At roll call the following Aldermen were present: Bolger, Glab, Low, Murgatroyd, Wimmer. Absent: None. City Staff in attendance were: City Administrator Lobaito, City Clerk Jones, City Attorney McArdle, Director Public Works Marcinko, Director Community Development Napolitano and Director Parks and Recreation Merkel. Absent: Deputy Chief of Police Donahue, TEN MINUTE PUBLIC INPUT No one signed in to speak during the Ten Minute Public Input Session. CONSENT AGENDA Responding to Alderman Murgatroyd's request for clarification regarding additional engineering fees for Baxter & Woodman in the amount of$5,400, Director of Public Works Marcinko stated the expense was incurred by Baxter & Woodman while construction was underway and overlooked while closing out the file. REQUEST FOR USE OF PETERSEN PARK FOR ANNUAL CARNIVAL BY MCH LIONSENRY Director of Parks and Recreation Merkel informed Council the McHenry Lions Club is again requesting the use of Petersen Park for their annual Carnival, scheduled to take place June 5, 2002 through June 9, 2002. The Carnival is the Lions Club principal fundraiser and benefits individuals who are sight or hearing impaired. Director Merkel stated the Lion's Club requested park rental fees and sign permit fees be waived. Advertising signs would be posted at the following locations: • Route 31 and McCullom Lake Road • Route 120 and Ringwood Road • Route 31 and Pearl Street • Route 120 (on Bykowski Property) • Route 31 and High Street Alderman Glab opined the event benefited a worthwhile cause. He stated the signs should be erected no sooner than two weeks prior to the event and removed the day following the Carnival. Motion by Bolger, seconded by Wimmer, to approve the use of Petersen Park for their annual carnival on June 2, 2002 through June 5, 2002, March 18, 2002 Page 6 to grant a permit to allow the erection of temporary advertising signs at the following locations, subject to the condition that the signs be erected no more than two weeks prior to the event and removed the day following the event, and that all fees associated with the use be waived: • Route 31 and McCullom Lake Road • Route 120 and Ringwood Road • Route 31 and Pearl Street • Route 120 (on Bykowski Property) • Route 31 and High Street. REQUEST FOR SIGN VARIANCE AMERICAN COMMUNITY BANK 1500 SOUTH ROUTE 31 In attendance was Mr. Frank Leo of Innovative Sign Design. Mr. Leo addressed Council stating a variance is requested to allow a freestanding sign having a height of 8 _. feet, rather than the permitted 6 feet. Mr. Leo noted the design of the sign is consistent with the design used at other American Community Bank locations and the additional height permits installation of landscaping at the base without negatively impacting the visibility of the sign. Responding to Alderman Glab's inquiry regarding how placement of the sign might affect Albany Drive should Route 31 be widened in the future, City Attorney McArdle opined the parties could stipulate the sign must be a minimum of 20.4 feet from the right of way. Mr. Leo assured Council adjustments would be initiated, prior to installation of the sign, to ensure the sign would be a minimum of 20.4 feet from the right-of-way. Motion by Bolger, seconded by Glab, to approve the request for a sign variance to permit an 8' high monument sign for American Community Bank located at 1500 South Route 31. Voting Aye: Bolger, Glab, Low, Murgatroyd, Wimmer. Voting Nay: None. Absent: None. Motion carried. REQUEST FOR CONDITIONAL USE PERMIT FOR OUTDOOR STORAGE OF VEHICLES AND TRAILERS AND VARIANCE TO THE MINIMUM LOT WIDTH REQUIRED IN THE 1-1 ZONING DISTRICT CORNERSTONE MATERIAL RECOVERY Mr. Steve Clements, owner and operator of Cornerstone Material Recovery, was in attendance and addressed Council. He noted extensive cleanup of the site has been done. He indicated he would like to construct a metal building and utilize the property to relocate March 18, 2002 Page 7 their business which is currently sited in Richmond. Director of Community Development Napolitano stated the property is designated as medium-density residential and commercial according to the City of McHenry Comprehensive Plan. Staff feels the use proposed by Cornerstone Material Recovery is good use at the present time. He noted some vehicles and trailers might be stored periodically at the subject property for repair or temporary holding purposes. Any vehicles will be setback at least 670 feet from Bull Valley Road and would not be visible from the roadway. Director Napolitano stated the Applicant is seeking a variance, as the lot width at the front building line is only 14 to 16 feet. The Zoning Ordinance requires a 200-foot minimum lot width along an arterial street. The gravel driveway is part of the subject property. The driveway cannot be expanded at this time due to adjacent business buildings abutting the driveway. The drive provides access from Bull Valley Road for several adjacent businesses. Mayor Althoff noted the unanimous recommendation of the Zoning Board of Appeals following a Public Hearing held on February 21, 2002, subject to the following conditions, and inquired if Applicant was willing to comply with the following five conditions: 1. The property shall be cleared of all debris and inoperable vehicles and/or equipment 2. There shall be no storage of anything other than vehicles or trailers on the property; 3. The applicant shall be required to meet the requirements of all City ordinances, including, but not limited to, paving, parking and signage; 4. The applicant shall permit the City of McHenry to drop off unwanted wood or metal items for disposal at the subject property; and 5. The conditional use permit shall be granted for a period of seven years, with yearly renewals thereafter, at which time, the applicant shall be required to come before the City Council to discuss future options with the City. Applicant stated his willingness to comply with the conditions imposed by the Zoning Board of Appeals. Alderman Bolger opined the appearance of the property has greatly improved, but expressed concern with Item No. 2. Responding to Alderman Bolger's concern, Mr. Clements stated there is a trailer on the premises used for storage of items dropped off for salvage. When the trailer becomes full it is hauled away for disposal. Motion by Glab, seconded by Bolger, to approve the Conditional Use Permit for the outdoor storage of vehicles and trailers, and a variance for the minimum lot width required -� in the 1-1 zoning district To Cornerstone Material Recovery, subject to the following conditions: I. The property shall be cleared of all debris and inoperable vehicles and/or March 18, 2002 Page 8 equipment 2. There shall be no storage of any thing other than vehicles or trailers on the property; 3. The applicant shall be required to meet the requirements of all City ordinances, including, but not limited to, paving, parking and signage; 4. DISCUSSION REGARDING NO RIGHT TURN ON RED FROM PEARL STREET ONTO NORTH RICHMOND ROAD --- Director of Public Works Marcinko summarized a proposed amendment to the Traffic Code for a no right turn on red at Pearl Street and Richmond Road. Director Marcinko stated this proposed amendment was initially presented to Council at its March 1, 2000 regularly scheduled meeting. Motion was made and died for lack of a second to amend the Traffic Code by prohibiting right turns on red at this intersection. Director Marcinko noted the issue was discussed at a Public Works Committee meeting in October 2001, assuming Riverside Drive would be completed and the impact of construction and rerouting of traffic onto Route 31 would be finished. Director Marcinko noted at the Public Works Committee meeting held this evening it was indicated Riverside Drive would not be completed until late May, 2002. Director Marcinko suggested the matter be revisited following completion of work on Riverside Drive. It was the consensus of Council to direct Staff to provide Council with information for review, and the subject of no right turn on red at Pearl Street and Richmond Road be revisited in September 2002, following completion of the work on Riverside Drive DISCUSSION REGARDING CAPITAL IMPROVEMENT PROJECTS PRIORITY LIST City Administrator Lobaito addressed Council stating a list has been compiled from the information received from the Mayor and City Council regarding the priority ranking of proposed Capital Improvement Projects for 2002/2003. City Administrator Lobaito informed Council the projects were divided into two categories, Non-Enterprise and Enterprise. Non-Enterprise projects would be funded through a variety of revenue sources, predominantly. General Fund revenues, with few exceptions. March 18, 2002 Page 9 The following Non-Enterprise Fund Projects were previously approved by Council or are in progress carried over from a prior year: • Edgebrook Drainage— Phase II • Riverwalk o Fund allocated to comply with a Grant for matching funds • Maple and Leonard Sidewalk • Route 120 Street Lights • Street Improvements Program • Traffic Signal — Royal & Crystal Lake Road Prioritizing the remaining Non-Enterprise Fund Projects was based on a series of point totals and projects were ranked accordingly: • Veterans Park Electrical o Will include Whispering Oaks electrical improvements • Traffic Signal —Winding Creek and Crystal Lake Road • Public Safety Radio Infrastructure Improvements • Lakeland Park— Box Culvert, Meadow • Petersen Park Beach Expansion • Public Works Garage • Access Drive — Knox Park, Municipal Center • Playground Renovations o Funded from the Developer Park Donation Fund • Civil Defense Sirens • Freund Field Improvements • Olde Mill Ponds Bridge, Lot 106 • Bull Valley Drainage Improvements • Recreation Center o Funded from the Recreation Center Reserve Fund • South Riverfront Park Bridge • McHenry Zone Skate Park Lights The following Enterprise Fund projects are funded from revenues of the Water/Sewer Fund, Capital Development Fund and bond proceeds repaid over time by revenues of the Water/Sewer Fund. The only exception would be the purchase of the McHenry Shores Water Company. If Council decides to purchase the system, Staff recommended a special service area be created to generate the necessary revenue to purchase the utility system. • North Interceptor Sewer (approved) • Sioux Lane Elevated Tank Painting • Design and Construction of Water Plant No. 5 (East of Fox River) -� CWWTP Expansion & Nitrification • SWWTP Expansion • Construction of Well #12 March 18, 2002 Page 10 • Main Street Sanitary Sewer • Water Utility Purchase • Design, Elevated Water Tank (West) • Water Source Study City Administrator Lobaito stated the specific funding amount for the Capital Improvement Plan (CIP) for Fiscal Year 2002/2003 has yet to be determined. The Finance and Personnel Committee is scheduled to meet on March 201h and March 27th to discuss the proposed Fiscal Year 2002/2003 Budget. Based on available funds and funding sources, projects will be removed from the CIP, starting with the lowest priority project, until the budget is balanced. Alderman Murgatroyd opined the ranking is not definitive, but merely a tool to utilize while setting the budget. It was the consensus of Council to continue discussions regarding the priority ranking of the Capital Improvements Projects at the March 20, 2002 and March 27, 2002 Finance and Personnel Committee Meetings. BOUNDARY AGREEMENT BETWEEN THE CITY OF MCHENRY AND THE VILLAGE OF MCCULLUM LAKE Mayor Althoff informed Council the Village of McCullom Lake trustees approved the proposed Boundary Agreement at their village meeting held on March 12, 2002. She noted the last revised proposed boundary map was distributed to the Council on October 11, 2001. At that time the north end of the Voss Property was inadvertently omitted from the MCCullom Lake boundary area. The oversight has been corrected. In response to an inquiry, Mayor Althoff stated the City makes no representation to provide sanitary sewer services during annexation discussions. Following a lengthy discussion regarding ownership of the lakebed of McCullom Lake, Director Merkel stated a portion of the lakebed is owned by the Village of McCullom Lake and a portion is owned by individual lakeside property owners, as determined by a lake study performed in 1995. Motion by Bolger, seconded by Low, to approve Clerk's execution of a Boundary Agreement between the City of McHenry and the VillageI ty of McCullom Lake. Voting Aye: Bolger, Glab, Low, Wimmer. MAYOR - STATEMENT AND REPORT Mayor Althoff notified Council the Intergovernmental Agreement on the McCollum March 18, 2002 Page 11 Lake sanitary sewer service will be brought before Council at the regular Council meeting scheduled for April 1, 2002. 9 Mayor Althoff informed Council she received a letter from the McHenry Township Fire Protection District requesting use of Petersen Park on Saturday, June 15, 2002, for a fundraising event entitled "Party in the Park II and waiving of all associated fees. Mayor Althoff stated the Fire District will utilize the event to raise money to send children, who are burn victims, to a summer camp. Alderman Low stated she attended the first Party in the Park and was impressed with the event. Motion by Low, seconded by Glab, to approve the request by the McHenry Fire Protection District to use Petersen Park for a fundraising event on Saturday, June 15, 2002 and to waive all associated fees. Mayor Althoff reminded Council at the end of the Committee of the Whole meeting on March 7, 2002, regarding Meyer Material, Staff was given direction to obtain and provide Council with findings. Mayor Althoff requested direction on how Council would like to address the findings, suggesting: • Committee of the Whole Meeting; • Special Meeting; or • An Agenda Item at a regular Council Meeting Alderman Bolger suggested the matter be discussed as an Agenda Item at a re ul Council Meeting. Alderman Murgatroyd concurred with Alderman Bolger. 9 ar Alderman Glab opined the issue is substantial and requires a meeting of its own. Alderman Low concurred with Alderman Glab, noting the discussions might be lengthy. Alderman Wimmer concurred with Aldermen Bolger and Murgatroyd so long as there was sufficient time to discuss the issues. It was the consensus of Council to address Staffs findings resulting from issues brought forth at the Committee of the Whole meeting held on March 7, 2002 as an Agenda Item at a regularly scheduled Council Meeting. COMMITTEE REPORTS Finance and Personnel Committee Chairman Alderman Murgatroyd informed Council two Finance and Personnel Committee meetings have been scheduled, one on March 18, 2002 Page 12 March 20, 2002 at 7:00 p.m. in the Aldermen Conference Room and the other on March 27, 2002 at 7:00 p.m. in the Aldermen Conference Room to discuss the 2002-2003 Budget. DEPARTMENT HEAD REPORTS Director of Parks and Recreation Merkel informed Council on the subject of discussions with the McHenry Fire Protection District regarding Party in the Park II. Director Merkel stated the event has not been held in a few years and it is the intent of the Fire District to stage an event, which includes a national music group, food vendors and alcohol sales. Director Merkel opined anticipation is something on the level of Fiesta Days Big Band Night. Alderman Low stated the original motion was based upon information provided to Council. She expressed concerns regarding the magnitude of the event and the impact on Staff. She requested more definitive information prior to approval. Mayor Althoff suggested Director Merkel meet with the McHenry Fire Protection District informing them of Council's tentative approval pending receipt of additional information. Motion by Low, seconded by Glab, to withdraw the motion to approve the request by the McHenry Fire Protection District to use Petersen Park for a fundraising event on Saturday, June 15, 2002 and to waive all associated fees; and to direct Staff to expeditiously provide Council with definitive information regarding the event. Director of Community Development Napolitano reported the building, which previously housed Laguna Hair Tech, was demolished over the weekend. Council went back into Open Session at 9:14 p.m. Motion by Bolger, seconded by Wimmer, to approve out-of-class to Anne Kranz to pay for Senior Accountant activities in February 2002 in the amount of $255.65 and to continue to compensate Ms. Kranz an additional $4.37 per hour when performing those duties, the difference between her current rate of Grade 4 and Grade 14, the rate for an entry level Senior Accountant Position, until the position is filled.
