AUGUST 18, 2003
The Regular Meeting of the McHenry City Council was called to order by Mayor Low
at 7:30 P.M. on Monday, August 18, 2003 in the Council Chambers of the Municipal
Center. At roll call the following Aldermen were present: Bolger, Glab, Low, Murgatroyd,
Peterson, Condon. Absent: Wimmer. City Staff in attendance were: City Administrator
Maxeiner, Assistant Administrator Lockerby, City Clerk Jones, City Attorney McArdle,
Director of Public Works Marcinko, Chief of Police O'Meara, Director of Community
Development Napolitano, Director of Parks and Recreation Merkel. Absent: None.

CONSENT AGENDA
Alderman Peterson requested Item B, Resolution authorizing Motor Fuel Tax Funds
for Crestwood Drive improvements, be removed from the Consent Agenda for further
discussion.
Alderman Glab noted the request for a Special Use Permit for the Cesar Basiche
party to be held on August 30, 2003 does not specify which park will host the event.
Alderman Glab stated he has no issue with the request provided the venue for the party is
Petersen Park. Director of Parks and Recreation Merkel assured Alderman Glab the
requesting party would be notified of the requirement.
Motion by Glab, seconded by Bolger, to approve the Consent Agenda as amended:

RESOLUTION AUTHORIZING UTILIZATION OF• MOTOR FUEL TAX FUNDS FOR
CRESTWOOD DRIVE IMPROVEMENTS
Director of Public Works Marcinko informed Council when Motor Fuel Tax (MFT)
funds are utilized, as proposed for the Crestwood Drive Improvements, the Illinois
Department of Transportation (IDOT) requires the municipality applying for funding to pass
a Resolution earmarking the funds received for proposed improvements specifically stated
on the Resolution. The Resolution assures the municipality will use the MFT funds toward
the project.
Alderman Peterson expressed concern with the project, specifically regarding the
impact on the residents of Crestwood Drive and the removal of off street parking.
Director of Public Works Marcinko informed Alderman Peterson correspondence
would be provided to each resident prior to initiation of the project informing the residents
of the project and the possible impact of impending work.
Motion by Condon, seconded by Murgatroyd, to approve Staffs recommendation
and to approve a resolution authorizing utilization of Motor Fuel Tax Funds for Crestwood
Drive improvements.

ORDINANCE GRANTING CONDITIONAL USE PERMIT TO SERVE ALCOHOLIC
BEVERAGES IN CONJUNCTION WITH A RESTAURANT — BURRITOVILLE. 4305
WEST ELM STREET
Director of Community Development Napolitano stated pursuant to direction at the
July 14, 2003 City Council meeting, Staff prepared an ordinance granting a Conditional
Use Permit to serve alcoholic beverages in conjunction with the restaurant commonly
known as Burritoville, located at 4305 West Elm Street.
Alderman Glab expressed strong concerns regarding the impact on the surrounding
residential community with a restaurant serving alcoholic beverages on the premises.
Council was assured alcoholic beverages would be served only to patrons
consuming food indoors on the premises.

Motion by Bolger, seconded by Peterson, to approve an ordinance granting a
Conditional Use Permit to serve alcoholic beverages in conjunction with the operation of
the Burritoville Restaurant located at 4305 West Elm Street.

DISCUSSION: SCHOOL RESOURCE OFFICER PROGRAM
City Administrator Maxeiner stated on June 30, August 11 and August 18, 2003, the
Finance and Personnel Committee met to discuss the School Resource Officer (SRO)
Program and the requests by Districts 15 and 156 for financial assistance with the
Program. He stated grant monies assisting with underwriting the Program will expire in
August 2003. He noted both school districts are experiencing budget difficulties and are
seeking City financial assistance with continuing the SRO Program. City Administrator
Maxeiner noted representatives from both school districts have presented valid arguments
regarding the value of the program as a component to educational programming.
City Administrator Maxeiner informed Council the Police Department budget is
impacted by the proposed continuation of the SRO Program as the commitment of two
officers to the program removes the officers from their planned patrol duties. Continuation
of the program in District 156 will necessitate the addition of two additional officers.
City Administrator Maxeiner stated, following lengthy discussions with
representatives of District 156, Staff is recommending a 60140 funding agreement whereby
60% of the actual cost of an SRO, during school months, is paid by the participating district
with the remaining portion funded by the City. This arrangement would result in a cost of
approximately $34,000 per officer for participating districts down from approximately
$50,000 under the expiring agreement.
City Administrator Maxeiner informed Council District 15 has also utilized an SRO in
past years, but due to budgetary constraints is unable to pursue an agreement at this time.
However, District 15 has expressed interest in pursuing a cost share agreement should
their financial situation alter in the future.
A brief discussion ensued. Alderman Murgatroyd opined the Agreement as outlined
is reasonable and benefits all the parties. Alderman Peterson concurred with Alderman
Murgatroyd.
Alderman Condon expressed strong opinions regarding the financial condition of
the school districts and the City's responsibility to the students. She suggested the City
consider funding a police officer presence for District 15 two days per week during the
school year.

Motion by Murgatroyd, seconded by Peterson, to accept the recommendation of the -t
Finance and Personnel Committee, and to approve continuation of the SRO Program, with
funding to be shared on a 60/40 (school district/City) basis of the actual costs of the
officers during school months, and to direct Staff to prepare an Agreement with District 156
with modification to the Agreement as follows:
• If at any time the Police Chief feels the SRO's are not being utilized correctly by the
districts, he would have the ability to remove the officer; and
• The Police Department would have the ability to remove an SRO from a school for
temporary re-assignment as workloads may demand;
and approving a budget amendment of $10,000 per officer, required for the SRO Program
to maintain adequate police staffing levels.

PROPOSAL FOR WAUKEGAN ROAD: STREET AND WATER MAIN IMPROVEMENTS -
LEVERNIER ENTERPRISES INC.
City Administrator Maxeiner informed Council, at the January 20, 2003 Regular City
Council Meeting, Council approved the conceptual development plans for the Riverwalk
Place Townhomes. As part of the Developer's Agreement, the City agreed to fund the -�
improvement of Waukegan Road with Tax Increment Financing.
Director of Public Works Marcinko informed Council the improvements originally
estimated by Staff were to cost approximately $170,000. However, the estimate did not
include any improvements to the water main or to the sidewalk on the south side of the
street.
On June 2, 2003 Council approved Baxter & Woodman's Engineering Service
Agreement for the design of the Waukegan Road improvements necessary for the
Riverwalk Place development. Baxter & Woodman's plans identified the water main
serving Waukegan Road as deficient in size and condition and should be replaced.
Additionally, the proposed realignment of Waukegan Road, to soften the curve and shift t
the footprint of the roadway slightly south, results in additional improvements for sidewalks
and a small retaining wall on the south side of the road. Incorporating the modifications
into the engineering plans, the engineer's estimate of the cost of the improvements totaled
$426,625.50. The design was submitted to the developer's contractor, Levernier
Enterprises, Inc., for a proposal based on data provided by Baxter& Woodman.
City Administrator Maxeiner informed Council that Levernier Enterprises, Inc. has
submitted a proposal of $338,500 for materials and construction of the Waukegan Road _
improvements and water main installation, exclusive of the sidewalk and retaining wall
improvements. Carey Electric is requesting improvements to the sidewalk and retaining
wall on the south side of Waukegan Road in exchange for donation of the land to expand
the existing Waukegan Road right of way. Carey Electric contends construction of the
improvements during the improvements to Waukegan Road would minimize disruptions to

the area. It is estimated installation of the sidewalk along the south side of Waukegan
Road and a segmental concrete block wall would cost approximately $44,700, for a total of
.... $383,200 when combined with the improvements proposed by Levernier Er'arprises, Inc.
City Administrator Maxeiner noted the program is time sensitive. Requiring
compliance with the bidding process would delay the project a minimum of eight weeks.
Staff suggests $131,438, for the costs associated with the water main come out of
the Water/Sewer Fund, $170,000 would come from the TIF Fund, once the increment is
sufficient to make the transfer, and the remaining $81,762 would be paid out of the
General Reserve Fund.
Mr. Curt Langille, developer of the Riverwalk Place Townhome development,
expressed his confidence in Levernier Enterprises, Inc.
Alderman Bolger stated he would normally require a project of this magnitude go to
bid, but in this case he supports Levernier Enterprises' completion of the proposed
improvements.
Alderman Murgatroyd, concurring with Alderman Glab, opined the entire amount to
fund the project be realized from TIF funds.
Responding to an inquiry, City Administrator Maxeiner noted the improvements
would ultimately have been normal upgrades and/or improvements to the infrastructure.
City Attorney McArdle informed Council according to statute, in order to authorize
Levernier Enterprises, Inc.'s completion of the Waukegan Road and water main
improvements, a positive vote from five of the six alderman present would be required.

DESIGN AND INSTALLATION OF WATER SYSTEM TELEMETRY CONTROL
UPGRADE (SCADA) SYSTEM SERVICE AGREEMENT — B & W CONTROL SYSTEMS
INTEGRATION, LLC
Director of Public Works Marcinko informed Council the Environmental Protection
Agency (EPA) has mandated that public utilities provide increasing oversight of utility
systems. It has been determined a radio telemetry system, commonly referred to as
�.. SCADA (Supervisory Control and Data Acquisition) System provides for remote monitoring
and control of freshwater collection and distribution throughout the municipality. The
system provides for the automatic transmission of data from a remote source to a receiving

station for recording, analysis and system management.
Director Marcinko noted the Water Division's utility system is spread throughout the
City making radio telemetry the most reliable and cost effective means to tie each remote
location back to the plant and/or administrative offices. Using a common radio channel, a
computer at the water plant or other location, can query each of the remote locations for
status of pumps, valves and pressures. Using the.-same radio channel the computer can
control the operation of each of the components.
Director Marcinko informed Council that currently all the utility sites are tied together
through aging phone lines. The phone lines are frequently hit during underground
excavation, which causes the water division to monitor and control the remote facilities
manually. - Manual monitoring requires water division personnel to visit each site to assess
system operation.
Additionally, Director Marcinko noted the SCADA system would permit.-the Water
Division to discover potential problems prior to matters reaching a critical stage. The
SCADA system proposed in the Engineering Services Agreement from B&W Control
Systems Integration, LLC consists of designing, furnishing and installing a complete
SCADA system to replace the existing telemetry controls for the City's water system.
Director Marcinko noted $175,000 has been included in the 2003/2004 Budget for
purchase of such a system.
Following a brief discussion, Alderman Glab recommended the matter be discussed
further at a Public Works Committee Meeting. Alderman Bolger concurred with Alderman
Glab stating he was unable to support the purchase and installation of the SCADA system
at this time.
City Attorney McArdle informed Council.according to statute, in order to approve the
proposal by B&W Control Systems Integration, LLC the motion would require a positive
vote from five of the six alderman present.
Motion by Murgatroyd, seconded by Condon, to accept Staffs recommendation to
approve a Service Agreement with B&W Control Systems Integration, LLC's for design and
installation of a complete SCADA system, in an amount not-to-exceed $173,200.

ENGINEERING SERVICES AGREEMENT FOR CRESTWOOD DRIVE IMPROVEMENTS

Director of Public Works Marcinko informed Council in 2002 the Crestwood Drive
water and sewer main improvements were completed. The project consisted of
replacement of the water and sewer main as well as installation of storm sewer. As part of
these improvements Crestwood Drive was reconstructed from Mill Street to Logan Street.

Due to project limits from Mill Street to Logan Street, the remainder of Crestwood Drive
between Logan Street and Lillian Street was not resurfaced. Director Marcinko noted this
area of Crestwood Drive is in poor condition with excessive edge cracking.
Director Marcinko stated the Public Works Committee recommended consideration
of the project in the 2003/2004 Budget.
Smith Engineering Consultants, Inc. has submitted an Engineering Services
Agreement for the design of the Crestwood Drive improvements. The improvements
consist of resurfacing Crestwood Drive from Lillian Street to Logan Street. In the proposed
Agreement, Smith Engineering would perform all the necessary duties to prepare the
specifications and design plans to facilitate the bidding process.

Agreement with Smith Engineering Consultants, Inc. for the Crestwood Drive
improvements, in an amount not-to-exceed $7,500.

APPROVE PURCHASE OF HOLIDAY LIGHTING DISPLAYS FOR WHISPERING OAKS
PARK—TEMPLE DISPLAY, LTD.
Director of Parks and Recreation Merkel informed Council the Parks and Recreation
Committee considered new holiday displays for the Whispering Oaks Park at their
committee meeting held on June 26, 2003. The animated Giftbox Bear and Teddy Bear
Snowball Fight were the two displays favored by the Committee. The 2003/2004 Budget
includes $13,500 to purchase holiday lighting displays for Whispering Oaks Park.
Motion by Murgatroyd, to approve the purchase of two seasonal holiday displays
from Temple Display, Ltd., in an amount not-to-exceed $12,550. Motion died for lack of a
second.
Motion by Glab, seconded by Bolger, to defer discussion regarding the purchase of
seasonal holiday displays for Whispering Oaks Park to the Parks and Recreation
Committee.

COMMITTEE REPORTS
Alderman Murgatroyd informed Council a Finance and Personnel Committee
meeting took place at 6:30 p.m. prior to this evening's Council meeting. Discussion
occurred regarding the City Clerk/Collector position. He stated continued discussion
regarding this matter would take place at a Committee Meeting on either September 3,
2003 or September 29, 2003, at 6:30 p.m., prior to the Council meeting.
Alderman Bolger stated he would like to schedule a Public Works Committee
meeting prior to the Council meeting on Monday, September 15, 2003 at 6:30 P.M.
DEPARTMENT HEAD REPORTS
Police Chief O'Meara stated an eight-month long narcotics investigation, conducted
by the City in conjunction with the Sheriffs Department, has resulted in an arrest.
Director of Parks and Recreation Merkel invited Council to participate in a boat tour
of McCullom Lake on Wednesday, August 20, 2003 at 4:30 p.m. to assess excessive weed
growth. He suggested anyone interested should contact his office.

Alderman Peterson opined he would like to see the funds for the project come out of
Tax Increment Financing (TIF) Fund. Alderman Murgatroyd stated he would support 60%
of the funds coming out of Capital Development Fees and 40% of the funds originating
from TIF funds. A brief discussion ensued.

denying the request, and to accept Staffs recommendation to authorize Levernier
