ORDINANCE NO 21-29 AN ORDINANCE GRANTING VARIATIONS, ZONING MAP AMENDMENT, AND CONDITIONAL USE PERMIT FOR THE AUTHENTIX MCHENRY INTEGRATED DESIGN DISTRICT DEVELOPMENT LOCATED EAST OF THE INTERSECTION OF N. RICHMOND ROAD AND BLAKE BOULEVARD, IN THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage of this Ordinance constitutes an exercise of the City's home rule powers and functions as granted in the Constitution of the State of Illinois; and WHEREAS, a petition has been filed with the City by Continental 601 Fund, LLC. ("CONTRACT PURCHASER") on behalf of Vantage McHenry Holdings, LLC. ("PROPERTY OWNER"), requesting a Zoning Map Amendment to IDD, Integrated Design District, a Conditional Use Permit to allow a planned multifamily residential development, along with the approval of certain variances for the property known as Lot 1 of the Subdivision of Authentix at McHenry listed in "Exhibit A", attached hereto and incorporated herein; "SUBJECT PROPERTY"; and WHEREAS, a public hearing on said petition was held before the Planning and Zoning Commission on May 19, 2021 in the manner prescribed by ordinance and statute, and as a result of said meeting, the Planning and Zoning Commission did recommend to the City Council the granting of the requested Variation,Zoning Map Amendment, and Conditional Use Permit; and WHEREAS, the City Council has considered the evidence and recommendations from the Planning and Zoning Commission and finds that the approval of the requested Conditional Use Permit, Zoning Map Amendment, and Zoning Variations are consistent with the objectives of the City of McHenry Zoning Ordinance to protect the public health, safety, morals and general welfare of its residents. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS: SECTION 1:That the SUBJECT PROPERTY is hereby granted a Variation from §11-11-4 of the Zoning Ordinance and §12-4-3 of the Subdivision Control and Development Ordinance to allow for simultaneous review of a Preliminary and Final Plat of Subdivision and Plan. SECTION 2: In granting said Variation,the City Council finds that the Approval Criteria for Variances listed in §11-19-5 have been met. SECTION 3: That the SUBJECT PROPERTY is hereby granted a Zoning Map Amendment from the C-5 Highway Commercial District to the IDD Integrated Design District. SECTION 4: In granting said Zoning Map Amendment, the City Council finds that the Approval Criteria for Zoning Map Amendments listed in §11-5-5 of the City of McHenry Zoning Ordinance have been met. SECTION 5: That the SUBJECT PROPERTY is hereby granted a Conditional Use Permit to allow a planned, 288-unit, multifamily Integrated Design District development subject to the following conditions: 1. The project shall be in substantial conformance with the following plans, attached hereto, and incorporated herein as "Exhibit B": Overall Site Plan dated 5/12/2021, Landscape Construction Documents dated 4/22/2021, and Conceptual Elevations, Floor Plans, and Imagery dated 01/04/2021, 02/25/2021, and 3/25/2021. 2. The owner of the Subject Property shall install a 6-foot privacy fence along the eastern property line. 3. The owner of the Subject Property shall enact a backup Special Service Area encompassing the Subdivision of Authentix at McHenry on or before June 7, 2022. 4. The property owner shall replace all damaged or destroyed screening facilities, such as privacy fencing and landscaping, within 30 days of notification by the City of McHenry or other reasonable timeframe as determined by the Zoning Administrator. 5. The property owner shall be required to install a secondary emergency access on the property subject to be reviewed and may be approved by the McHenry Police Chief. 6. All other federal, state, and local laws shall be met. SECTION 6: In granting said Conditional Use Permit, the City Council finds that the Approval Criteria for Development Review listed in §11-11-5 and Approval Criteria for Conditional Use Permits listed in §11-15-5 in the City of McHenry Zoning Ordinance have been met. SECTION 7: That the SUBJECT PROPERTY is hereby granted relief from Minimum Floor Space Requirements, listed in §10-1-10 of the City of McHenry Building Regulations to allow the construction of 485 ft2 efficiency units and 595 ft2 1-bedroom units in lieu of the required 550 ft2 and 650 ft2. SECTION 8: In granting said relief, the City Council finds that the request will not negatively impact the health, safety, and welfare of the general public. SECTION 9:That the SUBJECT PROPERTY is hereby granted relief from §10-20-13 of the City of McHenry Sign Code to allow for the construction of two (2) temporary advertising signs with a combined area of sixty-four square feet. SECTION 10: In granting said relief from the Sign Code, the City Council finds that such relief: 1. Will not be materially detrimental to the public welfare or injurious to other property in the vicinity; 2. Will not impair an adequate supply of light and air to adjacent property, increase the danger of fire, endanger public safety, or substantially impair property values in the neighborhood; 3. Shall not give the property owner or business an unfair advantage over a similar business; and 4. Will not cause a hazard to the public safety by being distracting because of size or location, or being located within rights-of-way. SECTION 11: All ordinances or parts thereof in conflict with the terms and provisions hereof are hereby repealed to the extent of such conflict. SECTION 12: This Ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, McHenry County, Illinois. SECTION 13: This Ordinance shall be in full force and effect from and after its passage, approval, and publication in pamphlet form as provided by law. Passed this 7th day of June, 2021.
