DECEMBER 13, 1999
A Regular Meeting of the McHenry City Council was called to order by Mayor
Cuda at 7:30 P.M. on Monday, December 13, 1999 in the Council Chambers of the
Municipal Center. At roll call the following Aldermen were present: Bolger, Glab,
McClatchey, Murgatroyd. Absent: Baird. City Staff in attendance were: City
Administrator Lobaito; City Clerk Althoff, City Attorney McArdle, Chief of Police
Kostecki, Director of Public Works Batt, Director of Parks and Recreation Merkel,
Director of Community Development Napolitano, Assistant Administrator Maxeiner.
Absent: None.

No one signed in to speak during the Ten Minute Public Input Session.
PUBLIC HEARING: 1999 TAX LEVY
Mayor Cuda opened the Public Hearing on the proposed 1999 Property Tax Levy
at 7:35 p.m. He noted the proposed 1999 Property Tax Levy was presented for
Council review and comment at the November 17, 1999 regularly scheduled Council
Meeting. The 1999 Tax Levy Ordinance must be filed with the McHenry County Clerk
by the last Tuesday of December, December 28, 1999.
Assistant Administrator Maxeiner explained revenues needed to operate the
various City functions and which are funded through property taxes must be estimated
and submitted to the County Clerk prior to the last Tuesday in December. As the 1999
Tax Levy request of $2,574,980 reflects an increase of 15% over 1998's tax
extension of $2,239,1 1 12, a Public Hearing must be conducted to meet the
requirements of the Truth in Taxation Act. Public notice for the Hearing was published
in the Northwest Herald on December 1 , 1999.
Assistant Administrator Maxeiner stated the actual 1999 Tax Levy extension
will, in all likelihood, be considerably less, after the County Clerk has applied the
property tax extension limitation. If the tax extension limitation has been exceeded, the
County Clerk will provide a limiting tax extension. Assistant Administrator Maxeiner
stated it is therefore critical the original for tax levy request be considerably higher
than the anticipated levy, in order to capture all new growth in the community, and all
of the property tax revenue the City of McHenry is entitled to receive. The proposed
1999 Property Tax Levy was presented as follows:

Assistant Administrator Maxeiner noted the City of McHenry's levy extension
over the past five years has grown between 5.5% and 6.8%. A brief discussion
followed. In response to Council inquiry, Assistant Administrator Maxeiner stated
individual tax bills will most likely see a modest !.6% increase in the City's portion of
their tax bill.
Mayor Cuda opened the floor to Public Comment and/or question. There were
none. In response to Mayor Cuda's inquiry, City Clerk Althoff noted no written or
verbal comments and/or questions were received by the Clerk's Office regarding the
proposed 1999 Tax Levy.

CONSENT AGENDA
In response to Council request, Consent Agenda Item #1 Police Department
General Orders Revisions was removed from the Consent Agenda. Mayor Cuda
requested Chief Kostecki provide Council with a copy of the current Police Department
General Orders prior to taking formal action on the proposed revisions.

WINDSOR DEVELOPMENT SIGN VARIANCE REQUEST FOR PARK RIDGE ESTATES
SUBDIVISION
Wendy Mustard of Windsor Development Corporation was in attendance. Ms
Mustard stated Windsor Development Corporation is seeking a variance to permit the
installation of an off-site sign advertising the Park Ridge Estates Subdivision. The
proposed sign would be located on the north side of Bull Valley Road at Ridgeview
Drive measuring 12' by 18' with a height of 15' for a total area of 216 square feet.
The sign would be setback 30' from the Bull Valley Road right-of-way.
In response to Council inquiry, Director of Community Development Napolitano
clarified Windsor Development was granted a sign variance for the same sized sign at
this same location in February of 1998. Council, however, denied Windsor's renewal
request in February of 1999. Some discussion followed.

Motion by Glab, seconded by Bolger, to grant a sign variance to Windsor
Development Corporation permitting the installation of a 12' by 18' sign with a height
of 15' on the north side of Bull Valley Road at Ridgeview Drive, subject to the
following restrictions:
1 . The sign shall be double-sided a maximum of 12' by 18' in
area, a maximum of 15' in height, and setback a minimum of 30'
from the right-of-way line of Bull Valley Road;
_ 2. The sign shall be removed or relocated if it is not maintained
or if it is determined to be a traffic hazard;
3. Removal of the sign shall be within one year of the sign
permit issuance date, subject to additional approval by the
City Council for subsequent periods.

DIAL-A-RIDE LOCAL SHARE AGREEMENT
City Administrator Lobaito reported the City of McHenry since 1987 has entered
into a local share agreement with PACE, a division of the Regional Transportation
Authority (RTA) to provide a curb-to-curb Dial-A-Ride Program. The curb-to-curb
service is funded through the collection of fares with the remaining service cost-funded
by PACE at 75% and the City of McHenry at 25%. The PACE contribution will be the
lesser of 75% of the actual operating deficit attributed to a maximum of 5,214 vehicle
hours of service or $134,227. The contribution is calculated monthly on a year-to-date
basis. It is estimated the City's share for the 2000 calendar year will be $48,384. The
City of McHenry increased full fare ridership to $1 .75 from $1 .50 in December of
1996. Some discussion followed.
City Administrator Lobaito, in response to Council inquiry, noted the City of
McHenry's actual expenditure has been lower than the original PACE estimate for the
past several years.
Alderman Glab requested Staff investigate the possibility of developing a PACE
route through the McHenry Corporate Center. He noted currently Corporate Center
personnel must gain PACE access by walking to Route 31 . As the Corporate Center
does not provide for any type of walkway access, other than through the streets, a
safety hazard exists.
Mayor Cuda requested City Administrator Lobaito draft a written inquiry to
PACE representatives requesting the development of a PACE route through the
McHenry Corporate Center.
Motion by McClatchey, seconded by Murgatroyd, to approve the Local Share
Agreement with PACE Paratransit, a division of the Regional Transportation Authority,
for the calendar year 2000, in an amount not-to-exceed $48,384, and to authorize the
Mayor and City Clerk's execution of the Agreement.

REALLOCATION OF POLICE BUDGET LINE ITEMS
Finance and Personnel Committee Chairman Alderman Murgatroyd reported the
Finance and Personnel Committee at its November 23, 1999 meeting unanimously
recommended the reallocation of various 1999-2000 Police Department Budget Line
Items. Chief Kostecki is requesting the refurbishment of a patrol car in the amount of
$12,000 and a $6,000 reimbursement from the North Central Narcotics Task Force

be utilized to purchase emergency supplies and equipment, including response warning
equipment, additional hand guns, mobile data terminals, and Y2K compliant
breathalyzer equipment.
Motion by Murgatroyd, seconded by Bolger, to approve the reallocation of 1999-
2000 Police Department Budget Line Items in the following manner:

In response to Alderman Glab's inquiry, Finance and Personnel Committee
Chairman Alderman Murgatroyd reported the Finance and Personnel Committee had
requested Staff develop a comprehensive survey and patrol car status report. The
information can be utilized by the Finance and Personnel Committee to develop a multi-
year patrol car replacement program.
BREATHALZER REPLACEMENT REQUEST
Chief Kostecki reported the City of McHenry Police Department currently utilizes
an Intoximeter IR3000 model to conduct breathalyzer testing. This specific Intoximeter
was developed and placed into service during the 1970's. The manufacturer has
recently notified the City of McHenry's Police Department the equipment is not Y2K
compliant, and, as of January 1 , 2000, support will not be provided for replacement
parts. Staff is recommending of this piece of equipment. The recently approved 1999-
2000 Police Department Budget Reallocation included the replacement purchase for
the Intoximeter. The replacement equipment can be purchased from the State _
cooperative purchase plan and meets all State of Illinois requirements. A possible
trade-in allowance of $525 reduces the overall expenditure to $4,725.
Motion by McClatchey, seconded by Murgatroyd, to approve the purchase of
one Intox EC/IR Intoximeter for the City of McHenry Police Department at a cost not-
to-exceed $5,250.

PUBLIC WORKS DEPARTMENT SEWER TELEVISING AND CLEANING BID AWARD
Director of Public Works Batt reported, as per Council direction and in
anticipation of the inception of the 2000 Streets Program, bids were developed and
sought for the cleaning and televising of suspect sanitary sewer lines in order to avoid
paving a street over a potential sanitary sewer repair. Streets having sewer lines in
poor condition will be eliminated from the Streets Program until sanitary sewer repair
and/or replacement can occur. The following streets are recommended for televising:

3. Clearview Drive Oak to Central; Central to Eastern
4. Clover Timothy to Dale

Three bids were received and opened on Tuesday, November 30,1999, at 1 1 :00
a.m. The low bidder was Heritage Environmental of Marengo, Illinois, in the amount of
$20,804.94. Director Batt also noted this is a unit-based price contract. The award is
based on a $155/hour cleaning and a $.59/foot televising cost.
Motion by Bolger, seconded by McClatchey, to award the sanitary sewer
cleaning and televising contract to the low bidder, Heritage Environmental of Marengo,
Illinois, in an amount of $20,804.94 with the understanding this contract is a unit-
based price contract.

PARK DEPARTMENT MAINTENANCE TRUCK BID AWARD
Director of Parks and Recreation Merkel reminded Council the 1999-2000
Budget included $36,000 for the purchase of a replacement pickup truck for the Park
Maintenance Division. Director Merkel reported, as per Council direction, bids
specifications were developed and bids sought for the purchase of a Park Maintenance
pickup truck with a full crew cab, to permit the transport of part time and seasonal
park maintenance employees. Three bids were received with the low bidder Gary Lang
Chevrolet of McHenry, Illinois, in the amount of $23,399. Director Merkel noted
although the bid specifications called for a six-foot box, Lang Chevrolet will be
providing a pickup truck with an eight-foot box. Staff stated bids can exceed
specifications.
Motion by Glab, seconded by Murgatroyd, to award the purchase of a Park
Maintenance pickup truck with a full crew cab to Gary Lang Chevrolet of McHenry,
Illinois, in an amount not-to-exceed $23,399.

ATHLETIC FIELD AND FARM PROPERTY FENCING BID AWARD
The 1999-2000 Budget included line items for fencing improvements for two
athletic fields and for wood fence replacements at Hickory Creek Farm and Petersen

Farm. Fence contractors were invited to bid on each type of installation or on both
installations. The bid was separated to permit contractors who specialize in agricultural
fencing and commercial fencing to submit individual bids. Five bids were submitted
and opened on Tuesday, November 30, 1999 at 11 :15 a.m. The low bidder for the
wood fencing replacement at Hickory Creek Farm and Petersen Farm was She-and-I
Fencing of Woodstock, Illinois, in the amount of $10,050. The low bidder for the
athletic field chain link fencing was Durabilt Fence of Round Lake, Illinois, in the
amount of $9,377. Both companies have successfully completed fencing projects for
the City of McHenry.

work at Hickory Creek Farm and Petersen Farm to the low bidder She-and-I Fencing of

RATIFICATION OF 2000-2001 NISRA MEMBER DUES
Director of Parks and Recreation Merkel informed Council, as a participating
member of the Northern Illinois Special Recreation Association (NISRA), Council must
approve the proposed membership dues and budget for the Association's upcoming
Fiscal Year. NISRA bylaws require a 2/3 majority by the membership's governing
bodies for dues ratification. The City of McHenry's proposed dues for the 2000-2001
Fiscal Year are $61 ,365. Director Merkel noted member district dues shall not exceed
an increase over 5% or the Consumer Price Index during the twelve-month calendar
year preceding the levy year, whichever is less, plus the percentage of new growth.
Participating member dues will be reviewed every five years. Any member whose levy
rate exceeds the average levy rate of all the members shall be adjusted to equal the
average levy rate.
In response to Alderman McClatchey's inquiry, Director Merkel reported,
although the Village of Barrington informed the Association last year of their intent to
withdraw, the Village of Barrington Board has reconsidered, and will retain their
membership within the Association.
Motion by Bolger, seconded by Murgatroyd, to approve the expenditure of
$61 ,365 for the 2000-2001 Northern Illinois Special Recreation Association
membership dues subject to the adjustment by the actual equalized assessed valuation
for the City of McHenry.

1998 INTERNATIONAL PROPERTY MAINTENANCE CODE ORDINANCE
Director of Community Development Napolitano reported, in response to
numerous complaints regarding overcrowding, the Community Development
Committee met November 3, 1999, to discuss methods to address overcrowding of
residential units. He noted when residential units are overcrowded, basic health,
sanitation, and life safety requirements are compromised and the overall general well
being of the residential occupants is adversely affected. The Committee considered the
current definition of "Family" found in the City's Zoning Ordinance, as well as the
adoption of Building, Housing, and/or Property Maintenance Codes. The Community
Development Committee considered and recommended the adoption of the 1998
International Property Maintenance Code. This Code includes occupancy requirements
and provides minimum square footage requirements per occupant for sleeping areas.
An added benefit to the adoption of the 1998 International Property Maintenance Code

would be the continuation of the City's stated intent to modernize and upgrade current
City building codes. The Committee also directed Staff to revise the current definition
of "Family" found in the City's Zoning Ordinance, to reflect both the traditional and
non-traditional household types. Staff will work with City Attorney McArdle to develop
appropriate definitions and schedule the required Public Hearing before the Zoning
Board of Appeals for Zoning Ordinance amendment
Council directed Staff, at the suggestion of Alderman Glab, to develop a
definition for "guest", in addition to the definition of "family".
Motion by McClatchey, seconded by Glab, to pass an ordinance adopting the
1998 International Property Maintenance Code and to direct Staff to prepare the
documents and schedule the required Public Hearing necessary to amend the City's
Zoning Ordinance for the definition of "family" and "guest".

MUNICIPAL CODE AMENDMENT CHAPTER 4 - LIQUOR LICENSES
Director of Community Development Napolitano reported the Community
Development Committee at its November 3, 1999 meeting evaluated the different
classes of Liquor Licenses and associated fees, specifically Class A and Class F
Licenses. It was the consensus of the Committee to take no action, retaining the
current Class A Liquor License parameters. However, it was the consensus of the
Committee to create two Class F categories. Currently a Class F License permits the
sale of retail alcoholic liquors in packages only with no consumption on the premises.
The license fee is $1 ,100 annually. Class F Licenses are issued to liquor stores and
grocery stores that sell alcoholic beverages. Previous Council discussions noted the
same license and fee were applicable to both a business that devotes only a small area
of its retail store to alcohol sales and those retailers that sell alcoholic beverages only.
The creation of two Class F License categories would permit:
■ Class F-1, permitting the sale of retail alcoholic beverages in packages for consumption off-
premises, where the principal source of sale is alcoholic beverages.
■ Class F-2, permitting the sale of retail alcoholic liquors where the principal source of sales for an
entity is of commodities other than alcoholic beverages;
The annual fee for Class F-1 Liquor License would be remain at $1 ,100,
whereas the annual fee for Class F-2 Liquor License would be reduced to $800.
Director Napolitano noted the City of McHenry currently has eight Class F Liquor
Licenses. The creation of two Class F Liquor License categories will result in two
license holders in category F-1 (Armanetti's and Gold Standard Liquors) and six license
holders in category F-2.
Motion by Bolger, seconded by McClatchey, to pass an ordinance establishing
two Class F Liquor License categories:
■ Class F-1, permitting the sale of retail alcoholic beverages in packages for consumption off-
premises, where the principal source of sale is alcoholic beverages, with an annual license fee of
$1,100;.
■ Class F-2, permitting the sale of retail alcoholic liquors where the principal source of sales for an
entity is of commodities other than alcoholic beverages, with an annual license fee of $800.
effective with the beginning of the Fiscal Year 2000-2001 .

ORDINANCE ESTABLISHING SPECIAL SERVICE AREA
Assistant Administrator Maxeiner reminded Council Staff has been working on
the establishment of a Special Service Area for traffic lane improvements on Route 31
south of Bull Valley Road, as well as the installation of a traffic signal at the
intersection of Route 31 and Shamrock Lane. Council passed an ordinance proposing
the establishment of the Special Service Area, conducted a Public Hearing, notified all
affected property owners via U.S. mail, and waited the required sixty day period
receiving no petitions against the establishment of the Special Service Area. Current
action requires Council pass an ordinance establishing the Special Service Area and file
the appropriate documentation with the County Clerk and County Recorder within sixty
days of the ordinance's passage.
Assistant Administrator Maxeiner also noted the Special Service Area will be
referenced as 1-A as the City had a previous Special Service Area in 1982.
Motion by Glab, seconded by Murgatroyd, to pass an ordinance establishing a
Special Service Area No. 1-A of the City of McHenry and the issuance of bonds in an
amount not-to-exceed $800,000 for the purpose of paying the cost of providing
Special Services, specifically, traffic lane improvements and the installation of a traffic
signal at the intersection of Route 31 and Shamrock Lane.

THORNWOOD DRAINAGE DITCH IMPROVEMENTS
City Administrator Lobaito informed full Council the Finance and Personnel
Committee at its November 23, 1999 meeting, agreed to send a no recommendation --
vote regarding the payment of $4,500 to the Waters Edge Condominium Association
Unit 1 for the settlement of the Thornwood Drainage Ditch Project and easement.
Finance and Personnel Committee Chairman Alderman Murgatroyd reported the
Committee had received a correspondence form Waters Edge Condominium
Association Unit 1 President Tom Quamme, agreeing to a final settlement figure for
the Thornwood Drainage Ditch Project. Chairman Alderman Murgatroyd recommended
the matter be resolved. Some discussion followed.

to the Water's Edge Condominium Association Unit 1 for the Thornwood Drainage
Ditch Improvement Project and easement.

MAYOR STATEMENT AND REPORTS
Mayor Cuda, referencing his memo of December 6th regarding the Vazzano's
correspondence and his subsequent response, requested Council provide him with any
comments and/or recommendations, prior to the next regularly scheduled Council
Meeting.
Mayor Cuda, referencing Roger Gerstad's response to the Council's written
request for additional information regarding Mr. Gerstad's proposal to connect to City
of McHenry sanitary sewer services, informed Council he and City Administrator
Lobaito will be meeting on Wednesday, December 29th with City Engineering firm
Baxter and Woodman representatives to review and analyze Mr. Gerstad's proposed
P.E. usage level.
In conclusion, Mayor Cuda informed Council he would be meeting with the
owners of property located east of Riverside Drive and north of Orchard Beach Road,
known as the V3 Realty Subdivision, tomorrow, Tuesday, December 14, 1999. The

property owners are requesting annexation, and are proposing a mixed use
development. Copies of the concept plan will be provided Council in Friday's Agenda
Packet.

STAFF REPORTS
Director of Community Development Napolitano reported the McHenry Township
Fire Protection District is requesting demolition of property the district owns located at
3610 Freund Avenue within the corporate boundaries of the City of McHenry. The
McHenry Landmark Commission has submitted a written "no objection" statement to
the Community Development Department. The McHenry Township Fire Protection
District is requesting Council approve the waiving of the $100 demolition permit fee.
Some discussion followed.
In response to Council inquiry, Director Napolitano noted the McHenry township
Fire Protection District is not proposing a burn-down for this specific location.

fee for the demolition of McHenry Township Fire Protection District property located at
3610 Freund Avenue.

Director of Public Works Batt reported information from the sewer line televising
will be compiled and provided the Public Works Committee prior to its January 12,
2000 meeting, addressing the 2000 Streets Program.
Director of Parks and Recreation Merkel, referencing his memo of December
13th, noted the McCullom Lake Beach Analysis was one of the best received by the
City of McHenry in many years, regarding the fecal chloroform count. He noted
significantly high bacteria counts appear after significant rainfalls when runoff from
yards and septic fields impact the lake. Director Merkel also reminded Council of the
Millennium Firework Display on December 31 s` at 6:30 p.m. He noted, weather
permitting, the fishing derby wil take place, and the City of McHenry's ice rinks will be
established.
In response to Alderman Glab's request for a status report regarding the
extension of sanitary sewer service to the Village of McCullom Lake, Mayor Cuda
stated the Village was proceeding with the engineering for the sewer extension
project. The Village of McCullom Lake was successful in obtaining a $45,000
Community Developer Block Grant from the County. Further information will be
provided Council at the December 29, 1999 regularly scheduled Council Meeting.
Alderman Glab strongly recommended sanitary sewer be extended to West Shore
Beach Subdivision residents as well as the Polish Camp. Staff noted extending sanitary
sewer service to the Village of McCullom Lake is the first step in providing service to
other areas including West Shore Beach and the Polish Camp.
Chief of Police Kostecki reported the three recently hired police officers will
graduate from the Suburban Law Enforcement Academy in Champaign, Illinois, on
Friday, December 17, 1999. They will begin their field training on Monday, December
20, 1999.
City Administrator Lobaito reported Council had requested further information
regarding estimated costs and potential funding mechanisms for the Route 31 and
McCullom Lake Road intersection improvements. Traffic Engineer Gary Rozwadowski
of Smith Engineering was unavailable and the requested information will be provided

Council at the December 291h regularly scheduled Council Meeting.
NEW BUSINESS
In response to Council inquiry, Staff noted neither the Home Builders
Association nor the Illinois Realtors Association submitted any written documentation
supporting their verbal contentions the Council's recent action increasing Water Capital
Development Fees and Park Donation Fees was incorrect.
Alderman McClatchey requested Staff clean up the accumulated garbage along
the riverfront at Weber Park. He also noted the fire truck at Veteran's Memorial Park is
showing age and needs repair work. Staff noted playground equipment repair and
replacement will be addressed at the next Parks and Recreation Committee Meeting.
After some discussion, it was the consensus of Council to remove Executive
Session to discuss personnel from this evening's regularly scheduled Council Meeting
Agenda
Chief of Police Kostecki presented David Scott Harwood as a candidate for the
vacant telecommunications dispatcher position in the City of McHenry Police
Department. Mr. Harwood was employed for three years as a telecommunications
dispatcher for the City of Evanston and is currently employed with the Village of
Vernon Hills as a telecommunications dispatcher. Mr. Harwood has utilized the same
computerized dispatch system as is utilized in the City of McHenry's Police
Department. Because of Mr. Harwood's previous experience and familiarity with the
City of McHenry computer system, Staff is recommending Mr. Harwood begin at Step
1 of the Collective Bargaining Agreement Wage Schedule between the City of
McHenry and the Civilian Bargaining Unit of the McHenry Police Officers Association.
Motion by McClatchey, seconded by Murgatroyd, to approve the hiring of David
Scott Harwood as Telecommunications Dispatcher at Step 1 of Appendix A of the
Collective Bargaining Agreement between the City of McHenry and the Civilian
Bargaining Unit of the McHenry Police Officer's Association, with a beginning salary of
$29,525.
