`.- The Regular Meeting of the McHenry City Council was called to order by Mayor
Althoff, at 7:30 P.M. on Wednesday, June 18, 2001 in the Council Chambers of the
Municipal Center. At roll call the following Aldermen were present: Bolger, Glab, Low,
Murgatroyd, Wimmer. Absent: None. City Staff in attendance were: City Administrator
Lobaito, City Clerk Jones, City Attorney McArdle, Chief of Police Kostecki, Director Public
Works Batt, Assistant Administrator Maxeiner and Director Community Development
Napolitano. Director Parks and Recreation Merkel arrived at 7:50 p.m.

ORDINANCES APPROVING ANNEXATION AGREEMENT, ANNEXATION, REZONING
TO RS-4 AND VARIANCE - 1107 AND 1109 RIVER ROAD
In attendance was Joseph Gottemoller, attorney for applicant Jeff Kleinhans. Mr.
Gottemoller requested Council consider passing ordinances granting the following:
■ An Annexation Agreement with Jeff Kleinhans for 1107 N. River Road and 1109
N. River Road, in McHenry County, Illinois;
■ The Annexation of 1107 N. River Road and 1109 N. River Road, located on the
south side of River Road, 400 feet south of Route 120, in McHenry County,
Illinois;
■ A zoning map amendment for the property located at 1107 N. River Road; and
■ A variance to property located at 1109 N. River Road, in McHenry County,
Illinois.
Mr. Gottemoller stated the Public Hearing was held on December 20, 200. He noted
the ordinance granting the setback variance for 1109 N. River Road includes the condition
that the existing house must be demolished within six months of annexation, and that
construction of the new house must begin within one year of annexation.
Mr. Gottemoller noted the annexation agreement has been amended to include the
requirement that the existing house at 1109 N. River Road must be demolished within six _
months of annexation. The engineering plans for the proposed sanitary sewer extension to
service the referenced properties has been submitted and reviewed.
Motion by Bolger, seconded by Wimmer, to pass and approve an ordinance
authorizing the Mayor and City Clerk's execution of the annexation agreement between the
City of McHenry and Mr. Jeff Kleinhans and the Estate of Lucile P. Kleinhans for the
properties located at 1107 N. River Road and 1109 N. River Road, McHenry, Illinois.

annexing the Kleinhans property located at 1107 N. River Road and 1109 N. River Road,
McHenry, Illinois.

Motion by Bolger, seconded by Low, to pass and approve an ordinance
■ granting a zoning map amendment to RS-4 and variance for 1107 River Road;
and to pass and approve an ordinance
■ granting a zoning map amendment to RS-4 and variance for 1109 River Road,
subject to the following condition:
■ that the owner shall obtain all required permits and demolish the existing
residence at 1109 N. River Road within six (6) months and shall begin
construction of the new residence within one (1) year following the City
Council approval of the annexation.

CONDITIONAL USE PERMIT FOR OUTDOOR STORAGE AT 4030 W. MAIN STREET
In attendance was Peggy Benzschawel of Portable Tool Sales and Service; and
Attorney Joseph Gottemoller of Madsen, Sugden & Gottemoller. Attorney Gottemoller
stated Portable Tool Sales and Service is requesting a conditional use permit for outdoor
storage of construction equipment at 4030 W. Main Street. Attorney Gottemoller reported
the Applicant has a 1-year lease with an option to purchase the property that expires in
November 2001. The Applicant appeared before the Zoning Board of Appeals (ZBA) at a
Public Hearing on March 20, 2001 and received a unanimous recommendation for
approval subject to certain conditions.
Staff suggest Council consider the recommendations of the ZBA and approve the
requested conditional use permit, subject to the following conditions:
1. A detailed plan providing for the installation and maintenance of screening
(landscaping, wood or chain-link fence with nylon privacy mesh) along Crystal
Lake Road shall be provided for review prior to final approval. The screening
shall extend at least 135 feet to the north of the principal building along Crystal
Lake Road, as depicted on the latest site plan included with the application.
2. Outdoor storage shall be limited to particular types of equipment, as defined by
the applicant prior to final approval, and shall not include bulk material or
inoperable equipment.
3. All equipment service shall be performed within enclosed buildings, and shall not
be permitted in the outdoor storage area.

4. No equipment refueling shall be conducted on the property; all fueling shall be
done at off-site locations;
5. Direct access to the property from Crystal Lake Road shall be prohibited.
6. The gravel/grass area at the southeast corner of the property along Main Street
shall be paved within 120 days of approval.
Alderman Bolger commented that the current condition of the property is excellent
and complimented Ms. Benzschawel on the maintenance of the property.
Discussion occurred concerning the landscaping and fence height, the aesthetics of
the nylon privacy mesh, the choice of color of the nylon privacy mesh and the paving of the
gravel/grass area at the southeast corner of the property.
Motion by Bolger, seconded by Glab to accept the unanimous recommendation of
the Zoning Board of Appeals and to pass an ordinance granting a conditional use permit to
Portable Tool Sales and Service for outdoor storage of construction equipment for the
property located at 4030 W. Main Street, subject to the following conditions:

NORTH INTERCEPTER SEWER PROJECT
Staff reported that in conjunction with Rubloff Development and the City's North -�
Interceptor Sewer Project and to keep pace with the Illinois Route 31 road widening, the
City requested a proposal from Rubloff Development to install a 783 lineal foot portion of
the City's north interceptor sewer main parallel to Illinois Route 31. Staff stated that this
permits the businesses along Route 31, that will be affected by the highway construction,

to be disturbed only once rather than twice. Rubloff Development submitted a quotation of
$166,510.50 for this portion of the project. Staff informed Council that with the additional
expense of flagmen, dump fees, shoring, resetting of survey markers, utility service repair
and safety fencing the total project cost could amount to $250,000. Staff requests a waiver
of the bid process in order to expedite the construction process.
Discussion followed regarding the North Interceptor Sewer Project. Mayor Althoff
suggested that Council approve the project in an amount not to exceed $250,000 with Staff
to notify Council when the project reaches $200,000.
Motion by Bolger, seconded by Wimmer, to approve the waiver of bids for the North
Interceptor Sewer Project and to authorize expenditures for the installation of 783 lineal
feet of the North Interceptor Sewer Project in an amount not to exceed $250,000 subject to
the condition Staff notify Council when the project costs reach $200,000.

Mayor Althoff announced that Donald R. Meyer is retiring from the Planning
Commission.
Mayor Althoff reminded Council and Staff that the Strategic Planning Meeting is
scheduled to take place on Saturday, June 23, 2001 at 8:00 a.m. The Mayor expressed
enthusiasm about the meeting and encouraged attendance by all invitees.
COMMITTEE REPORTS
Alderman Low informed Council and Staff that a committee meeting has been
scheduled for the Parks and Recreation Committee on July 10, 2001 at 7:00 p.m.
DEPARTMENT HEAD REPORTS
Director of Parks and Recreation Merkel reported that preparations are underway
for Family Heritage Days, sponsored by The City of McHenry Landmark Commission,
scheduled to take place on June 23 and June 24, 2001, from 10:00 a.m. to 3:00 p.m. at
Hickory Creek Farm.
NEW BUSINESS
Alderman Glab requested status of brush pickup throughout Ward 2. Staff
responded that the issue of brush pickup will be reviewed and reported to Alderman Glab.
