�,... The Regular Meeting of the McHenry City Council was called to order by Mayor
Althoff, at 7:30 P.M. on Monday, February 18, 2002 in the Council Chambers of the
Municipal Center. At roll call the following Aldermen were present: Bolger, Glab, Low,
Murgatroyd, Wimmer. City Staff in attendance were: City Administrator Lobaito, City Clerk
Jones, City Attorney McArdle, Assistant Director of Public Works Marcinko, and Director
Community Development Napolitano. Absent: Director of Parks and Recreation Merkel,
Director of Public Works Batt and Deputy Chief Donahue.
TEN MINUTE PUBLIC INPUT
No one signed in to speak during the Ten Minute Public Input Session.
PUBLIC HEARING: RIVERSIDE HOLLOW SPECIAL SERVICE AREA
Mayor Althoff opened the Public Hearing at 7:34 p.m. on the proposed Riverside
Hollow Special Service Area.
In attendance was Caroline A. Nash, Attorney for Kennedy Homes. Ms. Nash noted
the Special Service Area is a requirement of the Riverside Hollow Annexation Agreement.
She explained the function of a back up Special Service Area is to serve as the City's
remedy should the homeowners' association not function adequately in the maintenance of
the common areas. She stated following adjournment of the Public Hearing there is a 60-
day waiting period to provide affected owners and electors in the Special Service Area the
opportunity to file a petition blocking the creation of the Special Service Area. Ms. Nash
advised Council notice of the Public Hearing was published in the newspaper, as required,
15 days prior to the hearing and written notice was provided 10 days prior to the Hearing
to the last known taxpayer within the proposed Special Service Area.
Mayor Althoff inquired if there were any comments or questions from the audience.
There were none. In response to Mayor Althoffs inquiry, City Clerk Jones stated no
inquiries have been received, verbal or written, regarding the Public Hearing.
Motion by Bolger, seconded by Glab, to close the Public Hearing regarding the
proposed Riverside Hollow Special Service Area at 7:38 p.m.

REQUEST FOR TEMPORARY USE AND WAIVER OF RENTAL FEES FOR VETERANS
MEMORIAL PARK - MC HENRY PUBLIC LIBRARY
Mayor Althoff informed Council the McHenry Public Library is requesting the use of
Veteran's Memorial Park to sponsor a Lemonade Social and a Victorian Fashion Show.
The event, held in conjunction with the McHenry County Civil War Round Table, will be
held on Saturday, June 29, 2002 between the hours of noon and 4:00 p.m. The Library
requests reservation of the gazebo and shelter in the park and waiver of all rental fees.
Motion by Bolger, seconded by Low, to approve the request for use of Veteran's
Memorial Park by the McHenry Public Library, for the Lemonade Social and Victorian
Fashion Show to be held on June 29, 2002 from noon to 4:00 p.m., and to waive all rental
fees associated with the use.

REQUEST FOR TEMPORARY USE - PRO BASS SHOP, 2920 NORTHSIDE AVENUE
In attendance was Mr. Jeff Kleinhans, property owner of 2920 Northside Avenue.
Mr. Kleinhans requested Council permission for his tenant, McHenry Pro Bass to
temporarily locate in his 4-unit industrial building located at 2920 Northside Avenue.
Mr. Kleinhans informed Council McHenry Pro Bass operated from the address at
2913 W. Route 120; but since a fire in June the property has not been occupied. Mr.
Kleinhans stated he intends to demolish the existing building and construct a new building
on the site. The property at 2920 Northside Avenue is located directly behind the old
address and would facilitate his tenant resuming business in time for the spring fishing
season.
Alderman Bolger requested no signage be displayed at the intersection of North
Side and River Road in deference to the residents in the area. Mr. Kleinhans advised the
only signs requested would be a directional sign on Route 120, indicating access to Pro
Bass Shop in Northside Avenue and a sign on the building indicating which of the four
units on the premises is Pro Bass Shop.
Director of Community Development Napolitano suggested a limit be put on the size
of the directional sign permitted. Director Napolitano stated typically a directional sign on
a commercial property is 4 square feet with a height of no more than 3 feet. Because this
particular sign would be directing someone to a business offsite, he suggested two signs
no larger than 16 square feet each:
■ One sign located at 2913 W. Route 120; and
■ The other sign to be placed at 2920 Northside Avenue.

Motion by Bolger, seconded by Wimmer, to approve the temporary use for a Pro
Bass Shop at 2920 Northside Avenue, and permitting two signs of a size not to exceed 16
square feet each, one to be located at 2913 W. Route 120 and the other to be located at
2920 Northside Avenue, until January 1, 2003.

CITY OF MCHENRY WARD REDISTRICTING
Mayor Althoff noted the 2000 Census indicated a City population of 21,501.
Pursuant to State Statutes, the City is required to create two additional wards, as the
population exceeds 20,000. A Ward Redistricting Ad Hoc Committee was established and
chaired by Alderman Glab to research the redistricting from five to seven wards.
Alderman Glab stated the Ward Redistricting Ad Hoc Committee has met on three
occasions to consider various configurations for new ward district boundaries. Alderman
Glab summarized the process involved in reconfiguration from five wards to seven wards
noting, as required by statute, each of the seven wards specify a total populous within 1%
`— of each other. He stated natural boundaries were taken into consideration during the
review process, as was each alderman's close proximity to constituents in the ward
represented.
Alderman Low commended Alderman Glab and the Committee on their efforts.
Mayor Althoff noted the efforts of Building Commissioner Ryan Schwalenberg who spent a
great deal of time assisting Alderman Glab with number counts and interpretation of
Census software. Alderman Glab added his appreciation of Ryan Schwalenberg's efforts
and thanked his fellow Council members for their input and cooperation.
Alderman Bolger opined he was not pleased with the reconfiguration of the wards
and was unable to support a motion.
Motion by Murgatroyd, seconded by Wimmer, to direct Staff to prepare an ordinance
designating the boundaries for the seven newly-established aldermanic wards and to
approve the preparation of a land survey, if required, indicating the valid legal description
of each ward in an amount not to exceed $10,000.

In response to Alderman Murgatroyd's inquiry Mayor Althoff stated the new wards

BAXTER AND WOODMAN ENGINEERING SERVICES AGREEMENT FOR THE DESIGN
OF WATER PLANT NO. 5. IN AN AMOUNT NOT-TO-EXCEED $92,000
In attendance was Bob Benson of City Engineering consultant Baxter and
Woodman. Assistant Director of Public Works Marcinko informed Council Water Plant No.
5 would be located east of the river near the Adams water tower, possibly on Outlot B.
The treatment facility will be designed for 1,000 gallons per minute capacity; 500 gallons
per minute from City Well No. 11 and an additional 500 gallons per minute from a future
well located on the Gerstad Diedrich Farm. Assistant Director Marcinko noted a line item
for this project in the 2002-2003 Budget in the amount of $150,000. City Engineer Baxter
and Woodman's proposal is in the amount of$92,000.
Alderman Bolger opined $92,000 is high for the project. Assistant Director Marcinko
explained the high cost is due to the aeration system required because of the high iron and
sulfate content in the water in the ground east of the river. He stated this system would
provide a more efficient running plant.
Responding to Alderman Murgatroyd's inquiry, Bob Benson of Baxter and
Woodman, stated the high volume of iron and sulfates in the water necessitates the use of '1
this process in order to achieve the desired water quality.
In response to Alderman Wimmer's inquiry, Mr. Benson stated the contract calls for
completion of the design within 120 days. Mr. Benson stated the contract is an hourly
contract, in an amount not to exceed $92,000. If the man hours were not expended the
City would not be billed. Assistant Director of Public Works Marcinko noted the cost of the
plant construction is included in the 2002/2003 Budget.
Motion by Bolger, seconded by Murgatroyd, to approve the Mayor and City Clerk's
execution of an Engineering Services Agreement between Baxter & Woodman, Inc.
Consulting Engineers and the City of McHenry for the design of Water Plant No. 5, in an
amount not-to-exceed $92,000.

BAXTER AMD WOODMAN ENGINEERING SERVICES AGREEMENT FOR
EDGEBROOK DRAINAGE WAY PHASE 11, IN AN AMOUNT NOT-TO-EXCEED $36,000
Assistant Director of Public Works Marcinko reported Baxter and Woodman has
submitted an Engineering Services Agreement in the amount of $36,000 for completion of
the design and engineering of the Edgebrook Drainage Project, Phase II. Engineering for
Phase II consists of improvements of the Edgebrook Drainage Way between Front Street
and the entrance of the Edgebrook culvert. Assistant Director Marcinko stated this is the

second of three phases. Phase I was completed in 2001; Phase II will extend west of
Route 31. It was noted no time frame has yet been set for Phase III.
Assistant Director Marcinko noted the project is budgeted in the 2002/2003 Budget
in an amount of $396,000. He reminded Council 70% of the project is to be funded with
Community Development Block Grant funds in the amount of$179,662.
Motion by Bolger, seconded by Wimmer, to approve the Mayor and City Clerk's
execution of an Engineering Services Agreement for Edgebrook Drainage Project Phase II,
in amount not-to-exceed $36,000

AUTHORIZATION TO CONDUCT A PUBLIC HEARING BEFORE THE ZONING BOARD
OF APPEALS — TO COMBINE THE PLAN COMMISSION AND ZONING BOARD OF
APPEALS
Director of Community Development Napolitano reminded Council of previous
�-- discussions regarding the Mayor's intent to combine the City's Plan Commission and
Zoning Board of Appeals. He stated the intent is to allow for a more efficient development
process, fewer meetings and better coordination of information on new developments.
Director Napolitano noted if approved by Council, this would take effect with the beginning
of the fiscal year on May 1, 2002.
Director Napolitano noted Staff has been working with Attorney Kelly Cahill of
Zukowski, Rogers, Flood and McArdle, regarding the process involved in combining the
Boards. In summary:
1. An ordinance must be prepared to repeal the ordinances that created the Zoning
Board of Appeals and Planning Commission. A two-thirds vote of Council is
required to pass the ordinance.
2. The same ordinance creates the new combined Planning and Zoning Commission,
pursuant to statute.
3. A new chapter in the Municipal Code is created to outline the Commission's duties
and powers.
4. An amendment to the Zoning Ordinance is required to effectuate this change. A
Public Hearing is required. Council must pass the ordinance by a two-thirds vote.
Motion by Glab, seconded by Wimmer, to authorize Staff to prepare the necessary
`.. paperwork to hold a Public Hearing before the Zoning Board of Appeals to amend the
Zoning Ordinance repealing the Zoning Board of Appeals and creating the Planning and
Zoning Commission; and to prepare the ordinances necessary to amend the Municipal
Code to create the Planning and Zoning Commission.

MAYOR—STATEMENT AND REPORT
Mayor Althoff reported the Landmark Commission will be conducting an Open
House on April 4, 2002, inviting the public to discuss the designation of a Historic District
covering Main Street, John Street and Waukegan Road, from approximately Crystal Lake
Road to Green Street.
Mayor Althoff reminded Council the Household Hazardous Waste Collection Event
is scheduled for April 13, 2002 from 8:00 a.m. to 3:00 p.m. McHenry County College is
hosting the event and everyone is encouraged to participate. Mayor Althoff expressed her
appreciation of Council's co-sponsorship of the event.
Mayor Althoff stated a Joint Review Board for the Tax Increments Financing District
would be held on February 26, 2002 at 10:00 a.m. in the Council Chambers.
Mayor Althoff advised Council the City would be conducting liquor control hearings
on February 21, 2002 before the Liquor Control Commission. The hearings will be
conducted at 4:00 p.m. in the Aldermen's Conference Room and concerned three
establishments which were caught serving alcohol to minors on February 8, 2002.

DEPARTMENT HEAD REPORTS
Assistant Director of Public Works Marcinko informed Council the week of March 4,
2002, George Kennedy intends to begin construction of the lift station for the North
Interceptor Sewer Project. The completion date for the project is May 1, 2002; however,
Assistant Director Marcinko opined it is unlikely they will meet that completion date.
Director of Community Development Napolitano reported on February 12, 2002 the
City received a permit request to remove the underground storage tanks at the former
Handy Pantry site at 4502 West Elm Street. Upon issuance of the permit, five tanks were
removed. Several soil samples were taken to determine the extent of contamination.
Results from the soil samples are expected in 30 to 60 days, and remediation will begin
immediately thereafter. Director Napolitano informed Council discussions have taken
place with the new owner concerning future development on the site.
City Clerk Jones requested Council's approval of the expenditure of $100.00 each
for retirement gifts to .he presented to Director of Public Works Batt and Deputy Chief
Donahue at the retirement dinner scheduled on Friday, March 1, 2002.

City Administrator Lobaito reminded Council he will be bringing the Capital Projects
rankings before Council at the regular meeting scheduled for March 11, 2002. He has
received elected official's response and is awaiting those remaining.
City Administrator Lobaito informed Council the first meeting has been scheduled to
review the Budget with the Chairman of the Finance and Personnel Committee. The
meeting has been scheduled for February 26, 2002. City Administrator Lobaito stated the
Budget is on schedule and should be ready to bring before the entire Finance and
Personnel Committee the last two weeks in March.
NEW BUSINESS
Alderman Low stated she has received a request from Patrick Summers, owner of
After the Fox on Riverside Drive. Mr. Summers is requesting Council consider additional
parking on the east side of Riverside Drive to facilitate his business. Alderman Low
requested the matter be discussed at the next Public Works Committee meeting.

discuss Property Acquisition.
