`.. A Regular Meeting of the McHenry City Council was called to order by Mayor Cuda,
at 7:30 P.M. on Tuesday, January 16, 2001 in the Council Chambers of the Municipal
Center. At roll call the following Aldermen were present: Bolger, Glab, McClatchey,
Murgatroyd, Baird. Absent: None. City Staff in attendance were: City Administrator Lobaito,
City Clerk Althoff, City Attorney McArdle, Chief of Police Kostecki, Director Public Works
Batt, Director of Parks and Recreation Merkel, Director Community Development
Napolitano, Assistant Administrator Maxeiner. Absent: None.
TEN MINUTE PUBLIC INPUT SESSION
Chuck Majercik, McHenry Township Road Commissioner, addressed Council,
noting recent annexations by Johnsburg, Lakemoor, McCullom Lake, Ringwood,
Richmond, and Prairie Grove have increased the number of McHenry Township roads with
multi-jurisdictional boundaries. He noted the increased difficulty in determining
maintenance and snowplowing responsibilities, even with intergovernmental agreements in
place addressing these issues. Road Commissioner Majercik requested no formal action.
At Alderman Glab's initiation some discussion followed regarding the speed limit on
Bull Valley Road. Mr. Majercik and Staff noted Bull Valley Road is a County road and
under the County Board's jurisdiction.
PUBLIC HEARING: ANNEXATION — 2120 WEST LINCOLN ROAD, MCHENRY SCHOOL
DISTRICT 15
Mayor Cuda opened the Public Hearing at 7:35 p.m. regarding the annexation of
McHenry Elementary School District 15's 38-acre Middle School site, located on the
northwest corner of the Lincoln and Chapel Hill Roads intersection, commonly known as
2120 West Lincoln Road. McHenry Elementary School District 15 Assistant
Superintendent Jeffrey O'Connell and School Board member Chris Cardamone were in
attendance.
Staff noted when annexation discussions originated, this school site was not
contiguous to the City's corporate limits. As McHenry Elementary School District 15
required City of McHenry utility service to facilitate the construction of a middle school on
this site, an intergovernmental agreement was drafted to delineate the terms and
conditions of a utility service connection to the City's water and sewer systems, prior to
annexation. During the review and modification of the intergovernmental agreement, the
City of McHenry annexed the Gerstad Diedrich Farm property, which is contiguous to this
school site, along the property's north and west perimeter. The McHenry Elementary
School District 15 Middle School property could therefore be legally annexed, thus
eliminating the need for an intergovernmental agreement.
An annexation agreement was drafted addressing water recapture monies owed by
the School District, as well as recapture provisions for the school district's construction of
oversized sanitary sewer and water mains. The 38-acre site will receive E Estate zoning
upon annexation. In addition, Staff noted McHenry Elementary School District 15 will need
to appear before the Zoning Board of Appeals to obtain a conditional use permit,
subsequent to annexation. Schools are a conditional use in all residential districts.

In response to Alderman Murgatroyd's inquiry, Staff noted the ten-year annexation
agreement term was standard for all annexation agreements since 1993. In addition, no
annexation agreement was required for either the McHenry Elementary School District 15
Valley View School or Hilltop School properties, as no recapture agreement conditions
were applicable to these properties.
Mayor Cuda opened the floor to audience comments and/or questions. There were
none. In response to Mayor Cuda's inquiry, City Clerk Althoff stated there had been no
written or verbal comments received in the City Clerk's Office regarding the McHenry
Elementary School District 15 petition for annexation of the property located at 2120 West
Lincoln Road.
Motion by Bolger, seconded by Glab, to close the Public Hearing at 7:45 p.m.
Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird, Cuda.
Voting Nay: None.
Absent: None.

In response to Alderman Baird's inquiry, Staff stated both Mr. Adams and McHenry
Elementary School District 15 have agreed to the water reimbursement amount as
specified in the District 15 annexation agreement. —,

Mayor and City Clerk's execution of an Annexation Agreement with McHenry Elementary
School District 15 for the McHenry Middle School located on the northwest corner of the
intersection of Lincoln and Chapel Hill Roads, commonly known as 2120 West Lincoln
Road.
Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird, Cuda.

REQUEST TO ADVERTISE FOR BID — FOX RIDGE PARK IMPROVEMENTS
Parks and Recreation Committee Chairperson Alderman Baird informed Council the
Parks and Recreation Committee, at last evening's committee meeting, approved a motion
to recommend to full Council the authorization of Staff to advertise for bids for the Fox
Ridge Park Improvements as presented. Smith Engineering, in conjunction with Parks and
Recreation Department Staff, completed the plans and specifications for the proposed
improvements. Improvements include the development of athletic areas consisting of five
baseball/softball fields, two soccer fields, an archery range, a walking path, and parking
lot. Director of Parks and Recreation Merkel distributed a detailed project cost estimate
sheet.

Alderman Glab expressed concern with the proposed plan's density. He also ,IN
expressed concern with the location of baseball/softball field #1 facing Whitmore Street.
He opined the plan as presented would encourage onstreet parking on Whitmore Street.
Alderman Murgatroyd clarified the Committee's motion to authorize the
advertisement of Fox Ridge Park Improvement Bids should specify the archery range be
bid separately, or, as an alternative. Staff also clarified these fields will be used primarily
as practice fields. Some discussion followed regarding the size of the proposed gravel
parking lot. Alderman Murgatroyd opined expanding the size of the proposed parking lot at
this juncture would be fiscally irresponsible.
Alderman Glab noted the parking lot, as designed, provides only 22 parking stalls
per field, he suggested the design be revised with two less ballfields. Mayor Cuda noted
the City could expand the parking lot at a later date if usage required the expansion.
Director of Parks and Recreation Merkel informed Council the bids will be
advertised locally as well as submitted to the bidders list provided by Smith Engineering.
The proposed deadline date for bid submittal is Monday, February 5, 2001. Bid approval
will be presented to Council for formal consideration at the regularly scheduled February
14, 2001 Council Meeting. A project completion date of September 7, 2001 will be
specified. Director Merkel reminded Council the 2000-2001 Budget includes $225,000 for
this project. The City of McHenry received $100,000 in Legislative Initiative monies from
Representative Franks. --N
Motion by Bolger, seconded by Baird, to authorize Staff to advertise for bids for the
Fox Ridge Park Improvements as presented, subject to the bidding of the archery range as
an alternative.

McHenry Elementary School District 15 Assistant Superintendent Jeffrey O'Connell
requested Council direct Staff to investigate the status of a proposed roadway from
Dartmoor Drive traversing the boundary of the school site exiting at Whitmore Drive.
Council concurred. Alderman Murgatroyd also suggested Staff investigate alternative sites
for the archery range, as it is currently being bid as an alternative.
YEAR 2000 LOCAL LAW ENFORCEMENT BLOCK GRANT PROGRAM
Chief of Police Kostecki informed Council the McHenry Police Department is in
receipt of an invitation to apply for local law enforcement block grants through the Illinois
Criminal Justice Information Authority. Chief Kostecki is requesting Council approve the
submission of a $10,987 grant application to purchase equipment to be utilized in evidence
collection. The grant does require matching funds by the City of McHenry in an amount of
$1,373.

Local Law Enforcement Block Grant in an amount of $10,987 for the purchase of
equipment to be utilized in police evidence collection.

RECREATION CENTER ADVISORY QUESTION
Assistant Administrator Maxeiner informed Council Staff was directed at the July 12,
2000 regularly scheduled Council Meeting, to prepare language for an advisory
referendum question for a community recreation center to appear on November 7, 2000
ballot. Council direction was to prepare a simplistic question asking voters to advise the
City Council on whether they want a recreation center without providing information on
funding for construction and operation. At the August 16, 2000 regularly scheduled Council
Meeting, Council postponed placing the question on the November 7, 2000 General
Election ballot, placing the question on the April 3, 2001 Consolidated Election ballot
instead.
The following referendum question language was presented for Council
consideration:
`- "Shall the City of McHenry construct and operate a community recreation
center — which would include a gymnasium, fitness center, walking/jogging
track, activity rooms, racquetball courts, preschool/toddler care rooms, and
possibly an indoor lap pool — to address the recreational programming needs
of the residents of the City of McHenry."
Parks and Recreation Committee Chairperson Alderman Baird informed Council the
Parks and Recreation Committee recommended the inclusion of senior programs in the
proposed advisory question language. The question should now read:
"Should the City of McHenry construct and operate a community recreation
center — which would include a gymnasium, fitness center, walking/jogging
track, activity rooms, racquetball courts, preschool/toddler care rooms,
programs for senior citizens, and possibly an indoor lap pool — to address the
recreational programming needs of the residents of the City of McHenry?"
Some discussion followed regarding the phrase "possibly an indoor lap pool'. Staff
clarified the inclusion of a lap pool was as yet a debatable option.
Motion by Baird, seconded by Murgatroyd, to pass a resolution authorizing the
following advisory referendum question language to be included on the April 3, 2001
Consolidated Election ballot for the City of McHenry:

Alderman Bolger requested financing and cost information be provided in any
informational materials provided the general public. Mayor Cuda requested City Attorney
McArdle investigate whether the City could expend monies to develop informational
literature regarding the proposed recreation center advisory question.
Alderman Baird clarified a financing plan has not yet been developed. The question
is to determine public support for the development of a financing plan to construct and
operate a recreational center.
MAYOR STATEMENT AND REPORTS
Mayor Cuda reported he and Village of Bull Valley President Brian Miller were
scheduled to meet to pursue the development of a Boundary Agreement between the
Village of Bull Valley and the City of McHenry. Council will be kept apprised of their
progress.
COMMITTEE REPORTS
Parks and Recreation Committee Chairperson Alderman Baird reported the Parks
and Recreation Committee had met last evening, January 15, 2001. Minutes will be
provided in Friday's Agenda Packet for Council review.
Finance and Personnel Committee Chairperson Alderman Murgatroyd reminded
Council a Finance and Personnel Committee had been scheduled for Wednesday,
January 24, 2001 at 6:30 p.m. to discuss the proposed Capital Improvement Projects
Policies and to consider the budget review process.
Community Development Committee Chairperson Alderman McClatchey scheduled
a Community Development Committee Meeting for January 31, 2001 at 6:30 p.m. to
continue discussions on the Crystal Lake Road Corridor Study.
DEPARTMENT HEAD REPORTS
Director of Community Development Napolitano reminded Council a Public Hearing
had been scheduled for Wednesday, January 24, 2001, to consider the Shamrock Farm
Property annexation and development.

Director of Parks and Recreation Merkel informed Council as previously reported,
L. the McCullom Lake Aeration System has been activated. Director Merkel also informed
Council announcement had been made regarding Open Space Land Acquisition
Development (OSLAD) Grants. The City of McHenry has been successful in obtaining the
$400,000 OSLAD Grant for the acquisition of the Petersen Farm Homestead Property.
City Administrator Lobaito reported he and D's Marine owner Jerry Danko were
meeting to pursue the development of a lease between Mr. Danko and the City of McHenry
for the operation of the recently acquired Riviera Marina Property. Alderman Murgatroyd
requested a copy of the draft lease agreement be provided Council in Friday's Agenda
Packet, along with a summary of the outstanding issues.
City Clerk Althoff requested Council approve the connection of Modine
Manufacturing, of Ringwood, Illinois, to the City's Police Alarm Panel, as per the McHenry
Township Fire Protection District's recommendation. In response to Council inquiry, City
Clerk Althoff noted connection is required as the City of McHenry is the designated area
911 center.
Motion by Bolger, seconded by McClatchey, to approve Modine Manufacturing
Company of Ringwood, Illinois request to connect to the City of McHenry Police Alarm
Panel.

NEW BUSINESS
Alderman Baird requested Staff investigate additional complaints regarding multiple
tenants on a property located on south Riverside Drive.
In response to Council inquiry, City Administrator Lobaito reported the McHenry
Theatre property owners were meeting with Mayor Cuda and him next week on
Wednesday. Council will be informed as to the outcome.
At Alderman Glab's initiation, some discussion followed regarding Inland Real
Estate Development's sign located on the south side of Bull Valley Road at Ridgeview
Drive. Alderman Glab noted, as per Council direction, Staff informed Inland the sign must
be removed. Director of Community Development Napolitano noted Inland Representative
Gregg Gabel had been informed of the request; however, inclement weather has delayed
its removal.
Alderman Glab also requested Staff notify the appropriate parties of Wm. Ryan
Homes, D.R. Horton, and Cobblestone Crossing Developments regarding advertisement
signs placed in the public right-of-way. After some discussion, it was the consensus of
Council to direct Staff to annually inform area developers of the City's sign ordinance
requirements and restrictions.
