At roll call the following Aldermen were present: Bolger, Glab, Low, Murgatroyd, Wimmer. Absent: None. City Staff in attendance were: City Administrator Lobaito, Assistant City Administrator Maxeiner, City Attorney McArdle, City Clerk Jones, Director of Public Works Batt and Director of Community Development Napolitano. Alderman Bolger requested Council have an opportunity to review the job descriptions for the positions of Assistant City Administrator and Information Technology Specialist prior to either position being filled. REQUEST FOR ZONING MAP AMENDMENT, CONDITIONAL USE PERMIT AND VARIANCE - 1309 N. RICHMOND ROAD Applicant, Kimberly Popovich, 4005 Boone Creek Circle, was in attendance. Director of Community Development Napolitano stated the Petitioner is requesting Council approval to rezone the property located at 1309 N. Richmond Road from 0-1 Local Office to RM-2 High Density Residential. Additionally, the Applicant is requesting the granting of a conditional use permit to allow minimum square footage per unit in the RM-2 District and Page 7 12/17/01 a variance to reduce the north side yard setback from 15 feet to 20 feet. The Applicant intends to construct a 10-unit apartment building on the site. Thomas Popovich, attorney for the Applicant, addressed Council noting the benefits of additional multi-family housing in the community, opining the benefits outweigh the detriments. Mayor Althoff noted the Zoning Board of Appeals recommendations at the Public Hearing held on October 18, 2001, with regard to the Petitioner's request: ■ To deny the zoning request from 0-1 to RM-2 by unanimous vote; ■ To deny the side yard setback variance by unanimous vote. Mayor Althoff stated an affirmative vote from four of the five members of the Council, a supermajority determination, will be required in order to over ride the Zoning Board's recommendation. It was noted no vote was taken on the conditional use permit during the Zoning Board of Appeals hearing as the requested zoning reclassification was not approved. City Attorney McArdle inquired if Applicant had any objection to the zoning reclassification and the setback variance being voted on simultaneously. The Applicant responded a single simultaneous vote would be acceptable. �-- Alderman Glab noting existing congestion expressed concern regarding additional vehicular traffic in the area. Alderman Low concurred with Alderman Glab, expressing concern regarding the impact of additional vehicular traffic on both Route 31 and Freund Avenue. Alderman Bolger expressed concern regarding drainage issues and protection of the older residences in the neighborhood. Mayor Althoff opened the floor to public comments. Pamela Gough, of 3615 W. Freund Avenue, voiced severe concern about drainage. She also noted apprehension about destruction of trees on the property, which she believes are protected by the City's Tree Preservation Ordinance. Dave Henderson, of 1311 N. Richmond Road, stated his hopes regarding Council's concurrence with the recommendation of the Zoning Board of Appeals and his desire for the character of the neighborhood, principally the old homes in the area, to remain unchanged. Page 8 12/17/01 Motion by Bolger, seconded by Low, to accept the unanimous recommendation of the Zoning Board of Appeals, and to deny the Applicant's following zohing requests for the property located at 1309 North Richmond Road: ■ a zoning map amendment from 0-1 Local Office to RM-2 High Density Residential; ■ a conditional use permit to allow minimum square footage per dwelling unit to permit construction of a 10-unit apartment complex; and ■ a variance from 15' to 10' for the north side yard setback. Voting Aye: Bolger, Glab, Low, Murgatroyd, Wimmer Voting Nay: None. Absent: None. Motion carried. HICKORY CREEK FARM LEASE AGREEMENT City Administrator Lobaito stated in 1994 the City of McHenry was successful in securing grant funds through the Open Space Lands Acquisition and Development, OSLAD, Program for the purchase of the Hickory Creek Farm property. In acquiring the property the City also took possession of the barn which was then leased to Mickey Sikula, who operates a horse boarding and training facility. The City has not yet developed a comprehensive plan for the ultimate use of the property and consequently has maintained the lease with Mr. Sikula, which is renewed annually. City Administrator Lobaito advised the current lease for the Hickory Creek Farm between the City of McHenry and Mickey Sikula expires on January 31, 2002. He presented a draft of the proposed Lease Agreement for discussion and requested Council consider approval of a two-year term for the lease agreement including an increase of the monthly lease amount to $2,005 in 2002 and an amount to be determined in 2003, pursuant to the Consumer Price Index of All Urban Consumers for Chicago-Gary-Kenosha, published by the U.S. Department of Labor. City Administrator Lobaito stated, following consensus by Council, a request for formal action will be placed on the January 7, 2002 regularly scheduled Council Meeting Agenda. Nancy O'Conner, a resident of McHenry and an investigator, for eleven years, for the Hooved Animal Humane Society, stated she boards her horse at the Hickory Creek Farm opined the facility was one of the most meticulously maintained stables in the area. Ms. O'Conner complimented Mr. Sikula on the condition of the horses in his care, the cleanliness of the stable and opined the City should be very proud of Mr. Sikula's tenancy Motion by Bolger, seconded by Low, to approve the terms of the proposed lease agreement and to instruct Staff to prepare the lease agreement for formal action by Council at the January 7, 2002 regularly scheduled Council Meeting. Page 9 12/17/01 REQUEST FOR SUBORDINATION OF LIEN - QU AUTOMOTIVE 926 NORTH FRONT STREET City Administrator Lobaito advised Council Joseph Rubino, owner of D&J Automotive, 926 North Front Street, was granted a Department of Commerce and Community Affairs Revolving Loan with the City in 1998. The loan is secured by a second mortgage position against the property located at 926 North Front Street. First Midwest Bank currently holds the first mortgage position. Mr. Rubino is attempting to refinance an existing loan for $80,000 with Illinois State Bank to reduce the interest rate. The loan would pay off the First Midwest Bank loan. Illinois State Bank would secure their proposed loan with a mortgage filed against the property, and move to first mortgage position. City Administrator Lobaito stated Mr. Rubino requested the City of McHenry execute a Subordination of Lien, permitting Illinois State Bank to obtain first mortgage position against the property. The City of McHenry would continue to hold second position. City Administrator Lobaito informed Council the Subordination of Lien has been reviewed by City Attorney McArdle. In response to Alderman Murgatroyd's inquiry, City Clerk Jones noted revolving loan payments are current. Motion by Bolger, seconded by Glab, to authorize the Mayor's execution of a Subordination of Lien Agreement with Illinois State Bank regarding the City's Department of Commerce and Community Affairs Revolving Loan for the property located at 926 North �- Front Street, owned by Mr. Joseph Rubino. Voting Aye: Bolger, Glab, Low, Murgatroyd, Wimmer Voting Nay: None. Absent: None. Motion carried. RECOMMENDATION TO NAME AMCORE BANK AS CITY OF MC HENRY DEPOSITORY Assistant Administrator Maxeiner stated the City of McHenry's existing banking services agreement with Amcore Bank expires December 31, 2001. In 1998 the City Council determined banking services should be revisited after every Mayoral election. City Treasurer Welter and Staff received authorization from Council to conduct a competitive process for the selection of the depository bank for the City. Requests for Proposal for Municipal Depository information were distributed with eight local banks responding. The final responses were summarized, and, based upon the qualifications of each financial institution, Treasurer Welter and Staff narrowed the candidates to four. Interviews with representatives from each of the qualifying institutions were conducted. At the Finance and Personnel Committee meeting held on December 4, 2001 Chairman Alderman Murgatroyd opined all of the final qualifying financial institutions could provide the services required by the City of McHenry. Assistant City Administrator Maxeiner noted the City's current depository, Amcore Bank, has provided several services free of charge including the following: Direct Deposit Payroll, Wire Transfers, Checking, On-Line Banking, City Credit Card (minimal fee), subject to the City's maintenance of a Page 10 12/17/01 $1.3 million annual average balance in our account. Amcore Bank has provided numerous services to the City in a professional, expedient manner. Some discussion followed. It was noted the recommendation of the Finance and Personnel Committee was to continue the relationship with Amcore Bank. Motion by Murgatroyd, seconded by Bolger, to retain the services of Amcore Bank as the City of McHenry Depository for a term expiring April 30, 2004, subject to the inclusion of a sixty-day termination clause. Mayor Althoff noted the City has adopted a new policy which will be incorporated in the new Subdivision Control Ordinance and will require developers to submit a traffic study dictating the location of stop signs. Page 12 12/17/01 RESOLUTION AND JOINT AGREEMENT WITH ILLINOIS DEPARTMENT OF TRANSPORTATION FOR ROUTE 120 IMPROVEMENTS Assistant Director of Public Works Marcinko outlined the Resolution and Joint Agreement between the Illinois Department of Transportation (IDOT) and the City of McHenry for Illinois Route 120 Improvements. Assistant Director Marcinko noted there are multiple items which will be considered on a cost share basis and others which requires the City absorb the entire cost. Assistant Director Marcinko informed Council the Route 120 improvements is a unit cost project with the final cost determined by multiplying the final quantities times the contract prices, plus 15% for construction and preliminary engineering. The total City of McHenry financial responsibility is $141,635 for the Illinois Route 120 Reconstruction Project, which includes traffic signals, new sidewalks, curb and gutter, storm sewer, parking lanes and water main adjustment. It was noted the traffic signals already exist but will be upgraded. Some discussion occurred. Staff recommended postponement until a later date the installation of the Commercial Avenue public right-of-way, in order to permit acquisition of easements to extend fire hydrants along Illinois Route 120. Assistant Director Marcinko stated the following discretionary items should be considered: • 12-inch new watermain from Oak Drive to Scully Avenue on the north side of Illinois Route 120: This item is in accordance with the City's Master Plan adopted in February 1994 and would connect two water plants together improving flow and offering improved fire protection to the business district along Illinois Route 120. The cost of engineering and watermain construction is approximately $414,000. • Street Lights: In order to meet the new federal guidelines for street lights along Illinois Route 120, the cost would be approximately $800,000 for cast aluminum light poles. Several options have been considered: 1. Provide lighting for the entire project within the City limits with cast aluminum poles, at a total cost of approximately $800,000. Black colored poles would cost approximately $840,000. 2. Provide lighting at sixteen intersections within the project to meet federal lighting guidelines, two light poles at each full intersection and one at each 3- way intersection: 19 cast aluminum poles $114,000 ($6,000 per pole) 19 black colored poles $119,700 ($6,300 per pole) 3. Provide lighting at only the signalized intersections, five, within the project; two mast arms per intersection: 10 cast aluminum poles $ 60,000 ($6,000 per pole) 19 black colored poles $ 63,000 ($6,300 per pole) Assistant Director Marcinko noted the additional cost for each black colored pole, with a smooth cast aluminum finish, is approximately $200 to $300 per pole. He also pointed out if the City should choose to install black-colored lighting poles, IDOT, at a City of McHenry cost of$400 per pole, will provide black traffic signal poles. Page 13 12/17/01 Assistant Director Marcinko advised Council, the bid letting for the project is June 2002. The award of the contract will likely occur in July 2002. Upon award of the contract for the improvements, the City is required to pay the State of Illinois 95% of the City's obligation under the Agreement. Mayor Althoff noted the original cost of the project was $800,000, which through Staffs commendable efforts, has been reduced significantly. Director of Public Works Batt advised the lighting project meets federal standards and will be higher and brighter than currently exists. Director Batt also noted power consumption would be reduced due to the modernized fixtures. Alderman Murgatroyd expressed concern regarding sufficient lighting as a safety factor, expressing no strong preference for the black light pole over the silver light pole. Director Batt responded to Alderman Murgatroyd's concerns stating there will be sufficient light when used in conjunction with parking lot lighting adjacent to the roadway. Alderman Bolger expressed opposition to any additional expense, which may be incurred by utilizing black lighting poles rather than the standard silver poles. Alderman Glab stated his concern regarding insufficient lighting along sidewalks, as opposed to street lighting, but stated he would favor the black poles in this project as more aesthetically pleasing. Staff was directed to explore surrounding municipalities and provide �-' Council with photographs of black poles in order to make a comparison. City Administrator Lobaito suggested Staff provide Council a copy of the lighting plan for review when the plan is received from IDOT. It was the consensus of Council to provide street lighting at all intersections with direction that should Staff determine there is insufficient light at the intersection they contact IDOT regarding providing additional street lighting and inform Council of the additional cost. The decision regarding whether the light poles should be black or the standard silver was deferred to a future Council meeting. It was the consensus of Council to postpone installation of the watermain from Oak Drive to Scully Avenue on the north side of Illinois Route 120. MAYOR STATEMENT AND REPORT Mayor Althoff summarized the 2001 Annual Report of the McHenry Landmark Commission. Mayor Althoff requested Council confirm the appointment of Karen James, to the McHenry Landmark Commission, to fulfill the unexpired term of Henry Nell who resigned. Ms. James' term would expire on April 30, 2003. Mayor Althoff noted Ms. James' appointment comes with the recommendation of Chairman Greg Lofgren. Mayor Althoff noted the City of McHenry has the distinct honor of having the International President of Kiwanis as a resident of the City, Mr. Brian Cunat. The McHenry Noon Kiwanis Club is requesting Council consider the placement of an acknowledgement at the entrance points of the City during Mr. Cunat's term of office for a period of one year. Alderman Bolger opined his support of such an acknowledgement, suggesting the City first determine the exact size and location prior to commitment. Council concurred with Alderman Bolger. Staff was directed to obtain the requested information at which time the matter will be brought back to Council for consideration. COMMITTEE REPORTS There were no Committee Reports. DEPARTMENT HEAD REPORTS Director of Community Development Napolitano reported a vehicle struck the VFW building on Friday, December 14, 2001. The crash occurred near the storage area of the building creating minor structural damage. The area has been boarded and repair will commence immediately. City Administrator Lobaito recommended Council consider delaying the issuance of bonds for the Route 31 McCullom Lake Road Project. City Administrator Lobaito advised Staff was originally authorized to issue $940,000 in Alternate General Obligation Bonds as part of the financing source for the project. The balance of the funding was to be provided from Surface Transportation Funds via the Council of Mayors, in the amount of $520,000 and Illinois First Funds, in the amount of$750,000, via State Representative Lee Daniels. City Administrator Lobaito noted he has recently been made aware of the possibility of receiving additional funding from the Council of Mayors. City Administrator Lobaito stated Mayor Althoff will be requesting additional funding in the amount of $480,000 toward this project from the Council of Mayors. This would bring total funding for this project from the Council of Mayors to $1,000,000, the maximum permitted for any one project. City Administrator Lobaito reported, in addition to the request to the Council of Mayors, the City is submitting an application to Congestion Mitigation and Air Quality Improvement Program (CMAQ) for funding. Funds through this program are directed toward projects, which improve air quality. In this case, the improvement of air quality would be the lowering of vehicle emission by interconnecting two or more traffic signals in the area. The CMAQ application submittal date is March 2002 and will be awarded in the fall of 2002. Page 15 12/17/01 Staff recommended Council delay issuance of the bonds for the McCullom Lake Road Route 31 Project as, potential funds from the programs outlined, if successful, can reduce the bond issuance. It was noted there would be minimal cost involved in issuing the bond as a separate bond at a later date. Motion by Murgatroyd, seconded by Bolger, to direct Staff to postpone the issuance of the bonds for the McCullom Lake Road Route 31 Project pending the outcome of the applications for additional funding to the Council of Mayors and CMAQ. City Administrator Lobaito summarized the Tax Increment Financing (TIF) District discussion, which occurred at the Committee of the Whole meeting on December 10, 2001. He noted the next step in the process is to conduct a Public Meeting for the residents within the TIF for the purpose of bringing forth a draft of the redevelopment plan. The Public Meeting is anticipated to take place on January 14, 2002. Notice to affected residents within the TIF will be sent out immediately after the first of the year. City Administrator Lobaito also reported Staff is exploring the cost of the Phase I �., Environmental Study for the TIF District. He anticipates including this matter as an Agenda Item at the January 7, 2002 regularly scheduled meeting. Additionally, City Administrator Lobaito advised Council he is working with Trkla, Pettigrew, Allen & Payne regarding a Letter of Proposal for a Project Coodinator to assure the Study is completed in a timely manner. This matter will be an Agenda Item at a regularly scheduled meeting sometime in January, 2002. City Administrator Lobaito outlined the Dispatch Service Agreement stating the City of McHenry has contracted services with Johnsburg, McCullom Lake and the McHenry Township Fire Protection District for dispatching. Staff anticipates evaluation of the costs on a yearly basis. City Administrator Lobaito will bring the Dispatch Service Agreements before Council for consideration in early January 2002, in order to precede Budget discussions, although the agreements do not expire until May 1, 2002. NEW BUSINESS Alderman Glab inquired about the status of the Dartmoor Drive aesthetics improvement. City Administrator Lobaito advised following exploration of various treatments, proposed improvements are cost prohibitive. Therefore, the project has been abandoned. Alderman Glab suggested Staff explore additional options. It was the consensus of Council to address the matter at a Public Works Committee Meeting. Increasing annual salary to $100,000, retroactive and prorated from December 1, 2001 to March 29, 2002; in consideration of Deputy Chief Donahue's duties in fulfilling the position of Chief of Police in addition to Deputy Chief; 2. Resignation of Deputy Chief Donahue, upon signing the Release and Settlement Agreement, effective March 29, 2002, or earlier if he so chooses; 3. City of McHenry to contribute to the payment of health insurance premiums, not to exceed $61,000, until Deputy Chief Donahue becomes eligible under another heath insurance plan, upon reaching the age of 65, or death; 4. Reimbursement to Deputy Chief Donahue for attorney's fees in an amount not to exceed $10,000; and 5. Motion by Glab, seconded by Wimmer, to direct Staff to draft an ordinance repealing the Police Commission's involvement in the search and selection of a Police Chief for the City of McHenry and transferring authority for the search and selection to the Council, subject to the matter being brought forward for further discussion and consideration at the next regular scheduled Council meeting. City Administrator Lobaito recommended soliciting the expertise of a search firm in the hiring of the Chief of Police, whether or not the Police Commission is involved in the process. He opined the assistance of a search firm offers every applicant an equitable opportunity and will expedite the process. The City is currently involved in the budget process and has a number of vacancies in Administration, which need to be filled. Alderman Low concurred with City Administrator Lobaito's suggestion regarding a search firm. Alderman Bolger objected strenuously to using a search firm. Alderman Murgatroyd stated he would not consider repealing the current ordinance without serious consideration being given to hiring a search firm for the selection process. In response to Alderman Low's inquiry Mayor Althoff stated she has a number of applicants she is in the process of interviewing and will be bringing the information before Council shortly. It was the consensus of Council to postpone a decision regarding use of a search firm in the Chief of Police hiring process.
