MARCH 20, 1996
The Regular Meeting of the McHenry City Council was called to order by Mayor
Cuda on Wednesday, March 20, 1996 at 7:30 P.M. in the Council Chambers of the
Municipal Center. At roll call the following Aldermen were present: Bolger, Locke,
Bates, Lawson. Alderman Baird arrived at 7:36 P.M. Absent: None. City Staff in
attendance were: City Clerk Althoff, Chief of Police Joyce, Director of Building and
Zoning Lobaito, Director of Public Works Batt, City Attorney McArdle. Absent:
Director of Parks and Recreation Merkel.
TEN MINUTE PUBLIC INPUT SESSION
No one signed in to speak during the Ten Minute Public Input Session.
PRESENTATION BY McHENRY TOWNSHIP FIRE PROTECTION DISTRICT TO
McHENRY POLICE DEPARTMENT
McHenry Township Fire Protection District Fire Chief, Chris Bennett, and Code
Enforcement Officer Steven Laing were in attendance. Chief Bennett presented
plaques of commendation to Officers John Jones, Edward O'Donnell, David Porter and
Telecommunications Dispatcher Joseph Doherty citing their swift and professional
response to a fire call on February 15, 1996 which assisted the Fire District in saving
the lives and the home of City of McHenry residents. Director of Building and Zoning,
John Lobaito, was also thanked publicly.
Alderman Baird arrived at 7:36 P.M.
CONSENT AGENDA
Alderman Bolger requested further clarification and discussion on reimbursement
expenses for a candidate to the City Administrator's position. Council concurred.
Motion by Lawson, seconded by Locke, to approve the Consent Agenda as
presented, subject to the removal of the $851 .62 reimbursement expense for a
candidate to the City Administrator's position.

ZONING ORDINANCE REQUEST - JIFFY LUBE INTERNATIONAL
Attorney for the petitioners, James Cowlin, addressed Council. He drew
Council's attention to the affidavit from adjacent residential property owner Georgene
Taylor, stating no objection to the proposed use variation allowing an oil change and
cellular telephone facility on this property, subject to the construction of a privacy
fence and some additional landscaping improvements. Cowlin also noted the
proposed ordinance granting the use variance has been revised to include three of the
four conditions cited by the Zoning Board of Appeals at their February 19, 1996
meeting, including:
(1) A cross easement agreement shall be approved by the City and in place
prior to occupancy of the structures;
(2) Access from the abutting property to the south shall be developed prior
to occupancy permits being issued; and,
(3) Trees shall be planted along the west property line with the design and
type subject to City Council approval.
The fourth condition concerning ingress and egress to the site from McCullom
Lake Road is before Council for discussion.
The petitioners are seeking both ingress and egress to McCullom Lake Road, as
per staff recommendation, however, the Zoning Board of Appeals has recommended
only an ingress from McCullom Lake Road to the site be permitted. A lengthy
discussion ensued. Alderman Baird suggested the egress and ingress to McCullom
Lake Road from the property be permitted subject to a two-year time frame. If at any
time within the two year period the City Council determined the McCullom Lake Road
ingress and egress to be a traffic or safety hazard, Council could require at the
property owner's expense and with no litigation, the elimination of the egress onto
McCullom Lake Road from the property. The property owners agreed to this
restriction. Further discussion followed regarding waste oil refuse. Council also
discussed the possibility and desirability of the City's participation in the cost of a
potential traffic signal on Route 31 at this property's southern-most ingress and
egress.
Staff informed Council that an agreement exists between the affected property
owners and tenants regarding a possible traffic signal along Route 31 . The City is not
a party to this agreement, and as Route 31 is a State arterial thoroughfare, these
parties may deal direct with the Illinois Department of Transportation seeking the
construction of a traffic signal.
Mayor Cuda opened the floor to comments from any concerned residents in
attendance regarding this project. Curt and Donna Pepe of 3609 W. Cornell Court
addressed Council stating their objections to the construction of this type of
automotive facility at this location. Mr. Pepe continued, stating the development of
this property for the use of this type of automotive facility was most inappropriate,
citing air pollution, noise and additional traffic congestion. Mayor Cuda then noted,
as the petitioners were seeking a use variance, Council was in a position to impose
several conditions on the development of this property in an effort to alleviate the
concerns of adjacent property owners. He reminded Council this would not be the
case under other circumstances, as the property is zoned C-3 and can be developed
under the permitted conditions of this particular zoning classification.
Motion by Baird, seconded by Lawson, to acknowledge the no recommendation
of the Zoning Board of Appeals and pass an ordinance granting a use variance for the
property commonly known as 1807 N. Richmond Road to permit the construction of
an oil change facility and cellular telephone store, subject to:
(1) A City-approved cross easement agreement, in place prior to occupancy
of the structures on this property;
(2) Access from the abutting property to the south shall be constructed prior
to the occupancy permits being issued for the subject property;
(3) Staff approval of landscaping along the west property line;
(4) The construction, if engineering studies prove feasible, of a deceleration
lane on McCullom Lake Road, and a two year time frame dating from the
date of first occupancy permit whereby the McHenry City Council may,
if determined necessary, remove the property's egress to McCullom Lake
Road.

Council also requested the ordinance contain an acknowledgement that the City
of McHenry is not financially obligated to pay any portion or all of the costs associated
with the construction of a traffic signal along the Route 31 property boundaries of The
McHenry Grounds and Target developments.
ORDINANCE ESTABLISHING ADDITIONAL PROCEDURES FOR BIDDING AND LETTING
OF CONTRACTS BY THE CITY NOT OTHERWISE COVERED BY STATE STATUTES
City Clerk Althoff presented a bidding and letting of contracts ordinance draft
for Council consideration. She explained that although the City of McHenry complies
with the State Statute requiring bidding and contracting for all public improvements
in excess of $10,000, the Statute does not address bidding procedures nor does it set
criteria for determining the lowest responsible bidder. The proposed ordinance
incorporates the City's current bidding process and enumerates specific criteria to
determine the lowest responsible bidder, as per recommendation and review by Illinois
Municipal Law Handbook and City Attorney McArdle.
City Clerk Althoff noted Statutory provisions requiring competitive bidding
contain numerous exceptions. Supplies, office equipment and garbage collection are
some of these exceptions and are not subject to the requirement for competitive
bidding. Council may wish to require, through this ordinance, competitive bidding for
any item(s) or work above a specified amount. This amount could remain at the
statutory limit of $10,000 or be lowered to a more acceptable figure. A lengthy
discussion followed.

Motion by Bates, seconded by Baird, to table further discussion on this bidding
ordinance until the next regularly scheduled Council meeting on April 3, 1996.

City Clerk Althoff was directed to provide further information regarding this
ordinance in the Friday agenda packet.
RENEWAL OF LEASE BETWEEN CITY OF McHENRY AND UNION PACIFIC RAILROAD
COMPANY
Mayor Cuda explained the City of McHenry had entered into a ten-year lease
agreement with the Chicago and Northwestern Railroad for the land and passenger
station located on Main Street. This ten-year lease expired January 1 , 1996, requiring
a renewal. As the Chicago Northwestern Railroad Company was recently acquired by
the Union Pacific Railroad Company, the City of McHenry must renew the lease with
this new entity. The Union Pacific Railroad Company is requesting only a one-year
extension of the lease, as the Union Pacific Railroad typically does not enter into this
type of a lease agreement, and must revise this lease to comply and conform to their
standard lease agreements.
Motion by Locke, seconded by Bolger, to authorize the Mayor to execute the
one-year lease agreement with Union Pacific Railroad Company to lease the passenger
station and land on Main Street in the City of McHenry with a 180-day termination
notice with no cost to the City.

Mayor Cuda also noted that Trey & Tom Corporation, doing business as Main
Street Station, a bar & grill, has rented the station from the City of McHenry for $200
per month since 1986. The Trey & Tom lease expires April 1 , 1996 and must be
renewed. The terms and conditions required of the City under the Union Pacific lease
have been incorporated in the Trey & Tom Corporation lease, as well as other City
requirements i.e. indemnification of the City, appropriate insurance coverage, etc.. It
is the recommendation of staff to increase the rent from $200 per month to $300 per
month until December 31 , 1996, at which time a new lease will be presented for
Council consideration.
Mayor Cuda drew Council's attention to the letter received from Attorney
Donahue, dated March 19, 1996 stating his client's (Trey & Tom Corporation)
agreement to accept a $100 per month increase in rent effective April 1 , 1996.

Motion by Locke, seconded by Lawson, to authorize the Mayor to execute a 9-
month extension of the current Trey & Tom Corporation lease for the Union Pacific
Railroad passenger station located on Main Street for a rental fee of $300 per month.

ORDINANCE INCREASING NUMBER OF AUTHORIZED PATROLMEN
Mayor Cuda noted the attached ordinance draft will increase the number of
authorized patrolmen positions from 22 to 24. The ordinance will reflect the actual
number of patrolmen currently hired by the City of McHenry. He noted the additional
positions were recently added, one as part of the COPS FAST Grant, the other position
as part of the Drug Abuse Resistance Education Program.

NEW BUSINESS
Alderman Baird requested clarification of Director of Public Works Batt's request
to hire Conway Surveying Company to perform easement surveys for east of the River
sanitary sewer extension upon the completion of engineering studies by City Engineers
Baxter & Woodman. Discussion followed, noting the consensus of Council to hire
Conway Surveying Company to perform the easement surveys.
Alderman Locke requested the inclusion as an agenda item for the next regularly
scheduled Council meeting on April 3, 1996, recommendation s for projects to be
submitted for the Community Development Block Grant Program. Council concurred.
Director of Public Works Batt suggested the engineering and clean-up for Lakeland
Park drainage ditch be considered.
Alderman Lawson noted the next Finance Committee meeting was scheduled
for April 1 , 1996 at 7:00 P.M. and would be held in Executive Session for discussion
of Personnel.
