HomeMy WebLinkAboutMinutes - 04/11/2001 - City Council REGULAR MEETING APRIL 11, 2001 �-- A Regular Meeting of the McHenry City Council was called to order by Mayor Cuda, at 7:30 P.M. on Wednesday, April 11, 2001 in the Council Chambers of the Municipal Center. At roll call the following Aldermen were present: Bolger, Glab, McClatchey, Murgatroyd. Alderman Baird arrived at 7:35 p.m. Absent: None. City Staff in attendance were: City Clerk Althoff, City Attorney McArdle, Chief of Police Kostecki, Director Community Development Napolitano, Director of Public Works Batt, Director Parks and Recreation Merkel, Assistant Administrator Maxeiner. Absent: City Administrator Lobaito. TEN MINUTE PUBLIC INPUT Paul Dreiske of 2316 Orchard Beach Road, Orchard Beach Homeowners Association representative, addressed Council regarding the proposed. V3 Realty Riverside Hollow Residential Subdivision development located on the northwest corner of Orchard Beach Road and Riverside Drive. Mr. Dreiske distributed an informational handout and informed Council the Orchard Beach Homeowners Association had three general concerns: ■ Safety; ■ Water Infiltration; ■ Maintenance. Alderman Baird arrived at 7:35 p.m. `.. Mr. Dreiske requested Council consider the Homeowners Association concerns and provide the Association with some feedback. Mayor Cuda suggested the Association consider annexation to the City of McHenry. Alderman Glab suggested a Community Development Committee Meeting be scheduled for review of the Orchard Beach Homeowners Association concerns. Some discussion followed. It was the consensus of Council to send the Orchard Beach Homeowners Association concerns regarding safety, water infiltration and maintenance, with regard to the V3 Realty Riverside Hollow Subdivision development to Community Development Committee for review and recommendation. Diana Mantzoros of 1904 Oak Drive, addressed Council, thanking the Council for its prompt action in placing barricades and warning devices around the City of McHenry's exposed sanitary sewer project materials in her neighborhood. Ms. Mantzoros also provided photographic copies of the referenced safety violations. ANNE STREET/EDGEBROOK SUBDIVISION DRAINAGE IMPROVEMENT FUNDING Assistant Administrator Maxeiner informed Council the Five-Year Capital Improvement Plan recently approved by Council includes approximately $1.0 million in drainage improvements to the Anne Street/Edgebrook Subdivision Drainage area. Staff is proposing the implementation of a Special Service Area to pay for fifty percent of these drainage improvements. The balance would be considered the public benefit portion and financed through General Revenue Funds. The 2001-2002 proposed budget assumes the creation of a Special Service Area as the funding mechanism for this project. Assistant Administrator Maxeiner requested Council direct Staff to proceed with the Special Service Area or propose and prepare a funding mechanism alternative. The proposed Special Service Area was also presented. Assessed valuation for the proposed Special Service Area in 2000 values totaled approximately $88 million. Assistant Administrator Maxeiner noted the owner of a $150,000 property could expect to pay between $65 to $70 annually for the issuance of 15-year bonds. In response to Council inquiry, Assistant Administrator Maxeiner noted a Special -1 Service Area is a financing mechanism whereby a property tax is levied upon the owners property within a defined service area. Page 7 4/11/01 Alderman Bolger expressed his opposition to the initiation of a Special Service Area as a funding mechanism for this project. He also expressed concerns regarding the replacement cost of the spillway located on the McHenry Country Club property. He suggested Staff investigate the feasibility of developing a retention pond on the North Pacini Property. Alderman Bolger informed Council he had contacted both State Representative Franks and Senator Klemm via letter regarding State Member Initiative Monies for this project. In response to Alderman Glab's inquiry regarding the inclusion of undeveloped properties within the Special Service Area, Staff noted the proposed Area was conditional subject to Council consideration and revision. Alderman Bolger suggested Staff obtain easements from McHenry Country Club. Director of Public Works Batt noted the Anne Street/Edgebrook Subdivision Drainage Improvements Project requires three easements. The affected property owners have all verbally agreed to provide said easements to the City of McHenry for this project. Director Batt also expressed concern with the elimination of the project's alternative, citing the potential to negatively impact the McHenry Country Club spillway. Some discussion followed. Alderman Baird expressed concern with the inclusion of developed properties within the Special Service Area. Alderman Bolger suggested Staff revisit the low bid and attempt to negotiate a lower price. Staff recommended the Special Service Area be revised and a recapture agreement be created for properties developed in the future. Alderman Baird opined properties currently providing detention be eliminated from the Special Service Area. Director of Public Works Batt explained every property is positively impacted by the proposed Drainage Improvements. The current drainage system is no longer able to convey the water flow of a ten-year storm. Director Batt also noted these improvements do not negate the need for a detention basin to accommodate storm water runoff associated with 100-year storms. Discussion followed regarding the establishment of a Special Service Area. Alderman Murgatroyd noted if Council elects not to establish a Special Service Area for this project, other much needed projects will be postponed and/or eliminated. In response to Council inquiry, Assistant Administrator Maxeiner noted the customary time frame for the establishment of a Special Service Area is approximately six months. It was the consensus of Council to send the establishment of a Special Service Area to finance the Anne Street/Edg eb rook Subdivision Drainage Improvements Project to the Finance and Personnel Committee for further consideration. Alderman Murgatroyd reminded Council of the time constraints associated with this project due to the coordination with the McHenry Elementary School District 15 improvements prior to the start of the 2001-2002 school year. Page 8 4/11/01 --� Council suggested Staff continue moving forward with the project. Project financing can be determined at a later date. MAYOR— STATEMENT AND REPORT Mayor Cuda stated his report would be given during Executive Session addressing Potential Litigation. COMMITTEE REPORTS Finance and Personnel Committee Chairperson Alderman Murgatroyd reminded Council a Finance and Personnel Committee Meeting had been scheduled for Tuesday, April 17, 2001 at 7:00 p.m. to discuss the proposed 2001-2002 Budget. DEPARTMENT HEAD REPORTS Director Community Development Napolitano reported Riverside Hollow V3 Realty Subdivision Zoning Board of Appeals Public Hearing has been rescheduled to May 7, 2001, rather than as originally scheduled on April 16, 2001, due to a publication error. Director Napolitano also reported Windsor Development Corporation has begun site development on their senior living development located directly east of the McHenry Municipal Center on Charles Miller Highway. The building fees for this project totaled $371,000. "1 Director Parks and Recreation Merkel reported fund raising efforts for the McHenry Zone Skatepark continue. An update will be provided by volunteer coordinator chairperson Carol Chrisman at the April 18, 2001 regularly scheduled Council Meeting. Chief of Police Kostecki reported a Route 120 City of McHenry resident was evacuated on Saturday, due to the high winds experienced by the area. Chief Kostecki also reported the Bank One Financial Institution located on Oak Drive at Route 120 was robbed on Tuesday, April 101h. Officer Sexton and Officer Meier apprehended the alleged perpetrator. Further information will be provided in the Friday Report. Voting Nay: None. Absent: None. Motion carried. NEW BUSINESS In response to Alderman Glab's observation, Director Public Works Batt stated drainage on Ridgeview Drive South will be corrected. Director Community Development Napolitano, in response to Alderman Glab's inquiry, stated Staff will investigate reports of a dumpster being located on Oakwood Drive for an extended period of time. Director Napolitano also informed Alderman Glab the trees on Front Royal Court will be removed within the next 30 days. Director Public Works Batt, in response to Alderman Glab's request, agreed to provide Council with a complete status update report on the Manchester Mall/Deja residence flooding problem. EXECUTIVE SESSION: POTENTIAL LITIGATION Motion by Bolger, seconded by Glab, to go into Executive Session to discuss Potential Litigation at 8:27 p.m. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird. Council went back into Open Session at 9.00 p.m. Page 10 4/11/01 '1 In response to Alderman Bolger's inquiry, Assistant Administrator Maxeiner provided Council with an update regarding the Rubloff/Route 31 negotiations. He noted Rubloff has agreed to provide the City with a $125,000 Letter of Credit. The Letter of Credit will be issued for 180 days, and each of the three affected businesses must agree to its release. Mayor Cuda stated, in response to Alderman Murgatroyd's inquiry, all three affected property owners are being kept informed of the negotiations. Assistant Administrator Maxeiner also reported a meeting with the affected property owners of Fast Eddies Car Wash, Burger King, and Steak 'n Shake, in addition to the property owner to the east, Mr. Dan Blake, has been tentatively scheduled for Tuesday, April 17tn ADJOURNMENT Motion by McClatchey, seconded by Murgatroyd, to adjourn the meeting at 9:04 p.m. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird.
