MAY 13, 2002
The Regular Meeting of the McHenry City Council was called to order by Mayor
Althoff, at 7:30 P.M. on Monday, May 13, 2002 in the Council Chambers of the Municipal
Center. At roll call the following Aldermen were present: Bolger, Glab, Low, Murgatroyd
and Wimmer. Absent: None. City Staff in attendance were: City Administrator Lobaito,
Assistant Administrator Lockerby, City Clerk Jones, City Attorney McArdle, Director Public
Works Marcinko, Director Community Development Napolitano, Director Parks and
Recreation Merkel and Chief of Police O'Meara. Absent: None.
TEN MINUTE PUBLIC INPUT
Mr. Ken Kolk, a resident of 4708 Overland Trail, addressed Council, expressing
concern regarding traffic congestion. Mayor Althoff requested patience from residents and
announced Riverside Drive will reopen on May 24, 2002, which will aid the traffic
conditions.
Mr. Paul Legare, representing the Carson & Barnes Circus, addressed Council,
requesting to be added to the Agenda of the Council Meeting to be held on May 20, 2002.
He stated the purpose of the request is to seek permission from the City of McHenry to use
Petersen Park to perform two shows on Wednesday, June 19, 2002.
Motion by Bolger, seconded by Wimmer, to add the request of Carson & Barnes
Circus for the use of Petersen Park as an Agenda Item for the May 20, 2002 Council
meeting.
Voting Aye: Bolger, Low, Murgatroyd, Wimmer.
Voting Nay: Glab.
Absent: None

REQUEST FOR CONDITIONAL USE FOR OUTDOOR DISPLAY - ADAMS OUTDOOR
POWER EQUIPMENT, 3107 WEST ROUTE 120
Attorney James Cowlin of Cowlin and Cowlin, representing applicant Gary Adams of
Adams Outdoor Power Equipment, addressed Council. Mr. Cowlin stated Adams Outdoor _
Power Equipment would like to relocate their existing business to 3107 West Route 120.
Mr. Cowlin stated, addressing Staffs concerns with regard to aesthetics noted the
applicant has provided a landscaping plan, adding 11 mugo pines in two beds of cypress

mulch. Additionally, the applicant has agreed to provide landscaping around the perimeter
of the sign, as required by the Zoning Board of Appeals.
At its Public Hearing held on April 18, 2002, the Zoning Board of Appeals
unanimously recommended approval of the following:
• Outdoor display of lawn tractors for retail sale;
• Outdoor display of storage shed for retail sale;
• Outdoor storage of LP gas for retail sale.
subject to the following conditions:
1. Only 6 new lawn tractors shall be displayed in the front yard, located as
depicted on the site plan submitted with the Petition;
2. Only one new 8' x 12' shed shall be displayed to the east of the entrance as
depicted on the site plan submitted with the Petition;
3. Eleven mugo pines shall be planted in two beds of cypress mulch, as
depicted on the site plan submitted with the Petition;
4. Landscaping, in the forms of various ground cover and flower beds shall be
planted around the entire perimeter area of the sing on the subject property;
5. No parking spaces shall be utilized for anything other than customer parking;
6. Two evergreen shrubs with a maximum height of 3' shall be planted: one on
the northwest corner and one on the northeast corner of the shed;
7. The lawn tractors shall be displayed in a staggered fashion.
Mr. Cowlin advised Council the shed is changed-out annually as the new models
arrive for display.
Motion by Glab, seconded by Low, to direct Staff to draft an ordinance granting the
following:
■ a conditional use permit to allow for the outdoor display of lawn tractors and
storage sheds for purposes of sale; and
■ a conditional use permit for bulk fuel storage for liquid propane gas;
at 3107 West Route 120, subject to the following conditions:

REQUEST FOR SIGN VARIANCE - APPLEBEE'S NEIGHBORHOOD GRILL-AND BAR,
1700 NORTH RICHMOND ROAD
Ms. Barbara Wells, vice-president in charge of architectural services, on behalf of
the Applebee's Neighborhood Grill and Bar, addressed Council requesting a sign variance.
Ms. Wells noted the location of the building is such that visibility of the business is blocked
if approaching the site from a southerly direction. Applebee's currently has two wall signs,
on the west fagade and north fagade, totaling 93 square feet. Ms. Wells stated since the
opening of Applebee's, seven years ago, several competitors have opened. businesses in
the vicinity. Applebee's is requesting the same consideration provided their competitors
located along Route 31.
Director of Community Development Napolitano informed Council the additional
freestanding sign is being requested for several reasons. He noted Applebee's location is
lower than Route 31 and visibility northbound is severely limited. Applebee's is unable to
advertise on the existing freestanding sign for the shopping center as those spaces are
reserved for the in-line stores.
Responding to Alderman Murgatroyd's inquiry Director Napolitano stated the
monument sign would be located 150' south of the driveway and noted a provision for a
vision clearance triangle in the Ordinance, assuring no impact on sight lines.
Alderman Bolger agreed with Director Napolitano and noted he would have no
difficulty supporting a monument sign for Applebee's. Alderman Murgatroyd concurred
with Alderman Bolger opining each situation should be reviewed on an individual basis.
Alderman Low concurred with Aldermen Bolger and Murgatroyd. Lengthy discussion
ensued regarding the necessity of a monument sign and the size of the sign requested.
Motion by Bolger, seconded by Low, to approve a variance to allow a monument
sign for Applebee's Neighborhood Grill and Bar, 1700 North Richmond Road, not to
exceed 6' in height incorporating the "apple" into the apostrophy, with a maximum area of
33.75 square feet, as approved by Staff.
Voting Aye: Bolger, Low, Murgatroyd, Wimmer.
Voting Nay: Glab.

MAYOR - STATEMENT AND REPORT
Mayor Althoff informed Council she attended a function at Northern Illinois Medical
Center, a division of Centegra, in celebration of National Hospital Week.
COMMITTEE REPORTS
Alderman Low informed Council of a Parks and Recreation Meeting scheduled for
Thursday, May 16, 2002, at 7:00 p.m. in the Alderman's Conference Room.

DEPARTMENT HEAD REPORTS
Director of Public Works Marcinko stated the McHenry Country Club Sanitary Sewer
Project begins tomorrow. Completion is anticipated by May 31, 2002 according to
contract.
Director of Community Development Napolitano informed Council Meijers Fresh
Store is scheduled to open on Tuesday, May 21, 2002. The ribbon cutting will take place
at 6:45 a.m. on May 21, 2002.
City Administrator Lobaito introduced Assistant City Administrator John Lockerby.
Mr. Lockerby began his employment today and comes to McHenry from the City of
Woodridge where he spent six years in the administration office.
City Administrator Lobaito noted City Clerk Jones attended an informational meeting
regarding the West Nile Virus. He noted the matter is being monitored and information will
be passed on if inquiries are received. City Administrator Lobaito stated a Public
Information Meeting is scheduled for May 22, 2002 at McHenry County College.
City Administrator Lobaito informed Council bids were accepted today for the bond
sale on the $3.9 million Alternate Revenue Bonds for the Edgebrook Drainage Project and
the North Interceptor Sewer Project. Of the nine bids received, Robert W. Baird of
Milwaukee, Wisconsin was the low bid was at 4.29%. City Administrator Lobaito noted the
Bond Ordinance would be brought to Council at the regular Council meeting scheduled for
May 20, 2002. Proceeds from the bonds should be received by the end of the month.
City Clerk Jones informed Council addressing Alderman Glab's request regarding
clarification of the Solicitation Ordinance, copies of ordinances have been received from
four surrounding municipalities. Copies will be provided to Staff for review and comment.
