�... The Regular Meeting of the McHenry City Council was called to order by Mayor
Althoff, at 7:30 P.M. on Wednesday, September 5, 2001 in the Council Chambers of the
Municipal Center. At roll call the following Aldermen were present: Bolger, Glab, Low,
Murgatroyd, Wimmer. Absent: None. City Staff in attendance were: City Administrator
Lobaito, Assistant City Administrator Maxeiner, City Clerk Jones, City Attorney McArdle,
Chief of Police Kostecki, Director of Public Works Batt, Director Community Development
Napolitano and Director of Parks and Recreation Merkel. Absent: None.
TEN MINUTE PUBLIC INPUT
No one signed in to speak during the Ten Minute Public Input Session.
PRESENTATION
David Stone of the Kiwanis International Noon Club of McHenry presented a
monetary donation to Project Zone Skatepark Chairman Carol Chrisman in the amount of
$30,000.
PUBLIC HEARING TO CONSIDER VACATING A PORTION OF SOUTH STREET
Mayor Althoff opened the Public Hearing to consider vacating a portion of South
Street, located east of River Road, and south of State Route 120, at 7:37 p.m.
Director of Community Development Napolitano advised Council of Rich Adams'
annexation of two parcels earlier this year. Both of the annexed parcels have frontage on
Route 120 and South Street, east of River Road. Mr. Adams has requested the City
consider vacating the South Street right-of-way due to the fact it is unimproved and there
are no plans to improve the street in the future. Only a portion of South Street is within the
City limits and the remainder is in McHenry Township jurisdiction. Council previously
directed Staff to work with the Township to accommodate vacation of the entire street.
Director Napolitano informed Council of an existing sanitary sewer main which traverses
the right-of way. Director Napolitano stated it is the City's intent to reserve an easement to
maintain this and any other future public utility. Discussion ensued.
Motion by Glab, seconded by Bolger, to close the Public Hearing regarding the
vacation of the right-of way of South Street, located East of River Road and South of State
Route 120, in the City of McHenry, McHenry County, Illinois at 7:40 p.m.

Motion by Glab, seconded by Bolger, to approve an Ordinance vacating of the right
of way of South Street, located East of River Road and South of State Route 120, in the
City of McHenry, McHenry County, Illinois subject to review of the proposed utioity
easement by City Attorney McArdle.
Voting Aye: Bolger, Glab, Low, Murgatroyd, Wimmer.

CONSENT AGENDA:
At Alderman Glab's request, the following Agenda Items were removed from the
Consent Agenda for further discussion:
• Agenda Item #2: waiver of bids and award contract to Sincere Landscape for
brick paver replacement at Municipal Center;
■ Agenda Item #3: Final payment to Thompson Dyke & Assoc. Ltd. for McHenry
Zone Skate Park construction development/management.

WAIVER OF BIDS AND AWARD OF CONTRACT FOR MUNICIPAL CENTER BRICK
PAVER REPLACEMENT- SINCERE LANDSCAPE
In response to Alderman Glab's inquiry, Staff noted consideration was being given
to using the removed bricks at park sites throughout the City.
Motion by Glab, seconded by Murgatroyd, to approve the waiver of bids and award
of contract for Municipal Center paver brick replacement to Sincere Landscaping in an
amount not-to-exceed $10,930.

FINAL PAYMENT FOR MCHENRY ZONE SKATEPARK CONSTRUCTION
DEVELOPMENT/MANAGEMENT - THOMPSON DYKE & ASSOCIATES
In response to Alderman Glab's inquiry, Director of Parks and Recreation Merkel
stated Staff was pleased with Thompson Dyke and Associates' construction observation
and project management assistance.
Motion by Glab, seconded by Low, to approve final payment to Thompson Dyke &
Assoc., Ltd. for McHenry Zone Skate Park construction development management in the
amount of$7,383.24.

ANNUAL COUNTRY MEADOWS CRAFT SHOW, USE OF PETERSEN PARK AND

WAIVER OF ALL ASSOCIATED FEES
Director of Parks and Recreation Merkel advised Council the McHenry Area
Chamber of Commerce is once again requesting Council's permission to host the 91h
Annual Country Meadows Craft Show at the Petersen Park beach area on Sunday,
September 16, 2001 from 10:00 a.m. to 4:00 p.m. Director Merkel additionally advised
Council of the Chamber's request that all fees be waived for this special event.

Alderman Glab expressed concern regarding the number and aesthetics of signs
advertising the event throughout the community. Alderman Glab opined discussion should
occur at the committee level regarding signage on private property. Community
Development Committee Chairman Alderman Wimmer suggested the topic be addressed
at the next Committee meeting.
Motion by Low, seconded by Wimmer, to approve the use of Petersen Park beach
area by McHenry Area Chamber of Commerce for the 91h Annual Country Meadows Craft
Show on Sunday, September 16, 2001, from 10:00 a.m. until 4:00 p.m., and to waive all
associated fees.

ORDINANCE APPROVING A CONDITIONAL USE PERMIT FOR AN EDUCATIONAL
INSTITUTION - NORTHWEST BIBLE BAPTIST CHURCH, 4100 SHAMROCK LANE
Council at its August 28, 2001 regularly scheduled meeting, accepted the
recommendation of the Zoning Board of Appeals and directed Staff to prepare an
ordinance granting a conditional use permit for an educational institution to the Northwest
Bible Baptist Church for the property located at 4100 Shamrock Lane, currently occupied
by the Ramada Inn.
Alderman Glab expressed concern regarding the possibility of unrestricted future
building on the property and stated he could not support the conditional use permit.
Motion by Bolger, seconded by Murgatroyd, to approve an ordinance authorizing a
conditional use permit for an educational institution to Northwest Bible Baptist Church for
the property located at 4100 Shamrock Lane, subject to the following conditions:
• Dormitory supervisors shall be used to monitor dorm activities; and
• Signs shall be installed in appropriate locations to designate staff/employee,
student and visitor parking areas.

SALE OF SURPLUS PROPERTIES BY AUCTION
Assistant Administrator Maxeiner reported the McHenry County Central Purchasing
Department is conducting its annual auction on Saturday, September 15, 2001, at the
McHenry County Fairgrounds in Woodstock. The City of McHenry has stated its intent to
participate. An ordinance authorizing the sale of surplus municipal property must be
passed prior to the sale of any municipal goods. Assistant Administrator Maxeiner stated a
complete list of surplus property to be sold at auction is included in the ordinance
presented for Council review.
Motion by Glab, seconded by Low, to approve an ordinance authorizing the sale of
surplus municipal property at the annual McHenry County Auction being held at the
McHenry County Fairgrounds on Saturday, September 15, 2001.

MCHENRY CORPORATE CENTER RESUBDIVISION LOT 1, UNIT 8: PRELIMINARY
AND FINAL PLAT
In attendance were Scott Dixon of Prime Commercial and Joe Vavrina of Smith
Engineering Consultants. Mr. Dixon addressed Council, stating Prime Commercial is
seeking approval of the proposed re-subdivision of McHenry Corporate Center Lot 1, Unit

�-. 8. Prime Commercial Corp. is proposing the re-subdivision of the existing 5.74 acre lot into
three parcels for development of a hotel and retail building. Prime Commercial Corp. is
requesting approval of both the preliminary and final plats at this time.
Mr. Dixon stated Lot 1 of Unit 8 would be subdivided as follows:
■ Lot 1 - 1.19 acres with frontage on Prime Parkway;
■ Lot 2 - 2.97 acres with frontage on Route 31, proposed site of a hotel;
■ Lot 3 -1.59 acres with frontage on Route 31, proposed site of a retail building.
Mr. Dixon stated dual access is anticipated for each lot. The subdivision would
have full access at the intersection of Prime Parkway and Corporate Drive over an existing
60-foot wide access easement at the northwest corner of the property. A right-in, right-out
access is proposed at Route 31, between the proposed common lot line shared by Lots 2
and 3. Mr. Dixon informed Council Illinois Department of Transportation (IDOT) has
consented to the Route 31 access. Mr. Dixon advised Council a southbound deceleration
lane would be provided to assist with traffic flow at the right-in right-out access point. The
Plan Commission, at its August 16, 2001 meeting, recommended approval of the
preliminary and final plat of the McHenry Corporate Center Resubdivision of Lot 1, Unit 8,
subject to compliance with the City Engineer's comments and the Public Works review
letter dated July 23, 2001. Mr. Dixon stated the plats have been amended to reflect these
changes. Discussion ensued.
�— Alderman Glab expressed concern about sufficient drainage on the property and
inquired regarding the size of pipe was proposed for the site. Mr. Vavrina responded the
pipe is an 18-inch culvert pipe, which has been approved by IDOT. Director of Public
Works Batt advised Council the engineering specifications have been approved by City
Engineers, Baxter & Woodman. Alderman Bolger opined he believed an 18-inch culvert
pipe is sufficient for the project.
Motion by Murgatroyd, seconded by Low, to accept the unanimous recommendation
of the Plan Commission and approve:
■ McHenry Corporate Center Resubdivision Lot 1, Unit 8 Preliminary Plat
prepared by Smith Engineering with a revision date of 7/18/01;
■ McHenry Corporate Center Resubdivision Lot 1, Unit 8 Final Plat prepared by
Smith Engineering with a revision date of 8/29/01 with the stipulation the Final
Plat be recorded within six months of approval.

CRYSTAL LAKE ROAD AND ROYAL DRIVE, TRAFFIC SIGNAL, REJECT SOLE BID
`.. AND AUTHORIZE RE-BIDDING
Director of Public Works Batt addressed Council stating on August 14, 2001, bid
specifications were sought and opened for the purpose of installing a traffic signal at the
intersection of Crystal Lake Road and Royal Drive. Director Batt explained the bid

included repaving and installation of a series of islands. Home Towne Electric submitted
the only bid in the amount of $267,430.10. Director Batt stated Home Towne Electric's bid
is considerably higher than the estimated $215,281 and the budgeted amount of $175,000.
Staff requested Council approval to waive formalities and reject the sole bid of
Home Towne Electric and to authorize rebidding of the project in mid-winter in anticipation
of a better bidding climate.
Alderman Glab stated he would like to see a light and a small sign acknowledging
the subdivision. Director of Public Works Batt advised, at a minimal cost, conduit could be
installed prior to repaving. Discussion ensued. It was the consensus of Council to defer
discussions concerning installation of conduit for a light and sign, at Crystal Lake Road
and Royal Drive, to a Public Works Committee meeting.
Motion by Murgatroyd, seconded by Wimmer, to reject the Home Towne Electric bid
for installation of a traffic signal at Crystal Lake Road and Royal Drive in the amount of
$267,430.10, and to authorize the re-bid of this project at a later date.

MAYOR— STATEMENT AND REPORT
Mayor Althoff reminded Council of the information meeting with residents of the
Hunterville Subdivision on September 19, 2001 at 7:00 p.m. in the Council Chambers. The
topic of the meeting is annexation and possible water and sewer connection.
COMMITTEE REPORTS
Alderman Bolger informed Council of a Public Works Committee meeting scheduled
for September 12, 2001, and advised the topics will be Cooney Heights drainage issues,
Larkin Lane and restricting traffic on Allen Avenue.
DEPARTMENT HEAD REPORTS
Director of Public Works Batt informed Council Riverside Drive, between
McCullom Lake Road and Washington Street, is closed for construction of the North Sewer
Interceptor Project.
Director of Community Development Napolitano advised Council Douglas Martin,
City Planner, begins his position with the City on September 24, 2001. Director Napolitano
also reported Jason Lee begins his position as Inspector 1 on September 17, 2001.
Director of Parks & Recreation Merkel reported the fall baseball program has begun
and is receiving a good response. Alderman Glab noted he had received a telephone call
from a constituent indicating the City did not offer enough activities for seniors.

L-- City Administrator Lobaito informed Council he and Director of Public Works Batt
attended the Edgebrook Drainage Phase II Engineering Planning grant presentation on
August 5, 2001. City Administrator Lobaito advised Council the City is requesting $40,000
to be applied to this project. He opined information on the status of the applications would
not be received until late September or October.
NEW BUSINESS
Alderman Low advised Council she has been approached regarding the signs
displayed indicating Riverside Drive is closed. The signs are causing concern to business
owners on Riverside Drive who believe the signs indicate the entire street is closed.
Alderman Low inquired if a more understandable sign could be displayed indicating to
residents the businesses on Riverside Drive are still open for business during construction.
Staff was directed to research this issue.
