zoning Map
Amendment from 1-1 to C-2 and a Conditional Use Permit to allow the construction and
operation of a bank with a drive-thru facility on a 2.33-acre parcel of property located on
the southwest comer of Illinois State Route 120 and Draper Road. The bank and drive-
thru will consist of approximately 9,400 square feet. Mr. Cunat stated preliminary approval
has been received from the Illinois Department of Transportation for right-in right-out
egress from Illinois Route 120, noting there would be full access onto Draper Road.
Director of Community Development Napolitano informed Council the applicant has
sufficiently addressed concerns regarding safety and efficiency of traffic flow through the
site. He noted the site plan is in compliance with parking and landscaping requirements of
the Zoning Ordinance.
Director Napolitano informed Council at a Public Hearing held on December 19,
2002, the Planning and Zoning Commission unanimously recommended approval of the
following:

facility with drive-thru lanes with the conditions as recommended by Staff.
Mr. Neal Shepler, a resident of the Lakeland Park Subdivision, addressed Council.
Mr. Shepler commended the development. However; he expressed concern regarding the
size of the detention basin, fearing storm water would impact the Lakeland Park
Subdivision.
Responding to Alderman Glab's expressed concerns regarding drainage issues, Mr.
Cunat informed Council preliminary engineering has been conducted and the detention
basin is sized to comply with City Ordinance.
Responding to Alderman Murgatroyd's inquiry, Director Napolitano explained the
current plans meet, but do not exceed the City's requirements. A discussion ensued
concerning drainage issues.
Motion by Murgatroyd, seconded by Bolger, to direct Staff to prepare an ordinance
granting a Zoning Map Amendment from 1-1 to C-2 and a Conditional Use Permit for a
banking facility, with 4 drive-thru lanes, located at the southwest corner of Illinois State

RECOMMENDATION TO APPROVE AN AMENDMENT TO THE FISCAL YEAR
2002/2003 CITY OF MCHENRY BUDGET TO INCLUDE COMPUTER LICENSE
AGREEMENTS, IN AN AMOUNT NOT TO EXCEED $25,000
Assistant City Administrator Lockerby informed Council of the necessity for
information technology improvements. He stated forty-seven Microsoft Office 2000 and
thirty-three Windows 2000 licenses are needed for computers in all departments,
explaining the need for consistency, reliability and compliancy.
Assistant City Administrator Lockerby stated standardization would reduce variables
causing computers to malfunction with the newly established network and ultimately
increase reliability of the computers.
Staff requests Council approve a budget amendment to strengthen the software
management practices of the City and to facilitate compliance with copyright work
infringement laws concerning software violations. Assistant City Administrator Lockerby
stated the total expenditure would not exceed $25,000 and the funds will be realized from
the vacant Finance Director position. Thus there would be no overall increase in the
Budget.

MAYOR—STATEMENT AND REPORT
Mayor Althoff informed Council a matter regarding potential litigation would be
discussed in Executive Session.
Mayor Althoff informed Council two developers have expressed interest in the TIF
District. She stated both projects have potential and she would keep Council apprised.
Mayor Althoff stated eight Requests for Proposal were sent out regarding the
Riverwalk Project. The Proposals are due no later than February 20, 2003. To date, three
firms have responded expressing no interest in participation.
COMMITTEE REPORTS
Alderman Wimmer requested a Community Development Committee meeting be
scheduled on Wednesday, March 5, 2003 at 3:30 p.m. in the Aldermen's Conference
Room to discuss the Comprehensive Plan.
Alderman Murgatroyd reported a Finance and Personnel Committee meeting was
held prior to this evening's Council meeting.
DEPARTMENT HEAD REPORTS
Assistant City Administrator Lockerby informed Council the Recreation
FacilityNMCA Building Use Committee would be meeting on Wednesday, February 19,
2003 at 6:00 p.m. The City will be hosting leaders from neighboring communities in an
effort to gain feedback on recreational needs to be considered for the future facility.
Chief of Police O'Meara stated background checks are being completed on the
second and third individuals on the McHenry Police Officer Eligibility List. He informed
Council the responses should be received within the next ten days.
Director of Community Development Napolitano explained to Council he would be
initiating the process to annex the Levy property recently donated to the City, together with
the recently purchased Cunat property. Director Napolitano noted neither annexation
would require a Public Hearing but will be facilitated by Council approval of an Ordinance.
City Administrator Maxeiner stated Collective Bargaining Sessions were held today
and tentative agreements have been reached with the three collective bargaining units.
Staff is working to incorporate revisions into the contract language.
City Administrator Maxeiner noted Staff is working with the Department of Natural
Resources regarding a solution to the coyote problem being experienced in some
subdivisions within the City limits.

NEW BUSINESS
Alderman Glab expressed continuing concerns with drainage, suggesting a regional
detention plan be considered at a future Public Works Committee meeting. Alderman
Bolger, Chairman of the Public Works Committee, suggested a detention pond on the
property at Parkland School might be an option. Staff agreed to investigate the possibility
of a detention pond at Parkland School and provide the information at the Public Works
Committee meeting scheduled on Monday, March 3, 2003 at 6:30 p.m. in the Aldermen's
Conference Room.
Mayor Althoff noted further discussion regarding the proposed traffic light at
Winding Creek Drive and Crystal Lake Avenue would take place at the Public Works
Committee meeting on March 3, 2003.
Alderman Glab inquired about zoning issues concerning the Amoco station at the
corner of Crystal Lake Road and Bull Valley Road. Staff agreed to research the matter
and apprise Council in the Friday Report.
Mayor Althoff acknowledged and welcomed the presence in the audience of four
Boy Scouts from Troop 149.
