APRIL 25, 2001
The Annual Meeting of the McHenry City Council was called to order by Mayor
Cuda, at 7:30 P.M. on Wednesday, April 25, 2001 in the Council Chambers of the
Municipal Center. At roll call the following Aldermen were present: Bolger, Glab,
McClatchey, Murgatroyd. Baird arrived at 7:35 p.m. Absent: None. City Staff in attendance
were: City Administrator Lobaito, City Clerk Althoff, City Attorney McArdle, Chief of Police
Kostecki, Director Community Development Napolitano, Director of Public Works Batt,
Director Parks and Recreation Merkel, Assistant Administrator Maxeiner. Absent: None.
TEN MINUTE PUBLIC INPUT
Mrs. Annette Cuda, wife of Mayor Cuda, addressed Council enumerating Mayor
Cuda's many accomplishments over the past eight years including the annexation of
properties east of the Fox River, the renovation of the Hickory Creek Farm Barn, the
acquisition of the Petersen Farm Homestead Property, and the design and creation of the
Project Zone Skatepark. Mrs. Cuda acknowledged her husband's commitment to the
McHenry community and thanked him for his efforts.
Alderman Baird arrived at 7:35 p.m.

VARIANCE TO PERMIT TWO DWELLING UNITS ON A SINGLE LOT — 3808
MILLSTREAM DRIVE
In attendance were property owners Mr. and Mrs. Larry Holub, of 3808 Millstream
Drive.
As per Mayor Cuda's direction, Attorney McArdle in cooperation with Director of
Community Development Napolitano, drafted a restrictive ordinance regarding the
variance request of Mr. and Mrs. Larry Holub of 3808 Millstream Drive. Mr. and Mrs. Holub
are requesting Council approval of a variance to permit a second dwelling unit on their
property at 3808 Millstream Drive. It is Mr. and Mrs. Holubs intent to occupy the second
floor while the first floor would be used by Mrs. Holub's parents in an in-law arrangement.
Alderman Bolger stated his opposition to the Holubs' request, citing the
establishment of such an arrangement might establish precedence for further multi-family
conversions along Millstream Drive.
In response to Alderman McClatchey's inquiry, Mr. and Mrs. Holub stated it is their
intent to proceed with the second floor addition, whether or not Council approves their
request for a variance. Director of Community Development Napolitano clarified the
variance would permit the construction of a kitchen on the second floor; thereby creating
two independent dwelling units, a duplex situation, which is not permitted in the existing
RS4 Zoning District.

Motion by Baird, seconded by Murgatroyd, to grant a variance to Mr. and Mrs. Larry
Holub to permit modifications of the existing structure located at 3808 Millstream Drive, to
accommodate a two-flat with two independent dwelling units.
Voting Aye: Baird.
Voting Nay: Bolger, Glab, McClatchey, Murgatroyd.
Absent: None.
Motion failed.
APPROVAL OF THE CITY OF MCHENRY 2001-2002 FISCAL YEAR BUDGET
Assistant Administrator Maxeiner presented the 2001-2002 City of McHenry Budget
for Council approval. He noted the 2001-2002 expenditure budget totals $37,486,899. The
net budget after eliminating interfund transfers for items such as health insurance,
retirement contributions, debt service, and reserve transfers to capital project funds, totals
$30,663,980. The 2001-2002 budget reflects revenues of $34,353,296, with an additional
$4,268,956 in planned reserve reductions. Therefore, net available revenues total
$38,622,252. Assistant Administrator Maxeiner noted the following significant factors:
■ The budget format and overall chart of accounts has been revised for easier
reference by the general public.
General Fund Revenue:
■ Budgeted Revenues show a continued growth with an increase of 13.2% over
the 2000-2001 budget revenues;
■ The largest single source of General Fund Revenues is the sales tax revenue
which accounts for nearly 46% of the current General Fund revenues
■ The 2001-2002 Budget reflects a projected sales tax revenue increase of 3.9%
over the projected year-end actual for the 2000-2001 fiscal year.
■ Property tax revenues are projected to increase at a 7.9% level;
■ Assistant Administrator Maxeiner noted assessed value within the City of
McHenry grew $31.5 million in year 2000, representing a growth rate of 8%. The
City's portion of the State per capita income increases 15.9% over the prior
year's budget due to population growth, as identified by the 2000 Census. The
Fund reflects an addition of 6.00 full time equivalents:
■ Two patrol/investigative positions and one sergeant were added to the Police
Department;
■ A building inspector was added to the Community Development Department;
and
■ An information technology position was added to the Administration
Department.
The budget proposes a 3.0% wage increase pending the completion of the non-contract
s.. compensation study. The collective bargaining groups are entering the final year of their
three-year contracts and have agreed upon increases included in the budget.

General Fund Expenditure:
Highlights of the General Fund Expenditures Include:
■ A$500,000 contribution to the Riverwalk Project.
■ A$100,000 transfer of General Fund Reserves to the Street Program to
pursue a more aggressive improvement program in 2001-02.
■ Use of$310,000 of General Fund reserves for capital improvement
projects.
■ Maintaining the vehicle replacement program in the Police and Public
Works Department with planned replacements of four patrol cars, one
unmarked car, the Street Superintendent's vehicle, a one-ton dump truck,
and two large dump/snowplow trucks.
■ Implementation of a vehicle replacement program in the Community
Development and Parks and Recreation Departments with the planned
purchase of three replacement vehicles.
■ Grant funded purchases of police equipment totaling approximately
$140,000.
■ Addition of an Information Technology Coordinator in Administration
Department.
• Addition of one Sergeant and two Patrol Officers/Investigators in the
Police Department.
■ Addition of one Building Inspector in Community Development "1
■ Addition of one Recreation Supervisor as a temporary full-time
replacement for an employee currently on leave of absence.
■ General salary adjustments of 3% for non-contract positions.
• Commitments to capital projects consistent with the Five-Year Capital
Improvements Program (CIP) as highlighted in the attached Schedule D.
Water Sewer Fund:
The approved Water Sewer Utility Expenditure budget reflects $4,903,953. The net
expenditure budget total is $3,043,874, after discounting capital project activity and
interdepartmental transfers. The Water Division reflects an increase of two employees, to
initiate the City's meter reading system for water and sewer accounts. The City is currently
under contract with another utility to provide meter reads. The contractor has recently
notified the City of McHenry they will no longer provide this service. The contract expires in
November of 2001.
Assistant Administrator Maxeiner noted the proposed 2001-2002 budget provides for
the maintenance of existing service levels, while undertaking an aggressive capital
improvements program for street drainage, and water and sewer infrastructure
improvements. The budget is balanced as presented, using a planned use of reserves for
project or equipment, previously appropriated, for which an expenditure was not made, and
for one-time capital project expenditures.
The budget also reflects reserves for unforeseen events, changes in economic
conditions, and daily cash flow requirements.

Alderman Bolger noted the budget is a working guide and changes may be made
throughout the year. He complimented Assistant Administrator Maxeiner for the format
improvements and for a job well done.
Mayor Cuda also noted that the City of McHenry's overall tax rate did decrease.
LIQUOR LICENSE CLASS F(2)-4 TRANSFER REQUEST - RIVER ROAD SHELL, 3110
W ROUTE 120
In attendance was Mohammad Rasheed Khan, proprietor of the River Road Shell,
3110 West Route 120 in McHenry.
Mayor Cuda informed Council a Liquor License transfer request was received from
Mr. Mohammad Rasheed Khan who purchased the Shell Gas Station located at 3110 West
Route 120. Mr. Khan has submitted all the required paper worl.:, paid the required fees,
and has been fingerprinted by the McHenry Police Department, as has his new manager.
Mayor Cuda as Liquor Commissioner is recommending Council approve the transfer of the
River Road Shell Class F(2)-4 Liquor License from M and I Petroleum to Mohammad
Rasheed Khan of Shani Oil Company. The transfer approval would be conditional upon
satisfactory fingerprint results.
Motion by Glab, seconded by Bolger, to approve the Class F(2)-4 Liquor License
transfer from M and I Petroleum to Mohammad Rasheed Khan of Shani Oil Company d/b/a
River Road Shell, located at 3110 West Route 120, subject to the receipt of satisfactory
fingerprint results.
Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird.

REQUEST FOR CLASS G LIQUOR LICENSE — MICHAEL'S BISTRO_, 1.249 NORTH
GREEN STREET
Barbara Susong, owner and operator of Michael's Bistro, was in attendance.
Mayor Cuda, as Liquor Commissioner, informed Council, a Liquor License
�.. Application was received from Daniel and Barbara Susong, owners and operators of
Michael's Bistro, located at 1249 North Green Street.

A Class G Liquor License authorizes the retail sale alcoholic liquors, in addition to
beer and wine. The Susongs currently hold a Class H Liquor License, which authorizes the
retail sale of beer only. Both the Class H and Class G Liquor Licenses permit consumption
of alcoholic beverages at tables only. Bar sales are prohibited.
Mr. and Mrs. Susong have submitted all the appropriate paper work, the $700
annual liquor license fee, and have met with Liquor Commissioner Mayor Cuda. Mayor
Cuda, as Liquor Commissioner, is recommending Council approve the Susong's
application for a Class G Liquor License for Michael's Bistro Inc. d/b/a Michael's bistro, at
1249 North Green Street.
Motion by Bolger, seconded by Baird, to approve the Liquor License application for
a Class G Liquor License to Daniel and Barbara Susong of Michael's Bistro Inc. d/b/a as
Michael's Bistro at 1249 North Green Street.

2001 ANNUAL LIQUOR LICENSE RENEWALS
Mayor Cuda informed Council, as per the City of McHenry's Municipal Code
Chapter 4, liquor establishments located within the corporate boundaries of the City of
McHenry must renew their licenses annually by the end of the fiscal year, April 30t". The

Illinois.
Mayor Cuda also stated all new owners and managers were fingerprinted and all
license renewals are subject to the receipt of satisfactory fingerprinting results. In
conjunction with Council's approval of Michael's Bistro Inc. request for a Class G Liquor
License increasing the number of Class G Liquor License and decreasing the number of
Class H Liquor Licenses must be approved. In addition, the recent revocation of the Class
A Liquor License for Sunshine Enterprises Inc. reduces the number of Class A Liquor
Licenses, which also must be incorporated into City ordinance for approval.
Mayor Cuda is recommending the renewal of all Liquor Licenses as presented,
subject to the satisfactory fingerprinting results from the new owners and/or managers, as
well as the approval of the attached ordinance decreasing the number of Class A Liquor
Licenses from 25 to 24; increasing the number of Class G Liquor Licenses from 4 to 5; and
decreasing the number of Class H Liquor Licenses from 3 to 2.

DEPARTMENT HEAD REPORTS
Director Community Development Napolitano noted Council, at its April 11, 2001
regularly scheduled Council Meeting, sent the Orchard Beach Homeowners Association
concerns to Community Development Committee for consideration. He suggested May 16"'
at 6:30 p.m. assuming Mayor-elect Althof's Committee Appointments would be in place.
Director Napolitano also noted the City of McHenry experienced a complete residential fire
loss at 3426 Lorient Drive. Fortunately, no loss of life occurred and the investigation
regarding its cause is underway. Alderman Glab noted the family had a fire-escape plan in
place, which was responsible for the safe exit of the entire family.
Director Public Works Batt thanked the outgoing elected officials, Alderman
McClatchey, Alderman Baird and Mayor Cuda, for their efforts and providing a positive
direction for Staff over the past four years. He wished them well in their retirement.
Director Parks and Recreation Merkel distributed the McCare Night Flyers, noting
twelve local McDonald's have agreed to donate 15% of their proceeds between the hours
of 4 p.m. and 8 p.m. on Wednesday, May 2, 2001 to the McHenry Skatepark. Director
L.. Merkel also reminded Council of the Annual Arbor Day festivities on Friday, April 27, 2001
at 3 p.m. in the Municipal Building Council Chambers.

Chief of Police Kostecki informed Council a letter regarding the McCullom Lake boat
motor horsepower standards was sent to residents living along the McCullom Lake shores
in the fall season of 2000, not in the spring. He, too, thanked Mayor Cuda and Aldermen
McClatchey and Baird for the opportunity to work with them over the past year and a half.
City Administrator Lobaito also thanked the Aldermen and Mayor Cuda for providing
a positive working atmosphere and, in particular, thanked Mayor Cuda for providing him
with the opportunity to serve as City Administrator for the City of McHenry.
NEW BUSINESS
Alderman Glab requested Council approve sending a zoning clarification issue to
the Community Development Committee for further consideration by Staff and the City's
Attorney.
Motion by Glab, seconded by Bolger, to send a Planned Unit Development zoning
clarification issue to the Community Development Committee for Staff and City Attorney
review and direction.
