HomeMy WebLinkAboutMinutes - 07/15/2002 - City Council REGULAR MEETING JULY 15, 2002 The Regular Meeting of the McHenry City Council was called to order by Mayor Althoff at 7:30 P.M. on Monday, July 15, 2002 in the Council Chambers of the Municipal Center. At roll call the following Aldermen were present: Bolger, Glab, Low, Murgatroyd and Wimmer. Absent: None. City Staff in attendance were: City Administrator Lobaito, Assistant Administrator Lockerby, City Clerk Jones, City Attorney McArdle, Director Public Works Marcinko, Director Parks and Recreation Merkel and Chief of Police O'Meara. Absent: Director Community Development Napolitano. PRESENTATION Mayor Althoff announced on June 25, 2002 in Springfield, Illinois, the City of McHenry was presented with the Governor's Home Town Award for the McHenry Zone Skate Park. Mayor Althoff introduced Carol Chrisman and Bud Smith of the McHenry Zone Skate Park Committee. Mr. Smith stated McHenry won in Category V for communities with a population of 17,002 to 24,000. McHenry took second place overall in the State of Illinois Governor's Cup Award. Mr. Smith noted the Skate Park was built for the children of McHenry and it was fitting the children present the Governor's Home Town Award to the City of McHenry. He announced the children of McHenry worked diligently on the project and expressed great pride in receiving the award and presenting it to the City of McHenry. Mayor Althoff extended congratulations on winning the award and stated she was honored to accept the award on behalf of the City of McHenry. INTRODUCTION OF NEW EMPLOYEES Mayor Althoff introduced the following new employees: • Christopher Etten, Parks & Recreation Department • Timothy Harris, Information Technology, Administration Department • Bijal Maniar, Senior Accountant, Administration Department • Erin Montressor, Dispatcher, Police Department Chief of Police O'Meara announced Ms. Montressor began employment with the Police Department on July 10, 2002, stating he hopes she plans to remain in the employ of the City for many years. Assistant City Administrator Lockerby noted Ms. Maniar and Mr. Hams have both been employed by the City for at least a month and have already made contributions. He expressed pleasure both are on staff. Director of Park and Recreation Merkel noted Mr. Etten, in prior years, has worked for the City as a part-time seasonal employee during his years in school. Following graduation he applied for a full-time position making his career choice. July 15, 2002 Page 2 -t PUBLIC HEARING TO CONSIDER A REQUEST FROM C &A LEASING CORPORATION FOR AN ANNEXATION AGREEMENT; VACATION OF A PORTION OF HILL STREET; REZONING FROM ESTATE DISTRICT TO 1-1 INDUSTRIAL DISTRICT; CONDITIONAL USE PERMIT TO ALLOW FOR THE OUTSIDE STORAGE OF RECREATIONAL VEHICLES Mayor Althoff at 7:42 p.m. called to order the rescheduled Public Hearing originally set for July 1, 2002, regarding C &A Leasing Corporation's request for the following: • Annexation Agreement and request for annexation; • Vacation of a portion of Hill Street; • Rezoning from Estate District to 1-1 Industrial District; • Granting of a Conditional Use Permit to allow for the outside storage of recreational vehicles. In attendance were Applicant, Allen Miller and Attorney Mark Saladin from Militello, Zanck & Coen. Attorney Saladin addressed Council stating C&A Leasing Corporation proposes to construct and operate a business, which would be used for the outside storage of vehicles. The proposed property is currently zoned 1-1, Light Industrial in McHenry County. Mr. Saladin advised the Applicant is requesting annexation and rezoning to 1-1, Industrial .— District in the City of McHenry. Mr. Saladin advised the Petitioner is seeking to annex only 3.69 acres of property as 4.34 acres is already within City limits. The Petitioner proposes to combine the property currently within City limits with the property to be annexed to form the subject property zoned as 1-1 for the outside storage of recreational vehicles. The subject property is located on south of Illinois Route 120 and West of Draper Road. Access to the property would be off an existing private road. Mr. Saladin noted Petitioner has addressed Staffs concerns related to security and aesthetics of the property in the Annexation Agreement. Mr. Saladin advised Council a tree survey has been performed on the property. Responding to Alderman Murgatroyd's inquiry regarding Hill Street, Allen Miller stated it was platted in 1961 as an industrial subdivision in McHenry County. At the time the property was platted a portion of the street was not built, and the area to the east was used for settling basins for the gravel pit. The land is no longer suitable for a street and with the filling in of the school bus lot there are a number of elevation changes. With a 25- foot grade change to the east, the Applicant feels the property is better served if it accessed from the private road off of Draper Road. Mr. Miller stated the fence would consist of an 8-foot to 10-foot chain link fence inside the property line, with the existing trees outside the fence. Responding to Alderman Wimmer's inquiry Mr. Miller stated there would be no offices located on the property and the gate would be electronic and operated by a keycard. July 15, 2002 Page 3 __.. Alderman Low inquired if the property to be annexed included part of the private driveway. Mr. Miller responded affirmatively. Following Mr. Miller's explanations regarding landscaping, Alderman Low noted the Applicant has addressed the landscaping issues adequately and stated she has no problem with the use of the property. Mr. Miller informed Council there would be approximately 240 slots available for storage. Alderman Glab opined he would like the entire driveway to be located within the City limits. Additionally, Alderman Glab expressed concerns regarding use of the property when the proposed West McHenry Bypass is constructed. Alderman Glab expressed concerns regarding the property draining through and eventually ending up in the Lakeland Park drainage area running through Lakeland Park. Mr. Miller opined the property drains down Draper Road to the south to Boone Creek. Responding to Alderman Murgatroyd's inquiry regarding landscaping issues, City Attorney McArdle stated language would be inserted in the Annexation Agreement referencing pre-approval of the landscaping plan by City Staff. Alderman Glab requested the issues regarding drainage routes be researched by Staff, and information provided Council in the Friday Report. Responding to Alderman Glab's inquiry Mr. Miller responded Hill Street is a deadend street, which has never been improved. Mayor Althoff noted the issue regarding the vacation of the road and payment needs to be addressed by Council. Responding to Alderman Low's inquiry City Administrator Lobaito stated the circumstances of this situation are unique regarding payment for vacation of the road due to the fact many years have elapsed, and the vacation is being requested by the same family that owned the property at the time it was donated to the City for a right-of-way. Alderman Low opined she did not believe the Petitioner should be required to pay a fee for vacation of the property. Alderman Glab concurred with Alderman Low. It was the ` consensus of Council to insert language in the Annexation Agreement stating as long as the property remains zoned Industrial there will be no fees required for the vacation of a portion of Hill Street. Mayor Althoff inquired whether the audience had comment regarding the annexation. No one in the audience had comment or questions. Responding to Mayor 1--Althoffs inquiry, City Clerk Jones stated no written or verbal comments/questions had been received regarding this matter July 15, 2002 Page 4 Motion by Bolger, seconded by Low to close the Public Hearing at 8:21 p.m. Voting Aye: Bolger, Glab, Low, Murgatroyd, Wimmer. Voting Nay: None. Absent None Motion carried. Motion by Bolger, seconded by Wimmer, to direct Staff to prepare the appropriate ordinances providing for the following for C&A Leasing Corporation: • Authorizing an Annexation Agreement; • Annexation; • Vacation of a portion of Hill Street; • Rezoning from Estate District to 1-1 Industrial District. DISTRIBUTION OF SEMI-ANNUAL DEVELOPER DONATIONS TO TAXING DISTRICTS Mayor Althoff announced the semi-annual distribution of Developer Donations to taxing districts has been withdrawn from the Agenda and will be rescheduled for the Regular City Council Meeting on July 29, 2002. REQUEST FOR FENCE VARIANCE FROM CORNER SIDE YARD SETBACK AT 602 SOUTH HILLTOP AVENUE City Administrator Lobaito stated Petitioners Dale and Nora Brown were not in the audience. He informed Council the Petitioners reside at 602 S. Hilltop and are requesting a variance to allow the installation of a 3-6 foot high decorative, wood picket fence in their corner side yard. He noted the City ordinance provides that any fence in a front or corner side yard must be limited to a 3-foot high split rail fence. Petitioners are specifically requesting a picket fence. Alderman Glab opined ordinances are created and should be enforced. He strongly objected to setting precedence whenever a resident requests a variance. Alderman Glab requested review of the ordinance at a Community Development Committee meeting. Alderman Low opined Staff and Council are adhering to procedure and each request is reviewed on individual merit. Staff stated support for the variance for the fence, noting the height, style and setback of the proposed fence does not pose a problem to vehicular sight lines on the property or at the street intersection. Motion by Bolger, seconded by Low, to approve a variance to allow a 3'-6' wooden, picket fence in the corner side yard on the property located at 602 S. Hilltop, as presented. July 15, 2002 Page 12 RECOMMENDATION TO INCREASE THE FEE CHARGED FOR BULK WATER USE Mayor Althoff stated bulk water is sold primarily to landscaping and swimming pool contractors. Water tickets are purchased at the administrative offices and the contractor presents the tickets at the City garage where the water is pumped into a tanker truck. She noted the current fee charged for 2,000 gallons is $10.00. Community Development Committee Chairman Alderman Wimmer informed Council at the June 26, 2002 Community Development Committee meeting the Committee recommended the City increase the rates charged for the sale of bulk water as follows: ■ 500 gallons $25.00 ■ 1,000 gallons $50.00 ■ 2,000 gallons $75.00 It was the consensus of the Committee that current charges do not adequately cover Staff costs associated with providing this service. The Committee recommended the rates be reviewed every two years. Following passage of the ordinance, Staff will draft a letter to affected contractors informing them of the rate increase. PAYMENT TO RUBLOFF DEVELOPMENT FOR 50/50 COST SHARE FOR MCCULLUM LAKE ROAD IMPROVEMENTS IN AN AMOUNT NOT TO EXCEED 62 342.83 Mayor Althoff informed Council in conjunction with the Rubloff Development commercial project on North Richmond Road, the developer was required to make certain improvements to McCullom Lake Road. The improvements included the installation of traffic signals and widening of McCullom Lake Road to three lames at the new intersection. Mayor Althoff stated as plans progressed Staff received plans from the City Engineer for the State Route 31/McCullom Lake Road Intersection Project. It was discovered, upon review of the plans, that the limits of the City's intersection project ended 312 feet short of the developer's improvements to McCullom Lake Road. In order to facilitate motor vehicle safety and avoid leaving a segment of McCullom Lake Road unimproved, an agreement was reached with Rubloff Development to share 50% of the cost to improve the omitted segment of McCullom Lake Road and to include it in Rubloffs improvement plan. The cost of the project $124,685.66, was reviewed and approved by the City Engineer as being a reasonable cost for the project. In the spring of 2002 the project was completed. Staff has inspected and approved the improvements and Rubloff July 15, 2002 Page 13 McHenry, LLC is requesting payment of the agreed upon 50% of the project cost, -- $62,342.83. Mayor Althoff informed Council funds necessary to pay the expense have been accounted for in the State Route 31/McCullom Lake Road Intersection Improvements Project Fund. Motion by Murgatroyd, seconded by Bolger, to authorize the payment of$62,342.83 to Rubloff McHenry, LLCI for the installation of certain improvements to McCullom Lake Road. MAYOR - STATEMENT AND REPORT Mayor Althoff informed Council the City is in receipt of the executed copy of the Agreement regarding the purchase of the Cunat property. Mayor Althoff announced she would like to scheduled Committee of the Whole meetings regarding the Gerstad Property, north of Bull Valley Road and east of Draper Road and, Prime Commercial Development for their property located on the east side of South Route 31. Mayor Althoff requested Council direction regarding whether they chose to combine the two projects in one meeting or address each development on an individual basis. It was the consensus of Council to give each submission adequate attention and focus on each individually. Mayor Althoff suggested the following dates for consideration by Council for Committee of the Whole meetings: • Prime Commercial on Tuesday, August 6, 2002 or Thursday, August 8, 2002; and • Gerstad on Tuesday, August 20, 2002, Monday, August 26, 2002 or Tuesday, August 27. Responding to Alderman Murgatroyd's statement regarding his availability in late August, Mayor Althoff stated the dates are tentative and subject to change. COMMITTEE REPORTS Alderman Murgatroyd reported a Finance and Personnel Committee meeting took place prior to this evening's Council meeting at which the Committee recommended Staff `L- initiate a search to add a Finance Director to the administrative staff. July 15, 2002 Page 14 DEPARTMENT HEAD REPORTS Chief of Police O'Meara announced beginning September 17, 2002 the Police Department would begin the 10-week Citizens Police Academy. The classes will take place on Tuesday evenings. The exact time and dates will be advertised in the newspaper. Director of Public Works Marcinko informed Council Staff is considering the initiation of an odd/even sprinkler ban. Director Marcinko requested scheduling a Public Works Committee Meeting on July 29, 2002 at 6:30 p.m. Director of Parks and Recreation Merkel announced the Fiesta Days festivities are progressing well. Director Merkel noted the BMX Endurance Race, proposed for the end of July, has been postponed due to low registration. Fa stated when a new date has been selected Council will be informed. Director Merkel requested the Parks and Recreation Committee meeting, in August, typically scheduled on the second Thursday of the month be rescheduled for either August 15, 2002 or August 22, 2002, as he will be out of town on the regularly scheduled date. City Clerk City Clerk Jones reminded Council the Fiesta Day Parade is being held on Sunday, July 21, 2002, at 1:30 p.m. She requested all parties involved assemble, no later than 12:30 p.m., at Crystal Lake Road and Main Street for check in. City Administrator Lobaito stated the City of McHenry has received notice a decrease in assessed value, of what may be $100,000 or more, is being sought by Gary Lang, Beneficiary of Trusts, involving the property at 1111-1116 South Route 31 and also from Follett Library regarding their property in the Corporate Center. In the past the City of McHenry has requested the City Attorney to file papers of intervention with the McHenry County Board of Review, which permit the City to participate in the process. Intervention requires the Board of Review to provide the City with filings and notices of hearings throughout the process. Alderman Bolger opined he objects to interference with the process. City Administrator Lobaito stated the filing of papers of intervention is utilized as a monitoring tool for tax appeals exceeding $100,000, as a decision may have an effect on the various taxing districts. He advised that it does not interfere with the procedures of the Board of Review. Alderman Murgatroyd opined he believed it prudent to monitor the procedure and remain informed. It was the consensus of Council to direct Staff to file the necessary papers of intervention regarding the Commercial Appeals filed by Gary Lang, Beneficiary of Trusts and Follett Library. NEW BUSINESS Alderman Low stated she has received three telephone calls from individual July 15, 2002 Page 15 constituents residing on Riverside Drive noting Kennedy Construction's insurance company has not been forthcoming, or cooperative, in addressing the flooding issues from damage incurred in early June from flooding. Mayor Althoff assured Alderman Low Staff would look into the matter and a full report would be forthcoming in the Friday Agenda Packet.
