APRIL 14, 2003
The Regular Meeting of the McHenry City Council was called to order by Mayor
Althoff at 7:30 P.M. on Monday, April 14, 2003 in the Council Chambers of the Municipal
Center. At roll call the following Aldermen were present: Bolger, Glab, Low, Murgatroyd
and Wimmer. Absent: None. City Staff in attendance were: City Administrator Maxeiner,
Assistant Administrator Lockerby, City Clerk Jones, City Attorney Cahill, Director Public
Works Marcinko, City Planner Martin, Director of Parks and Recreation Merkel. Absent:
Chief of Police O'Meara, Director Community Development Napolitano and City Attorney
McArdle.
TEN MINUTE PUBLIC INPUT
Mr. Eric Verhoven, purchaser of a home in the Riverside Hollow Subdivision,
addressed Council expressing frustration regarding the delay in issuance of an occupancy
permit for his residence. Director of Public Works Marcinko responded Staff is working with
the developer regarding installation of the permanent sanitary sewer lift station backup
generator and completion is scheduled for the first week in May 2003.

Alderman Bolger announced supplies are still being purchased from out of town
vendors. He requested Department Heads stress that an effort be made to purchase from
local vendors whenever possible.
REQUEST FOR FENCE VARIANCE TO ALLOW A 6-FOOT FENCE ALONG THE
PROPERTY LINE AT 1823 REDWOOD LANE
Mr.. Robert T. Pales of 1823 Redwood Lane addressed Council requesting a
variance to allow installation of a 6' high wooden fence along his McCullom Lake Road
property line, approximately 14' from the curb.
Director of Community Development Napolitano informed Council Mr. Pales has a
double frontage lot, with frontage on McCullom Lake Road and Redwood Lane. Director
Napolitano stated access to the property is from Redwood Lane and the applicant is
seeking additional privacy from McCullom Lake Road. Staff indicated there are similar
fences in the subdivision and no impact is likely regarding the sight lines due to the
setback of the proposed fence.
Motion by Glab, seconded by Low, to approve a variance to allow a six foot high
wooden fence along the McCullom Lake Road property line at 1823 Redwood Lane.

REQUEST FOR CONNECTION TO SANITARY SEWER SYSTEM, 2409 LINCOLN ROAD
Debra Dawson, owner of the property located at 2409 Lincoln Road, addressed
Council requesting approval to connect to the City's sanitary sewer system. Ms. Dawson
stated she has conferred with Director Community Development Napolitano and is
agreeable to a Pre-Annexation Agreement committing to annexation to the City of McHenry
once the property becomes contiguous.
In Director Napolitano's absence Mayor Althoff informed Council the property is
located in unincorporated McHenry County and is not currently contiguous to the City
boundary. She stated connection is possible because sanitary sewer service has been
extended along Lincoln Road as part of the Liberty Trails Subdivision. Under normal
circumstances, the owner of property which is contiguous to the City limits of McHenry is
required to annex to the City within ninety days when requesting connection to municipal
services. Upon annexation the non-resident portion of the annexation fees are refunded to
the applicant. Mayor Althoff stated in this case the subject property might not be
contiguous for several years.

Alderman Murgatroyd suggested a provision be added to the Pre-Annexation
Agreement which states upon achieving contiguity, annexation would be required,
regardless of the current owner of the property.
Motion by Bolger, seconded by Wimmer, to approve the request for connection of
the property located at 2409 Lincoln Road to the City of McHenry sanitary sewer system,
subject to the following:
• Execution of a Pre-Annexation Agreement stating the property is to be annexed to
the City of McHenry within 90 days following the property becoming contiguous to
the City of McHenry, subject to including language stating once contiguity is
achieved, annexation would be required, regardless of the current owner of the
property; and
• Payment of the required connection and capital development fees for non-residents.

REQUEST FOR CLASS A LIQUOR LICENSE FROM PLUM GARDEN RESTAURANT ,
D/B/A PLUM GARDEN RESTAURANT, INC.. LOCATED AT 3917 W. MAIN STREET: '
AND ORDINANCE INCREASING THE NUMBER OF CLASS A LIQUOR LICENSES
FROM 25 TO 26; AND DECREASING THE NUMBER OF CLASS G LIQUOR LICENSES
FROM 5 TO 4
Perry Moy, owner and operator of Plum Garden Restaurant, was in attendance and
requested a change in his liquor license classification from Class G to Class A. This would
enable him to sell packaged liquors at retail. It is Mr. Moy's intent to begin hosting wine
dinners at the restaurant and he would like the opportunity to sell his exclusive packaged
Plum Wine.
Mayor Althoff noted Mr. Moy has been a business owner in McHenry for over 30
years and is active in the revitalization efforts in McHenry's Downtown. All required
paperwork has been submitted together with fingerprinting.
Motion by Bolger, seconded by Low, to approve the request from Plum Garden
Restaurant, Inc. d/b/a Plum Garden Restaurant, located at 3917 W. Main Street, for a
Class A Liquor License; and to approve an ordinance increasing the number of Class A
Liquor Licenses from 25 to 26 and decreasing the number of Class G Liquor Licenses from
5 to 4, effective May 1, 2003.

REQUEST FOR VARIANCE TO ALLOW A REDUCTION IN REQUIRED OFF STREET
PARKING FOR MCHENRY GROUNDS SHOPPING CENTER, LOCATED AT 1777 N.
RICHMOND ROAD
Todd Scott, Applicant and local franchisee of Papa Saverio's Pizzeria and Dan
Fortin, President of Papa Saverio's, were in attendance. Mr. Scott addressed Council
requesting approval of a variance to allow a reduction in the number of parking spaces
required to open a cant' out/delivery pizzeria on the subject property. He explained the
proposed Papa Saverio's Pizzeria would primarily be for deliveries, accounting for
approximately 75% of the business with carryout the remaining 25%. Mr. Scott informed
Council there is no seating proposed for the business and no consumption of food will take
place on the premises.
Staff informed Council the Applicant's unit would utilize approximately 1,680 square
feet for the proposed Papa Saverio's. According to the City's Zoning Ordinance, four
parking spaces per 1,000 square feet of net commercial space, 85% of the gross area, is
required for a shopping center. Restaurant use in a shopping center is calculated at 20
spaces per 1,000 square feet for a sit down or fast foot restaurant, or 16 spaces per 1,000
for carry out restaurant. -
At a Public hearing held on March 20, 2003, the Planning and Zoning Commission
unanimously recommended approval of the request for a variance to reduce the number of
required off-street parking spaces subject to the following conditions:
• There be no eat-in seating provided within the restaurant; and
• Delivery drivers be permitted to utilize the alley at the rear of the building so long as
there is no stacking of vehicles, and no complaints are received from adjacent
residents and business owners due to light pollution and noise.
Responding to Alderman Lows inquiry City Planner Martin stated parking spaces
are not designated for the delivery drivers. Alderman Low suggested striping designated
parking spaces for delivery drivers.
Motion by Bolger, seconded by Wimmer, to direct Staff to prepare an ordinance
granting a variance to allow a reduction in the number of required off-street parking spaces
required for Papa Saverio's located in the McHenry Grounds Shopping Center at 1777 N.
Richmond Road from 17 to 3, subject to the following:
• There be no eat-in seating provided within the restaurant; and
• Designated parking spaces be striped for delivery drivers.

REQUEST FOR VARIANCE TO EXTERIOR FACADE REQUIREMENTS FOR BOONE
CREEK UNIT 6 TOWNHOMES FROM GERSTAD BUILDERS, INC.
Robert Shannon, Vice President of Construction for Gerstad Builders, addressed
Council requesting a reduction in the amount of masonry required for townhomes, which

are to be constructed in Boone Creek Unit No. 6. The Applicant is proposing an exterior of
51% brick and 49% Hardiplank siding. Mr. Shannon explained Hardiplank is a cement and
wood fiber composite material, which is architecturally and aesthetically pleasing and more
durable than aluminum or vinyl siding. It is fire resistant, resists shrinking and swelling,
and holds paint three to four times longer than wood.
Staff informed Council Section 7-19 of the-Municipal Code requires 75% of the
exterior walls of buildings located in the RM-1 and RM-2 districts be faced with brick, brick
and masonry veneers, natural or cast stone veneers, or other masonry materials. The
Applicant is requesting a variance due to the offsets and cantilevers in the exterior design
of the buildings. Staff indicated no concern with Applicant's request for a variance as the
building would maintain an attractive appearance and the exterior 51% brick would meet
the RA-1 requirements consistent with other townhome developments in the City.
Motion by Bolger, seconded by Low, to approve the request for a variance to permit
51% brick exterior fagade to Gerstad Builders for Boone Creek Unit 6 Townhomes.

ORDINANCE AUTHORIZING THE EXECUTION OF AN ANNEXATION AGREEMENT
ZONING MAP AMENDMENT, VARIANCES AND PRELIMINARY PLAT OF SUBDIVISION
TO MERCY HEALTH CARE SYSTEM CORPORATION
Mayor Althoff announced following the Public Hearing held on March 31, 2003, Staff
was directed to draft Ordinances necessary to:
• Approve the Annexation Agreement with Mercy Health System Corporation;
• Annex the property located at 818 and 904 South Illinois Route 31, consisting of
approximately 10.943 acres;
• Approve ordinances rezoning the property, granting certain variances and
approving the preliminary plat prepared by Condon Consulting Engineers with a
revision date of 3/18/03.
Motion by Bolger, seconded by Murgatroyd, to pass and approve an ordinance
authorizing the Mayor and City Clerk's execution of an Annexation Agreement with Mercy
Health Care System Corporation and to pass an ordinance annexing approximately 10.943
acres located approximately one quarter mile south of Bull Valley Road on the east side of
Illinois Route 31 in McHenry County, Illinois and commonly known as 818 and 904 South
Route 31.

Motion by Low, seconded by Murgatroyd, to pass and approve an ordinance
Granting a Zoning Map Amendment to 02 Office Park Zoning District for the property
located at 818 and 904 South Route 31;
Granting the following variances:
o Lot width variance from 200 feet to 168 feet for Lot 7
o Lot size variance from 40,000 square feet to 38,000 square feet for Lot 7
o Lot width variance from 100 feet to 23 feet for Lot 3
o Use variance to allow the existing residence on Lot 2, provided that such use
shall expire on May 1, 2006, and within 120 days thereafter all existing
structures shall be demolished upon issuance of required City permits.
Granting approval of Professional Plaza Subdivision Preliminary Plat as prepared by
Vanderstappen Surveying Inc dated 11/13/02 with a revision date of 3/18/03.

RECOMMENDATION TO PURCHASE REPLACEMENT GENERAOR FOR THE
OPERATION OF 911 EMERGENCY SYSTEM FROM PATTEN POWER SYSTEMS AND
TO AUTHORIZE THE EXECUTION OF A CONTRACT WITH B&Z ELECTRICAL
CONTRACTORS, INC. TO INSTALL THE GENERATOR
Director of Public Works Marcinko informed Council the Municipal Center has a
generator in place capable of providing an emergency source of power to the building if
the regular supply is disrupted. The generator is designed to provide power to operate the
911 emergency dispatch center, the telecommunication system, and emergency lighting
throughout the building. Director Marcinko stated the generator currently in place, which
was installed during the original construction of the Municipal Center, recently failed.
Director Marcinko noted Staff has investigated repairing the existing generator,
however the repair estimates were in excess of $10,000. Staff opined it is more cost
effective to replace the generator rather than repair an aged piece of machinery with a
limited remaining useful life. Additionally, the existing generator is undersized when taking
into consideration the increased utilization of technology. Staff solicited quotes for a new
generator. Patten Power Systems provided the only quote including a transfer case in the
amount of$22,939
Additionally, Director Marcinko stated, due to the increase size of the proposed
generator, the wiring would need to be updated and replaced to the main power supply.
This works requires the services of an electrician. The estimate for electrical work is
$7,906 from B&Z Electrical Contractors.

MAYOR—STATEMENT AND REPORT
Mayor Althoff informed Council the interviews with the Finance Director candidates
were completed today and recommendations to Council would be forthcoming.
Mayor Althoff stated she met with property owner Tom Ryan on April 11, 2003. Mr.
Ryan owns approximately fourteen acres on the southeast corner of Lincoln Road and he
is considering annexation to the City of McHenry and construction of a senior assisted
living facility. Mayor Althoff noted the property is located inside Lakemoor's Facility
Planning Area and permission would have to be requested from NIPC. She informed
Council the property is not currently contiguous with the boundaries of the City of
McHenry. However, Mr. Ryan is currently in discussions with the Presbyterian Church to
achieve contiguity.
COMMITTEE REPORTS
Finance and Personnel Committee Chairman Alderman Murgatroyd informed
Council the General Fund is in balance and one additional Finance and Personnel
Committee meeting is scheduled on April 15, 2003 to complete discussions on the
remaining funds, together with an annual review of the TIF District Funds.
DEPARTMENT HEAD REPORTS
Director of Public Works Marcinko acknowledged Alderman Bolger's efforts in
obtaining easements for the Edgebrook Phase II Project.
Director of Parks and Recreation Merkel informed Council a Rally for the Troops
has been organized by a group of citizens and is scheduled to take place in Veteran's Park
on Wednesday, April 16, 2003 at 7:00 p.m. Director Merkel also reported the Illinois
Nature Preserves Commission Staff would conduct a controlled burn in the Wheeler Fen
on Tuesday, April 15, 2003.
City Administrator Maxeiner informed Council the Gypsy Moth Aerial Spray Program
is scheduled to begin in May at Petersen Park east to Orleans Street. He stated this area
was chosen as a result of the number of moths found in traps placed around the City by
the State of Illinois in July 2002. The spraying is to be performed in the early morning
hours, between 5:00 a.m. and 6:00 a.m. using a bacterial agent safe to humans, animals
and fowl. City Administrator Maxeiner noted the spraying is contingent upon weather
conditions.

Development regarding Inland's contribution to remediation of the Olde Mill Pond drainage
issue. Results of the conversation are pending and Council will be kept informed.
NEW BUSINESS
Alderman Glab informed Council the parking situation in the Whispering Oaks
Subdivision has again deteriorated near West Campus, extending to Wiltshire. Alderman
Glab requested Staff investigate restricting parking on Wiltshire.
Alderman Glab requested Staff research the possibility of the installation of a traffic
light at Ridgeview Drive and reducing the level of vehicular speed on Bull Valley Road.
Responding to Alderman Glab, Director of Public Works Marcinko advised the City has
received permission from the County to install a traffic light at Ridgeview Drive; however,
the cost of installation would be entirely borne by the City of McHenry. Regarding
reduction of the speed of vehicular traffic on Bull Valley Road, Director Marcinko explained
the City is awaiting documentation from McHenry County regarding the traffic study.

Property Acquisition
City Administrator Maxeiner stated as part of the preliminary process involved in the
McCullom Lake Road and Route 31 intersection improvements, City Engineer Smith
Engineering Consultants, Inc. has been working on property acquisition for the right-of-way
required for the project. As part of the required process an IDOT approved right-of way
appraiser and negotiator was employed as a sub-consultant.
To date, the City has reached agreement with six of the fourteen property owners from
which right-of-way acquisitions are required. The six agreements were reached when the
property owner agreed to the appraised price. City Administrator Maxeiner stated further
negotiation would be required with the remaining property owners in an effort to reach a
purchase price acceptable to both parties.
Staff is requesting Council:
• Authorize the purchase of the six parcels on which a purchase price has been agreed on
based upon the appraised amount; and
• Authorize the City Administrator to continue negotiations wit the remaining property
owners for the acquisition of right-of-way, with fmal purchase approval requiring City
Council approval.
It was the consensus of Council, following a brief discussion, to take action in Open
Session.
