The Regular Meeting of the McHenry City Council was called to order by Mayor
Steven Cuda on Wednesday, September 18, 1996 at 7:30 P.M. in the Council
Chambers of the Municipal Center. At roll call the following Aldermen were present:
Bolger, Locke, Bates, Lawson, Baird. Absent: None. City Staff in attendance were:
City Clerk Althoff, City Administrator Jordan, City Attorney McArdle, Director of
Public Works Batt, Director of Building and Zoning Lobaito, Director of Parks and
Recreation Merkel and Chief of Police Joyce. Absent: None.
Mayor Cuda requested Council concurrence in presenting the City's Resolutions
of commendation and the McHenry Township Fire Protection District's recognition of
Officers Molnar and Leonard and Sgt. Prazak for their rescue efforts during the Irish
Prairie fire on Monday, September 2, 1996, as well as the presentation of $2,000 to
the D.A.R.E. Parents Committee and D.A.R.E Officer Patricia Laycock by Steven
Farshi, owner and operator of the McHenry Jeep Eagle dealership to the top of this
evening's published agenda. Council concurred.
Motion by Lawson, seconded by Bolger, to pass Resolutions of Commendation
for Police Officers James Molnar, Kathleen Leonard and Sgt. Kenneth Prazak for their j
rescue efforts during the Irish Prairie fire on Monday, September 2, 1996.
Voting Aye: Bolger, Locke, Bates, Lawson, Baird.
Voting Nay: None.
Absent: None.
Motion carried.
Mayor Cuda then presented the Resolutions to Officer Molnar, Officer Leonard
and Sgt. Prazak acknowledging and praising their heroic efforts during the Irish Prairie
fire.
Wayne Amore and Phillip Gust, Deputy Chiefs for the McHenry Township Fire
Protection District, also presented plaques of commendation to each of the officers in
recognition of their efforts. Deputy Chief Amore also noted the ongoing cooperative
and coordinated efforts between the McHenry Township Fire Protection District and
the City of McHenry.
Steve Farshi, owner and operator of the McHenry Jeep Eagle dealership,
presented a $2,000 check to the McHenry D.A.R.E. Parents Committee and D.A.R.E.
Officer Patricia Laycock. The $2,000 represents a portion of the proceeds from the
D.A.R.E./Jeep Eagle dealership "Back-to-School" fundraiser held in August. Officers
of the D.A.R.E. Parents Committee Carol Chrisman, Dave Maire and Mary Brunner
graciously accepted the $2,000 and praised Mr. Farshi for his community spirit and
interest. Mayor Cuda expressed Council's appreciation for Mr. Farshi's efforts as
well.
TEN MINUTE PUBLIC INPUT SESSION
Lucky Spooner, Development Consultant and Coordinator for Inland
Management's Olde Mill Pond Subdivision, addressed Council requesting stormwater
management construction work be allowed to take place on Saturdays at the Olde Mill
Ponds subdivision located south of McCullom Lake Road. A brief discussion followed
regarding City of McHenry ordinance requirements for conducting construction work
on Saturdays. Mr. Spooner was directed to make his request in writing enumerating
the reasons why working on Saturdays is necessary. If these reasons concern public
health and safety, Council may reconsider this request at its October 2, 1996 regular
meeting.

PUBLIC HEARING - FIRST AMENDMENT TO THE BUSCH-KNOX ANNEXATION
AGREEMENT
Mayor Cuda opened the public hearing for the First Amendment to the Busch-
Knox Annexation Agreement at 8:00 P.M. He explained the petitioner's attorney, Mr.
Guy Youman, was unable to provide all required documents for this evening's public
hearing prior to the agenda deadline. Mayor Cuda, therefore, requested a continuance
of this evening's public hearing on the First Amendment to the Busch-Knox
Annexation Agreement to October 2, 1996, which is the next regularly scheduled
Council meeting.
Motion by Lawson, seconded by Locke, to adjourn the public hearing on the
First Amendment to the Busch-Knox Annexation Agreement and continue it to October
2, 1996, the next regularly scheduled Council meeting.

ANNUAL CLAIMS ANALYSIS - SCOTT SMIRICKY, THE SPLINTER GROUP
Mr. Scott Smiricky of The Splinter Group was in attendance and presented a
brief review of the City of McHenry's health, vision and dental claims performance at
the end of the first six months. Referencing the cost analysis provided to Council in
their agenda packets, Mr. Smiricky noted the City of McHenry is currently
experiencing a very good year and is under budget by approximately $6,000. In
response to Alderman Bates' inquiry, Mr. Smiricky explained incurred claims are those
claims incurred and submitted after February 1 st and run-in claims are those claims
incurred prior to February 1 st, but submitted for payment after February 1 st. Run-in
claims are tracked for specific insurance reimbursement purposes. Specific insurance
is the insurance which pays for claims which exceed $30,000.00. City Clerk Althoff
also noted that no figure was budgeted for vision claims, although, $8,000 was
previously calculated by former City Administrator Jerry Peterson. It was incorrectly
assumed by the 1996-97 Budget Committee that the $335,000 figure budgeted for
claims included the $8,000 vision claims figure. The City is still under budget, even
with this omission.

Mr. Smiricky also noted he had met with City Auditor John Eder to review
1995-96 year-end figures. Mr. Smiricky also stated his availability to assist staff in
determining 1997-98 premium and claim figures. In conclusion, Council was provided
with cost comparison figures between the City of McHenry's current self-insured
program and the 1993-94 City of McHenry Blue Cross/Blue Shield program. It was
noted the City of McHenry's current health insurance program is a $51 ,000 savings
over the 1993-94 Blue Cross/Blue Shield program, and a comparison of the 1994-95
Blue Cross/Blue Shield renewal proposal reflects a $92,000 savings. Mayor Cuda,
noting there were no further questions, thanked Mr. Smiricky for his presentation.
'— RESOLUTION - McHENRY JAYCEES ANNUAL CHRISTMAS PARADE
McHenry Area Jaycees representative James Humbard addressed Council
requesting approval of the annual Jaycees Christmas Parade on Sunday, November
10, 1996 at 10:00 A.M. in conjunction with the Riverside Drive Area Merchants
Christmas Walk. The parade route is: Kane Avenue (Edgebrook and McHenry J.H.
schools) north to Green Street to Route 120, east to Riverside Drive, then north to
Broad Street and west to end at Veterans Park. Mr. Humbard stated this proposed
route had been amended at the request of the McHenry Police Department. The
alternative route has been reviewed and approved by Lieutenant Donahue of the
McHenry Police Department.
Motion by Bolger, seconded by Lawson, to pass an IDOT resolution requesting
the partial closing of State Route 120 for the McHenry Area Jaycees Annual Christmas
Parade on Sunday, November 10, 1996 from 10:00 A.M. to Noon.

Mr. Humbard invited all Council members to participate in the annual Christmas
Parade.
ORDINANCE RENAMING INDUSTRIAL DRIVE TO OAK DRIVE FROM ROUTE 120,
NORTH TO CITY CENTRE BUSINESS PARK
Mayor Cuda reminded Council that at the January 31 , 1996 regularly scheduled
Council meeting, Council authorized the renaming of a portion of Industrial Drive to
Oak Drive from Route 120 north to the south line of City Centre Business Park
subdivision. Industrial Drive running in an easterly and westerly direction will remain
Industrial Drive. City Clerk Althoff noted that official notice must be provided to the
election authority, County Clerk Katherine Schultz, and the post office branch of the
street renaming. The ordinance will then take effect 30 days after the notice is given.
Motion by Baird, seconded by Lawson, to pass an ordinance renaming that
portion of Industrial Drive from Route 120 north to the southern boundar of the
McHenry City Centre Business Park.

RESOLUTION APPROVING CHANGE IN NAME OF CITY DEPOSITORY FROM
COMERICA BANK TO LA SALLE NATIONAL TRUST, N.S.
Mayor Cuda reminded Council that at its September 6, 1995 regularly scheduled
Council meeting Council passed a resolution adding Comerica Bank as a designated
depository for the City of McHenry. Subsequently, LaSalle National Trust, N.S. of
Chicago purchased Comerica Bank. All terms and conditions of the City's agreement
with Comerica have been transferred to LaSalle National Trust, N.S. LaSalle banks are
owned by ABNAMRO North America, Inc, which is the second largest holding bank
in the state of Illinois. In order to continue to take advantage of this investment
vehicle, it is necessary for Council to pass the attached resolution changing the name
of the approved designated depository from Comerica to Lasalle National Trust, N.S.

Motion by Bolger, seconded by Baird, to pass a resolution approving LaSalle
National Trust, N.S. of Chicago as a designated depository for the City of McHenry
replacing Comerica Bank and authorize the Mayor, City Clerk and Treasurer to execute
the appropriate transfer documents.

PURCHASE OF MAIN STREET PROPERTY FOR MUNICIPAL PARKING FACILITY
Mayor Cuda informed Council that as per Council direction, staff has completed
negotiations with School Districts 15 and 156, as well as adjacent property owner Mr.
James Kirk for the purchase of property located at 3926 Main Street in the amount
of $126,000. The reduced purchase price reflects the loss of two parking spaces due
to the necessity of redesigning the original parking lot configuration to accommodate
Mr. Kirk's prescriptive easement claims. Mr. Kirk has agreed to pay his fair share,
$9,000, for the loss of one parking space prior to the real estate closing. The total
cost to the City of McHenry for the purchase of property located at 3926 Main Street
will be $1 17,000. City Attorney McArdle reported he had reviewed all of the
documents and all is in order. Both the School Board Elementary District 15 and High
School District 156 have executed the purchase contract.
Motion by Lawson, seconded by Bolger, to pass an ordinance authorizing the
Mayor and City Clerk to execute the Purchase Agreement for School Board District 15
and School Board District 156 property located at 3926 Main Street in the amount of
$126,000, subject to the payment by Mr. James Kirk of $9,000.

In response to Alderman Locke's inquiry, City Attorney McArdle noted the
property title will be obtained at closing.
MAYOR - STATEMENT AND REPORTS
Mayor Cuda reported he had met with McHenry City Centre property owner and
developer Mark Towne. Mr. Towne is requesting Council consider allowing the
closure of current Oak Drive between the Boone Creek crossing and his south property
line during construction hours Monday through Friday. Mr. Towne is citing safety
concerns. Mayor Cuda directed Mr. Towne to provide a detailed written request for
Council consideration at its regularly scheduled Council meeting on October 2, 1996.
Mayor Cuda reported that in conjunction with the McHenry County's pursuit of
right-of-way for Phase II of the Bull Valley arterial project, Route 120 property owner
R.J. Roberts has approached the City of McHenry through his attorney investigating
annexation possibilities. There is some suggestion the acquisition of this right-of-way
may be tied to annexation privileges.
Lastly, Mayor Cuda reported the RDG Development Group had met with him
and staff to discuss the developmental possibilities of the former 1 1-acre library
property located on Green Street, just south of the Green Valley subdivision
development. Staff and Mayor Cuda informed RDG of the annexation requirements
and conditions.
COMMITTEE REPORTS
Chairman of the Parks and Recreation Committee, Alderman Bates, scheduled
a Parks and Recreation Committee meeting for October 15, 1996 at 7:00 P.M.

Chairman of the Public Works Committee, Alderman Bolger, reminded Council
of the Public Works Committee meeting on Wednesday, September 25, 1996. He
asked that the Committee members meet at 5816 Radcliff Court, Mrs. Poulos'
residence, at 6:45 P.M. in order to view her drainage problem first hand. The balance
of the meeting will be conducted at the Municipal Center.
Chairman of the Finance Committee, Alderman Lawson, reported the Finance
Committee had met on Tuesday, September 17, 1996 and the minutes would be
forthcoming. Lawson reported the Committee had agreed to make a recommendation
to the full Council increasing the Mayor's salary from $9,000/year to $12,000/year,
commencing with the beginning of the May, 1997 term.
Motion by Lawson, seconded by Bates, to authorize staff to draft an ordinance
increasing the Mayor's salary from $9,000/year to $12,000/year, commencing at the
beginning of the May, 1997 term.

Some discussion followed regarding the feasibility and legality of an expense
account for the Mayor.
Chairman of the Building and Zoning Committee, Alderman Baird, reported the
Building and Zoning Committee had met September 15, 1996. The minutes would be
forthcoming as well as revisions to the current sign ordinance and recommendations
regarding a tree preservation ordinance.
Alderman Baird also reported representatives of the Landmark Commission had
presented an historic preservation ordinance for the Commission's review and
comments. The Zoning Board of Appeals and Plan Commission will also be reviewing
the proposed ordinance, forwarding their comments on to the Building and Zoning
Committee for further review and compilation.
STAFF REPORTS
Director of Building and Zoning Lobaito informed Council that residents of the
Mill Creek subdivision have recently reported their sump pumps have stopped running
incessantly. Mr. Lobaito stated these occurrences may be directly related to the
current stormwater construction on the adjacent Olde Mill Ponds subdivision property.
Director Lobaito stated he would continue to keep Council informed.
Director of Public Works Batt informed Council of his numerous discussions
with Mr. Spooner throughout the past week leading to Mr. Spooner's request during
the Ten Minute Public Input portion of this evening's Council meeting. Director Batt
also reported that the Park Street water main is being replaced with a new plastic pipe
and the Riverside Drive Downtown Revitalization project is progressing as scheduled.
Currently trees and tree grates are being installed and the street lights are scheduled
for delivery October 7, 1996.
Director of Parks and Recreation Merkel drew Council's attention to the Chicago
Tribune article on the Petersen family. He also referenced the Illinois Department of
Natural Resources letter found in the agenda packets informing the City of McHenry
that the Brookside Park grant will not be considered for funding this year.
City Administrator Jordan requested the Finance Committee consider scheduling
a demonstration by Jerry Davenport of the GIS program at their next Finance
Committee Meeting.
City Clerk Althoff requested Council pass the distributed proclamation
designating September 29th through October 5th as "Chamber of Commerce Week"
in McHenry in honor of the 81 st Anniversary celebration of the Illinois Association of
Chamber of Commerce's.

City Clerk Althoff also requested Council approve Mike Wallin's request to host
a block party on Sunday, September 22, 1996 at 1702 Knoll Avenue. She noted the
request was not received by the Clerk's office until Tuesday, September 17, 1996.

block party to be held on Sunday, September 22, 1996 on Knoll Avenue.

In response to City Clerk Althoff's request to set Halloween "Trick-or-Treat"
hours, a brief discussion ensued.
Motion by Baird, seconded by Lawson, to set the hours of 4:00 p.m. to 8:00
p.m. on Thursday, October 31 , 1996 as the official City of McHenry trick-or-treating
hours for Halloween.

Alderman Bates informed Council he had received requests from City residents
to install "Slow" or "Children Playing" signs near North Oak Park. In response to

Some discussion occurred regarding the relocation of displaced animals from the
McHenry City Centre Business Park development. It was the consensus of Council
to defer this issue to the Finance Committee.
