At roll call the following Aldermen were present: Bolger, Glab, Low, Murgatroyd, Wimmer. REQUEST FOR USE OF PETERSEN PARK FOR ROCK THE PARK MUSICAL EVENT - MCHENRY PUBLIC LIBRARY Director of Parks and Recreation Merkel addressed Council stating the taxing entity McHenry Public Library District is again requesting the use of Petersen Park to sponsor a musical event entitled "Rock the Park." Director Merkel noted the event received positive acclaim from the community when held last year at Petersen Park on August 3, 2001. He advised the Library District is requesting Council's approval for the use of the annual event at Petersen Park on Friday, June 14, 2002 from 6:00 p.m. to 10:00 p.m. Motion by Low, seconded by Bolger, to approve the request of the McHenry Public Library to use Petersen Park for the "Rock the Park" musical event scheduled for Friday, June 14, 2002 from 6:00 p.m. to 10:00 p.m. Voting Aye: Bolger, Glab, Low, Murgatroyd, Wimmer Voting Nay: None. Absent: None. Motion carried. REVIEW OF SITE PLAN FOR CHURCH OF HOLY APOSTLES PROPOSED RECTORY BUILDING, 5201 W. BULL VALLEY ROAD In attendance was Mr. Tim Adams, Business Manager for Church of Holy Apostles. Mr. Adams informed Council the church is proposing construction of a new rectory building on the south side of the property located at 5201 Bull Valley Road. He noted the rectory would be the primary residence for the Pastor of the church. Director of Community Development Napolitano noted, pursuant to the Annexation Agreement, all new construction on church property requires site Ian approval Council. Director Napolitano advised Council access to the rectory would be provided from the columbarium driveway. Eight new parking spaces would be constructed for the rectory, providing visitors with convenient parking. Director Napolitano opined construction of the premises at this location would create little impact on either parking or traffic in the vicinity. Motion by Bolger, seconded by Low, to approve the site plan for the proposed Church of Holy Apostles Rectory at 5201 W. Bull Valley Road. January 21, 2002 Page 6 Alderman Glab requested the Bull Valley Road speed limit be placed on the agenda of a Public Works Committee Meeting for discussion. City Administrator Lobaito stated McHenry County has been approached regarding speed limit reduction on Bull Valley Road. He noted a speed study was conducted in 1995. Based upon its analysis, the County refused a reduction of the speed limit, suggesting reapplication at a later date. Responding to Mayor Althoff inquiry regarding the installation of the traffic light at Ridgeview and Bull Valley Road, City Administrator Lobaito noted a preliminary count was conducted in August 2000,and City Administrator Lobaito noted Assistant Director Public Works Marcinko who stated warrants for a traffic signal were not met at that time. REQUEST FOR A CONDITIONAL USE PERMIT FOR A RESTAURANT SERVING ALCOHOLIC BEVERAGES - CHILI'S GRILL AND BAR 2409 N. RICHMOND ROAD In attendance was John K. McVickers, principal of McVickers Development, L.L.C. Real Estate, owner of the property. Director of Community Development Napolitano advised Council Chili's Grill and Bar plans to open a restaurant in the Meijer/Home Depot subdivision on Outlot 6 and part of Outlot 5, located at 2409 N. Richmond Road. A Conditional Use Permit has been requested to allow the sale of alcoholic beverages at the site. Staff noted Chili's is a full service restaurant with a seating area for customers and a separate bar area. Mayor Althoff stated Chili's is requesting a Conditional Use Permit at this time, which may be revoked by the Council if the conditional use is not established, or a building permit is not obtained and construction initiated within one year from the date of issuance of the permit. She informed Council the City has not granted a liquor license, as it is Chili's intention to apply at the beginning of the fiscal year, nearer to the opening of the establishment. Mayor Althoff noted the Zoning Board of Appeals unanimously voted in favor of approval of the Conditional Use Permit at a Public Hearing held on December 13, 2001. Motion by Glab, seconded by Bolger, to accept the unanimous recommendation of the Zoning Board of Appeals and to direct Staff to prepare an ordinance granting a Conditional Use Permit for a restaurant serving alcoholic beverages to Brinker Restaurant Corporation d/b/a Chili's Grill and Bar, located at 2409 N. Richmond Road Voting Aye: Bolger, Glab, Low, Murgatroyd, Wimmer Voting Nay: None Absent: None Motion carried. ORDINANCE PROPOSING THE ESTABLISHMENT OF A BACK-UP SPECIAL SERVICE "1 AREA FOR THE RIVERSIDE HOLLOW SUBDIVISION EAST SIDE OF RIVERSIDE DRIVE AT MC CULLOM LAKE ROAD In attendance was Caroline A. Nash, Attorney for Kennedy Homes. Ms. Nash addressed Council explaining the function of a back up Special Service Area is to serve as January 21, 2002 Page 7 the City's remedy should the homeowners' association not function adequately in the maintenance of the common areas. Director of Community Development Napolitano stated the Riverside Hollow Annexation Agreement requires the developer establish a back-up Special Service Area (SSA). The SSA provides a method of financing for the maintenance of common areas, including detention ponds, fencing and landscaping, in the event the homeowners' association fails to care for these areas. Director Napolitano noted within sixty days after adoption of the ordinance proposing the establishment of a backup Special Service Area, a Public Hearing must be held to create the Special Service Area. Director Napolitano informed Council February 18, 2002 has been suggested as the tentative date for the Public Hearing. Responding to Alderman Glab's inquiry, Ms. Nash stated, as per the terms of the Riverside Hollow Annexation Agreement, the homeowners association becomes responsible for maintenance of the common areas of the subdivision following the sale of a specified percentage of homes in the subdivision. Motion by Murgatroyd, seconded by Glab, to pass and approve an ordinance proposing the establishment of a back-up Special Service Area for Riverside Hollow Subdivision, located on the east side of Riverside Drive at McCullom Lake Road, in order to assure financing for the maintenance of common areas of Riverside Hollow Subdivision should the homeowners' association default in providing said services. Voting Aye: Bolger, Glab, Low, Murgatroyd, Wimmer Voting Nay: None. Absent: None. Motion carried. PURCHASE OF VEHICLES - POLICE DEPARTMENT PATROL AND INVESTIGATION DIVISIONS City Administrator Lobaito advised Council pursuant to the Vehicle Replacement Program established by Council in 1999, vehicles are ordered annually through the State of Illinois Joint Purchasing Contract Program. The Illinois Department of Central Management Services accepts formal bids each year. This year the contract was awarded to Landmark Automotive Group in Springfield, Illinois for Ford Taurus and Ford Crown Victoria patrol vehicles. In order to take advantage of the state contract pricing, orders must be placed prior to January 25, 2002. City Administrator Lobaito stated in the past local dealers have been able to piggyback on the state contract, for a fee of approximately $200/vehicle, permitting the City to purchase vehicles through local dealers. The local dealership has been unable to determine if they can piggyback on the state contract. He advised there is a net difference of approximately $50 per vehicle, when purchasing from a local vendor and utilizing the state contract. The state contract vendor charges a $150 delivery fee/vehicle. Staff is January 21, 2002 Page s requesting Council authorization to either purchase the vehicles locally, including the additional fee, or to place an order through the state vendor. Motion by Glab, seconded by Bolger, to authorize Staff to purchase four replacement Patrol Division vehicles at a cost of $84,600, and one Investigation Division vehicle for the Police Department, utilizing the services of a local vendor, including an additional fee of approximately $200 per vehicle. MAYOR— STATEMENT AND REPORT Mayor Althoff requested an Executive Session to discuss Personnel, specifically pertaining to the Chief of Police Search. Mayor Althoff requested Council approve a Proclamation acknowledging the 501h Anniversary of the McHenry Area Chamber of Commerce. Motion by Low, seconded by Bolger, to authorize the Mayor's execution of a Proclamation, acknowledging the 501h Anniversary of the McHenry Area Chamber of Commerce, to be presented at the Annual Dinner Dance on Saturday, January 26, 2002. Voting Aye: Bolger, Glab, Low, Murgatroyd, Wimmer Voting Nay: None. Absent: None. Motion carried. Mayor Althoff informed Council a check was received today for the Riverwalk Project, in the amount of $10,000 from longtime McHenry resident Amy Wattman of Whispering Oaks Subdivision. Mayor Althoff reported the Riverwalk Foundation's current balance is $103,000. COMMITTEE REPORTS Chairman Alderman Murgatroyd requested a Finance and Personnel Committee Meeting to discuss the financial aspects, revenues and anticipated expenses related to the TIF District be scheduled for Wednesday, January 30, 2002 at 7:00 p.m. in the Aldermen Conference Room. Chairman Alderman Glab advised Council the second meeting of the Ward Redistricting Committee was held on Wednesday, January 16, 2002. The borderlines are being reconfigured and minutes of the meeting will be forthcoming. Chairman Glab stated the newly established aldermanic wards would be ready for Council's approval on February 18, 2002. January 21, 2002 Page 9 Mayor Althoff reminded Council of the Community Development Committee Meeting on Wednesday, January 30, 2002 at 3:30 p.m. in the Aldermen Conference Room. DEPARTMENT HEAD REPORTS Director of Parks and Recreation Merkel reported letters regarding the aeration system have been sent to the waterfront property owners along McCullom Lake. Director Merkel noted the aeration system is utilized only on an as-needed basis when the oxygen is depleted in order to prevent winter fish kill. With the mild winter this year the aeration system may not be utilized at all. Director Merkel requested the Parks and Recreation Committee meeting currently scheduled for February 14, 2002 be cancelled, due to Valentine's Day. The next Parks and Recreation Committee meeting is scheduled to take place on March 14, 2002. Director Merkel advised Council a meeting will be held in the Municipal Building Classroom on March 21, 2002 at 6:00 p.m. with the youth and adult athletic associations. Athletic fields will be allocated for the upcoming year. In the past the meeting has been posted as a Parks and Recreation Committee meeting. The public is welcome to attend. Director Merkel advised project coordinators for the Skate Park would submit applications in mid-February to the Department of Commerce for Community Affairs, who, together with the Governor's Office, presents the Governor's Hometown Awards for community involvement and volunteerism. Notifications would be received by the end of April. Participants will be invited to Springfield for the awards program in June. City Clerk Jones reported the vehicle sticker scofflaw collection program initiated on January 14, 2002 has collected $3,208.50 to date. City Administrator Lobaito informed Council Meyer Material has submitted a petition for annexation of approximately 157-acres north of Route 120 across from the existing gravel mine. In accordance with the Concept Plan Review Process approved by Council in January 2000, the next step in the process is to schedule a Committee of the Whole meeting to discuss the proposal with the Petitioner. Mayor Althoff suggested tentatively setting the Committee of the Whole meeting for Wednesday, February 20, 2002 at 7:00 p.m. Alderman Murgatroyd stated he would like an opportunity to review the minutes of the Zoning Board of Appeals Public Hearing set for February 7, 2002, prior to committing to a Committee of the Whole meeting. City Administrator Lobaito reminded Council a Workshop meeting will take place on February 11, 2002. Professor Martin Jaffe of the University of Illinois will discuss growth management and current design review with an emphasis on environmental management �-- issues and how they relate to land planning. Zoning Board members and Plan Commission members have been invited to attend. City Administrator Lobaito informed Council, he, Mayor Althoff, Alderman Low and January 21, 2002 Page 1 o '1 Director of Parks and Recreation Merkel will be meeting with the YMCA on Wednesday, January 23, 2002 to begin discussions regarding the Recreation Center development. City Administrator Lobaito will keep Council apprised. NEW BUSINESS Alderman Glab requested Staff be directed to contact the County requesting renewed exploration of speed limit reduction on Bull Valley Road. Mayor Althoff suggested City Administrator Lobaito send a letter to the County, requesting a current study be conducted, and that Council be provided a copy of the past study.
