REGULAR CITY COUNCIL MEETING
Monday, May 17, 2021, 7:00 p.m.
In light of the current COVID-19 public health emergency, this meeting will be held remotely
only.

Call to Order: The City Council of the City of McHenry, Illinois, met in regular session on
Monday, May 17, 2021, at 7:00 p.m.
The meeting was held remotely via Zoom due to the COVID-19 pandemic. The meeting was
in compliance with the Open Meetings Act per guidelines by the Illinois Attorney General's
Office.

Roll Call: Mayor Jett called the roll call.
Members present: Alderman Santi, Alderman Glab, Alderman McClatchey, Alderman Harding
Alderman Strach, Alderman Devine, Alderwoman Miller, and Mayor Jett. Others present:
Attorney McArdle, Administrator Morefield, Director of Public Works Strange, Director of
Community Development Polerecky, Finance Director Lynch, Director of Parks and Recreation
Hobson, Director of Economic Development Martin, Chief of Police Birk, City Planner Sheriff,
and City Clerk Ramel.
Pledge of Allegiance: Mayor Jett led the pledge.
Public Comments: Keith Varkalis, resident, spoke regarding the zoning notice signs that went
up located across from Aldi, he noted that the IL statutes states that the signs need to be put
up two weeks prior, in a spot visual to the residents. He explained the sign facing the Aldi is a
spot where many can view it. In conclusion had requested that the sign faces west so that it
could have more public visibility.
Kristine Reinhard, resident, spoke regarding her experience, she attended the last planning
and zoning meeting; where she learned the process of what the training is and currently what
is transpiring. She learned that there was a decision to forgo the two-point process, questioned
the consistency of it and training. Demanding that Continental go through the correct process;
in regard to the zoning hearing that is upcoming for the apartment complex, by Continental.
Sam Catalano, resident, spoke to mirror the above statements and that zoning should follow
the process as well.

Consent Agenda: Motion to Approve the following Consent Agenda Items:
A. An Ordinance amending Section 7-4-25 Fifteen Minute Parking of the McHenry
Municipal Code by adding a third, fifteen-minute parking spot on the north side of
Main Street in front of 3908 W. Main Street; (Birk)
B. Award of a material supply contract for bulk rock salt to Compass Minerals of
America, Inc. of Overland Park, Kansas in the amount of$114,463.56 (1,500 tons at
$76,309 per ton); and, to approve a contingency allowance for a twenty percent
overage on the contract in the amount of$22,893.00; (Strange)
C. Award of a contract to Visu-Sewer Inc. for the 2021 Sanitary Sewer Lining Program
in the amount of $170,913.00 (actual amount may vary based on final measured
quantities). (Strange)
D. Award of bid for the 2021 Thermoplastic Pavement Markings contract to Precision
Pavement Markings in an amount of$21,232.83 (actual amount may vary based on
final measured quantities); (Strange)
E. Liberty Club, NFP requests for street closure of Park Street from 1306/1308 Park to
Elm Street on Sunday, June 6, 2021 and Sunday, August 8, 2021 from 1:OOpm to
6:OOpm;
G. American Legion request for closure of the alley west of Riverside Drive on Sunday,
June 27, 2021 from 12:OOpm to 5:OOpm;
H. McHenry Rotary Club request to host the annual Oktoberfest Event at Miller Point on
Saturday, October 2, 2021 from 12:OOpm to 11:00pm, and to reduce fees to the event
organizers by 50% for the event;
I .Parks & Recreation Facilities and Special Use Permit Requests;
J. May 3, 2021 City Council Meeting Minutes;
K. Issuance of Checks in the amount of $191,911.26;
L. Issuance of As Needed Checks in the amount of$951,573.53
A motion was made by Alderman Santi and seconded by Alderman Glab to approve
Consent Agenda Items as presented: Roll Call: Vote: 7-ayes: Alderman Santi, Alderman
Glab, Alderman McClatchey, Alderman Harding, Alderman Strach, Alderman Devine,
Alderwoman Miller. 0-nays, 0-abstained. Motion carried.
*Clerks Note: Consent Agenda Item F pulled for separate consideration by Alderman Glab
F. Dancin' on Main Event request for street closure of a portion of Main Street from
9:OOam to 5:OOpm on Saturday, June 26, 2021, to allow open container and
consumption from 11:00am to 5:OOpm, and to reduce fees to the event organizers
by 50% for the event;
Alderman Glab expressed his concerns with the closing off the Walgreens exit during this
event. The number of cars that enter and exit along with delivery trucks is very frequent on a
Saturday. The space for cars to turn around is not conducive to what is being asked, proposed
that we move it back a few hundred feet.
Chief Birk did meet with the event planners and walked the streets with them, in regard to live
music for the Main Street Event.

• The southwest corner of Elm Street and Riverside Drive as "Honorary Kay
Bates Way"
A motion was made by Alderman Santi and seconded by Alderman McCatchey to

B. Motion to approve an Ordinance amending the FY21/22 Tax Increment Finance Budget -�
in the amount of$14,500; and, to enter into an agreement with HR Green, Inc. to update
the 80% construction plans for the Riverwalk from north of the Route 120 Bridge to
South of Weber Park. (Hobson)
As explained by Director of Parks and Recreation, Hobson, work began in 2014 for the second
phase of the Riverwalk and now would like to add more to finalize the design elements. The
Riverwalk Foundation President, John Smith was present as well and he thanked The Council
for considering this along with he discussed the support of the business owners on Riverside
Drive. Alderman Santi thanked John Smith and his time for going over the Riverwalk ideas with
him. No public comment.

C. Motion to permit the property located at 2303 W. Country Lane to connect to the City's
sanitary sewer system and pay resident rates for both the connection and sanitary sewer
usage. (Polerecky)
Waiving annexation, will pay the normal resident rate. Has occurred with two separate
other properties. .�

a. Motion to approve the transfer of a Class B Liquor License from Big ANG, Inc.
(Hickory Pit) to Kojak's McHenry, Inc. dba Kojak's, located at 3102 W. Illinois
Route 120. (Mayor Jett)
This is a whole new application and considered a brand new license, they are paying for almost
a full year, per Deputy Clerk Monte Johnson. No public comment.

Discussion Items:
c. Presentation by Erik Doersching of Tracy Cross & Associates regarding the
results of an Apartment Study. (Polerecky)
Director Polerecky explained that there has been many inquires for apartments therefore Erik
gave an overview of the findings regarding this study.
d. Discussion regarding permitted areas for the establishment of Recreational
Marijuana Dispensaries. (Polerecky)
Cody Sherriff discussed the zoning regulations and shared a brief presentation regarding
the locations. Mayor Jett asked for input from The Council. The discussion went on for some
time regarding this. Many were in favor of expanding the areas where the dispensaries
could be located. Chief Birk did go ahead and discuss the security of the operations as well.
Conditional use /permitted use was also explained by Director Polerecky. Conditional Use
will prolog the process. The permitted use will allow a faster turn around time.
Executive Session:
A motion was made by Alderman Glab and seconded by Alderwoman Miller to adjourn
to Executive Session at 8:45 p.m. to discuss pending litigation the purchase or lease of
real estate property for the use of the public body, including meetings held for the purpose of
discussion whether a particular parcel should be acquired {5 ILCS 120/2(c)(5)).
Mayor Jett reconvened the meeting from Executive Session at 9:05 p.m. A motion was
made by Alderman Glab and seconded by Alderwoman Miller to return to open session.

carried.
Staff Reports:
f. Transmittal of Staff Report for May 17, 2021
Per Administrator Morefield to direct questions to himself regarding this report.
There will also be new IPADS old ones will be swapped out, look for information regarding
this.
`- In 14 weeks construction for Thorton's to breaking ground.
Per Director Hobson - rentals are open, live music will be on the Riverwalk from 1-4
