APRIL 28, 2003
The Annual Meeting of the McHenry City Council was called to order by Mayor
Althoff at 7:30 P.M. on Monday, April 28, 2003 in the Council.Chambers of the Municipal
Center. At roll call the following Aldermen were present: Bolger, Glab, Low, Murgatroyd
and Wimmer. Absent: None. City Staff in attendance were: City Administrator Maxeiner,
Assistant Administrator Lockerby, City Clerk Jones, Director Public Works Marcinko,
Director of Parks and Recreation Merkel, Director Community Development Napolitano.
Absent: Chief of Police O'Meara and City Attorney McArdle.
Mayor Althoff acknowledged Bob Novak, a past member of the Landmark
Commission, owner of Petals and Stems and local artist, for his donation to the City of
McHenry of an oil painting of the Petersen Farm Homestead.
OATH OF OFFICE: CANINE OFFICER ESTA
Esta, the City of McHenry's first K-9 officer was sworn in by Police Commission
Chairman Dennis Adams. K-9 Officer Esta was accompanied by her trainer Officer Eric
Sexton. Following the ceremony, Officer Sexton informed those in attendance,that Esta
was two years old on February 3, 2003, and while training is ongoing she has passed a
120-hour training course. Officer Sexton provided a brief presentation of Esta's abilities.
Deputy Chief Brogan commended Officer Sexton for his efforts during the
fundraising process to obtain a K-9 officer and the many hours of personal time he has
devoted to training Esta.
TEN MINUTE PUBLIC INPUT
Mr. Jim Heffelfinger, a resident of 1805 N. Donovan, expressed concerns regarding
Inland Real Estate Development's request for rezoning of the property located on the
south side of Bull Valley Road from Business Park to Residential.

ANNUAL REPORTS BY TAXING DISTRICTS
MCHENRY PUBLIC LIBRARY DISTRICT
In attendance was Executive Director Arlene Kaspik of the McHenry Public Library
District (MPLD). Ms. Kaspik stated the Library District's mission is to enrich community
life. Ms. Kaspik stated library services continue to expand, citing the following:
• Making aggressive mortgage payments;
o With the re-finance of its mortgage the Library hopes to pay off the mortgage
in early 2006 without a balloon payment.
• Enhancing library services and collections;
o Sunday hours have been reinstated.
o Hours of service have been expanded.
• Providing public Internet access;
• Expanding computer services;
o Utilized by over 16,000 persons in 2002/2003
• Developing community partnerships;
• Reaching out to a diverse community;
• Responding to community requests; and
• Continuing to plan for the future.
Ms. Kaspik mentioned contributions by Friends of the Library, such as the lighted
sign in front of the building and a plasma video display screen. She noted this fall the
library will be initiating a new planning process and seeking input from the community.
MCHENRY TOWNSHIP FIRE PROTECTION DISTRICT
In attendance was McHenry Township Fire Protection District (MTFPD) Chief
Wayne Amore. Chief Amore thanked Mayor Althoff and Council for the opportunity to
present an oral report to the City. He noted a copy of the 2002 MTFPD Annual Report was

included in Council's Agenda Packet. He stated highlights of the Annual Report include:
• All three stations are fully staffed with 10 persons on duty, 24-hours per day,
7 days per week;
• Passing of the Ambulance Tax Referendum;
• 50 part time members who serve the public;
• Approximately 3,286 calls for aid were handled in 2002, a 2% increase from
2001.
Chief Amore stated the Insurance Service Offices (ISO) classification rating remains
at "4", explaining the ISO rating is tied to the household insurance premiums a resident
must pay. The lower the ISO rating, the lower the insurance premiums for household fire
protection insurance.
Chief Amore noted on June 15, 2002, the McHenry Firefighters' Association hosted
a "Party in the Park" at Petersen Park in McHenry and the District was able to raise
$25,000 for contribution to the Illinois Fire Safety Alliance Burn Camp "Camp I Am Me".
Additionally, Chief Amore noted a FEMA Grant was obtained to replace air packs for the
District.
Chief Amore stated with the passing of the Referendum in November 2002,
planning is underway for a fourth fire station. He noted construction would likely take
place in Fiscal Year 2005/2006.
--r In conclusion, Chief Amore stated services of the MTFPD continue to expand and
residents may learn more about the District on their Web Site located at www.mtfpd.orc.
Mayor Althoff made mention of the cooperative efforts between the various
departments and noted the updated Emergency Plan.
MCHENRY HIGH SCHOOL DISTRICT 156
In attendance was Superintendent Phil Hintz of McHenry High School District 156.
Mr. Hintz stated current enrollment is 2,270 students, up 24 students from last year.
Superintendent Hintz noted the addition of two new Board Members, Tom Wagner,
who will fill the vacancy created by Jim Finch's resignation, and recently elected member,
Dave Boger. He stated administrative changes include the retirement of long time
Assistant Superintendent Norb Wolter who would be replaced by Teresa Lane. East
Campus Principal Tom Carl will retire and be replaced by David Moyer, and a new Athletic
Director, Drew Pothoff, has been appointed following Dan Boland's retirement.
Superintendent Hintz stated a cross-section of twenty-eight individuals from the
community comprised the Steering Committee established to formulate a strategic plan,
which has not been undertaken since 1996.
Superintendent Hintz noted the budget outlook appears bleak and stated next year
expenditures would exceed revenue. Construction is scheduled for completion at East and
West High Schools by August 2003. The Open House and Dedication are scheduled for

Homecoming Week the last week in September 2003.

MCHENRY ELEMENTARY SCHOOL DISTRICT 15
Superintendent Dr. D. William Dodds of McHenry Elementary School District 15 was
in attendance. Dr. Dodds introduced Lauren Manusos, recently appointed to the School
Board, who will be representing District 15 at Council meetings. Additionally, Dr. Dodds
stated Dave Lawson was elected to the Board.
Dr. Dodds informed Council, effective July 1, 2003, Debbie Johnson would be
Principal of Riverwood School.
There are 4,700 children enrolled in District 15. Test scores have continued to stay
above state average. Dr. Dodds informed Council of activity highlights, which take place
at the various schools in District 15. Dr. Dodds expounded on the proposed budget and
the lack of funding for education. Dr. Dodd's stated it is likely rental fees and custodial
fees would be implemented in the coming school year for all groups using school facilities.
Responding to Alderman Bolger's inquiry regarding consolidation of the school
districts, Dr. Dodds stated if the Governor's proposed budget is approved, there would be
no incentive funding available for consolidation.
TAX INCREMENT FINANCING (TIF) DISTRICT
Assistant City Administrator Lockerby stated on April 15, 2002 the City Council
approved a Tax Increment Financing (TIF) District encompassing the area between John
Street on the south and the Fox River on the east, Third Street on the west and Pearl and
Broad Street on the north. The intent of the TIF District is to revitalize the downtown area
with a focus on generating funds for the proposed Riverwalk project.
Mr. Lockerby stated the equalized assessed value of the TIF District, when initially
created was $14,653.480. He noted the first year of the TIF District has generated
$38,000 in increment through property taxes. The first year of the two year$500,000 grant
obtained through Illinois State Senator Dick Klemm was completed in December 2002.
The grant required a $500,000 match from the City of McHenry. Additionally, a federal
grant in the amount of $200,000 was received from United States Senator Dick Durbin
through the Department of Housing and Urban Development's Neighborhood Initiative
Program. In total the TIF District revenues received to date are $1,238,000.
Mr. Lockerby informed Council the past year has included much due diligence and
the approval of the first development within the TIF District.
Mayor Althoff noted each of the Taxing Districts would receive a copy of the City of
McHenry Tax Increment Financing (TIF) District Annual Report.

City Administrator Maxeiner presented to Council a summary of the proposed
2003/2004 Fiscal Year Budget, stating a copy of the detail pages would be provided upon
completion of the budget process.
City Administrator Maxeiner stated the proposed 2003/2004 Fiscal Year Budget
Expenditures total $46,802,784 for all funds. Following elimination of inter-fund transfer
for such things as health insurance, retirement contributions, debt service and transfers of
reserves to capital project funds, the net budget totals $37,154,824.
City Administrator Maxeiner noted Sales Tax Revenue, which accounts for 49.4% of
the General Fund's current revenues, is budgeted at $6,500,000, an increase of$300,000,
4.8% over the 2002-2003 budget.
City Administrator Maxeiner summarized the Fiscal Year 2003/2004 Budget, as
proposed, continues to reflect an increase in the retail activity taking place in the City
through development, and provides for the maintenance of existing service.,levels and
programs while moving forward with an aggressive capital improvements program. The
budget, as proposed, achieves the City's goal of maintaining adequate reserves in the
General Fund for unforeseen events, changes in economic conditions, and daily cash flow
requirements, despite undertaking an aggressive infrastructure improvement program with
the issuance of minimal debt.
City Administrator Maxeiner noted some of the highlights of the 2003/2004 General
Fund expenditure budget include:
• Maintenance of current service levels without the implementation of new taxes or a
tax increase;
• Implementation of an Informational Technology Fund to begin network and
computer system enhancements to better meet the data processing and information
management challenges ahead;
• A transfer of$507,100 in General Fund Reserves for capital improvement projects;
• Continuing the vehicle replacement program with the scheduled replacement of
three marked and one unmarked squad in the Police Department, one inspector's
vehicle in the Community Development Department, a 4x4 pickup and one large
dump truck in the Public Works Department/Street Division, and a large truck in the
Public Works Wastewater Division;
• Addition of administrative support in the Police Department (Records Clerk and
Dispatcher) as well as an evening Community Service Officer;
• Increase of hours for a part-time position in the Community Development
Department to better assist customers at the counter;
• General salary adjustments of 1.6%for non-contract positions; and
• Commitments to capital projects consistent with the Five-Year Capital Improvements
Program (CIP).
City Administrator Maxeiner expressed appreciation to the Department Heads, Staff,
and Finance and Personnel Committee Chairman Alderman Murgatroyd for the many
hours committed to the creation and balancing of the 2003-2004 Fiscal Year Budget.

Mayor Althoff informed Council, as per the City of McHenry's Municipal Code
Chapter 4, liquor establishments located within the corporate boundaries of the City of
McHenry must renew their licenses annually by the end of the fiscal year, April 30th. The

Mayor Althoff stated all new managers were fingerprinted and all license renewals
are subject to the receipt of satisfactory fingerprinting results. In conjunction with the
annual liquor license renewals, Mayor Althoff noted additional requests will be forthcoming
from No Way Jose, to reinstate their liquor license; Horsin' Around, for a license to sell
Beer and Wine, and Aldi's Grocery, for the sale of package goods.
Additionally, Mayor Althoff noted with the closing of Eagle Food Store on Elm Street
in May, approval of an ordinance reducing the number of Class F-2 liquor licenses from
ten to nine is requested; the closing of the Clark Gas Station at 3111 W. Route 120
precipitates a reduction in Class B liquor licenses from three to two.

AUTHORIZATION TO ENTER INTO AN ENGINEERING SERVICES AGREEMENT WITH
BAXTER AND WOODMAN FOR THE DEVELOPMENT OF THE CENTRAL
WASTEWATER TREATMENT PLANT LONG-RANGE PLAN
Director of Public Works Marcinko informed Council of a typographical error on the
agenda supplement, stating the correct amount of the agreement with Baxter and
Woodman for the development of the Central Wastewater Treatment Plant Long Range
Plan is $36,000.
Director Marcinko explained Baxter and Woodman has submitted a plan to
investigate the costs involved in the abandonment and/or upgrading the existing Central
Wastewater Treatment Plant as well as the feasibility of conveying waste flowage to an
expanded South Wastewater Treatment Plant. Director Marcinko briefly outlined the
scope of services in the proposal.
Alderman Murgatroyd opined the performance of this study is important in order to
facilitate an intelligent decision as the City moves forward with issues concerning the
wastewater treatment plants. Alderman Murgatroyd requested copies be provided to the
current Council and the new Alderman of the Statement of Qualifications ("SOQ"),
submitted by both Baxter and Woodman and Smith Engineering Consultants, relative to
the Study. Director Marcinko assured Alderman Murgatroyd the SOQ's would be provided
in the Friday Report.
Motion by Bolger, seconded by Wimmer, to authorize the Mayor's execution of an
Engineering Services Agreement from Baxter and Woodman for the City of McHenry's
Wastewater Treatment Plant Options Study, in an amount not-to-exceed $36,000.

Mayor Althoff stated she and Alderman Low met and reviewed the following annual

Mayor Althoff informed Council she received notice today from the Northeastern
Illinois Planning Commission that the Village of Lakemoor has requested a Facility Plan
Area modification to construct a new treatment facility within their FPA.
Mayor Althoff stated City Attorney McArdle will be unavailable to attend the
Committee of the Whole Meeting scheduled to take place on April 29, 2003" However,
Kelly Cahill, an associate of the Zukowski, Rogers, Flood and McArdle, will be in
attendance.
Mayor Althoff stated she has been called to Springfield and would be unavailable to
attend the Committee of the Whole Meeting on Tuesday, April 29, 2003. She anticipates
attending all Regular Council Meetings scheduled in May 2003.

DEPARTMENT HEAD REPORTS
Director of Public Works Marcinko informed Council of Baxter and Woodman's
approval of the Riverside Hollow lift station. Director Marcinko stated he and Director of
Community Development Napolitano are working to expedite issuance of occupancy
permits for residents of the subdivision.
Director of Parks and Recreation Merkel reported briefly on the extensive
renovations taking place in Petersen Park.
Director of Community Development Napolitano stated the two topics covered by
the Committee of the Whole Meeting scheduled for April 29, 2003 at 7:00 p.m. would be
the apartment complex proposed by developer David Kotiw and the proposed residential
map amendment for Inland Business Park.
Director Napolitano informed Council the first inspection of the Meyer Material
Gravel Pit would take place on April 29, 2003.
-�„ City Administrator Maxeiner reported a resident on Ponca Street in unincorporated
McHenry County is experiencing a water shortage due to a community well drying out.
The possibility of annexation exists and Staff is researching a method to address this

matter. He stated the topic would be included on May 5, 2003 Agenda.
NEW BUSINESS
Alderman Glab opined a committee should be formed to explore a Comprehensive
Traffic Study.
