JULY 7, 2003
The Regular Meeting of the McHenry City Council was called to order by City Clerk
Jones at 7:30 P.M. on Monday, July 7, 2003 in the Council Chambers of the Municipal
Center. At roll call the following Aldermen were present:-Bolger, Glab, Low, Murgatroyd,
Wimmer, Peterson, Condon. Absent: Mayor Althoff. City Staff in attendance were: City
Administrator Maxeiner, Assistant Administrator Lockerby, City Clerk Jones, City Attorney
McArdle, Director of Public Works Marcinko, Director of Parks and Recreation Merkel,
Chief of Police O'Meara, Director of Community Development Napolitano, Director of
Finance Kline. Absent: None.
City Administrator Maxeiner read a letter of resignation from Mayor Althoff, which
became effective July 7, 2003 at 7:00 p.m.
City- Clerk Jones requested a motion from the floor to nominate and elect an Acting
Mayor to fill the unexpired term of Mayor Althoff.
Motion by Bolger, seconded by Glab, to nominate Alderman Low as Acting Mayor to
fill the unexpired term of Mayor Althoff with said term expiring April 30, 2005.
Voting Aye: Bolger, Glab, Murgatroyd, Wimmer, Peterson, Condon.
Voting Nay: None.
Abstaining: Low
Absent: None.

Motion by Glab, seconded by Bolger, to close the nominations and elect Alderman
Low as the Acting Mayor to fill the unexpired term of Mayor Althoff with said term expiring
April 30, 2005.

OATH OF OFFICE: MAYOR LOW
City Clerk Jones swore in Mayor Low to the office of Acting Mayor to fill the
unexpired term of Mayor Althoff.
Mayor Low expressed appreciation to the Council for the nomination of Mayor.
Expressing her affection for the City of McHenry, she stated she is very proud to be in the
position and would do her best while holding the office of Mayor of the City of McHenry.

Mr. Robert Kirschner of 4516 Lakewood expressed concern regarding parking on

AUTHORIZATION FOR ADDITIONAL SURVEY WORK FOR RIVERWALK AND
DOWNTOWN AREA—GENTILE &ASSOCIATES
Responding to Alderman Glab's inquiry, Assistant Administrator Lockerby explained
additional survey work is needed to prepare the McHenry Riverwalk project and pedestrian
walkway locations in the downtown area. The work is required to identify the necessary
easements for construction, maintenance and grading; and also to acquire information on
each parcel along the path of the Riverwalk for title policies, legal descriptions and
surveys.
Motion by Glab, seconded by Murgatroyd, to authorize Gentile & Associates, Inc. to
perform additional survey work for the Riverwalk and Downtown area, in an amount not-to-
exceed $18,280.

2003/2004 URBAN FORESTRY DEMONSTRATION PROJECT
Responding to Alderman Glab's inquiry, Director of Parks and Recreation Merkel
informed Council the Urban Forestry Demonstration Project is a pilot program
demonstrating what a comprehensive community forestry program would accomplish in
selected areas of the City. Director Merkel stated the program would include tree removal,
tree planting and pruning. The funding for the program is derived from the $84,600

received from the Meyer Material annexation for tree replacement and forestry initiatives.
Motion by Bolger, seconded by Condon, to approve implementation of the Urban
Forestry Demonstration Project for Fiscal Year 2003/2004, in an amount not to exceed
$25,000.

REQUEST FOR TEMPORARY USE OF PETERSEN PARK- HOPE RIDE FUNDRAISER
Director of Parks and Recreation Merkel stated correspondence has been received
from Canticle Ministries requesting the use of Petersen Park as on overnight campsite for
the Hope Ride Fundraiser on Saturday, July 19, 2003. He explained the 4-day bike ride
has been organized to replace the Heartland Aids Ride. The all-volunteer event is a
smaller version of the Aids Ride and only 100 participants are expected.
Director Merkel noted the Faith Night Fiesta Day program would be held on the
same evening in the beach area of the park, while the overnight event would be located in
the picnic area.
Director Merkel stated Canticle Ministries is requesting all rental and permit fees be
waived for the volunteer fundraising event.
Responding to Alderman Condon's inquiry regarding the use of Petersen Park as
opposed to Knox Park, Director Merkel noted Petersen Park has adequate space for
utilization by large groups of people and the bike riders would be coming into the park from
the bike path.
Responding to Alderman Wimmer's inquiry, Chief of Police O'Meara noted no
concerns regarding this event.
Motion by Murgatroyd, seconded by Peterson, to approve the request for a Special
Use Permit for the Hope Ride in Petersen Park on Saturday, July 19, 2003 and the waiver
of all rental and permit fees for the event.

REQUEST FOR VARIANCE TO ALLOW SWIMMING POOL IN FRONT YARD -4720 ,
JOYCE LANE
Director. of Community Development Napolitano informed Council that applicants
Mario and Maliea Penuela of 4720 Joyce Lane are requesting a variance to allow the
installation of an above-ground swimming pool in their front yard adjacent to Dartmoor

Drive. Director Napolitano explained the applicants have a double frontage lot with
frontage on both Joyce Lane and Dartmoor Drive. The yard adjacent to Dartmoor Drive is
�— the back of their lot, however according to the Zoning Ordinance, it would be considered a
front yard. He noted swimming pools are not permitted in the front yard.
Director Napolitano stated the applicants are proposing a swimming pool, which
would be 24 feet in diameter, located off the northwest corner of the home, approximately
27 feet from the Dartmoor Drive property line. Staff has no concerns with the request.
Director Napolitano further noted the Planning and Zoning Commission, at a Public
Hearing held on June 19, 2003, unanimously recommended approval of applicant's
request.
Motion by Glab, seconded by Wimmer, to accept the unanimous recommendation of
the Planning and Zoning Commission, and to pass an ordinance granting a variance to
allow construction of an above-ground swimming pool in the Dartmoor Drive front yard
located at 4720 Joyce Lane.

REQUEST FOR A CONDITIONAL USE PERMIT TO ALLOW THE SALE OF
ALCOHOLIC BEVERAGES AND LIVE ENTERTAINMENT—3421 WEST ELM STREET
Director Napolitano informed Council applicant Sheila Eiler, owner and operator of
Horsin' Around Karaoke Kafe & Store, located at 3421 West Elm Street, has requested a
Conditional Use Permit to allow the sale of alcoholic beverages in conjunction with the
operation of a restaurant providing live entertainment.
Director Napolitano noted restaurant and retail establishments are permitted uses in
the C-4 zoning district. The proposed use requires a Conditional Use Permit because it
includes the sale of alcoholic beverage associated with a restaurant having live
entertainment. The applicant is applying for a Class H liquor license, which permits the
sale of beer and wine only. He noted the alcohol must be consumed at tables. No bar
sales are permitted.
Staff indicated no concerns with the request. Director Napolitano noted the subject
property is located within the City's downtown area. The applicant has been in business
for several months and desires to enhance business by offering this service. He noted the
Planning and Zoning Commission, at a Public Hearing held on June 19, 2003,
unanimously recommended approval of a Conditional Use Permit to allow the consumption
of. alcoholic beverages in conjunction with the operation of a restaurant with live
entertainment.
Motion by Bolger, seconded by Wimmer, to accept the unanimous recommendation
of the Planning and Zoning Commission, and to direct Staff to prepare an ordinance
granting a Conditional Use Permit for a restaurant serving alcoholic beverages with live
entertainment at 3421 W. Elm Street.

REQUEST FOR CONDITIONAL USE PERMIT TO ALLOW THE OUTDOOR DISPLAY,
ASSEMBLY, AND STORAGE OF BOATLIFTS AND PIERS—2914 WEST ELM STREET
Director Napolitano stated applicant Rodney Schuh is requesting a Conditional Use
Permit for the outdoor display, storage and assembly of boatlifts and piers. Applicant
currently is in the business of installing and repairing boatlifts and piers on the Chain of
Lakes. To supplement that business the applicant decided to sell boatlifts and piers at the
property located at 2914 W. Route 120. Director Napolitano noted this property was
annexed as part of the east of the river annexation in 1995.
Director Napolitano informed Council the applicant has agreed to limit the outside
display to two jet ski lifts, one boatlift and one pier. All display items would be located 10
feet or more from the back of the curb on Route 120. He noted this is the approximate
distance from the property line to the state right-of-way. Director Napolitano stated the
applicant has agreed to store all other parts and materials for the boatlifts and piers behind
the existing building in the fenced-in area. The applicant assured Staff he would remove
all other items not directly related to his business and store them offsite or inside the --
building. Additionally, the applicant has agreed to install a section of fencing from the west
side of the building to the existing fence to prohibit access to the side and rear of the
building.
Director Napolitano stated Staff recommends, and applicant and the property owner
have agreed, to a one-year time frame for the Conditional Use Permit. If all the conditions
are met the Conditional Use Permit could be renewed for the life of the business. Should
there be future problems Council could decide not to grant/renew the Conditional Use
Permit.
Alderman Glab stated he prefers a three-year time frame versus a one-year time for
the Conditional Use Permit in order to ascertain how the area is developing.
Alderman Murgatroyd opined he is in favor of the one-year time frame but does not
support a permanent conditional use after one year even if all conditions are met.
Attorney Steven Cuda, representing applicant Rodney Schuh, stated the applicant
is agreeable to placing three planters in front of the existing building at 2914 W. Route 120
in an effort to make the property more aesthetically pleasing. It was noted that due to the
location and layout of the site landscaping is limited.
Director Napolitano stated the Planning and Zoning Commission recommended, by
a vote of 3 to 2, at Public Hearings held on November 7, 2002, March 20, 2003, May 1,
2003, and June 19, 2003, that the Conditional Use request be granted, subject to the
following conditions:

1. Only the following items shall be displayed at any one time in front of 2914 West
Route 120, all of which shall be aligned and not closer than 10 feet to the back of
the curb of State Route 120: _ -
a. Two jet ski lifts
b. One boat lift
c. One pier
d. One display board
2. Upon approval from Council the following improvements shall be made to 2912-
2914 West Route 120:
a. Fencing shall be extended on the west side of the building to close off the
existing gap;
b. A minimum 6' high fence shall be extended along the rear portion of the
building at 2912 West Route 120. It shall extend from rear property line to
the rear end of the building on the east side;
c. All dilapidated fencing at 2912-2914 W. Route 120 shall be repaired;
d. Parking spaces shall be striped in accordance with the approved site plan;
e. The rear of the building at 2914 W. Route 120 shall be re-sided;
f. A minimum of three planters shall be placed in front of the building at 2914
W. Route 120;
g. All wood behind the existing residence on the premises shall be stacked in a
neat and orderly fashion or removed from the site;
h. The jet ski and rubber tube shall be removed from behind the building at
2914 W. Route 120.
3. There shall be no storage other than materials used to construct boatlifts, jet ski lifts
or piers stored outside at 2914 W. Route 120.
4. All outside storage at 2914 W. Route 120 shall be kept within the confines of the
fenced area behind said building. Said storage shall not exceed the height of the
building directly to the south.
5. All assembly/construction of lifts and/or piers shall take place behind 2912 West
Route 120. There shall be no outside storage of any barrels, wood or
miscellaneous materials.
6. There shall be a clear access maintained at all times to the existing resident's
driveway in the rear of the property at 2914 West Route 120. Sufficient turnaround
space shall be maintained for emergency vehicles.
7. All building code violations shall be addressed and a Certificate of Occupancy shall
be issued within 30-days of ordinance approval.
8. The conditional use permit shall expire one year from the date of ordinance
passage. After one year, if City Staff determines there has been no significant
violation of said conditional use permit, said conditional use permit shall be
renewed indefinitely. If significant violation(s) of the conditional use permit
has/have been found, Applicant shall appear. before City Council for renewal. No
additional public notice shall be required.

REQUEST FOR VARIANCE TO ALLOW A REDUCTION FROM REQUIRED 5-FOOT
PARKING LOT SCREENING STRIP — MCHENRY GROUNDS SHOPPING CENTER
1711-1787 NORTH RICHMOND ROAD
Director Napolitano stated the applicants, the City of McHenry and property owner
Gus 'Demas Building Corporation, are requesting approval of a variance to allow a
reduction in the required parking lot screening strip from 5 feet to 3.5 feet at the McHenry
Grounds Shopping Center. Because of the proposed intersection improvements at the
Route 31/McCullom Lake Road intersection, the applicants have agreed to donate
additional land along the Route 31 frontage. The donation of the land reduces the width of
the parking screening strip to 3.5 feet placing the parking lot in a non-conforming status.
Director Napolitano stated the owner of the subject property, Gus Demas Building
Corporation,, agreed to the dedication when the parking variance for Panera Bread was
approved in 2001, by Ordinance Number Ord-01-1055. The owner is now selling the
McHenry Grounds Shopping Center and the potential purchaser is requesting assurance
that the parking lot could be rebuilt to the exact condition if damaged or destroyed. Staff
suggests a variance is the only way to provide such assurance.
Director Napolitano noted Staff has no concerns with the variance. The hardship
placed upon the property was not self-induced, but caused by the dedication of land for the
road improvements. The dedication furthers the public interest by enhancing the safety
and operation of the intersection upon completion of the road improvements.

foot reduction from the required 5-foot parking lot screening strip for the property located
at 1711-1787 N. Richmond Road, commonly known as the McHenry Grounds Shopping
Center.

RENEWAL 2003/2004 - MCHENRY COUNTY MUNICIPAL RISK MANAGEMENT
AGENCY MEMBERSHIP
Assistant Administrator Lockerby informed Council the City of McHenry has been a
member of the McHenry County Municipal Risk Management Agency (MCMRMA)
insurance pool since its inception in 1988. MCMRMA consists of eight public entities and
provides risk-financing mechanisms for funding of worker compensation claims, property
loss, general liability and public officials insurance, in addition to providing loss prevention
and claims administrator services.
Assistant Administrator Lockerby stated following September 11, 2001 insurance
rates have been dramatically increasing as the insurance market attempts to recover from
the catastrophic losses incurred. The City of McHenry's portion of the 2003/2004 renewal
is increasing a modest $10,104, or 1.9% from last year. This is due, in part, to the
conservative management philosophy of the pool and improved efforts by the members in

the area of loss control
Staff is recommending the payment of $557,251- to the McHenry County Risk
Management Agency for the 2003/2004 Insurance Renewal Year, to be divided into two
payments of$278,626, due July 1, 2003 and October 1, 2003.

McHenry County Risk Management Agency in the amount of $557,251, for the year
2003/2004, to be divided into two payments of$278,626, due July 1, 2003 and October 1,
2003.

DISCUSSION: HUNTERSVILLE SUBDIVISION ANNEXATION AND EXTENSION OF
MUNICIPAL WATER/SEWER UTILITIES
City Administrator Maxeiner addressed Council stating the residents of the
Huntersville Subdivision have approached the City of McHenry on a number of occasions
regarding connecting to the City's water and sewer utilities. Apparently, septic and well .�
systems are failing in the subdivision, creating a negative environmental impact upon the
river, generating expensive maintenance bills for owners, and inconveniencing residents in
the neighborhood.
City Administrator Maxeiner noted previously the cost of extending the sewer main
to the subdivision was prohibitively expensive due to the distances involved. However,
with construction of the Liberty Trails infrastructure, the sewer main is available on Lincoln
Road and the cost is more manageable.
City Administrator Maxeiner informed Council on June 26, 2003 Staff met with the
president and vice-president of the homeowners association. At the meeting updated
estimates for infrastructure improvements were discussed. City Engineers Baxter &
Woodman produced estimates of construction and engineering as follows:
Water $575,000
Sewer $731,000.
Additionally, capital development fees were identified, the Recapture Agreement for
Liberty Trails discussed, and the homeowner's responsibility for the service lines revealed.
City Administrator Maxeiner observed if a Special Service Area is established for
the project the cost of the infrastructure improvements would require approximately
$100,000 annually for 20 years at 4% interest for debt service with capital development
fees adding approximately $25,000 annually. It was noted using these figures without any
public benefit contribution from the City of McHenry, the average annual cost to a
homeowner would approach $2,000. Should the City of McHenry commit a 20% public
benefit to the project for infrastructure costs, the annual cost to a single homeowner would

decline to approximately $1,650.
City Administrator Maxeiner informed Council_ the representatives of the
homeowners association indicated more than half of the owners of the 64 structures would
desire both sewer and water. It was suggested that other unincorporated property in the
vicinity be contacted to ascertain if there was an interest in participating in the project.
City Administrator Maxeiner stated Staff is requesting direction from Council
regarding the project and identification of a public benefit level, should the project be
determined as advantageous to the City of McHenry. He noted in the past a public benefit
level of 20% has been used. Should Council authorize Staff to proceed, a meeting with
the entire subdivision would be scheduled and legal documents prepared to initiate
annexation proceedings for the Huntersville Subdivision.
Alderman Glab opined he is pleased the Huntersville Subdivision is enthusiastic
regarding annexing to the City of McHenry, but is unable to support a public benefit that
diminishes the City's coffers. Alderman Glab suggested Subdivision representatives
contact the Fox Waterway Agency regarding participation in the public benefit.
Alderman Murgatroyd stated he encourages moving forward with the project,
opining support for a 20% public benefit should all the homeowners participate. Alderman
Murgatroyd requested drainage issues and road reconstruction be incorporated into the
language of the Special Service Area. Alderman Bolger concurred with Alderman
Murgatroyd, but suggested a public benefit of 15%.
Alderman Glab reiterated he would support no public benefit. Alderman Peterson
indicated he would support no more than 10% public benefit. Alderman Wimmer
concurred with Alderman Peterson. Mayor Low stated she supports a 15% public benefit.
Alderman Condon concurred with Mayor Low.
City Administrator Maxeiner noted he would like to provide the homeowner's
association with an amount regarding the public benefit.
It was the consensus of Council to authorize Staff to begin preparation of the legal
documents required for annexation of the Huntersville Subdivision and to begin
discussions defining the public benefit for water and sewer improvements at 10%.

Director of Parks and Recreation Merkel stated construction of the Skate Park fence
has been completed and supervisory personnel has been hired to oversee activities at the
Skate Park.
Director of Parks and Recreation Merkel noted the fireworks display in Petersen
Park was well attended. He stated parking was organized due to Police Department
assistance. Director Merkel thanked the other departments for their participation.
City Clerk Jones congratulated Mayor Low on her selection as Mayor and invited all
parties in attendance to join Mayor Low for cake and coffee in the Police Department
classroom following the Council meeting.
City, Administrator Maxeiner welcomed Kelly Kline, the City of McHenry's first
Finance Director.
NEW BUSINESS
Motion by Glab, seconded by Peterson, to rescind the Resolution passed on
December 16, 2002, relating to the authority of the Mayor to represent the City of McHenry
in meetings and negotiations. except under the following conditions:
• A majority of the City Council shall authorize the meeting or negotiation;
• The City Administrator and any other staff requested by the City Administrator or the J
majority of the City Council shall be present;
• A member of the City Council shall also be present if it is deemed appropriate by a
majority of the City Council;
• The City Council shall in, a timely fashion, be kept apprised of matters discussed at
these meetings.
Voting Aye: Bolger, Glab, Murgatroyd, Wimmer, Peterson, Condon.
Voting Nay: None.
Abstain: Low.
Absent: None.
