ORDINANCE NO 21-30
AN ORDINANCE GRANTING APPROVAL OF A PRELIMINARY AND FINAL PLAT OF SUBDIVISION OF AUTHENTIX
AT MCHENRY IN THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as contemplated
under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage of this Ordinance
constitutes an exercise of the City's home rule powers and functions as granted in the Constitution of the State
of Illinois; and
WHEREAS, a petition has been filed with the City by Continental 601 Fund, LLC. ("CONTRACT
PURCHASER") on behalf of Vantage McHenry Holdings, LLC. ("PROPERTY OWNER"), requesting approval of the
subdivision of the property legally described in "Exhibit A"; and
WHEREAS, a public meeting on said petition was held before the Planning and Zoning Commission on
May 19, 2021 in the manner prescribed by ordinance and statute, and as a result of said meeting, the Planning
and Zoning Commission did recommend to the City Council the granting of the requested final plat of
subdivision; and
WHEREAS, the City Council finds that the approval of the final plat is in conformance with the ordinances
of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY, MCHENRY
COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1: That the final plat entitled, "Final Plat of Subdivision of Authentix at McHenry," prepared
by V3 Engineers, Scientists, and Surveyors, and bearing the date 3/24/21, attached hereto ("Exhibit B") and
incorporated herein by reference, be and the same is hereby approved with the following conditions:
1. The recordation of the final plat shall occur within six (6) months of City Council approval.
2. An access easement shall be granted to the City of McHenry, their successors and assigns, that allows
the City to install, maintain, renew, and remove facilities used in connection with stormwater drainage,
if such maintenance obligations are not met by the property owner(s).
3. The City shall provide the property owner(s) at least thirty (30) days' notice, or another mutually
agreed upon timeframe, to address any maintenance obligations that have been unfulfilled.
4. Any additional public utility easements as required by federal, state, and local laws or at the discretion
of the Public Works Director shall be provided to the Public Works Director for review and final
approval before recordation of the final plat.
5. A plat restriction shall be placed on the Plat of Subdivision prior to recordation that requires all future
installation of residential landscaping and screening strips, as required by local ordinance, to be
substantially similar in appearance and design as the residential landscaping and screening strip on lot
1 as determined by the City of McHenry Community Development Director.
SECTION 2: All ordinances or parts thereof in conflict with the terms and provisions hereof are hereby
repealed to the extent of such conflict.
SECTION 3: This Ordinance shall be published in pamphlet form by and under the authority of the
corporate authorities of the City of McHenry, McHenry County, Illinois.
SECTION 4: This Ordinance shall be in full force and effect from and after its passage, approval, and
publication in pamphlet form as provided by law.
