HomeMy WebLinkAboutMinutes - 11/11/1999 - City Council REGULAR MEETING NOVEMBER 10, 1999 A Regular Meeting of the McHenry City Council was called to order by Mayor Cuda at 7:30 P.M. on Wednesday, November 10, 1999 in the Council Chambers of the Municipal Center. At roll call the following Aldermen were present: Bolger, Glab, McClatchey. Alderman Murgatroyd arrived at 7:35 p.m. Alderman Baird arrived at 7:37 p.m. Absent: None. City Staff in attendance were: City Administrator Lobaito, City Clerk Althoff, City Attorney McArdle, Chief of Police Kostecki, Director of Public Works Batt, Director of Parks and Recreation Merkel, Director of Community Development Napolitano, Assistant Administrator Maxeiner. Absent: None. TEN MINUTE PUBLIC INPUT SESSION No one signed in to speak during the Ten Minutes of Public Input Session. Alderman Murgatroyd arrived at 7:35 p.m. PRESENTATION: MILLENNIUM CELEBRATION CONTEST WINNERS Mayor Cuda presented Millennium celebration sweatshirts to Dan Ellicson, first place winner of the Millennium Celebration Banner Contest, and Andrew Green, author of the Millennium Time Capsule plaque inscription. Council thanked both gentlemen for their contributions toward the City of McHenry`s Millennium Celebration. Alderman Baird arrived at 7:37 p.m. CONSENT AGENDA Motion by Bolger, seconded by Baird, to approve the Consent Agenda as follows: ■ Approval of Semi-Annual 1990 General Obligation Bond Payment for Interest and Agent Fees in the amount of $259,105.77; ■ Approval of Request for Proposals for Televising Sewers; ■ Approval to advertise for Police Department Telecommunications position; ■ Approval of Proclamation declaring November 15-November 19, 1999 American Education Week; ■ Approval of Temporary Signs and waiving fees for St. Patrick Parish Craft Show; ■ Approval City Council Meeting Minutes: ■ October 20, 1999. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird. Voting Nay: None. Absent: None. Motion carried. SIDEWALK INSTALLATION EXTENSION REQUEST — OLDE MILL PONDS Pat Stanley of Inland Real Estate Development Corporation was in attendance. Mr. Stanley requested Council grant a one-year extension to Inland Real Estate Development Corporation for the installation of sidewalks within the Olde Mill Ponds Subdivision. Specific sidewalks would be installed, however, to provide a complete link throughout the subdivision. Staff informed Council a previous extension request was granted Inland Real Estate Development Corporation last season. Staff has not received one complaint about incomplete sidewalks, even though Inland is in its third full year of subdivision development. Previously, Green Valley Subdivision residents complained to the City Council about unfinished sidewalks. Since that time, all requests for extensions of time have been brought before City Council. Staff also informed Council all other public improvements have been completed including final street surfacing. Final inspection by the City has not been completed for acceptance of public improvements. Some discussion followed. Page 2 1 1/10/99 Alderman Glab requested future residential annexations include language requiring the installation of sidewalks within a specified time frame of days and/or months for all lots where sidewalks have been installed on either side. Some discussion followed regarding the destruction and subsequent replacement of sidewalks during home construction. Alderman Baird suggested Council evaluate sidewalks installed on Turnberry Drive prior to home construction. He also noted Council previously agreed to require sidewalk buildout once a subdivision was 80% complete. Further discussion followed regarding Inland's proposal to provide a complete sidewalk link through the Olde Mill Ponds subdivision. Motion by Bolger, seconded by Baird, to grant a one-year sidewalk installation extension from the date of the original Letter of Credit expiration date to Inland Real Estate Development Corporation to complete the installation of the remaining sidewalks within the Olde Mill Ponds subdivision, subject to the construction of a complete sidewalk link through the Olde Mill Ponds subdivision by installing sidewalks in front of lots 21 , 23, 24, and 25. MUNICIPAL CODE ORDINANCE AMENDMENT — WATER CAPITAL DEVELOPMENT FEES Mayor Cuda reported the Finance and Personnel Committee at its October 20, 1999 meeting, unanimously recommended the increase of Water Capital Development Fees for residential dwelling units. Water Capital Development Fees are charged new water users tapping into the City's water supply and distribution system. Fees are paid upon building permit issuance. Water Capital Development Fees are segregated from other water and sewer revenues into a special purpose fund which is used only for the construction, expansion, and extension of the water system necessitated by new development. City Engineering firm Baxter and Woodman completed a review and analysis of the City's water supply and storage to determine future capital improvements necessary to accommodate continued growth within the City of McHenry. The proposed new fee increase has been developed based on these findings. The Finance and Personnel Committee is recommending the following increases: Single Family Dwellings Current Water Fee Proposed Water Fee 2 bedroom or less $ 683.00 $1 ,352.00 3 bedroom $ 981 .00 $2,345.00 4 bedroom $1 ,273.00 $2,522.00 5 bedroom or more $1 ,275.00 $2,526.00 The Finance and Personnel Committee also recommended a 90-day grace period, subsequent to the passage of this ordinance. This grace period would permit Staff an opportunity to provide adequate notice of the increase to area builders and contractors. Staff reported the yearly increase, based on the Construction Cost Index, would be effective May 1 , 2001 . _t Finance and Personnel Committee Chairman Alderman Murgatroyd stated the proposed increase was reflective of the current cost for water capital improvements, including wells, treatment plant, water towers, and main extensions. Alderman McClatchey also supported the fee increase, citing the importance of planned growth management. Alderman Bolger opined, although an increase in the Water Capital Development Fees was needed, the proposed amount was too high. In addition, he suggested the 4- bedroom and 5-bedroom or more categories be combined. Some discussion followed. It was the consensus of Council to combine the 4-bedroom and 5-bedroom or more categories into one category, entitled 4-bedrooms or more. Page 3 1 1/1/0/99 Mayor Cuda opened the floor to audience comment. Bruce Deason, Vice President of Home Builders Association, addressed Council. Mr. Deason questioned City Engineering firm Baxter and Woodman's projected cost estimates used to determine the proposed Water Capital Development Fee increase. He also questioned the population equivalent estimates. Addressing the next Agenda Item as well, Mr. Deason opined the proposed Park Developer Donation was too high. The formula used by the City of McHenry to calculate the Developer Donation amount is based on a faulty ratio of 1 .5 acres/100 persons. He stated the developmental standard was 5.5 acres/1 ,000 persons. He noted the City of Woodstock and City of Crystal Lake utilized a 10-acre/1 ,000 persons ratio. Further discussion followed regarding Water Capital Improvement cost estimates. In response to Alderman Murgatroyd's inquiry, Mr. Deason stated his figures did not include financing. Mr. Deason requested Council reconsider the proposed Water Capital Development Fee increase. Alderman Murgatroyd suggested Council approve the proposed Water Capital Development Fee increase and invite the Builder's Association to provide additional substantive information for Council review. He noted the proposed increase would not take effect for 90 days. Alderman Baird opined the City's Capital Development Fund has never had enough money to complete infrastructure projects. Development should pay for itself. Mayor Cuda recognized Susan Hutchinson, of the McHenry County Association of Realtors. Ms. Hutchinson addressed Council stating the formula utilized to develop the proposed increase might be overly simplified. She suggested Council investigate formulas utilized by other municipalities. Alderman Bolger suggested the increase be �- initiated in two steps: ■ The first step would be effective after January 1 , 2000; ■ The second step would be effective after January 1 , 2001 . Local developer and home builder Roger Gerstad of Gerstad Builders addressed Council. In response to Mr. Gerstad's inquiry City Administrator Lobaito stated the difference between Water Capital Development Fees of a 3-bedroom and a 4-bedroom home was based on the Illinois School Consulting Service formula. The Illinois School Consulting Service determines the population per home. Mr. Gerstad also requested Council reconsider the proposed Water Capital Development Fee increase. Further discussion followed regarding a two-step approach to the proposed Water Capital Development Fee increase. Alderman Bolger suggested Council approve 60% of the proposed Water Capital Development Fee increase effective 90 days after ordinance passage, and the proposed total increase effective one year later. Some discussion followed. Motion by Murgatroyd, seconded by McClatchey, to pass an ordinance increasing Water Capital Development Fees at 60% of the proposed increase effective 90 days after ordinance passage, as follows: Detached Single Family: Two bedroom or less $1,084.00 Three bedroom $1,799.00 Four bedroom or more $2,022.00 Attached Single Family: One bedroom $ 642.00 Two bedroom $1,070.00 Three bedroom $1,285.00 Four bedroom or more $1,690.00 Apartments: Efficiency $ 695.00 One bedroom $ 945.00 Two bedroom $1,029.00 Three bedroom $1,640.00 Page 4 1 1/10/99 and the full proposed increase effective one full year later as follows: Detached Single Family: Two bedroom or less $1,352.00 Three bedroom $2,345.00 Four bedroom or more $2,522.00 Attached Single Family: One bedroom $ 800.00 Two bedroom $1,334.00 Three bedroom $1,603.00 Four bedroom or more $2,108.00 Apartments: Efficiency $ 867.00 One bedroom $1,178.00 Two bedroom $1,283.00 Three bedroom $2,046.00 with the understanding the annual Construction Cost Index will be put in place May 1 , 2001 , and the Five-bedroom category will be combined with the Four-bedroom category Voting Aye: Bolger, Glab, Murgatroyd. City engineering firm Baxter and Woodman representative Carl Moon informed Council Baxter and Woodman formula calculations were based on an operating period of 24-hours. Mayor Cuda invited Mr. Deason of the Home Builders Association to provide substantive information regarding capital improvement cost estimates to Staff before December 1st for further consideration., SUBDIVISION CONTROL AND MUNICIPAL CODE ORDINANCE AMENDMENTS —PARK DEVELOPER DONATION FEES Finance and Personnel Committee Chairman Alderman Murgatroyd reported the Finance and Personnel Committee at its October 27, 1999 meeting unanimously recommended an increase in the Park Developer Donation collected by the City for each new dwelling unit. Park Developer Donations are based on a formula that calculates the population generated by a new subdivision and the acreage of park lands needed to serve this population. The City`s current formula requires 1 .5 acres/100 persons. The City`s Subdivision Control Ordinance permits the acceptance of land or a cash donation in lieu of land. The amount of the cash donation is calculated by multiplying the amount of land required to serve the new subdivision by the fair market value of an improved acre of residential land in the City. Currently, the City of McHenry uses a fair market value of $36,820/acre. As the fair market had not been reviewed since 1991 , Council hired an appraiser to conduct a study to determine the present value of improved residential land in the City of McHenry. Based on the appraisal, the fair market value was estimated to be $1 13,000/acre. The Finance and Personnel Committee determined that an increase in the fair market value of an improved acre of residential land in the City of McHenry to $100,000/acre was appropriate. The population table utilized to calculate the number of persons generated by a new subdivision is published by the Illinois School Consulting Services. The Illinois School Consulting Services version presently used by the City of McHenry dates back to 1989. The table has been updated, most recently in 1996. The Committee unanimously recommended Council adopt the 1996 Illinois School Consulting Services Population Table as well. Some discussion followed. Alderman Bolger suggested the fair market value be tied to 1 acre of unimproved land as opposed to improved property. Aldermen Glab and Murgatroyd responded, noting most residents expect improved park areas, including washroom facilities, lighted ball fields, and access to water. Page 5 1 1/10/99 Susan Hutchinson of the McHenry County Association of Realtors addressed Council, noting the Parks and Recreation National Association standard formula for park lands is 5.5 acres/1 ,000 persons. She also noted neighboring municipalities, specifically Woodstock and Crystal Lake, utilize a formula of 10 acres/1 ,000 persons. She suggested Council review and evaluate its current Parks Developer Donation formula. Staff noted both Woodstock and Crystal Lake have park districts and the City of McHenry has a Parks Department. Further discussion followed. Local developer and home builder Roger Gerstad of Gerstad Builders addressed Council. He provided Council with a brief synopsis of the City of McHenry past growth patterns and noted past Park Developer Donations were utilized to build Knox Park Pool. He suggested Council consider accepting the construction and development of ball fields, tennis courts and other park amenities in lieu of passive detention areas. Motion by McClatchey, seconded by Baird, to pass an ordinance amending the Subdivision Control Ordinance and Municipal Code to increase the fair market value of a developed residential lot to $100,000/acre; to amend the Developer Donation Fees as follows: Detached Single Family Two bedroom $3,026 Three bedroom $4,349 Four bedroom $5,646 Five bedroom $5,655 Attached Single Family One bedroom $1,790 Two bedroom $2,985 Three bedroom $3,588 Four bedroom $4,718 Apartments Efficiency $1,941 One bedroom $2,637 Two bedroom $2,871 Three bedroom $4,580 and that a 90-day grace period following date of passage be granted to phase in the new fee structure; and that the Park Developer Donation Fees be increased in 2001 as dictated by current Consumer Price Index adjustments; and that the Illinois School consulting Services Population Table of 1996 be adopted. MAYOR STATEMENT AND REPORTS Mayor Cuda appointed Aldermen Glab and Murgatroyd to an Ad Hoc Police Liaison Committee. This Committee will meet with Board representatives from McHenry High School District 156 to discuss and resolve all outstanding Police Liaison contractual items. The draft agreement will then be presented to full Council for formal action. COMMITTEE REPORTS Finance and Personnel Committee Chairman Alderman Murgatroyd reminded Council a Finance and Personnel Committee Meeting was scheduled for Tuesday, November 22, 1999 at 7:00 p.m. to discuss the Personnel Policy revisions, refunding of the 1990 General Obligation bonds, and Police Department Budget reallocation. Page 6 1 1/10/99 Community Development Committee Chairman Alderman McClatchey noted the Community Development Committee had met prior to this evening's regularly scheduled Council Meeting to discuss driveway regulations, an adult use ordinance, and cell tower regulations. Minutes will be forthcoming. Draft ordinances on cell tower and driveway regulations will be presented to full Council for consideration and formal action. .... STAFF REPORTS Director of Community Development Napolitano reported the McHenry Economic Development Commission met on Tuesday, November 9, 1999. Economic Development Commission representatives will be requesting an appearance before Council for a formal presentation seeking Council's input and support of the Economic Development Commission Special Project, the McHenry Riverwalk. Director of Parks and Recreation Merkel informed Council the National Park and Recreation Association reports a 5.5 acre/1 ,000 average ratio for metro areas parklands, but recommends a 10 acre/1 ,000 population ratio. Director Merkel stated the formula currently utilized for the City of McHenry, 1 .5 acres/100 persons, was a conscientious choice by Council to take a leadership position in reserving open recreational space for the community. City Administrator Lobaito reported the proposed boundary agreement with the Village of Prairie Grove was delivered by the newly hired City Administrator. A copy of the proposed draft will be provided Council for review. Alderman Baird requested additional information, specifically, copies of the Village of Prairie Grove's Zoning Map, Comprehensive Plan, and the location of the Facility Planning Area boundary. City Clerk Althoff reminded Council of the Christmas Along the Fox activities scheduled for Sunday, November 14'. She also informed Council a Townhall Meeting had been scheduled to discuss the closing of the North Chicago Veteran's Medical Facility. The meeting will be held at the Veteran's of Foreign Wars facility on Route 120, November 16th at 9:00 a.m. United States Representative Manzullo will be the moderator. State Representatives Cal Skinner and Jack Franks, in addition to State Senator Dick Klemm, were invited to attend, as well. City Clerk Althoff also noted information on House Bill 523 Local Option Sales Tax would be provided Council in Friday's Agenda Packet. House Bill 523 permits non-Home Rule municipalities, by referendum, to impose a '/2 cent sales tax on goods, excepting food and drugs, to be utilized for infrastructure improvements. NEW BUSINESS Alderman Baird requested Chief Kostecki provide additional police coverage on Green Street. He noted he had received numerous complaints regarding speeding in this vicinity. Alderman Baird also noted further review of the City ball fields has resulted in the suggestion by Director of Parks and Recreation Merkel to enlarge both ball fields located at Knox Park. Director of Parks and Recreation Merkel stated, with the assistance of the Public Works Department, the Parks Department could easily make a few minor variations at both Knox Park ball fields enabling the City to accommodate more team play at each field. Some discussion followed. Mayor Cuda suggested Director Merkel provide Council with a detailed memo outlining his proposal in Friday's Agenda Packet. He also directed Staff to contact the girls Pigtail Softball League, informing them of Director Merkel's proposal. Alderman Glab suggested the development and location of a City skateboard park be addressed at the next Parks and Recreation Committee Meeting. He also informed Council of a concerned parents meeting to address the development of a skateboard park. The meeting will be held at Parkland School on Wednesday, November 17th at 3:00 p.m. Alderman Glab also requested Staff investigate and provide additional information regarding the proposed development of the Pacini Business Park on Route 31 south of the McHenry Corporate Center. He specifically questioned the extension of Ridgeview Drive from the Corporate Center to this Page 7 1 1/10/99 development. In the event of an extension, Alderman Glab suggested Staff review the need for a traffic signal, specifically, a stop light, at the intersection of Ridgeview Drive and Bull Valley Road. In response to Alderman Glab's inquiry, City Administrator Lobaito noted the McHenry County Transportation Department is conducting a speed limit study on Bull Valley Road. Letters have been sent regarding the McHenry City Council's concern regarding the speed limit on Bull Valley Road in this area. Alderman Bolger left the meeting at 9:10 p.m. Alderman Glab also requested Staff investigate reports of construction debris and dirt on Dartmoor Drive west of the bridge. Staff concurred. EXECUTIVE SESSION Motion by Murgatroyd, seconded by Glab, to go into Executive Session to discuss Property Acquisition, Litigation and Personnel at 9:24 p.m. Voting Aye: Glab, McClatchey, Murgatroyd, Baird.
