DECEMBER 29, 1999
A Regular Meeting of the McHenry City Council was called to order by Mayor
Cuda at 7:30 P.M. on Wednesday, December 29, 1999 in the Council Chambers of
the Municipal Center. At roll call the following Aldermen were present: Bolger, Glab,
McClatchey, Murgatroyd, Baird. Absent: None. City Staff in attendance were: City
Administrator Lobaito, City Clerk Althoff, Chief of Police Kostecki, Director of Parks
and Recreation. Merkel, Director of Community Development Napolitano, Assistant
Administrator Maxeiner. In City Attorney McArdle's absence, Zukowski, Rogers, Flood
�,. and McArdle partner Melissa Cooney was present. Absent: Director of Public Works
Batt.
PRESENTATION: STATE SENATOR DICK KLEMM
Mayor Cuda announced Senator Klemm regretfully sent his apologies, as he was not
able to attend this evening's regularly scheduled Council Meeting. Governor Ryan had
called for a Special Legislative Session, and Senator Klemm is currently engaged in
Springfield.

VARIANCE REQUEST TO PERMIT THE INSTALLATION OF A 200' MONOPOLE
COMMUNICATION TOWER - SPRINT PCS
Property owner Rich Adams and Jim Leahy of Richard Connor Riley and
Associates, in addition to Gary Ruse of Sprint PCS, were in attendance.

Richard Leahy addressed Council stating Sprint PCS has identified a specific area
within the City of McHenry's corporate boundaries east of the Fox River, to install a
tower to facilitate uninterrupted cellular telephone service. Although Sprint PCS has
five other tower sites within the general area, a problem service area has been
identified near the proposed tower site. Mr. Leahy stated the tower would be located
at the approximate midpoint between Lincoln Road and Route 120 on the Richard and
Rita Adams property located at the commonly known address of 2600 W. Route 120.
A variance is sought to accommodate the 200' tower height requirement. Mr. Leahy
noted, as radio signals are susceptible to obstructions, the tower must be 200' in
height to be utilized effectively. In addition, Sprint PCS is requesting a variance as to
the minimum setbacks in the E-Estate Residential District and a use variance to permit
the construction and operation of a radio tower in the E-Estate Residential Zoning
District. Sprint's original request was for a lattice-type tower design; however, the City
of McHenry Zoning Board of Appeals recommended denial of the lattice tower request
with a 4-2 vote at a Public Hearing held October 11 , 1999. Sprint PCS has revised its
proposal to include a monopole design in lieu of the original lattice tower design. The
balance of the petition regarding the location and height remained unchanged. The
tower design revision was significant enough to require a new Zoning Board of Appeals
Hearing. The Zoning Board of Appeals at a December 6, 1999 Public Hearing
unanimously recommended approval for:
■ A use variance to permit the construction and operation of a monopole radio
tower in the E-Estate Residential Zoning District;
■ A variance as to the minimum setbacks in the E-Estate Residential Zoning
District;
■ A variance as to the maximum height of a radio tower in the City of
McHenry, to permit a 200' tower;
subject to several conditions.
In response to Alderman Bolger's inquiry, Mr. Leahy stated locating the tower on
the proposed elevated water tank planned for this property was investigated. However,
the elevated tower height of 120 feet is not high enough to provide adequate
coverage. Mr. Ruse provided visual aids to demonstrate the current service areas as
well as the problem area. Some discussion followed regarding the recently constructed
Nextel cellular tower at the southeast corner of State Route 31 and Miller Road.
In response to Council discussion, Mr. Leahy also stated Sprint PCS has agreed
to permit other cellular carriers tower access. He noted the sharing of tower space was
common in the industry. In response to Alderman McClatchey's inquiry regarding the
proposed tower's proximity to an elementary school, Mr. Leahy stated Sprint PCS has
numerous sites close to both elementary and secondary schools, as well as in some
instances, construction on school property. Mr. Leahy also stated, responding to
Alderman Murgatroyd's inquiry, Sprint PCS would not find a future need for additional
towers. Currently, Sprint PCS has five additional tower sites (located outside the
corporate boundaries of the City of McHenry) serving the area. The proposed sixth site
would provide adequate signal coverage, increase cellular traffic, and capacity needs
will be addressed with additional signal frequencies and communication facility
equipment.
At Alderman Glab's initiation, some discussion followed regarding the location
of Sprint PCS towers along the west and southwestern edge of the City's corporate
boundaries. Mr. Leahy again stated the installation of the proposed cellular tower
would not only provide adequate signal coverage for current customers, but for
anticipated future customers as well.
Alderman Baird stated his support for the Zoning Board of Appeals condition
requiring Sprint PCS provide co-location for two additional providers on the proposed
tower. In response to Alderman Baird's request for clarification regarding language
requiring the City of McHenry to be a beneficiary to the terms of any future lease(s) to
competitors for tower space, Staff stated this requirement will be clearly

outlined in the ordinance granting Sprint PCS their conditional use and variances.
Sprint PCS representative Mr. Leahy stated the conditions as enumerated by the
Zoning Board of Appeals at the Public Hearing held December 6, 1999 were
acceptable to the Petitioner. A lengthy discussion followed regarding the proposed
200' height.
Responding to Alderman McClatchey's inquiry, Mr. Leahy stated that locating
their equipment on the recently constructed Nextel tower located on the southeast
corner of the intersection of State Route 31 and Miller Road, would not provide
adequate signal coverage for the identified problem area. Mr. Leahy explained the
proposed tower site must be located in the designated search area. Mr. Leahy opined
additional tower height would have a direct correlation on the required number of
towers needed to provide adequate signal coverage.
Mayor Cuda opened the floor to audience comment.
Allen Hunt of the Woodlawn Park Subdivision, addressed Council stating his
support of the Zoning Board of Appeals provision requiring the Petitioner to provide
tower space to other cellular providers. Citing the great number of cellular service
providers, Mr. Hunt stated his concern with the potential of numerous other tower
installations in the area.
Motion by Baird, seconded by Murgatroyd to acknowledge the unanimous
recommendation of the Zoning Board of Appeals and to direct Staff to draft an
ordinance for formal action at the January 12, 2000 regularly scheduled Council
Meeting granting Sprint PCS:
■ a use variance to permit the construction and operation of a monopole radio tower
in the E-Estate Residential Zoning District on the Richard and Rita Adams property
located at 2600 West Route 120;
■ a variance as to the minimum setbacks in the E-Estate Residential District;
■ a variance as to the maximum height of a radio tower in the City of McHenry, to
permit a 200' tower;
subject to the following conditions:
■ the tower shall be developed in substantial conformance with the application
drawings prepared by W-T Engineering Inc., dated October 26, 1999;
■ a six-foot chain link fence shall be installed and maintained around the perimeter of
the tower site;
■ the tower shall be equipped with an anti-climbing device;
■ no portion of the tower shall be used for advertising signs;
■ the tower shall maintain a galvanized steel finish or be painted so as to reduce its
visual obtrusiveness, unless prohibited by State or Federal authorities;
■ the tower shall not be illuminated by artificial means and shall not display strobe
lights, unless required by State or Federal authorities;
■ the tower shall be designed and constructed to accommodate the placement of no
fewer than two additional antennae for two additional providers;
■ a copy of the lease including appropriate guarantees an agreement to the co-
location of facilities and including the City of McHenry as a beneficiary to the
terms of the lease shall be provided to the City at the time of application for a
building permit; and
■ if the tower is abandoned or remains unused for a period of one year, it shall be
removed within eighteen months of its abandonment; all rental lease agreements
shall include language outlining this requirement.

Alderman Glab requested the Community Development Committee investigate
the development of an ordinance addressing tower maintenance standards and
violation penalties. Staff concurred.
1999 REAL ESTATE TAX ABATEMENT ORDINANCE
City Clerk Althoff informed Council the City of McHenry issued $3 million in
Alternate General Obligation Bonds in 1990 to construct the new Municipal Building. In
addition, the City of McHenry issued $3.6 million for the construction of the East of
the Fox River Sanitary Sewer Extension, entitled Series 1997A, and $1 .6 million for
the South Wastewater Treatment Plant Expansion, entitled Series 1997B. These bonds
were to be payable from sales tax revenues collected and water/sewer fund revenues,
respectively. Insuring the security of the repayment of these bonds to the bond
holders, the bonds are also secured by the full faith and credit of the municipality and
are included in the real estate property tax levy. It has been the intention of the City to
abate these real estate taxes every year and make the payments from sales tax
collected and water/sewer fund revenues.
The amounts for the 1999 Tax Levy Year are as follows:
■ Alternate General Obligation Bonds Series 1990 $297,500
■ General Obligation Bonds Series 1997A $358,750
■ General Obligation Bonds Series 1997B $122,925
In addition, City Clerk Althoff noted once financial consultant Harold Warren
provides appropriate figures, Council will be asked to consider abating the public
benefit portion of the State Route 31/Shamrock Lane Special Service Area No. 1 A
taxes.
Mayor Cuda requested consideration of this Agenda Item be postponed until
Staff could investigate further the need to abate the real estate taxes for the Series
1997B Bonds in the amount of $122,925. Some discussion followed regarding
potential water and sewer capital projects for the 2000-2001 Fiscal year.
Motion by McClatchey, seconded by Baird, to pass an ordinance providing for
the abatement of real estate taxes levied for the 1999 Tax Levy Year pursuant to an
ordinance adopted by the McHenry City Council on July 18, 1990 for the issuance of
Alternate General Obligation Bonds Series 1990 to construct the new Municipal
Center, in the amount of $297,500.

Motion by Baird, seconded by Bolger, to pass an ordinance providing for the
abatement of real estate taxes levied for the 1999 Tax Levy Year pursuant to an
ordinance adopted by the McHenry City Council on April 30, 1997 for the issuance of
Alternate General Obligation Bonds Series 1997A to extend the sanitary sewer service
east of the Fox River, in the amount of $358,750.

Formal action on the abatement of real estate taxes in the amount of $122,925
for the annual payment of the Alternate General Obligation Bond Series 1997B was
postponed until Staff could provide additional information.

ADOPTION OF INVESTMENT POLICY
Assistant Administrator Maxeiner presented the proposed City of McHenry
Investment Policy for Council consideration. He noted as per the Public Funds
Investment Act, amended in 1998, all local governments must have a written
investment policy in place by January 1 , 2000. The proposed policy is based upon the
model policy as prepared by the Association of Government Finance Officers. The
proposed policy addresses the legality of investments, safety of principal, liquidity of
funds, and return on investments, as well as defining who is authorized to make
decisions on these issues. Reporting requirements and performance measures are also
addressed. City Treasurer Welter and Finance Committee Chairman Alderman
Murgatroyd have reviewed and provided comment to Staff which has been
incorporated into the proposed draft model. Some discussion followed.
City Administrator Lobaito noted the City of McHenry currently invests all
additional revenues in Certificates of Deposit at four local financial institutions
approved by the McHenry City Council in resolution form.
Motion by Murgatroyd, seconded by Bolger, to approve and adopt the City of
McHenry Investment Policy as presented.

LOCAL LAW ENFORCEMENT BLOCK GRANT APPLICATION
Chief of Police Kostecki informed Council the United States Department of
Justice Bureau of Justice Assistance administers a Local Law Enforcement Block Grant --
Program. Local agencies are awarded funding from the Federal budget based on
formulas, taking into consideration a community's crime rate and population. If a
community's crime rate is high enough, funds are awarded directly to the local agency.
Otherwise, there is a requirement that the funds pass through a state agency
designated for this purpose. The City of McHenry's current crime rate requires the fund
pass-through process. Therefore, the City of McHenry's Police Department is
requesting authorization to apply to the Illinois Criminal Justice Information Authority
for a $20,000 grant. The funds would be utilized to acquire three additional laptop
computers for the City of McHenry's Police Department patrol cars. Although the Local
Law Enforcement Block Grant Program only requires a 1/9 matching contribution, the
total cost of three additional laptop computers is $26,577, making the City of
McHenry's match $6,577.
Motion by Bolger, seconded by Baird, to authorize the City of McHenry's Police
Department to submit an application to the Illinois Criminal Justice Information
Authority for Local Law Enforcement Block Grant Funds in the amount of $20,000, for
the purchase of three additional laptop computers for department patrol cars.

ROUTE 31/MCCULLOM LAKE ROAD PROJECT
City Administrator Lobaito reminded Council the State Route 31 and McCullom
Lake Road Intersection and Traffic Lane Improvement Project received approval for
80% Federal funding through the Council of Mayors Program. Mayor Cuda informed
Council at the December 1 , 1999 regularly scheduled meeting, this project has been
moved forward and can potentially receive funding as early as calendar year 2000.
Traffic engineer Gary Rozwadowski of Smith Engineering has informed Staff of
the need to develop Phase 1 Engineering. Council at its December 1 , 1999 regularly
meeting directed Staff to provide Phase 1 cost estimates for engineering as well as

conceptual plans and project specifications. Traffic engineering consultant Gary
Rozwadowski has also informed Staff approximately 50% of the engineering costs for
Phase 1 would be billed before April 30, 2000, if work begins in January of 2000.
Phase 1 Engineering is estimated at $85,569.
Staff is recommending Council consider utilizing monies saved from the
Shamrock Lane Traffic Improvements and Signal Installation Project. City Administrator
Lobaito reminded Council the City of McHenry's public benefit portion of this project
was included in the proposed bond issue. This action resulted in the additional
availability of budgeted funds in an amount of $190,000. Council has authorized the
additional expenditure of $29,000 for the Anne Street Drainage Study. A balance of
$161 ,000 remains. The total cost estimate for the Route 31'/McCulom Lake Road
Intersection Improvement Project construction is $815,000.
City Administrator Lobaito noted the estimate is preliminary as the exact scope
of the project will not be fully developed until Phase 1 Engineering is complete. Council
should consider funding Phase 1 Engineering for the State Route 31/McCullom Lake
Road Traffic Lane and Intersection Improvements with monies from the 1999-2000
Budget or providing funding within the 2000-2001 Budget. Some discussion followed.
In response to Council inquiry, City Administrator Lobaito clarified Federal
funding dollars do not include reimbursement for engineering expenses. Aldermen Glab
and Baird supported funding the Phase 1 Engineering from this year's 1999-2000
Budget. Discussion continued.
Motion by Baird, seconded by McClatchey, to approve the expenditure of
$42,784.50 from the 1999-2000 City of McHenry Budget, and to authorize the
Mayor's execution of an Engineering and Contract Preparation Contract for the Phase 1
McCullom Lake Road and State Route 31 Traffic Lane and Intersection Improvement
Project.

Alderman Murgatroyd requested Council consider earmarking the balance of the
1999-2000 Budget savings from the State Route 31/Shamrock Lane Traffic Lane
Improvements and Signal Installation Project totaling $1 18,215.50 for additional
drainage solutions for the Anne Street area.
MAYOR STATEMENT AND REPORTS
Mayor Cuda reminded Council of the Millennium Celebration Fireworks and
weekend events. Thanking all the business entities which contributed to the creation
of a Millennium Calendar, including First Midwest Bank of McHenry, Inland Real Estate
Development Corporation, and M & I Petroleum, Mayor Cuda informed Council and the
general public the one-of-a-kind Millennium momento was available free-of-charge for
McHenry City residents at all of the City of McHenry departmental areas.
Mayor Cuda also informed Council he, City Administrator Lobaito, Director of
Community Development Napolitano, Director of Public Works Batt, and City
Engineering firm Baxter and Woodman representative Carl Moon met with local
developer Roger Gerstad this afternoon. Mr. Gerstad has requested Council respond to
his request for City of McHenry sanitary sewer service for his Diedrich Farm property
located on the northwest corner of Chapel Hill and Lincoln Roads. Mr. Gerstad has
estimated the development would need a 770 P.E. capacity. Mayor Cuda noted the
Population Equivalent (P.E.) equates to the development of 219 single-family homes.
City Administrator Lobaito also noted the City of McHenry has received numerous
requests to provide sanitary sewer service to developments outside its corporate
boundaries. However, it has been the policy of former City of McHenry Councils to
deny these requests.

Mayor Cuda requested Council consider Mr. Gerstad's request and direct Staff
to provide a written response granting or denying sanitary sewer service to this
property. A lengthy discussion followed. Citing only environmental issues and property
long-term planning, it was the consensus, sanitary sewer services should be provided
this property. However, further discussion recommended City services be reserved for
current and future City residents.
In response to Council request for clarification, City Administrator Lobaito
reported, although this property is located within the City of McHenry's Facility
Planning Area, the City is under no legal obligation to provide City services to
properties located outside the City's corporate boundaries. Council directed Staff to
provide a list of pros and cons on the issue of providing sanitary sewer service to the
Gerstad Diedrich Farm property. The issue should be placed on a future regularly
scheduled Council Meeting Agenda for final consideration and determination.
Mayor Cuda reminded Council current City of McHenry annexation agreements
do not guarantee sanitary sewer and water service to future developments. He noted
Mr. Gerstad was also requesting Council guarantee future sanitary sewer service to
this property. Mayor Cuda concluded if the City was unwilling to guarantee sanitary
sewer and water services to future developments in an annexation agreement, Council
should be reluctant to guarantee these services to developments located outside the
City of McHenry's corporate boundaries.
COMMITTEE REPORTS
A Community Development Committee Meeting was scheduled for Wednesday,
January 19, 2000 at 6:30 p.m. before the regularly scheduled Council Meeting. The —�
Committee will be considering draft ordinances addressing cell tower maintenance and
adult uses.
STAFF REPORTS
Director of Parks and Recreation Merkel reported the ice-fishing derby scheduled
for Sunday, January 2, 2000 will proceed as scheduled. He noted Staff had augured
holes in McCullom Lake and discovered the ice layer was approximately 6-7" thick.
Registration will occur on Sunday, January 2"d just prior to the event at Petersen Park
Beach. Director Merkel also informed Council the Y2K computer compliance upgrade in
the Parks Department had been completed.
City Administrator Lobaito reported as the Wednesday, January 5, 2000
regularly scheduled Council Meeting Agenda was light, Council might consider
scheduling a Committee of the Whole Meeting directly after the regular business
meeting to consider Recreation Center Funding Options. If Council were to decide to
include a referendum question on the March ballot, the County Clerk's Office must be
notified prior to Tuesday, January 18, 2000. Although Alderman Glab opined the time
constraint was too great to consider a March ballot referendum question, Alderman
Baird noted the importance and appropriateness of full Council consideration of the
possibility of a recreational facility as well as well as possible funding mechanisms. It
was the consensus of Council to schedule a Committee of the Whole Meeting directly
after the regularly scheduled Wednesday, January 5, 2000 Council Meeting to discuss
the Recreational Center Facility and Potential Funding Mechanisms. City Administrator
stated full information will be provided Council tomorrow, Thursday, December 30,
1999.
NEW BUSINESS
Alderman Bolger reported the Millennium Brochure will be available in February

as Smith Engineering was underwriting the printing expenses, the brochure will be
available at no charge. Anyone interested in receiving a copy can contact the City
Clerk's Office or sign up during the weekend Millennium Celebration events.

Mayor Cuda reported the City of McHenry would continue celebrating the
Millennium throughout the 2000 calendar year. The Millennium Quilt currently under
construction will be dedicated and the time capsule will be buried during the Annual
Arbor Day Celebration, April 28, 2000.
Alderman Murgatroyd informed Council he and Alderman Glab met with High
School District 156 representatives to discuss future Police Liaison Agreements and
terms. The following recommendations were made:
■ Police Liaison Officer reimbursement to the City of McHenry will be 2/3 the
cost of the current salary (including pension, uniform, benefits, etc.) based
on the expenditures of a five-year officer, to be paid on a monthly basis;
■ The agreement shall be reviewed In conjunction with the terms of the
McHenry City Police Officers Association Collective Bargaining Agreement.
Alderman Murgatroyd reported the High School District 156 representatives
would be presenting the recommendations to their Board at their regularly scheduled
meeting in Tuesday, January 4, 2000.
Alderman Glab requested Staff provide Council with a copy of the letter sent to
PACE representatives regarding the addition of a bus route through the McHenry
Corporate Center as discussed at the December 13, 1999 regularly scheduled meeting.
