Amending Title 7: Motor Vehicles and Traffic; Chapter 4: Parking Regulations,
Section 7-4-7: Permit Parking Only, of the McHenry City Code
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule
municipality as contemplated under Article VII, Section 6, of the Constitution of the State of
Illinois, and the passage of this Ordinance constitutes an exercise of the City's home rule
powers and functions as granted in the Constitution of the State of Illinois.
NOW, THEREFORE BE IT ORDAINED by the City Council of the City of
McHenry, McHenry County, Illinois, as follows:
SECTION 1: Section 7-4-7, Subsection C. Snowfall, shall be renumbered to
Subsection 7-4-7, Subsection D. Snowfall.
SECTION 2: Section 7-4-7, Subsection B, shall be amended as follows:
B. Lease; Fee – Residential Permit Parking: Residential Permit Parking allows parking without
4-hour restrictions or overnight restrictions. Proof of residency is required. The parking spaces
specified in subsection A of this section may be leased for a twelve (12) month calendar year, with
an annual rental fee of sixty dollars ($60.00) each, payable in advance. Permits purchased after July
1 of any calendar year shall have a rental fee of thirty dollars ($30.00) each, and will not be
prorated further. Annual permits will be made available for purchase on December 1 of the
preceding year and shall be available on a first-come, first-served basis. No portion of this permit
shall be refundable under any circumstances.
SECTION 3: Section 7-4-7, Subsection C, shall be amended as follows:
C. Lease; Fee – Business Employee Permit Parking: Business Employee Permit Parking allows
for parking without 4-hour restrictions but does not allow for overnight parking. Proof of
employment is required. The parking spaces specified in subsection A of this section may be leased
for a twelve (12) month calendar year, with an annual rental fee of ten dollars ($10.00) each,
payable in advance. Permits purchased after July 1 of any calendar year shall have a rental fee of
five dollars ($5.00) each, and will not be prorated further. Annual permits will be made available
for purchase on December 1 of the preceding year and shall be available on a first-come, first-
served basis. No portion of this permit shall be refundable under any circumstances.
SECTION 4: If any section, paragraph, subdivision, clause, sentence or provision of
this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such
judgment shall not effect, impair, invalidate or nullify the remainder thereof, which remainder
shall remain and continue in full force and effect.
SECTION 5: All ordinances, or parts thereof, in conflict herewith are hereby repealed
to the extent of such conflict.
SECTION 6: This ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, Illinois.
SECTION 7: This ordinance shall be in full force and effect from and after its
passage, approval and publication, as provided by law.
