HomeMy WebLinkAboutMinutes - 01/06/1999 - City Council REGULAR MEETING JANUARY 6, 1999 The Regular Meeting of the McHenry City Council was called to order by Mayor Cuda at 7:30 P.M. on Wednesday, January 6, 1999 in the Council Chambers of the Municipal Center. At roll call the following Aldermen were present: Bolger, Glab, McClatchey, Murgatroyd, Baird. Absent: None. City Staff in attendance were: City Administrator Lobaito, City Clerk Althoff, City Attorney McArdle, Chief of Police Joyce, Director of Public Works Batt, Director of Parks and Recreation Merkel, Director of Community Development Napolitano. Absent: None. TEN MINUTE PUBLIC INPUT SESSION No one signed in to speak during the Ten Minutes of Public Input. PRESENTATION: DO THE RIGHT THING Sergeant William Brogan and Officer Patricia Laycock of the McHenry Police Department addressed Council stating this evening's Presentation would be the second in the continuing Do The Right Thing Program, which recognizes individuals and groups exemplifying good citizenship. The following four individuals were recognized: ■ Jose Ortiz and Joey Nanez, for their daily assistance at Riverwood School, acting as interpreters for other Spanish-speaking students; ■ Brian Connors, for reporting and working with McHenry Police Officers to retrieve over $5,000 worth of stolen merchandise, and apprehend the offenders; ■ Tolena Pawelczak, for coming to the immediate aid of a young man struggling in the Fox River. Each recipient received a Do The Right Thing certificate from Mayor Cuda, a dinner for four at McDonald's Restaurant, and a $100 savings bond. Sergeant Brogan noted the Presentation of a $100 savings bond to each recipient is made possible by Gary Lang Autogroup, TCI Cable of Illinois, First National Bank of McHenry, and Centegra. Mayor Cuda and the McHenry City Council congratulated each recipient and commended them for their achievements. PRESENTATION REGARDING ARGUS THERMO IMAGING CAMERA BY MCHENRY TOWNSHIP FIRE PROTECTION DISTRICT Assistant Chiefs Steven Laing and Tony Huemann of the McHenry Township Fire Protection District gave a brief presentation of the recently acquired Argus Thermo Imaging Camera. The infrared camera permits the user to locate objects emanating heat in a totally blind environment. Assistant Chief Laing thanked local resident Cherie Rickert for spear-heading fund raising efforts which facilitated the McHenry Township Fire Protection District's ability to purchase the thermo imaging camera. Mayor Cuda then recognized Street Superintendent Richard Stull in the audience. At Mayor Cuda's request, Superintendent Stull provided Council with a brief update on the City of McHenry's snow removal efforts. Mayor Cuda and Council offered their congratulations on a job well done and requested Superintendent Stull carry these congratulatory remarks back to snow removal crews. Mayor Cuda also informed Council at the request of McHenry Elementary School Superintendent Dodds, the City assisted District 15 in clearing sidewalks in front of Edgebrook School along Green Street. _ CONSENT AGENDA In response to Alderman Bolger's inquiry regarding the payment to IMS, Director of Public Works Batt stated all field work had been completed and a street catalog will be provided. In response to Alderman Glab's request, Consent Agenda Item No. 2, the Ordinance granting a variance for 5010 West Elm Street was removed from the Consent Agenda for further discussion. Alderman Glab expressed concern regarding the language found in Section 4 of the ordinance granting a variance to permit two principal buildings on a single lot at 5010 West Elm Street. He stated as written the ordinance would permit the future use of the existing residential structure as a business site. He opined this was not the intent of Council. Some discussion followed. Council directed Staff to revise the ordinance language in Section 4 expanding the ordinance approval and use limitations to include not only the residential structure's removal, but also its use as a residential site. ANNEXATION: PETERSEN FARM City Administrator Lobaito reported as the City of McHenry finally received the Governor's consent to annex state-owned property located within the recently purchased Petersen Farm Property, formal action annexing the Farm and the state property can occur. As per State Statute, state-owned property must be annexed by resolution. City- owned property can be annexed with the passage of an ordinance. January 6, 1999 Page 3 City Administrator Lobaito also noted the Petersen Farm Property will be zoned E Estate upon the annexation. Permitted uses in the Estate District include parks, playgrounds, forest preserves, wildlife sanctuaries, and other publicly-owned open spaces. Motion by Glab, seconded by Bolger, to acknowledge the receipt of the Governor's Consent and pass a resolution annexing to the City of McHenry State of Illinois Property designated as FAP 420 right-of-way located within the Petersen Farm Property. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird. Voting Nay: None. Absent: None. Motion carried. Motion by Bolger, seconded by McClatchey, to pass an ordinance annexing to the City of McHenry approximately 107.3 acres located on the north side of McCullom Lake Road approximately 1 ,500 north of Petersen Park Road in McHenry Township, commonly known as the Petersen Farm Property, and zoning the property E Estate Zoning District. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird. Voting Nay: None. Absent: None. Motion carried. In response to Council inquiry, City Administrator Lobaito noted the Petersen Farm barn roof repair is scheduled for completion in early February. In addition, the City of McHenry is currently obtaining quotes for window repair. AMENDMENT TO CONDITIONAL USE: REX AUTO BODY Petitioner Rex Olsen of Rex Auto Body Inc. was in attendance. Director of Community Development Napolitano reported Rex Olsen of Rex Auto Body Inc. located ._ at 4910 West Elm Street is seeking an amendment to the Conditional Use for his auto body repair shop permitting the construction of an overhead door on the north side of the building. The original Conditional Use was granted by Council in 1994. Director Napolitano noted Council may grant an expansion, enlargement or structural alteration to a Conditional Use without a hearing or action by the Zoning Board of Appeals. Mr. Olsen is proposing the installation of a new ten foot by ten foot overhead door and apron on the north side of his existing auto body repair shop. The door accommodates new equipment which is used to straighten bent frames on damaged vehicles. Because of the equipment and the location of existing structural support beams inside the building, installation of an overhead door on the north side of the building is the only feasible way to accommodate the new equipment. As the north side of the building abuts Commercial Avenue and is adjacent to single family homes on Home Avenue, Mr. Olsen contacted the three home owners located immediately north of his property, in addition to his commercial neighbor to the east. Letters signed by each of the property owners have been submitted stating no objections to the proposed structural alteration. Motion by Glab, seconded by Bolger, to direct Staff to draft an Ordinance amending Ordinance No. 0-94-659 permitting the construction of a ten foot by ten foot overhead door and paved apron on the north side of the building located at 4910 West Elm Street. January 6, 1999 Page 4 ORDINANCES ABATING REAL ESTATE TAXES FOR TAX LEVY YEAR 1998 AND COLLECTED IN 1999 City Clerk Althoff reported the following bonds issued by the City of McHenry are secured by the full faith and credit of the municipality to insure the security of their repayment to the bond holders and are therefore included in the Real Estate Property Tax Levy: ■ $3,000,000 Alternate General Obligation Bonds issued in 1990 to construct the new Municipal Center ■ $3,600,000 Alternate General Obligation Bonds issued in 1997 to construct the east of the Fox River Sanitary Sewer Extension ■ $1 ,600,000 Alternate General Obligation Bonds issued in 1997 to construct the South Wastewater Treatment Plan Expansion. It has been the stated intention of the City of McHenry to abate these Real Estate Taxes every year and make the bond payments from collected sales tax revenue. The 1998 Tax Levy Amounts are as follows: ■ Municipal Center Building Bonds $310,500 ■ General Obligation Bonds Series 1997A $316,250 ■ General Obligation Bonds Series 1997B $125,300. Motion by Bolger, seconded by Murgatroyd, to pass an ordinance providing for the Abatement of Real Estate Taxes levied for the 1998 Tax Levy Year pursuant to an ordinance adopted by the City Council of the City of McHenry on July 18, 1990 for the issuance of $3,000,000 General Obligation Bonds Series 1990 in an amount of $310,500. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird. Voting Nay: None. Absent: None. Motion carried. MAYOR - STATEMENT AND REPORTS Mayor Cuda again commended the efforts of the City of McHenry's snow removal crews in light of the heavy snowfall on Saturday and Sunday, January 2nd and 3rd. COMMITTEE REPORTS There were no Committee Reports. January 6, 1999 Page 5 STAFF REPORTS Director of Parks and Recreation Merkel reported theice rinks at Fox Ridge Park and Freund Field were installed and available for use. Chief of Police Joyce reported the final portion of the Lieutenant's exams, oral interviews, were scheduled for Saturday, January 30th. City Administrator Lobaito reported City engineering firm Baxter and Woodman recently discovered the existence of a federal enhancement program which might reimburse the City of McHenry 80% for general streetscape improvements and landscaping. City Administrator Lobaito and Director of Public Works Batt will investigate this possibility further, and will report their findings to Council. NEW BUSINESS In response to Alderman McClatchey's inquiry, Director of Public Works Batt reported the Timber Trail roads are private streets and snow removal is the responsibility of the homeowner's association. In response to Alderman Murgatroyd's inquiry, City Administrator Lobaito stated the most recent cable television franchise draft will be provided Council for review in the Friday, January 8, 1999 Agenda Packets. He opined, although negotiations are ongoing, they are winding down to a conclusion. Director of Community Development Napolitano responding to Alderman Murgatroyd's inquiry, stated information on an amusement tax ordinance will be forthcoming for Council review and consideration in the February 5, 1999 Agenda Packets. In response to Alderman Glab's inquiry regarding the current status of the Diedrich Farm /Gerstad Property Annexation, Mayor Cuda noted at this time no further action was forthcoming. In response to Alderman Bolger's request, City Administrator Lobaito stated he would investigate the McHenry PACE Paratransit schedule for Pioneer Center further and report his findings back to Council. EXECUTIVE SESSION Motion by Glab, seconded by Bolger, to go into Executive Session to discuss Personnel at 8:20 p.m. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird. Voting Nay: None. Council went back into Open Session at 8:36 p.m. January 6, 1999 Page 6 Motion by Baird, seconded by Murgatroyd, to authorize the payment to Northern Illinois University for tuition and course materials for City Administrator Lobaito in an amount not-to-exceed $650 subject to reimbursement in the event the course is failed or not completed.
