REGULAR MEETING
JULY 21, 2003
The Regular Meeting of the McHenry City Council was called to order by Mayor Low
at 7:30 P.M. on Monday, July 21, 2003 in the Council Chambers of the Municipal Center.
At roll call the following Aldermen were present: Bolger, Glab, Low, Murgatroyd, Wimmer,
Peterson, Condon. Absent: None. City Staff in attendance were: Assistant Administrator
Lockerby, City Clerk Jones, City Attorney McArdle, Director of Public Works Marcinko,
Director of Parks and Recreation Merkel, Chief of Police O'Meara, Director of Community
Development Napolitano, Director of Finance Kline. Absent: City Administrator Maxeiner.
PUBLIC HEARING: 2003-2004 APPROPRIATION ORDINANCE
Mayor Low opened a Public Hearing to consider the 2003/2004 Appropriation
Ordinance at 7:31 p.m.
Director of Finance Kline summarized the state statute relating to municipalities with
less than 500,000 inhabitants.
Director Kline stated the proposed appropriation totals $55,842,968. The
Ordinance provides the legal authority to allocate funds to specific spending activities and
establishes the City's legal spending limit for expenditures.
In response to Mayor Low's inquiry there were no comments from the audience. In
response to further inquiry City Clerk Jones stated no written or verbal comments had
been received.
Motion by Bolger, seconded by Murgatroyd, to close the Public Hearing regarding
consideration of the 2003/2004 Appropriation Ordinance at 7:34 p.m.
Voting Aye: Bolger, Low, Murgatroyd, Wimmer, Peterson, Condon.
Voting Nay: Glab.
Absent: None.
Motion carried.
Motion by Murgatroyd, seconded by Wimmer, to approve the 2003-2004
Appropriation Ordinance in the amount of$55,842,968.
Voting Aye: Bolger, Low, Murgatroyd, Wimmer, Peterson, Condon.
Voting Nay: Glab.
Absent: None.

PUBLIC HEARING: FOXCROFT RIDGE ANNEXATION, REZONING, CONDITIONAL
USE PERMIT, VARIANCES AND PRELIMINARY PLAT APPROVAL — KRUMHOLTZ
PROPERTY
Mayor Low opened a Public Hearing to consider Foxcroft Ridge annexation,
rezoning, conditional use permit, variances and preliminary plat approval regarding the
~' Krumholtz property at 7:35 p.m.

and applicant, Virginia Gully of Professional Realty and Development Corporation. Mr.
Saladin provided an overview of the Applicant's request. He noted the request pertains to
a 10.11-acre parcel currently zoned Agricultural within McHenry County. He stated 7.6
acres would be zoned RM-2 and utilized for a senior housing building; the remaining three
lots would be developed with auxiliary uses, which would provide needed services to not
only seniors but other residents in the vicinity. It is anticipated the remaining lots would be
zoned 0-1 or 0-2. He informed Council the Applicant is petitioning for annexation and
rezoning to RM-2, High-Density Multi-Family Residential, 0-1, Local Office and 0-2, Office
Park District. He noted the RM-2 portion of the property is located south of the Koehn
Farm and consists of 7.6 acres, while the 0-1 and 0-2 portions of the property are
comprised of approximately 2.5 acres and are located immediately south of the RM-2
parcel and have frontage on Bull Valley Road. The Applicant proposes the construction of
a 201-unit assisted and independent living senior housing facility on the RM-2 portion of
the property and is requesting approval of a concept plan for this portion of the
development.
Mr. Saladin stated the Applicant is also seeking a Conditional Use Permit for a
congregate living facility, variances from the Zoning Ordinance and preliminary subdivision
plat approval for the RM-2 parcel. The variances sought by applicant are:
• Variance from the RM-2 requirements to allow the proposed building on Parcel 1 to
be no more than fifty feet in height;
• Variance from the RM-2 lot area/dwelling unit requirements to allow no more than
230 residents on Parcel 1;
• Variance from the residential parking requirement to allow 126 parking spaces on
Parcel 1;
• Variance from the frontage requirements to allow frontage on a private road for
Parcel 1; and
• Variance from the 0-1 district lot width requirement to allow a 139-foot lot width for
Parcel 2.
Mr. Saladin stated the Applicant is requesting a Conditional Use Permit for a
congregate care/senior living facility, which is not directly addressed in the City's zoning
ordinance.
Mr. Saladin noted the proposed development would be beneficial to the community
fulfilling a proven need. He opined the use fits into the existing neighborhood with good
proximity to Centegra.
Mr. Saladin introduced Virginia Gully, an officer with Professional Realty and
Development Corporation (PRDC), developer of Foxcroft Ridge. Ms. Gully stated PRDC
has developed multiple senior housing facilities of this nature in Illinois and Wisconsin.
She stated the facilities are owned by the Applicant and managed by a professional care .—
management company.

Ms. Gully provided Council with a summary of some of the amenities which would
be provided to residents of the facility. She noted the building amenities would include:
• An elevator;

• Beauty shop/barber shop
• Heated underground parking;
• Storage spaces;
• A large parlor and dining room;
• Activity and craft rooms;
• TV rooms; and
• Laundry facilities on each floor.
Director of Community Development Napolitano summarized the comments from the
Committee of the Whole Meeting held on December 9, 2002 as follows:
• Proposal was for one 110,000 square foot building on a 4-acre parcel consisting of
100 units;
• Building would be constructed at one time and internal build-out phased over
several years;
• Businesses in Outlots would complement the senior assisted living facility, such as
medical or dental offices;
• The majority of the Council indicated support regarding the proposed development
of this type of facility;
• Concerns were expressed regarding traffic and the size of the building proposed in
relation to the size of the property;
• Council indicated only one access point onto Bull Valley Road was desirable;
• Consideration of a bike path was requested by Council;
Director Napolitano.stated the character of the area on Bull Valley Road in close
proximity to the site is mixed residential, institutional and possibly future commercial.
Single-family residential homes are situated to the north, townhomes to the east and future
commercial to the west. He, informed Council the proposed senior housing land use is in
conformance with several goals of residential development in the Comprehensive Plan.
He noted Staff believes the land uses and proposed zoning classifications are appropriate
for this site.
Director Napolitano stated Staff had the following general comments regarding the
Site Plan:
• Consideration should be given to a cross access easement with the parcel to the
west for a shared entrance on Bull Valley Road;
• No additional access points onto Bull Valley Road should be granted. Right-of-way
dedication for the property shall comply with the standards given by the Highway
Department, together with any recommended road improvements;
• Additional low maintenance walking paths should be provided around the site, along
with other amenities such as benches.
• Staff believes the private road is appropriate for this site as the use is unique. Staff
suggests a blanket road easement be granted to the City if the roadway is to be
private.

Director Napolitano noted the Planning and Zoning Commission, at a Public
Hearing held on June 26, 2003, unanimously recommended approval of:

• Zoning Map Amendments of RM-2, 0-1 and 0-2, upon annexation to the City;
• Conditional Use Permit to allow a senior housing facility, subject to Staffs
comments regarding the Site Plan be incorporated into the Annexation Agreement;
• Variances as follows:
o Density— maximum of 230 units on 7.61 acres of RM-2 zoned property;
o Height— maximum of 50' for senior housing facility;
o Parking — to permit a reduction from parking requirements to 126 total
spaces, including 60 underground spaces;
o Lot frontage —to permit utilizing the private loop road for frontage of buildings
located on Lots 1-4 of the Foxcroft Ridge Subdivision.
• Preliminary Plat of Subdivision for the subject property.
Attorney Saladin requested Council consider waiving the Park Donation Fees
required for each residential unit constructed upon issuance of each building permit. Mr.
Saladin stated the Applicant feels a senior living facility would have little or no impact on
parks. Alderman Glab stated he is unable to support waiving the Park Donation fees. A
lengthy discussion ensued regarding use of the fees.
Alderman Wimmer expressed concern regarding the outlots fronting Bull Valley
Road. He suggested the Applicant work with Staff to develop parking lot guidelines for the
office development. —
Alderman Murgatroyd requested a copy of all the approved uses.
Alderman Glab suggested since there are will be no 3-bedroom units available in
the complex all reference to a 3-bedroom unit should be removed from the Annexation
Agreement. Responding to Alderman Glab's inquiry regarding the depth of the retention
pond, Virginia Gully stated it is 10-feet at the deepest point.
Motion by Glab, seconded by Murgatroyd to close the Public Hearing regarding
Foxcroft Ridge annexation, rezoning, conditional use permit, variances and preliminary
plat approval regarding the Krumholtz property at 8:52 p.m.
Voting Aye: Bolger, Glab, Low, Murgatroyd, Wimmer, Peterson.
Voting Nay: None.
Abstained: Condon.
Absent: None.
Motion carried.
Motion by Murgatroyd, seconded by Glab, to direct Staff to draft the required
ordinances approving the annexation agreement, annexation, zoning, variances,
conditional use permit and Preliminary Plat for consideration at the next Council meeting. _

Abstained: Condon.

PRESENTATION: MCHENRY COUNTY TOURISM INITIATIVE/CONVENTION AND
VISITORS BUREAU
Karen Patel, President of the McHenry County Economic Development Corporation
(MCEDC) introduced Bonnie Heimbach of the Northern Illinois Tourism Council and Bob
Dora, Managing Partner of the McHenry Hampton Inn.
Ms. Patel informed Council that McHenry County, through the MCEDC, has
developed a plan for attracting tourism to McHenry County which includes creating a
McHenry County Convention and Visitors Bureau (MCVB). The MCEDC is asking each
municipality in McHenry County to respond by July 31, 2003 with an indication of interest
and commitment to invest in the MCVB.
Ms. Patel stated the MCVB would:
• Promote McHenry County in a cost-effective manner as a destination for
conventions, weekend getaways, sports competitions and special events;
• Enable access to State funds; and
• Facilitate collaboration between public and private entities to attract additional
patrons for restaurants, shopping, lodging and amenities, thereby generating
additional tax revenue.
Ms. Patel outlined the MCVB proposal as covering a three-year period, which
includes administrative expenses and marketing projects. She stated that McHenry
County has committed to fund 80% ($87,000), 60% ($88,000) and 40% ($65,000) of the
administrative costs of the proposed MCVB for the first three years. Three funding options
were suggested for McHenry City Council consideration:
• Funding through hotel tax, assuming 7 municipalities have or implement a hotel tax
and a consistent contribution is made by the other 23 municipalities;
• Funding through hotel tax for 7 municipalities and contributions based upon
cost/population for the other 23 municipalities; and
• Funding through McHenry County Assessed Value by municipality.
It was suggested a Hotel Operators' Occupation Tax is a logical funding source. It
was noted a Hotel Tax can be instituted through ordinance and cannot exceed 5% of the
gross rental receipts. A brief discussion ensued.
Mayor Low stated she supports McHenry as a recreational destination. Alderman
Murgatroyd opined he supports the concept of tourism. Alderman Bolger stated he would
support a Hotel Tax. Alderman Condon concurred with Alderman Bolger.
Motion by Murgatroyd, seconded by Condon, to support the McHenry County
Tourism initiative, including the establishment of the McHenry County Convention and
Visitors Bureau and to direct the Finance and Personnel Committee to determine the
amount of the contribution to be made.

REQUEST FOR CONNECTION TO MUNICIPAL SANITARY SEWER SYSTEM AT 2917 --�
LINCOLN ROAD
Director of Community Development Napolitano stated a letter had been received
from Mike and Jill Magnussen, owners of the property located at 2917 Lincoln Road,
requesting connection to the City's municipal sanitary sewer system. Director Napolitano
noted sanitary sewer service is available along Lincoln Road following installation of the
mains by the developer of Liberty Trails Subdivision. Director Napolitano noted the
Applicants are requesting to be allowed to connect immediately due to health concerns
precipitated by the failure of a septic system that is irreparable.
Director Napolitano informed Council similar requests have been received in the
past and Staff has no concerns. Previously the City has permitted hook-up upon payment
of non-resident fees and has required the property to annex to the City within 90-days of
becoming contiguous.
Motion by Bolger, seconded by Peterson, to approve the request for connection to
the municipal sanitary sewer of the property located at 2917 Lincoln Road, subject to the
following:
• The property being annexed to the City of McHenry within 90 days after becoming
contiguous;
• Payment of required connection and capital development fees for non-residents; _
and
• Payment of the non-resident rate for sewer service until annexation occurs.

REQUEST TO ALLOW ACCESS TO UNIMPROVED RIGHT-OF-WAY ON HAY STREET
Mr. Dave Kotiw, owner of two lots located in unincorporated McHenry Township
having frontage on unimproved Hay Street, informed Council Hay Street is an unimproved
right-of-way 30 feet in width, which is owned by the City of McHenry. He noted Hay Street
is located on the south side of Lillian Street east of the intersection of Lillian Street and
Sioux Lane.
Mr. Kotiw explained he is proposing construction of two single-family homes, one on
each of the aforementioned lots. McHenry County will not provide building permits without
access to a street. Because the unimproved right-of-way is within the City, the City has the
ability to issue a driveway permit, but is unable to do so because the lots do not have
access onto a public street. Mr. Kotiw stated he is unable to proceed and is seeking
assistance from the City to move forward with the proposed construction. --
Director of Community Development Napolitano stated there are three options
Council may wish to consider:
1. Allow both homes to be served by one new driveway leading to Lillian Street. This
option would place two driveways (both Kotiw's and ComEd's) in close proximity to

each other and could cause some undesirable vehicular conflicts.
2.. Allow each home to be served from the existing ComEd driveway. This option
— would eliminate the need for another curb cut on Lillian Street.
3. Obtain an additional 30' right-of way from ComEd and require Kotiw to construct the
road to City standards from Lillian to his southernmost lot line. This is the most
costly option to Mr. Kotiw. ComEd has indicated they have no desire to contribute
to the cost of the road, but they are willing to discuss dedication of the additional
right-of way. Director Napolitano noted the City is currently awaiting a response
from
ComEd regarding the dedication of the additional right-of-way.
Staff suggests Option No. 2 is the most practical. Director Napolitano suggested in
exchange for allowing Mr. Kotiw to use the existing driveway, the City could require a cash
deposit in a fixed amount that could be used for the future improvements of the road. The
amount could be based upon a per foot cost to construct the road over his frontage. A
lengthy discussion ensued regarding the options presented.
No determination was reached by Council. It was suggested that depending on the
response received from ComEd, Mr. Kotiw should continue to work with Staff.
AWARD OF BID FOR THE PURCHASE AND INSTALLATION OF PLAYGROUND
EQUIPMENT FOR FOX RIDGE PARK— REIL CONSTRUCTION
Director of Parks and Recreation Merkel informed Council that three years ago the
Parks and Recreation Department began a five-year playground improvement program
with the installation of new playground equipment at Freund Field, Knox Park and
Veteran's Memorial Park. He stated that this year the large play unit at Fox Ridge Park is
scheduled for replacement.
Director Merkel noted the renovation of the Fox Ridge Park playground includes
removal of all equipment and sand base. New equipment is to be installed with drainage
installation underneath the new wood fiber play safety surface.
Director Merkel stated two bids were received for the project and Reil Construction,
Inc. of Union, Illinois submitted the lowest bid at $84,745.
Motion by Wimmer, seconded by Condon, to accept Staffs recommendation and to
approve the award of bid for the purchase and installation of playground equipment for Fox
Ridge Park to Reil Construction, Inc., in the amount of$84,745.

reassignment of appointments to the following Standing Committees:
Alderman Robert Peterson as Chairman of the Parks and
Recreation Committee and removed from the Community Development

City Clerk Jones reported that a citywide mosquito abatement spraying would take

Alderman Glab reported that wood chips have been washing off of the walking
paths in Whispering Oaks Park.
