APRIL 28, 1999
The Annual Meeting of the McHenry City Council was called to order by Mayor
Cuda at 7:30 P.M. on Wednesday, April 28, 1999 in the Council Chambers of the
Municipal Center. At roll call the following Aldermen were present: Bolger, Glab,
McClatchey, Murgatroyd, Baird. Absent: None. City Staff in attendance were: City
Administrator Lobaito, City Clerk Althoff, City Attorney McArdle, Acting Chief of Police
Erkenswick, Director of Public Works Batt, Director of Parks and Recreation Merkel.
Absent: Director of Community Development Napolitano.
TEN MINUTE PUBLIC INPUT SESSION
No one signed in to speak during the Ten Minutes Public Input Session.
CONSENT AGENDA
City Administrator Lobaito distributed an Amended List of Bills for Approval for
Council review and consideration. The Amended List of Bills replaced the Bills for Approval
listed on the Consent Agenda.
At Alderman Murgatroyd's request the Amended List of Bills was removed from the
Consent Agenda.
Motion by Bolger, seconded by Glab, to approve the Consent Agenda, subject to
the removal of the Amended List of Bills, as follows:
• Request for Waiver of Temporary Use Fees - Home of the Sparrow Plant Sale;
• Approval: Ordinance to amend Subdivion Control Ordinance - Minimum
Watermain size;
• Approval: Career Development Payments - $5,500;
• Resolutions - Retiring Board/Commission Members:

Staff clarified numerous questions by Alderman Murgatroyd regarding the Amended
List of Bills, specifically:
• Reimbursement of a COPS Grant overpayment;
• Transfer of Capital Development monies into the Water/Sewer Fund.
City Attorney McArdle explained attorney fees for the on-going State Liquor
Hearing will not be reimbursable.

AMENDMENT TO MCHENRY MUNICIPAL CODE CHAPTER 13 - TRAFFIC AND MOTOR
VEHICLE ORDINANCE
Director of Public Works Batt reported the proposed amendments to Chapter 13 of
the City of McHenry Municipal Code will amend Section 805 by removing the weight
restriction on Bull Valley Road and implementing an 8,000 pound weight restriction on
Martin Road between State Route 120 and Ringwood Road. Director Batt noted the
construction of the Miller Highway, commonly known as the Bull Valley Arterial,
eliminates the need for a weight restriction on Bull Valley Road. In addition, the relocation
of Meyer Material's Gravel Pit entrance has increased the gravel truck traffic on Martin
Road. The weight restriction for Martin Road is 8,000 pounds.

In response to Alderman Baird's inquiry, Director Batt explained vehicles weighing
in excess of 8,000 require Type B license plates which are easily identified. The
discernible identification will assist ordinance enforcement. Alderman Glab stated his
support of the 8,000 pound weight restriction. He also suggested Council consider
returning to the old practice of conducting workshop meetings the second Council
Meeting of every month. He stated, then developmental issues, traffic concerns, etc.
could be discussed, considered, and acted upon.
Motion by McClatchey, seconded by Baird, to pass an ordinance, amending Chapter
13 of the City of McHenry Municipal Code repealing the Bull Valley Road weight
restriction and instituting an 8,000 pound weight restriction on Martin Road, between
State Route 120 and Ringwood Road.

AMENDMENT TO MUNICIPAL CODE CHAPTER 13 TRAFFIC ORDINANCE - MCCULLOM
LAKE ROAD SPEED LIMIT
Director of Public Works Batt stated, as per Council direction at the April 7, 1999
regularly scheduled meeting, Staff has drafted an ordinance reducing the 45 mph speed
limit from State Route 31 northwest to the City of McHenry's corporate boundary, just
west of the Hickory Creek Farm property. The speed limit on the balance of McCullom
Lake Road from State Route 31 east to Riverside Drive is currently 30 mph.
In response to Alderman Baird's inquiry, Director Batt noted State Statute permits
the establishment of a 30 mph speed restriction on any urban street without a warrant
study. A reduction to 35 mph would require a warrant study. Further Council discussion —'
noted the increase of general activity in this area, due in part to the completion of the
Conservation District's bike path across McCullom Lake Road along the Union Pacific
Railroad tracks.
Motion by Bolger, seconded by Glab, to pass an ordinance revising Chapter 13 of
the Municipal Code repealing Section 201 .6(a) establishing the 45 mph speed limit on
McCullom Lake Road and establishing a 30mph speed limit on all of McCullom Lake Road
located within the corporate boundaries of the City of McHenry.

TRANSFER OF CLASS A-8 LIQUOR LICENSE
Mayor Cuda informed Council a liquor license transfer request was submitted by
Mr. John Porter for the Whale's Tail Restaurant, located at 3425 West Pearl Street. A
lifelong McHenry resident, Mr. Porter, has submitted all the appropriate paperwork, paid
the $1 ,400 Annual Liquor License fee, and met with Mayor Cuda on Wednesday, April
21 , 1999. Mayor Cuda recommended Council approve the transfer of a Class A Liquor _
License from Patrick McVady of Butler Food Services to CarJen Corporation, d/b/s
Whale's Tail Restaurant at 3425 West Pearl Street, subject to the receipt of satisfactory
fingerprint results.
Motion by McClatchey, seconded by Baird, to approve the Mayor's
recommendation and transfer a Class A Liquor License from Butler Food Services d/b/a
Whale's Tail to CarJen Corporation d/b/a Whale's Tail Restaurant at 3425 West Pearl
Street, subject to the receipt of satisfactory fingerprint results.
Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird.

1999 ANNUAL LIQUOR LICENSE RENEWALS
City Administrator Lobaito informed Council as per the City of McHenry's Municipal
Code Chapter 4, liquor establishments located within the corporate boundaries of the City
must renew their licenses annually before the end of the Fiscal Year, April 30'. The

City Administrator Lobaito also noted as part of the renewal process any new
managers must be fingerprinted. Establishments who have added or replaced managers
are:

• The Liberty Club of McHenry Inc.
The liquor license applications for these establishments will be approved subject to
the receipt of satisfactory fingerprint results. Results of fingerprinting take between six
to eight weeks. Staff also informed Council Wine Express, Inc. of 1249 North Green
Street will not be renewing their liquor license. Therefore, an ordinance reducing the
number of Class B Liquor Licenses from six to five, must be passed. Some discussion
followed regarding the ability of Council to deny a liquor license. City Attorney McArdle
explained a license renewal can be denied only after a hearing is conducted by the liquor
commissioner.
Alderman Bolger suggested Council consider creating a new liquor license
classification for the retail sales of packaged liquor only. Currently, the City's liquor
ordinance categorized the sale and serving of alcoholic beverages under the same
classification. Mayor Cuda stated his support for Alderman Bolger's suggestion. IN
addition, establishments selling only packaged liquor, i.e. Armanetti's and Gold Standard,
are licensed under the same classification as those establishments selling liquor and
numerous other items, i.e. Jewel and Sullivan Foods. Further discussion occurred
regarding the Jewel Food Store and Osco Drug liquor license renewal. Council directed
Staff to conduct a survey of surrounding municipalities to discover how liquor licenses are
granted and renewed, specifically, with regard to the Jewel Food Stores and Osco Drugs.

of satisfactory fingerprinting results; and to pass and approve an ordinance amending the

Mayor Cuda informed Council he and City Administrator Lobaito had met with
McHenry Elementary School District 15 Administration representatives to discuss the
future annexation of Valley View School property and Hilltop School property. Mayor Cuda
and City Administrator Lobaito directed McHenry Elementary School District 15 to proceed
with both annexations, which will appear before Council for final approval some time in
the near future. In addition, final construction plans for the Parkland Junior High School
expansion were reviewed. Engineering reports and documents will be presented to the
City for review. McHenry Elementary School District 15 is also requesting Council
consider entering into a pre-annexation agreement for school property located at Lincoln
and Chapel Hill Roads.
COMMITTEE REPORTS
Finance Committee Chairman Alderman Murgatroyd reminded Council of the
Finance Committee Meeting scheduled for Thursday, April 29, 1999 at 7:30 p.m. he
noted it was the Committee's intent to present the final 1999-2000 Fiscal Year Budget
for Council approval.

STAFF REPORTS
Director of Public Works Batt reported the Illinois Department of Transportation will
be repaving the 4900 block of State Route 120 in the months of July and August.
Director Batt also noted he was experiencing difficulty in attracting summer help and
requested Council consider increasing the starting salary from $6.50/hour to $7.25/hour.
In response to Alderman Murgatroyd's inquiry, the increase will not negatively impact the
1999-2000 Budget as presented.
Motion by McClatchey, seconded by Glab, to authorize the increase in the Public
Works Department's beginning hourly wage for summer help from $6.50/hour to
$7.25/hour.

Director of Parks and Recreation Merkel reported the annual Arbor Day Celebration
will be held in the Municipal Building on Friday, April 30, 1999 at 3:00 p.m. The City
received six donations for trees: three to be planted at the Municipal Building, and three
to be planted in various City parks. He also reported the Annual Dance Recital will be held
this weekend on Friday and Saturday. Summer Program registration begins this week as
well.
Alderman McClatchey requested Staff investigate the installation of additional
"Tree City U.S.A." signs within the corporate limits of the City of McHenry. Staff
concurred.
City Administrator Lobaito reported Ken Lopez, Administrator for the Village of
Johnsburg, has requested a meeting to discuss the Village of Johnsburg/City of McHenry
Boundary Agreement for Saturday, May 8, 1999 at 8:00 a.m. Some discussion followed.
It was the consensus of Council to request a meeting for Wednesday, May 12, 1999 at
6:30 p.m. before the City of McHenry regularly scheduled Council Meeting. He also
announced an Executive Session would be required for this evening's meeting to discuss
Personnel, Potential Litigation, and the Sale of City Property.
NEW BUSINESS
Alderman Baird thanked the many people who assisted him in conducting the
Annual City of Riverwood mock City Council meeting, in particular, the City Clerk's Office,
City of McHenry Police Officer Doyle Kearns, Director of Parks and Recreation Merkel,
Jami Peterson of the Northwest Herald, and Rhonda Burke of the Chicago Tribune.
Alderman Baird also requested the Public Works Committee address the issue of driveway
apron installation on streets with a four-inch roll over curb.
